5948 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6049 SECTION 1. NEW LAW A new section of la w to be codified
6150 in the Oklahoma Statutes as Section 839.4 of Title 21, unless there
6251 is created a duplication in numb ering, reads as follows:
6352 A. No first responder or scene support personnel shall release
6453 to the public scene specific information or transmit to a social
6554 media site any photographic image or vi deo taken at a collision or
6655 crime scene without prior authorization from the in vestigating
6756 agency.
57+B. As used in this section:
58+1. “First responder” shall mean a full-time, reserve, or
59+volunteer, state, county, or municipal peace officer, firefighter,
60+paramedic, emergency medical technician, rescue service personnel,

95-B. As used in this section:
96-1. “First responder” shall mean a full-time, reserve, or
97-volunteer, state, county, or municipal peace officer, firefighter,
98-paramedic, emergency medical technician, rescue service personnel,
9987 emergency manager, medical examiner or employee of a medical
10088 examiner, or wrecker service provider;
10189 2. “Investigating agency” shall mean the city, county, or state
10290 agency responsible for investigating and repor ting the collision to
10391 the Department of Public Safety or the crim e report to the Oklahoma
10492 State Bureau of Investigation ; and
10593 3. “Scene support personnel ” shall include, but not be li mited
10694 to, towing or remediation services, funeral homes, c rime scene
10795 cleaners, or city, county, and state road maintenance employees.
10896 C. The provisions of subsection A of this section shall not
10997 prevent the Oklahoma State Bu reau of Investigation or the Oklahoma
11098 Highway Patrol from transmitting information when a law enforcement
11199 agency requests investigati ve assistance.
112100 D. Within ninety (90) days of the effective date of this act,
113101 any agency or entity employing first responders or scene support
114102 personnel shall notify the employees of the provisions of this act.
115103 E. Any person convicte d of a violation of this section shall be
116104 guilty of a misdemeanor punishable by a fine not to exceed One
117105 Thousand Dollars ($1,000.00), or by imprisonment in the county jail
118106 not to exceed one (1) year, or by both such fine and imprisonment .
107+SECTION 2. This act shall become effective November 1, 2023.
