2956 SECTION 1. AMENDATORY 21 O.S. 2021, Section 644, is
3057 amended to read as follows:

3258 Section 644. A. Assault shall be punishable by imprison ment in
3359 a county jail not exceeding thirty (30) days, or by a fine of not
3460 more than Five Hundred Dollars ($500.00), or by both such fine and
3561 imprisonment.

4394 current or former intimate partner or a family or household member
4495 as defined by Section 60.1 of Title 22 of the Oklahoma Statutes
4596 shall be guilty of domestic abuse . Upon conviction, the defendant

68143 51.1 of this title shall apply to any second or s ubsequent
69144 conviction for a violation of this paragraph.

71145 2. Any person who, without such cause, shoots an intimate
72146 partner or a family or household member as defined by Section 60.1
73147 of Title 22 of the Oklahoma Statutes by means of any deadly weapon

100195 F. Any person convicted of domestic a buse as defined in
101196 subsection C of this section that results in great bodily inj ury to
102197 the victim shall be guilty of a felony and punish ed by imprisonment
103198 in the custody of the Department of Corrections for not more than
104199 ten (10) years, or by imprisonment in the county jail for not more
105200 than one (1) year. The provisions of Section 51 .1 of this title
106201 shall apply to any second or subsequent conviction of a violation of
107202 this subsection.

109203 G. Any person convicted of domestic abuse as defined in
110204 subsection C of this section that was committed in the presence of a
111205 child shall be punished by imprisonment in the county jail for not
112206 less than six (6) months nor more than one (1) year, or by a fine
113207 not exceeding Five Thousand Dollars ($5,000.00), or by both such
114208 fine and imprisonment. Any person convicted of a second or
115209 subsequent domestic abuse as defined in subsection C of this section
116210 that was committed in the presence of a child shall be punished by
117211 imprisonment in the custody of the Department of Corrections for not
118212 less than one (1) year nor more than five (5) years, or by a fine
119213 not exceeding Seven Thousand Dollars ($7,000.00), or by both such
120214 fine and imprisonment. The provisions of Section 51.1 of this title
121215 shall apply to any second or subsequent offense. F or every

124245 household member as defined by Section 60.1 of Title 22 of the
125246 Oklahoma Statutes, the court shall:

127247 1. Specifically order as a condition of a suspended or deferred
128248 sentence that a defendant p articipate in counseling or undergo
129249 treatment to bring a bout the cessation of domestic abuse as
130250 specified in paragraph 2 of this subsection;
131-
132251 2. a. The court shall require the d efendant to complete an
133252 assessment and follow the recommendations of a
134253 batterers’ intervention program certified by the

137254 Attorney General. If the defendan t is ordered to
138255 participate in a batterers’ intervention program, the
139256 order shall require the defendan t to attend the
140257 program for a minimum of fifty -two (52) weeks,
141258 complete the program, and be evaluated before and
142259 after attendance of t he program by progra m staff.
143260 Three unexcused absences in succession or seven
144261 unexcused absences in a period of fifty -two (52) weeks
145262 from any court-ordered batterers’ intervention program
146263 shall be prima facie evidence of the violation of the
147264 conditions of probation for the di strict attorney to
148265 seek acceleration or revocation of any probation
149266 entered by the court.

151294 b. A program for anger management, couples counseling, or
152295 family and marital counseling sh all not solely qualify
153296 for the counseling or treatment r equirement for
154297 domestic abuse pursuant to this subsection. The
155298 counseling may be ordered in addition to counseling
156299 specifically for the treatment of domestic abuse or
157300 per evaluation as set forth belo w. If, after
158301 sufficient evaluation and attendance at re quired
159302 counseling sessions, the domestic violence treatment
160303 program or licensed professional determines that the
161304 defendant does not evaluate as a perpetrator of
162305 domestic violence or does evaluate as a perpetrator of
163306 domestic violence and should complete ot her programs
164307 of treatment simultaneously or prior to domestic
165308 violence treatment, including but not limited to
166309 programs related to the mental health, apparent
167310 substance or alcohol abuse or inability o r refusal to
168311 manage anger, the defendant shall be ordere d to
169312 complete the counseling as per the recommendations of
170313 the domestic violence treatment program or licensed
171314 professional;

