5144 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
5245 SECTION 1. NEW LAW A n ew section of law to be codified
5346 in the Oklahoma Statutes as Section 2217.2 of Title 74, unless there
5447 is created a duplication in numbering, reads as follows :
5548 A. No person shall:
5649 1. Physically occupy a campsite identified as “Reserved” by
5750 Oklahoma Tourism and R ecreation Department staff or by the park
5851 reservation system, or fail to vacate a campsite with in a reasonable
5952 time after being notified of t he campsite’s reserved status by
6053 Department staff; or
54+2. Enter an area of a state park that requires payment of an
55+entry fee for the person’s recreational vehicle or travel trailer
56+without having first paid the entry fee.
57+B. Any violation of the provisions of t his section may be
58+punishable by an administrative fine not exceeding:
59+1. Fifty Dollars ($50.00) for a firs t offense;

88-2. Enter an area of a state park that requires payment of an
89-entry fee for the person’s recreational vehicle or travel trailer
90-without having first paid the entry fee.
91-B. Any violation of the provisions of t his section may be
92-punishable by an administrative fine not exceeding:
93-1. Fifty Dollars ($50.00) for a firs t offense;
9486 2. One Hundred Dollars ($100.00) for a second offense ; and
9587 3. Two Hundred Fifty Dollars ($250.00) for any third or
9688 subsequent offense.
9789 C. All monies collected pursuant to thi s section shall be
9890 deposited in the Oklahoma Tourism and Recreation Department
9991 Revolving Fund.
10092 SECTION 2. AMENDATORY 74 O.S. 2021, Section 2220, is
10193 amended to read as follows:
10294 Section 2220. A. The Oklahoma Tourism and Recreation
10395 Commission may prescribe and collect reasonable rates and f ees
10496 pursuant to the provisions of this sec tion for the services,
10597 facilities, and commodities rendered by a ll property of the
10698 Commission.
10799 1. The Commission ma y establish maximum rates for rooms at the
108100 state lodges and cabins, for recreational activities, f or
109101 recreational vehicles and camping sites, and for community
110102 facilities under control of the Commission. The method whereby the
111103 rates are determined shall b e promulgated pursuant to Article I of
104+the Administrative Procedures Act. At least twenty (20) da ys prior
105+to the adoption or approval of an y rate changes by the Commission,
106+the Oklahoma Tourism and Recreation Department shall submit a copy
107+of the proposed rates, for informational purposes, to the Governor,
108+Speaker of the House of Representatives , and President Pro Tempore
109+of the Senate. Any change in the rates during the year when the

139-the Administrative Procedures Act. At least twenty (20) da ys prior
140-to the adoption or approval of an y rate changes by the Commission,
141-the Oklahoma Tourism and Recreation Department shall submit a copy
142-of the proposed rates, for informational purposes, to the Governor,
143-Speaker of the House of Representatives , and President Pro Tempore
144-of the Senate. Any change in the rates during the year when the
145136 Legislature is not in session shall be reported in w riting to the
146137 Governor, Speaker of the House of Represent atives, and President Pro
147138 Tempore of the Senate within five (5) busi ness days of such
148139 Commission action.
149140 2. The Commission may establish maximum charges for all
150141 activities at state-owned golf courses. The charges may vary among
151142 the different golf courses according to the practices of the golf
152143 industry. The method whereb y the maximum charges are determined
153144 shall be in accordance with rules promulgated pursuant to Article I
154145 of the Administrative Proce dures Act. At least twenty (20) days
155146 prior to the adoption or approval of any rate changes by the
156147 Commission, the Departmen t shall submit a copy of s uch proposed
157148 charges, for informational purposes, to the Governor, Speaker of the
158149 House of Representatives , and President Pro Tempore of the Senate.
159150 3. The Commission may establish entrance or day-use charges for
160151 the state park system shall establish an en trance fee only for
161152 recreational vehicles and travel trailers not to exceed Eight
162153 Dollars ($8.00) per day. All monies collected from entrance or day-
154+use charges the entrance fees for recreation vehicles and travel
155+trailers shall be used at the state parks where the charges were
156+collected. The Commission may establish an annual pass, or other
157+varied passes as appropriate to that park, for visitors ; provided,
158+the annual pass or other passes shall not restrict access to state
159+parks for visitors not using recreational vehicles or travel

