59	48		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
60	49		SECTION 1. AMENDATORY 49 O.S. 2021, Secti on 12, is
61	50		amended to read as follows:
62	51		Section 12. A. The Secretary of State may deny, refuse to
63	52		renew, or revoke a commission as a notary public f or a:
64	53		1. Conviction of any felony;
65	54		2. Failure to meet the qualifications and application
66	55		requirements set forth in Sections 1 and 1.1 of Title 49 of the
67	56		Oklahoma Statutes this title; or
	57	+	3. Failure to comply with the requirements set forth in Section
	58	+	2 of Title 49 of the Oklahoma Statutes this title; or
	59	+	4. Failure to comply in good faith with the requirements set
	60	+	forth in Section 113 of this title.

96		-	2 of Title 49 of the Oklahoma Statutes this title; or
97		-	4. Failure to comply in good faith with the requirements set
98		-	forth in Section 113 of this title.
99	87		B. Upon receipt of a final judgment from a district court in
100	88		this state or its equivalent in a foreign jur isdiction against a
101	89		notary public in this st ate for performing a false or fraudulent
102	90		notarial act, the Secre tary of State shall revoke the appointment of
103	91		the notary public.
104	92		SECTION 2. AMENDATORY 49 O.S. 2021, Section 113, is
105	93		amended to read as follows:
106	94		Section 113. A. In taking an acknowledgment, the notarial
107	95		officer must determine, e ither from personal knowledge or from
108	96		satisfactory evidence, that the person appearing before the officer
109	97		and making the acknowledgment is the person wh ose true signature is
110	98		on the instrument.
111	99		B. In taking a verification upon oath or affirmation, the
112	100		notarial officer must determine, either from personal knowledge or
113	101		from satisfactory evidence, that the person appearing before the
114	102		officer and making the v erification is the person whose true
115	103		signature is on the statement verified.
116	104		C. In witnessing or attest ing a signature the notarial officer
117	105		must determine, either from personal knowledge or from satisfactory
	106	+	evidence, that the signature is that of the per son appearing before
	107	+	the officer and named therein.
	108	+	D. In certifying or attesting a copy of a document or other
	109	+	item, the notarial officer must determine that the proffered copy is
	110	+	a full, true, and accurate transcription or reproduction of that

145		-	evidence, that the signature is that of the per son appearing before
146		-	the officer and named therein.
147		-	D. In certifying or attesting a copy of a document or other
148		-	item, the notarial officer must determine that the proffered copy is
149		-	a full, true, and accu rate transcription or reproduction of that
150	137		which was copied. In the case of official record s, only the
151	138		custodian of the official records may issue an offic ial certified
152	139		copy.
153	140		E. In making or noting a protest of a negotiable instrument the
154	141		notarial officer must determine the matters set forth in Section 3 -
155	142		509 of the Uniform Commercial Code.
156	143		F. A notarial officer has satisfactory evidence that a person
157	144		is the person whose true signature is on a document if that person
158	145		is personally known to the notarial officer, is identified upon the
159	146		oath or affirmation of a credible witness personally known to the
160	147		notarial officer or is identified on the basis of identifica tion
161	148		documents.
162	149		G. A notarial officer who performs a notarial act pur suant to
163	150		this section without first making in good faith the required
164	151		determination of the identity of the person appearin g before the
165	152		notary shall be guilty of a misdemeanor and upon conviction be
166	153		subject to a fine not to exceed One Thousand Dollars ($1,000. 00), to
167	154		imprisonment in the county jail not to exceed ten (10) days, or both
168	155		such fine and imprisonment.