173315 3. a. The court shall set a review hearing no more than one
174316 hundred twenty (120) days after the defendant is
175317 ordered to participa te in a domestic abuse counseling

176345 program or undergo treatment for domestic abuse to
177346 assure the attendance and compliance of the defendant
178347 with the provisions of this subsection and the

181348 domestic abuse counseling or treatment requirements.
182349 The court may suspend sentencing of th e defendant
183350 until the defendant has presented proof to the court
184351 of enrollment in a program of treatme nt for domestic
185352 abuse by an individual licensed practitioner or a
186353 domestic abuse treatment program certified by the
187354 Attorney General and attendance at wee kly sessions of
188355 such program. Such proof shall be presented to the
189356 court by the defendant no later th an one hundred
190357 twenty (120) days after the defendant is ordered to
191358 such counseling or treatment. At such time, the court
192359 may complete sentencing, beginni ng the period of the
193360 sentence from the date that proof of enrollment is
194361 presented to the court, and sc hedule reviews as
195362 required by subparagraphs a and b of this paragraph
196363 and paragraphs 4 and 5 of this subsection. Three
197364 unexcused absences in succession o r seven unexcused
198365 absences in a period of fifty -two (52) weeks from any
199366 court-ordered domestic abuse c ounseling or treatment
200367 program shall be prima facie evidence of the violatio n

203397 probation entered by the court.

205398 b. The court shall set a second review hearing after the
206399 completion of the counseling or treatment to assure
207400 the attendance and compliance of the defendant with
208401 the provisions of this subsection and th e domestic
209402 abuse counseling or treatment requirements. The court
210403 shall retain continuing jurisdiction over the
211404 defendant during the course of ordered counseling
212405 through the final review hearing;
213-
214406 4. The court may set subsequent or ot her review hearings as the
215407 court determines necessary to assure the defendant attends and fully
216408 complies with the provisions of this subsection and the domestic
217409 abuse counseling or treatment requireme nts;
218-
219410 5. At any review hearing, if the defendant is not
220411 satisfactorily attendi ng individual counseling or a domestic abuse
221412 counseling or treatment program or is not in compliance w ith any
222413 domestic abuse counseling or treatment requirements, the court may

225414 order the defendant to further or continue counseling, tr eatment, or
226415 other necessary services. The court may revoke all or any part of a
227416 suspended sentence, deferred sentence, or p robation pursuant to
228417 Section 991b of Title 22 of the Oklahoma Statutes and s ubject the
229418 defendant to any or all remaining portions of the original sentence ;

231446 6. At the first review hearing, the court shall require the
232447 defendant to appear in court. Thereaft er, for any subsequent review
233448 hearings, the court may accept a report on the progress of the
234449 defendant from individual counseling, d omestic abuse counseli ng, or
235450 the treatment program. There shall be no requirement for the victim
236451 to attend review hearings; and
237-
238452 7. If funding is available, a referee may be appointed and
239453 assigned by the presiding judge of the district court to hear
240454 designated cases set for re view under this subsection. Reasonable
241455 compensation for the referees shall be fixed by the presiding judge.
242456 The referee shall meet the requirements and perform all duties in
243457 the same manner and procedure as set forth in Section s 1-8-103 and
244458 2-2-702 of Title 10A of the Oklahoma Statutes pertaining to referees
245459 appointed in juvenile proceedings.

247460 The defendant may be required to pay all or part of the cost of
248461 the counseling or treat ment, in the discretion of the court.
249-
250462 H. As used in subsection G of this sect ion, “in the presence of
251463 a child” means in the physical presence of a child; or having
252464 knowledge that a child is present and may see or hear an act of
253465 domestic violence. For the purposes of subsections C and G of this
254466 section, “child” may be any child whe ther or not related to the
255467 victim or the defendant.

