2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6 -111, as
3259 last amended by Section 53, Chapter 282, O.S.L. 20 22 (47 O.S. Supp.
3360 2022, Section 6-111), is amended to read as follows:

3561 Section 6-111. A. 1. Service Oklahoma shall, upon payment of
3662 the required fee, issue to every applicant qualifying therefor a
3763 Class A, B, C or D driver license or identification card as applied
3864 for, which license or card shall bear thereon a distinguishing
3965 alphanumeric identificatio n assigned to the licensee or cardholder,
4066 date of issuance and date of expiration of the license or card, the

4194 full legal name, signature or computerized signature, date of birth,
4295 residence address, unless specified as an exception in the Code of
4396 Federal Regulations per 6 C.F.R., Section 37.17, sex, a computerized
4497 color image of the licensee or cardholder taken in accordance with
4598 Service Oklahoma rules and security features as determined by
4699 Service Oklahoma. The image shall depict a fu ll front unobstructed

49100 view of the entire face of the licensee or cardholder; provided, a
50101 commercial learner permit shall not bear the image of the licensee.
51102 When any person is issued both a driver license and an
52103 identification card, Service Oklahoma shall ensure the informatio n
53104 on both the license and the card are the same, unless otherwise
54105 provided by law.

56106 2. A driver license or identification card issued by Service
57107 Oklahoma on or after Ma rch 1, 2004, shall bear thereon the county of
58108 residence of the lic ensee or cardholder.

60109 3. Service Oklahoma may cancel the distinguishing number, when
61110 that distinguishing number is another person ’s Social Security
62111 number, assign a new distinguishing alphan umeric identification, and
63112 issue a new license or identification c ard without charge to the
64113 licensee or cardholder.

66114 4. Service Oklahoma may promulgate rules for inclusion of the
67115 height and a brief description of the licensee or cardholder on the
68116 face of the card or license identifying the licensee or cardholder
69117 as deaf or hard-of-hearing.

71145 5. It is unlawful for any person to apply, adhere, or otherwise
72146 attach to a driver license or identification card any decal,
73147 sticker, label, or other attachment. Any la w enforcement officer is
74148 authorized to remove and dispose of any u nlawful decal, sticker ,
75149 label, or other attachment from the driver license of a person. The
76150 law enforcement officer, the employing agency of the officer,
77151 Service Oklahoma, and the State of Oklahoma shall be immune from any
78152 liability for any loss suffered by the licensee, cardh older, or the
79153 owner of the decal, sticker, label, or other attachment caused by
80154 the removal and destruction of the decal, sticker, label, or other
81155 attachment.

83156 6. Service Oklahoma may develop by rule a procedure which
84157 complies with the provisions of subsec tion G of Section 6-101 of
85158 this title whereby a person may apply for a renewal or replacement
86159 Oklahoma Class D license or Oklahoma identification card.

88160 B. 1. Service Oklahoma may issue or authorize the issuance of
89161 a temporary permit or license to an appl icant for a driver license
90162 permitting such applicant to operate a motor vehicle while Service

93163 Oklahoma is completing its investigation and determination of all
94164 facts relative to such applicant’s privilege to receive a license,
95165 or while a permanent driver l icense is being produced and delivered
96166 to the applicant. Such permit or license must be in the immediate
97167 possession of the driver while operating a motor vehicle, and it

98195 shall be invalid when the applicant’s permanent driver license has
99196 been issued and delivered or for good cause has been refused.

101197 2. Service Oklahoma may issue or authorize the issuance of a
102198 temporary identification card to an applicant, permitting the holder
103199 the privileges otherwise granted by identification cards, w hile a
104200 permanent driver license is being provided and delivered to the
105201 applicant. Such card shall be invalid when the applicant ’s
106202 permanent identification card has been issued and delivered , or for
107203 good cause has been refused.

109204 C. 1. Service Oklahoma may issue a restricted co mmercial
110205 driver license to drivers eighteen (18) years of age or older for
111206 any of the following specific farm -related service industries:
112-
113207 a. farm retail outlets and sup pliers,
114-
115208 b. agri-chemical businesses,
116-
117209 c. custom harvesters, and
118-
119210 d. livestock feeders.

121211 The applicant shall hold a valid Oklahoma driver license and
122212 shall meet all the requirements for a commercial driver license.
123213 The restricted commercial driver license sha ll not exceed a total of
124214 one hundred eighty (180) days within any twelve-month period.

