31	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	60		SECTION 1. NEW LAW A new section of law to be codified
34	61		in the Oklahoma Statutes as Section 774 of Title 15, unless there is
35	62		created a duplication in n umbering, reads as follow s:

37	63		As used in this act:

39	64		1. “Admission ticket” means evidence of a right of entry to a
40	65		venue or an entertainment event ;

42	93		2. “Event” means a concert, thea trical performance, sporting
43	94		event, exhibition, show, or other similar ac tivity held in this

48	96		3. “Initial sale” means the first sale of an admission ticket

53	100		4. “Person” means any individual, partnership, corporation,
54	101		limited liability company, other organization, or any combination
55	102		thereof;

57	103		5. “Place of entertainment ” means any privately or publicly
58	104		owned or operated entertainment facility within this state, s uch as
59	105		a theater, stadium, museum, arena, park, racetrack, or other place
60	106		where concerts, theatrical performances, sporting events,
61	107		exhibitions, shows, or other similar ac tivities are held and for
62	108		which an entry fee is charged;

64	109		6. “Presale” means a sale of admission tickets at or below the
65	110		price printed on the ticket by, or with the permission of, a ticket
66	111		seller, prior to their release to the general public;

68	112		7. “Promoter” means a person who organizes financing and
69	113		publicity for an entertainment event; and

71	114		8. “Ticket seller” means a person that makes admi ssion tickets
72	115		available, directly or indirectly, at an initial presale or sale to
73	116		the general public, and may include an owner or operator of a place

75	145		participating in an event, a theater company, a musical group, or
76	146		similar participant in an event, or an employee or agent of any such
77	147		person.

79	148		SECTION 2. NEW LAW A n ew section of law to be codified
80	149		in the Oklahoma Statutes as Section 774.1 of Title 15, unless there
81	150		is created a duplication in numbering, reads as follows:

83	151		A. A person shall not:
84		-
85	152		1. Use software to circumvent, th wart, interfere with, or evade
86	153		a security measure, access control system, or other control measure
87	154		on a ticket seller’s Internet website; or

91	155		2. Sell software that is advertised for profit with the express
92	156		purpose to circumvent, thwart, inter fere with, or evade a security
93	157		measure, access control system, or other control or measure on a
94	158		ticket seller’s Internet website.

96	159		B. The user or seller shall b e in violation of subsection A of
97	160		this section if the user or seller knows or should know that:
98		-
99	161		1. The purpose of the software is to circumvent, thwart,
100	162		interfere with, or evade a security measure, access control system,
101	163		or other control or measure on a t icket seller’s Internet website in
102	164		order to purchase admission tickets during the initial sale or
103	165		presale for an event held at a place of entertainment ; or

105	166		2. The use of the software led to the admission tickets being
106	167		resold on the initial seller’s Internet website or an Internet site

111	198		business practice and shall be subject to the provisions of the
112	199		Oklahoma Consumer Protecti on Act.