190-use charges the entrance fees for recreation vehicles and travel
191-trailers shall be used at the state parks where the charges were
192-collected. The Commission may establish an annual pass, or other
193-varied passes as appropriate to that park, for visitors ; provided,
194-the annual pass or other passes shall not restrict access to state
195-parks for visitors not using recreational vehicles or travel
196186 trailers. The method whereby the maximum charges are determined,
197187 sold, and collected shall be in accordance with rules promulgated
198188 pursuant to Article I of the Administrati ve Procedures Act. At
199189 least twenty (20) days prior to the adoption or approval of any rate
200190 changes by the Commission, the Department shall submit a copy of
201191 such proposed charges, for informational purposes, to the Governor,

203193 the Senate.
204194 4. Fees Except for the fee established in paragraph 3 of this
205195 section, fees shall be promulgated pursuant t o Article I of the
206196 Administrative Procedures Act.
207197 5. Fees may reflect the seasonal usage of the parks and
208198 facilities and for promotional purposes and goals.
209199 B. All fees, licenses, and other charges shall be posted in a
210200 convenient place in each park. Ever y person using any of the
211201 facilities in a park shall be charged the same fees, licenses, and
212202 every other charge except:
203+1. Residents of this state six ty-two (62) years of age and over
204+and their spouses shall not be charged any admission fees for
205+entrance into any state-owned and -operated park. The Commission
206+may promulgate rules establishing different fees for residents and
207+nonresidents sixty-two (62) years of age and over. Identification

240-1. Residents of this state six ty-two (62) years of age and over
241-and their spouses shall not be charged any admission fees for
242-entrance into any state-owned and -operated park. The Commission
243-may promulgate rules establishing different fees for residents and
244-nonresidents sixty-two (62) years of age and over. Identification
245-may be established by presentatio n of proof of age, residency, a
246-state driver license, a state license for identification only, birth
247236 certificate, or any other form of identification author ized by the
248237 Commission;
249238 2. Individuals who have been certified as totally disabled
250239 under state or federal law and their spouses shall be entitled to a
251240 fifty percent (50%) reduction of fee s which apply to recreational-
252241 use facilities;
253242 3. Children’s groups, volunteer groups as specifi ed by the
254243 Commission, or governmental entities that provide beneficial
255244 services at the facility for which the fee may be reduced or waived;
256245 and
257246 4. Special discount rates as authorized in this section may be
258247 waived for individua ls who are members of a grou p being provided a
259248 special group rate as allowed by law.
260249 C. The failure to collect such fees, licenses , and other
261250 charges shall subject an employee of the Comm ission to a fine of
262251 Twenty-five Dollars ($25.00) for each and every violation.

253+amended to read as follows:
254+Section 2254. There is hereby created in the State Treasury a
255+revolving fund for the Oklahoma Tourism and Recreation Department to
256+be designated the “State Park System Imp rovement Revolving Fund ”.
257+The fund shall be a continuing fund not subject to fiscal year
258+limitations. The fund shall consist of all monies that are rece ived
259+by the Department, from all entrance or day-use charges for the

290-SECTION 3. AMENDATORY 74 O.S. 2021, Section 2254, is
291-amended to read as follows:
292-Section 2254. There is hereby created in the State Treasury a
293-revolving fund for the Oklahoma Tourism and Recreation Department to
294-be designated the “State Park System Imp rovement Revolving Fund ”.
295-The fund shall be a continuing fund not subject to fiscal year
296-limitations. The fund shall consist of all monies that are rece ived
297-by the Department, from all entrance or day-use charges for the
298286 state park system, including char ges for an annual pass for visitors
299287 to the state parks. All monies accruing to the fund are hereby
300288 appropriated and may be expended by the Department at the state park
301289 where the charges were collected as authorized by Sec tion 2220 of
302290 this title. Expendit ures from the fund shall be made upon wa rrants
303291 issued by the State Treasurer against claims filed as prescribed by
304292 law with the Director of the Office of Management and Enterprise
305293 Services for approval and payment.
306294 SECTION 4. This act shall become effective November 1, 2023.
