53109 SECTION 2. NEW LAW A new section of law to be codif ied
54110 in the Oklahoma Statutes as Section 160.32 of Title 17, unless there
55111 is created a duplication in numbering, reads as follows:

57112 As used in this act:

59113 1. “Commission” means the Corporation Commission;

61114 2. “Direct current fast charging station” means an electric
62115 vehicle charging system capable of d elivering electricity at a
63116 minimum of fifty (50) kilowatts direct current to an electric
64117 vehicle’s rechargeable battery at a minimum voltage of two hundred
65118 (200) volts;

67119 3. “Electric cooperative” means an electric cooperative
68120 corporation organized under Section 437.1 of Title 18 of the
69121 Oklahoma Statutes that provides electric service to the public;

111201 manufactured primarily for off-road use and that has a
112202 maximum speed of thirty (30) miles per hour or less;

114203 5. “Electric vehicle charging provider” means the owner of an
115204 electric vehicle charging station operating in a retail electric
116205 supplier’s designated service area ;

118206 6. “Make-ready infrastructure” means the electrical
119207 infrastructure required to se rvice an electrical load, but shall not
120208 include an electric vehicle charging s tation;

122209 7. “Retail electric supplier” means any person, firm,
123210 corporation, association , electric cooperative, or beneficial trusts
124211 thereof engaged in the furnishing of retail electric s ervice not to
125212 include municipal corporat ions; and

128214 to a consumer for ultimate consumption.

143250 B. After December 31, 2023, any electric vehicle charging
144251 station that is provided by, owned, operated, or maintained by a
145252 retail electric supplier, or a subsidiary or affilia te thereof,
146253 shall not, directly or indirectly, be subsidized by any fee or
147254 charge associated with the retail electric service provider’s
148255 regulated service offerings .

150256 C. An electric vehicle charging provider shall not be
151257 considered to be a public utility pursuant to the provisions of
152258 Section 151 of Title 17 of the Oklahoma Sta tutes or a retail
153259 electric supplier pursuant to the provisions of this act or Section
154260 158.22 of Title 17 of the Oklahoma Statutes.

156261 D. Nothing in this section shall be construed to res trict a
157262 retail electric supplier from subsidizing the costs of make -ready
158263 infrastructure through fee s or charges for services provided by its
159264 regulated services so long as such subsidy is offered to electric
160265 vehicle charging providers on a non discriminatory basis between such
161266 providers.

183308 distribution system in order to const ruct or maintain such electric
184309 charging station and the municipality shall keep such accounts,
185310 books, and records as may be required in order for an audit of the
186311 municipal expenditures to be performed at any time in order for the
187312 municipality to prove compl iance with the provisions of this
188313 section.

190314 SECTION 6. NEW LAW A new section of law to be codified
191315 in the Oklahoma Statutes as Section 130.36 of Title 17, unless there
192316 is created a duplica tion in numbering, reads as follows:

194317 A. The Commission shall have authority to en force violations of
195318 this act for retail electric su ppliers that are rate-regulated by
196319 the Corporation Comm ission. A complaint may be brought to the
197320 Commission at any time. If the Commission determines, after
198321 investigation and an evidentiary hearing, that the retail electric
199322 supplier has violated this act, the Commission may assess a fine

200349 against the utility for contempt as set forth in Section 1 et seq.
201350 of Title 17 of the Oklahoma Statutes and may order such further
202351 action as may be fair, just , and reasonable under the circumstances
203352 of the proceeding.

205353 B. The district court shall have authority to enforce
206354 violations of this act for retail electric suppliers not rate-
207355 regulated by the Commission and municipal corporations . A petition
208356 may be filed with the district court at any time by an aggrieved
209357 party. If the district court determines, after hearing the matter,
210358 that the retail electric supplier or municipal corporation is in
211359 violation of this act, the district court may order the violation
212360 cease and levy civil charges or penalties against the retail
213361 electric supplier or municipal corporation consistent with the civil
214362 enforcement provisions for contempt as set forth in Section 1 et
215363 seq. of Title 17 of the Oklahoma Statute s and may order such further
216364 action as may be fair, just, and reasonable under the circumstances
217365 of the proceeding.

459+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
460+SECTION 9. NEW LAW A new section of law to be codified

465+SECTION 10. NEW LAW A new section of law to be codified
466+in the Oklahoma Statutes as Section 160.32 of Title 17, unless there
467+is created a duplication in numbering, reads as follows:
468+A. The Legislature finds that :
469+1. It is in the best inte rest of this state t o establish a
470+framework designed to encourage private sector investment in the
471+deployment of electric vehicle charging stations. Such framework is
472+essential to ensure that this state is prepared for increased
473+adoption of electric vehicles and to ensure equitable provisions for
474+all electric vehicle chargin g providers;

501+2. Widespread deployment of electric vehicle charging
502+infrastructure is co nsistent with the public policy of this state;
503+and
504+3. Electric vehicle charging infra structure has the potential
505+to expand infrastruct ure investment, improve economic co nditions,
506+and develop this state to be a leader in new and innovative
507+technologies.
508+B. To facilitate investments in s uch stations by private
509+businesses, the Legislature de clares that it is necessary to:
510+1. Implement competitively neutral policies to encou rage
511+private sector investment in electric vehicle charging station
512+deployment on real property whose owners or tenan ts desire to make
513+such an investment;
514+2. Develop and implement competitively neutral electricity
515+tariffs aimed at and optimized for fair and robust competition while
516+ensuring transparency in pricing and compliance with 16 U.S.C.
517+2621(d)(21);
518+3. Encourage private investment, ownership, and operation of
519+publicly available electric vehicle charging stations, including
520+equipment that allows for fa st charging;
521+4. Stimulate innovation, competition , and private investment in
522+the electric vehicle charging market ;
523+5. Develop mechanisms to incentivize and support the short-term
524+and long-term efficient and cost -effective use of the electric grid

