3159 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3360 SECTION 1. NEW LAW A new section of law to be codified
3461 in the Oklahoma Statutes as Section 774 of Title 15, unless there is
3562 created a duplication in n umbering, reads as follow s:

3964 1. “Admission ticket” means evidence of a right of entry to a
4065 venue or an entertainment event ;

4293 2. “Event” means a concert, thea trical performance, sporting
4394 event, exhibition, show, or other similar ac tivity held in this

4896 3. “Initial sale” means the first sale of an admission ticket

53100 4. “Person” means any individual, partnership, corporation,
54101 limited liability company, other organization, or any combination

57103 5. “Place of entertainment ” means any privately or publicly
58104 owned or operated entertainment facility within this state, s uch as
59105 a theater, stadium, museum, arena, park, racetrack, or other place
60106 where concerts, theatrical performances, sporting events,
61107 exhibitions, shows, or other similar ac tivities are held and for
62108 which an entry fee is charged;

64109 6. “Presale” means a sale of admission tickets at or below the
65110 price printed on the ticket by, or with the permission of, a ticket
66111 seller, prior to their release to the general public;

68112 7. “Promoter” means a person who organizes financing and
69113 publicity for an entertainment event; and

71114 8. “Ticket seller” means a person that makes admi ssion tickets
72115 available, directly or indirectly, at an initial presale or sale to
73116 the general public, and may include an owner or operator of a place

75145 participating in an event, a theater company, a musical group, or
76146 similar participant in an event, or an employee or agent of any such

80149 in the Oklahoma Statutes as Section 774.1 of Title 15, unless there

83151 A. A person shall not:

85152 1. Use software to circumvent, th wart, interfere with, or evade
86153 a security measure, access control system, or other control measure
87154 on a ticket seller’s Internet website; or

91155 2. Sell software that is advertised for profit with the express
92156 purpose to circumvent, thwart, inter fere with, or evade a security
93157 measure, access control system, or other control or measure on a
94158 ticket seller’s Internet website.

96159 B. The user or seller shall b e in violation of subsection A of
97160 this section if the user or seller knows or should know that:

99161 1. The purpose of the software is to circumvent, thwart,
100162 interfere with, or evade a security measure, access control system,
101163 or other control or measure on a t icket seller’s Internet website in
102164 order to purchase admission tickets during the initial sale or
103165 presale for an event held at a place of entertainment ; or

105166 2. The use of the software led to the admission tickets being
106167 resold on the initial seller’s Internet website or an Internet site

110197 C. Any violation of this section shall constitute an unlawful
111198 business practice and shall be subject to the provisions of the
112199 Oklahoma Consumer Protecti on Act.

114200 SECTION 3. This act shall become ef fective November 1, 2023.
