43	65		An Act relating to unfunded mandates; defining term;
44	66		prohibiting certain mandates; stating standards for
45	67		what are considered unfunded mandates; providing for
46	68		unenforceability without adequate funding; providing
47	69		for codification; and providing an effective date .

53	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
54	76		SECTION 1. NEW LAW A new section of l aw to be codified
55	77		in the Oklahoma Statutes as Section 13001 of Title 74, unless there
56	78		is created a duplication in numbering, reads as follows:
57	79		A. As used in this section, “unfunded mandate” means any act,
58	80		law, order, decision, policy, or official action implemented by the
59	81		Legislature, state agency, department, or commis sion that mandates a
60	82		political subdivision, by action or inaction, to expend funds to
61	83		implement or eliminate any policy, ordinance, programs, or
62	84		activities without being fully appropriated.
63	85		B. The Legislature, state agency, department, or commission
64	86		shall not implement any mandate to any political subdivision of this

93	139		political subdivision for all costs related to the mandate. If no
94	140		appropriation is made to the politi cal subdivisions, the mandate
95	141		shall be considered an unfunded mandate and unenforceable. Any
96	142		financial impact of any size determined to exist by the political
97	143		subdivision shall be sufficient to deem an unfunded mandate.
98	144		Financial increases related to clerical work, office supplies, and
99	145		creating and submitting reports shall be exempted from this act.
100	146		SECTION 2. This act shall become effecti ve November 1, 2023.
