5948 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6049 SECTION 1. AMENDATORY 49 O.S. 2021, Secti on 12, is
6150 amended to read as follows:
6251 Section 12. A. The Secretary of State may deny, refuse to
6352 renew, or revoke a commission as a notary public f or a:
6453 1. Conviction of any felony;
6554 2. Failure to meet the qualifications and application
6655 requirements set forth in Sections 1 and 1.1 of Title 49 of the
6756 Oklahoma Statutes this title; or
57+3. Failure to comply with the requirements set forth in Section
58+2 of Title 49 of the Oklahoma Statutes this title; or
59+4. Failure to comply in good faith with the requirements set
60+forth in Section 113 of this title.

96-2 of Title 49 of the Oklahoma Statutes this title; or
97-4. Failure to comply in good faith with the requirements set

9987 B. Upon receipt of a final judgment from a district court in
10088 this state or its equivalent in a foreign jur isdiction against a
10189 notary public in this st ate for performing a false or fraudulent
10290 notarial act, the Secre tary of State shall revoke the appointment of
10391 the notary public.
10492 SECTION 2. AMENDATORY 49 O.S. 2021, Section 113, is
10593 amended to read as follows:
10694 Section 113. A. In taking an acknowledgment, the notarial
10795 officer must determine, e ither from personal knowledge or from
10896 satisfactory evidence, that the person appearing before the officer
10997 and making the acknowledgment is the person wh ose true signature is
11098 on the instrument.
11199 B. In taking a verification upon oath or affirmation, the
112100 notarial officer must determine, either from personal knowledge or
113101 from satisfactory evidence, that the person appearing before the
114102 officer and making the v erification is the person whose true
115103 signature is on the statement verified.
116104 C. In witnessing or attest ing a signature the notarial officer
117105 must determine, either from personal knowledge or from satisfactory
106+evidence, that the signature is that of the per son appearing before
107+the officer and named therein.
108+D. In certifying or attesting a copy of a document or other
109+item, the notarial officer must determine that the proffered copy is
110+a full, true, and accurate transcription or reproduction of that

145-evidence, that the signature is that of the per son appearing before

147-D. In certifying or attesting a copy of a document or other
148-item, the notarial officer must determine that the proffered copy is
149-a full, true, and accu rate transcription or reproduction of that
150137 which was copied. In the case of official record s, only the
151138 custodian of the official records may issue an offic ial certified
152139 copy.
153140 E. In making or noting a protest of a negotiable instrument the
154141 notarial officer must determine the matters set forth in Section 3 -
155142 509 of the Uniform Commercial Code.
156143 F. A notarial officer has satisfactory evidence that a person
157144 is the person whose true signature is on a document if that person
158145 is personally known to the notarial officer, is identified upon the
159146 oath or affirmation of a credible witness personally known to the
160147 notarial officer or is identified on the basis of identifica tion
161148 documents.
162149 G. A notarial officer who performs a notarial act pur suant to
163150 this section without first making in good faith the required
164151 determination of the identity of the person appearin g before the
165152 notary shall be guilty of a misdemeanor and upon conviction be
166153 subject to a fine not to exceed One Thousand Dollars ($1,000. 00), to
167154 imprisonment in the county jail not to exceed ten (10) days, or both
168155 such fine and imprisonment.
156+SECTION 3. This act shall become effective November 1, 2023.