126215 2. The restricted commercial driver license shall not be valid
127216 for operators of commercial motor vehicles beyond one hundred fifty
128217 (150) miles from the place of busines s or the farm currently being
129218 served. Such license shall be limit ed to Class B vehicles . Holders

130246 of such licenses who transport hazardous materials which are
131247 required to be placarded shall be limited to the following:

133248 a. diesel fuel in quantities of one thousand (1,000)
134249 gallons or less,

138250 b. liquid fertilizers in vehicle s with total capacitie s
139251 of three thousand (3,000) gallons or less, and

141252 c. solid fertilizers that are not mixed with any organic
142253 substance.

144254 No other placarded hazardous materials shall be tra nsported by
145255 holders of such licenses.

147256 D. Service Oklahoma may iss ue a non-domiciled commercial
148257 learner permit or a non-domiciled commercial driver license to:

150258 1. An H2A-Temporary Agricultural worker lawfully present in the
151259 United States as indicated on a n original, valid and unexpired I-94
152260 immigration status document i ssued by the United St ates Customs and
153261 Immigration Service; and
154-
155262 2. A J-1 Exchange Visitor Program participant lawfully present
156263 in the United States as indicated on a valid and unexpired J -1
157264 Visitor Visa issued by the United States Customs and Immigration
158265 Service and who is enr olled in an agricultural education training
159266 program.

161267 A person applying for such permit or license must comply with
162268 all testing and licensing requirements in accordance with applicable
163269 federal regulations, state laws and Service Oklaho ma rules. The

164297 issued license shall be valid until the expiration of the visa for
165298 the non-domiciled worker. Service Oklahoma may promulgate rules for
166299 the implementation of the process to ca rry out the provisions of
167300 this section.

169301 E. 1. Service Oklahoma s hall develop a procedu re whereby a
170302 person applying for an original, renewal or replacement Class A, B,
171303 C or D driver license or identification card who is required to
172304 register as a convicted sex offender with the Department of
173305 Corrections pursuant to the p rovisions of the Sex O ffenders
174306 Registration Act and who the Department of Corrections designates as
175307 an aggravated or habitual offender pursuant to subsection J of
176308 Section 584 of Title 57 of the Oklahoma Statutes shall be issued a
177309 license or card bearing th e words “Sex Offender”.

181310 2. Service Oklahoma shall notify every person subject to
182311 registration under the provisions of Section 1 -101 et seq. of this
183312 title who holds a current Class A, B, C o r D driver license or
184313 identification card that such person is requ ired to surrender the
185314 license or card to Service Oklahoma within one hundred eighty (180)
186315 days from the date of the notice.

188316 3. Upon surrendering the license or card for the reason set
189317 forth in this subsection, application may be made with Service
190318 Oklahoma for a replacement lic ense or card bearing the words “Sex
191319 Offender”.

193347 4. Failure to comply with the requirements set forth in such
194348 notice shall result in cancellation of the person ’s license or card.
195349 Such cancellation shall be in effect for one (1) year, after which
196350 time the person may make application with Service Oklahoma for a new
197351 license or card bearing the words “Sex Offender”. Continued use of
198352 a canceled license or card shall constitu te a misdemeanor and shall,
199353 upon conviction thereof, be punishable by a fine of not less than
200354 Twenty-five Dollars ($25.00), nor more than Two Hundred Dollars
201355 ($200.00). When an individual is no longer required to register as
202356 a convicted sex offender with the Department of Corrections pursuant
203357 to the provisions of the Se x Offenders Registrati on Act, the
204358 individual shall be eligible to receive a driver license or
205359 identification card which does not bear the words “Sex Offender”.

207360 F. Nothing in subsection E of this section shall be deemed to
208361 impose any liability upon or give rise to a cause of ac tion against
209362 any employee, agent or official of the Department of Corrections for
210363 failing to designate a sex offender as an aggravated or habitual
211364 offender pursuant to subsection J of Section 584 of Title 57 of the
212365 Oklahoma Statutes.

214366 G. A person subject t o an order for the installation of an
215367 ignition interlock device shall be required by Service Oklahoma to
216368 submit his or her driver license for a replacement. The replac ement
217369 driver license shall bear the words “Interlock Required” and such
218370 designation shall remain on the driver license for the duration of

219398 the order requiring the ignition interlock device. The replacement
220399 license shall be subject to the same expiration a nd renewal
221400 procedures provided by law. Upon completion of the req uirements for

224401 the interlock device, a person may apply for a replacement driver
225402 license.

227403 H. Service Oklahoma shall develop a procedure whereby a person
228404 applying for an original, renewal or replacement Class D driver
229405 license who has been granted modified d riving privileges unde r this
230406 title shall be issued a Class D driver license which identifies the
231407 license as a modified license.

233408 SECTION 2. It being immediately necessary for the preservation
234409 of the public peace, health or safety, an emergency is hereby
235410 declared to exist, by reason whereof this act shall take effect and
236411 be in full force from and after its passage and approval .
