47	40		in the Choosing Childbirth Act ; modifying definition;
48	41		amending 63 O.S. 2021, Section 1 -740.17, which
49	42		relates to grants to private organizations for
50	43		services; modifying grantmaking authority of the
51	44		State Department of Health; describing methods of
52	45		making grants and approving grant amounts ;
53	46		stipulating additional reimbursable services;
54	47		extending time period of certain services; adding and
55	48		updating statutory references; amending 63 O.S. 2021,
56	49		Section 1-740.18, which relates to grant complian ce
57	50		and monitoring; conforming language; updating
58	51		statutory language; providing an effective date; and
59	52		declaring an emergency.

65	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
66	59		SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-740.16, is
67	60		amended to read as follows:
68	61		Section 1-740.16. As used in the Choosing Childbirth Act:
69	62		1. “Abortion” means the use or prescription of any instrument,
70	63		medicine, drug or an y other substance or device to intentionally:
	64	+	a. kill the unborn child of a woman known to be pregnant,

98		-	a. kill the unborn child of a woman known to be pregnant,
99		-	or
100	92		b. terminate the pregnancy of a woman known to be
101	93		pregnant, with an intention other than:
102	94		(1) after viability of the unborn child, to produce a
103	95		live birth and preserve the life and health of
104	96		the child born alive, o r
105	97		(2) to remove a dead unborn child;
106	98		2. “Unborn child” means an individual organism of the species
107	99		Homo sapiens from fertilization until birth; and
108	100		3. “Grant-supervising entity” means a private entity which
109	101		approves all grants made under the Choosing Childbirth Act that are
110	102		not directly made to private organizations by the State Department
111	103		of Health for reimbursement of services provided under the Choosing
112	104		Childbirth Act and which:
113	105		a. is organized as a not-for-profit corporation in
114	106		Oklahoma and as a 501(c)3 entity under the federal
115	107		Internal Revenue Code, and
116	108		b. does not encourage or counsel any woman to have an
117	109		abortion not necessary to prevent her death, to
118	110		provide her such an abortion or to refer her for such
119	111		an abortion, and does not acce pt funds or services
120	112		knowingly from any entity which performs abortions or
121	113		receives money for abortions.
	114	+	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.17, is

149		-	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.17, is
150		-	amended to read as follows:
151	142		Section 1-740.17. A. The State Department of Health s hall make
152	143		grants, as directed in subsection B of this section , from funds
153	144		appropriated by the Legislature specifically for this purpose, to a
154	145		grant-supervising entity for the purpose of reimbursing for the
155	146		Choosing Childbirth Act.
156	147		B. The purpose of the gr ants shall be to reimburse private
157	148		organizations in Oklahoma this state for the reasonable expenses of
158	149		programs providing the following services: listed in subsection C of
159	150		this section. The Department shall make grants either:
160	151		1. Directly to the private organizations;
161	152		2. To one or more grant-supervising entities , who shall
162	153		reimburse the private organizations ; or
163	154		3. Both directly to the private organizations and to one or
164	155		more grant-supervising entities , who shall reimburse the private
165	156		organizations.
166	157		C. Reimbursable services provided under the Choosing Childbirth
167	158		Act shall include:
168	159		1. Providing information on, referral to and a ssistance in
169	160		securing the services of re levant existing programs or agencies that
170	161		assist women in Oklahoma this state to carry their children to term,
171	162		and/or providing services that as sist women to carry their children
	163	+	to term including, but not limited to, agencies and programs that
	164	+	will provide:

199		-	to term including, but not limited to, agencies and programs that
200		-	will provide:
201	191		a. medical attention for the pregnant woman for the
202	192		duration of her pregnancy including, but not limited
203	193		to, obstetric ultrasounds ,
204	194		b. mental health and substance abuse services,
205	195		c. nutritional support s ervices,
206	196		d. housing assistance,
207	197		e. transportation assistance,
208	198		f. adoption services,
209	199		g. education and employment assistance, and
210	200		h. parenting education and support services ;
211	201		2. Providing women in Oklahoma this state, in person and
212	202		through community outreac h, information and/or services that
213	203		encourage and assist them to carry their children to term; and
214	204		3. Providing services including, but not limited to, healthcare
215	205		services to mothers and infants up to three (3) years postpartum for
216	206		the purpose of reducing the rates of maternal mortality and infant
217	207		mortality in this state by three pe rcent (3%) within five (5) years
218	208		of the effective date of this act not later than July 1, 2026;
219	209		provided, however, no funds shall be provided to an organization
220	210		that provides, or whose affiliates provide, abort ion services.
221	211		B. D. To be eligible for a service grant, an organization
222	212		shall:
	213	+	1. Be registered with the Oklahoma Secretary of State as a not-
	214	+	for-profit corporation located in Oklahoma;

250		-	1. Be registered with the Oklahoma Secretary of State as a not-
251		-	for-profit corporation located in Oklahoma;
252	241		2. Have the grant amount approved by a:
253	242		a. the grant-supervising entity, if the grant was
254	243		provided to the private organization by a grant-
255	244		supervising entity, or
256	245		b. the Department, if the grant was provided directly to
257	246		the private organizatio n by the Department;
258	247		3. For services described in paragraphs 1 and 2 of subsection A
259	248		C of this section, provide each pregnant w oman counseled with
260	249		accurate information on the develop mental characteristics of unborn
261	250		children including offering the printed information described in
262	251		Section 1-738.3 of Title 63 of the Oklahoma Statutes;
263	252		4. Assure that the grant’s sole purposes are to assist and
264	253		encourage women to carry their children to term and to maximize
265	254		their potentials thereafter as provided in paragraphs 1 and 2 of
266	255		subsection C of this section or to reduce the rat es of maternal
267	256		mortality and infant mortality in this state as provided in
268	257		paragraph 3 of subsection A C of this section; and
269	258		5. Assure that none of th e funds provided pursuant to the
270	259		Choosing Childbirth Act, nor any other funds or services provided by
271	260		the organization, are used to encourage or counsel a woman to have
272	261		an abortion not necessary to prevent her death, to provide her such
273	262		an abortion or to refer her for such an abortion.
	263	+	SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is

301		-	SECTION 3. AMENDATORY 63 O.S. 2021, Section 1 -740.18, is
302		-	amended to read as follows:
303	291		Section 1-740.18. The State Department of Health shall make
304	292		grants to a grant-supervising entity under the Choosi ng Childbirth
305	293		Act from funds appropriated by the Legislature specifically for this
306	294		purpose. The State Department of Health shall annually monitor and
307	295		review the any grant-supervising entity participating in the
308	296		Choosing Childbirth Act and any private organization directly
309	297		receiving a service grant from the Department to assure ensure that
310	298		the grant-supervising entity or private organization carefully
311	299		adheres to the purposes and requirements of the Choosin g Childbirth
312	300		Act, and it. The Department shall cease funding a grant-supervising
313	301		entity or private organization that fails to do so adhere to such
314	302		purposes and requirements if the Department proves specific findings
315	303		of noncompliance, subject to judicial r eview.
316	304		SECTION 4. This act shall become effective July 1, 202 3.
317	305		SECTION 5. It being immediately necessary for the preservation
318	306		of the public peace, health or safety, an emergency is hereb y
319	307		declared to exist, by reason whereof this act shall tak e effect and
320	308		be in full force from and after its passage and a pproval.