551+in a manner that supports the operation of electric vehicle charging
552+stations; and
553+6. Ensure that the cost of the deployment of electric vehicle
554+charging stations, including, but not limited to, the costs set
555+forth in this act, is borne solely by the providers and consumers of
556+electricity used to charge electric vehicles, and is not subsidized
557+by other classes of electric utility ratepayers; provided, utilities
558+may offer incentives to reduce costs of make-ready infrastructure.
559+SECTION 11. NEW LAW A new section of law to be codified
560+in the Oklahoma Statutes as Section 160.33 of Title 17, unless there
561+is created a duplication in numbering, reads as follows:
562+As used in this act:

649+c. for purposes of this paragraph, the term “electric
650+vehicle” does not include a vehicle that is
651+manufactured primarily for off -road use and that has a
652+maximum speed of thirty (30) miles per hour or less;
653+5. “Charging station” means equipment by which electric current
654+is transferred to the power system of an electric vehi cle together
655+with the real property upon which such equipment is located or
656+affixed;
657+6. “Electric vehicle charging provider” means the owner of an
658+electric vehicle chargin g station operating in a retail electric
659+supplier’s designated service area ;
660+7. “Make-ready infrastructure” means the electrical
661+infrastructure required to se rvice an electrical load , but shall not
662+include an electric vehicle charging s tation;
663+8. “Retail electric supplier” means any person, firm,
664+corporation, association , electric cooperative, municipal
665+corporations, or beneficial trusts thereof engaged in the furnishing
666+of retail electric s ervice; and

698+A. A retail electric supplier or a subsidiary or affiliate
699+thereof that provides, owns, operates, or maintains an electric
700+vehicle charging station direc tly to the public shall do so only
701+through a separate, unregulated entity and must do so on the same
702+fees, terms, charges, and conditions offered to private providers of
703+electric vehicle charging stations pursuant to the retail electric
704+supplier’s approved tariffs.
705+B. After December 31, 2023, any electric vehicle charging
706+station that is provided by, owned , operated, or maintained by a
707+retail electric supplier, or a subsidiary or affiliat e thereof,
708+shall not, directly or indirectly, be subsidized by any fee or
709+charge associated with the retail electric service provider’s
710+regulated service offerings .
711+C. An electric vehicle charging provider shall not be
712+considered to be a public utility pursuant to the provisions of
713+Section 151 of Title 17 of the Oklahoma Sta tutes or a retail
714+electric supplier pursuant to the provisions of this act or Section
715+158.22 of Title 17 of the Oklahoma Statutes.
716+D. Nothing in this section shall be construed to rest rict a
717+retail electric supplier from subsidizing the costs of make -ready
718+infrastructure through fee s or charges for services provided by its
719+regulated services so long as such subsidy is offered to electric
720+vehicle charging providers on a non -discriminatory basis between
721+such providers.

748+SECTION 13. NEW LAW A new section of law to be codified
749+in the Oklahoma Statutes as Section 160.35 of Title 17, unless there
750+is created a duplication in numbering, reads as follows:
751+A. Each retail electric supplier shall be required to maintain
752+a commercial direct current fast charging station tariff utilizing
753+alternatives to traditional demand -based rate structures whi ch sets
754+forth the fees, terms, and conditions for the sale of electricity to
755+electric vehicle charging providers for the operation of electric
756+vehicle charging stations.
757+B. The fees, terms, and conditions of the retail electric
758+supplier’s tariff shall not discriminate among electric vehicle
759+charging providers, and the same fees , terms, and conditions thereof
760+shall apply to every electric vehicle charging provid er, including
761+the retail electric supplier’s separate, unregulated entity,
762+subsidiary, or affiliate.
763+C. Each retail electric supplier’s commercial tariff filed
764+under subsection A of this section shall not include the application
765+of demand ratchet provisio ns and shall be designed to be billed on
766+the basis of kilowatt-hours or kilovolt-amperes.
767+D. Each retail electric supplier’s commercial tariff shall
768+comply with the objectives of this act, including, but not limited
769+to, the requirement that an electric vehicle charging station not be
770+subsidized, directly or indirectly, by regulated services offered b y
771+

797+a retail electric service provider except as otherwise provided in
798+this act.
799+E. Retail electric suppliers who are rate regulated by the
800+Corporation Commission shall file an initial tariff with the
801+Commission that complies with the requirements of this act on or
802+before October 1, 2024. The Commission shall issue an order
803+approving or amending the retail electric suppli er’s commercial
804+tariff, in compliance wit h this act, within one hundred t wenty (120)
805+days of the tariff submission. An appeal from a deci sion of the
806+Commission may be made as provided by law.
807+F. All other retail electric suppliers, who are not rate
808+regulated by the Commission, shall publish a n initial tariff that
809+complies with the requirements of this act by October 1, 2024. The
810+tariff as published by the non-rate regulated retail electric
811+supplier may be challenged in court to enforce compliance with the
812+requirements of this act.
813+G. Each retail electric supplier’s commercial tariff filed
814+under this section shall remain in effect until a successor tariff
815+is approved in accordance with the provisions of this act .
816+SECTION 14. NEW LAW A n ew section of law to be codified
817+in the Oklahoma Statutes as Section 160.36 of Title 17, unless there
818+is created a duplication in numb ering, reads as follows:
819+The Corporation Commission may promulgate rules to implemen t and
820+ensure compliance with the provisions of this act.