257468 I. For the purposes of subsections C and G of thi s section, any
258469 conviction for assault and battery against an intimate partne r or a

260498 the Oklahoma Statutes shall constitute a sufficient basis for a
261499 felony charge:

263500 1. If that conviction is rendered in any state, county or
264501 parish court of record of this or any othe r state; or

268502 2. If that conviction is rendered in any mu nicipal court of
269503 record of this or any other state for which any jail time was
270504 served; provided, no conviction in a municipa l court of record
271505 entered prior to November 1, 1997, shall constitute a prio r
272506 conviction for purposes of a felony charge.

274507 J. Any person who commits any a ssault and battery with intent
275508 to cause great bodily harm by strangulation or attempted
276509 strangulation against an intimate partner or a family or household
277510 member as defined by Se ction 60.1 of Title 22 of the Oklahoma
278511 Statutes shall, upon conviction, be gui lty of domestic abuse by
279512 strangulation and shall be punished by imprisonment in the custody
280513 of the Department of Corrections for a period of not less than one
281514 (1) year nor more than three (3) years, or by a fine of not more
282515 than Three Thousand Dollars ($3, 000.00), or by both such fine and
283516 imprisonment. Upon a second or subsequent conviction for a
284517 violation of this section, the defendant shall be punished by
285518 imprisonment in the cu stody of the Department of Corrections for a
286519 period of not less than three (3) years nor more than ten (10)
287520 years, or by a fine of not more than Twenty Thousand Dollars

289549 of Section 51.1 of this title shall apply to any second or
290550 subsequent conviction of a violation of this subsection. As used in
291551 this subsection, “strangulation” means any form of asphyxia;
292552 including, but not limited to, asphyxia characterized by closure of
293553 the blood vessels or air passages of the neck as a result of
294554 external pressure on the neck or t he closure of the nostrils or
295555 mouth as a result of external pressure on the head.

297556 K. Any district cou rt of this state and any judge thereof shall
298557 be immune from any liability or prosecution for issuing an order
299558 that requires a defend ant to:
300-
301559 1. Attend a treatment program for domestic abusers certified by
302560 the Attorney General;
303-
304561 2. Attend counseling or trea tment services ordered as part of
305562 any suspended or deferred sentence or prob ation; and
306-
307563 3. Attend, complete, and be evaluated before and after
308564 attendance by a treatment program for domestic abusers, certified by
309565 the Attorney General.

313566 L. There shall be no charge of fees or costs to any victim of
314567 domestic violence, stalking, or sex ual assault in connection with
315568 the prosecution of a dome stic violence, stalkin g, or sexual assault
316569 offense in this state.

318570 M. In the course of prosecuting any charge of domestic ab use,
319571 stalking, harassment, rape, or violation of a protective order, the

320599 prosecutor shall provide the court, prior to sentencing or any plea
321600 agreement, a local history and any other available history of past
322601 convictions of the defendant within the last ten (10) years relating
323602 to domestic abuse, stalking, harassment, rape, violatio n of a
324603 protective order, or any other violent misdemeano r or felony
325604 convictions.

327605 N. Any plea of guilty or finding of guilt for a violation of
328606 subsection C, F, G, I or J of this se ction shall constitute a
329607 conviction of the offense for the purpose of this a ct or any other
330608 criminal statute under which the existen ce of a prior convicti on is
331609 relevant for a period of ten (10) years following the completion of
332610 any court imposed probationa ry term; provided, the person has not,
333611 in the meantime, been convicted of a misdemeanor involving moral
334612 turpitude or a felony.

336613 O. For purposes of subsect ion F of this section, “great bodily
337614 injury” means bone fracture, protracted and obvious disfigurement ,
338615 protracted loss or impairment of the function of a body part, organ
339616 or mental faculty, or substantial risk of death.

341617 P. Any pleas of guilty or nolo con tendere or finding of guilt
342618 to a violation of any provision of this section shall constitute a
343619 conviction of the offense for the purpose of any subsection of this
344620 section under which the existence of a prior conviction is relevant
345621 for a period of ten (10) years following the completion of any
346622 sentence or court imposed probationary term.
