39	40		47 O.S. 2021, Section 584, as last amended by Section
40	41		4, Chapter 192, O.S.L. 2022 (47 O.S. Supp. 2022,

48	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	54		SECTION 1. AMENDATORY 47 O.S. 2021, Section 584, as last
50	55		amended by Section 4, Chapter 192, O.S.L. 2022 (47 O.S. Supp. 2022,
51	56		Section 584), is amended to read as follows:
52	57		Section 584. A. The Oklahoma Used Motor Vehicle and Parts
53	58		Commission may deny an application for a license, impose a fine not
54	59		to exceed One Thousand Dollars ($1,000.00) per occurre nce and/or
55	60		revoke or suspend a license after it has been granted, when any
56	61		provision of Sections 581 through 588 of this title is violated or
57	62		for any of the following reasons:
58		-	1. On satisfactory proof of unfitness of the applicant or the
59		-	licensee, as the case may be, under the standards established by
60		-	Sections 581 through 588 of this title;

	90	+	1. On satisfactory proof of unfitness of the applicant or the
	91	+	licensee, as the case may be, under the standards established by
	92	+	Sections 581 through 588 of this title;
87	93		2. For fraud practices or any material misstatement made by an
88	94		applicant in any application fo r license under the provisions of
89	95		Sections 581 through 588 of this title;
90	96		3. For any willful failure to comply with any provision of
91	97		Section 581 et seq. of this tit le or with any rule promulgated by
92	98		the Commission under authority vested in it by Sections 581 through
93	99		588 of this title;
94	100		4. Change of condition after license is g ranted resulting in
95	101		failure to maintain the qualifications for license;
96	102		5. Continued or fla grant violation of any of the rules of the
97	103		Commission;
98	104		6. Being a used motor vehicle deale r, a used motor vehicle
99	105		salesperson, a wholesale used motor vehicle deale r, or a
100	106		manufactured home dealer, a restricted manufactured home park
101	107		dealer, a manufactured home installer, a manufactured home
102	108		salesperson or a manufactured home manufacturer who:
103	109		a. resorts to or uses any false or misleading advertising
104	110		in connection with business as a used motor vehicle
105	111		dealer, wholesale used motor vehicle dealer or a
106	112		restricted manufactured home park dealer or
107	113		manufactured home dealer, installer or manufacturer,
108		-	b. has committed any unlawful act which resulted in the
109		-	revocation of any similar license in another state,

	141	+	b. has committed any unlawful act which resulted in the
	142	+	revocation of any similar license in another state,
136	143		c. has been convicted of a felony crime that
137	144		substantially relates to the occupation of a used
138	145		motor vehicle dealer, a wholesale used motor vehicle
139	146		dealer, a manufactured home dealer, a restricted
140	147		manufactured home park de aler, a manufactured home
141	148		installer or a manufactured home manufacturer an d
142	149		poses a reasonable threa t to public safety,
143	150		d. has committed a fraudulent act in selling, purchasing
144	151		or otherwise dealing in motor vehicles or manufactured
145	152		homes or has misrepresen ted the terms and conditions
146	153		of a sale, purchase or contract for sale or p urchase
147	154		of a motor vehicle or manufactured home or any
148	155		interest therein including an option to purchase such
149	156		motor vehicles or manufactured homes,
150	157		e. has engaged in business under a past or present
151	158		license issued pursuant to Sections 581 through 588 of
152	159		this title, in such a manner as to cause injury to the
153	160		public or to those with whom the licensee is dealing,
154	161		f. has failed to meet or maintain the conditions and
155	162		requirements necessary to qualify for the issuance of
156	163		a license,
157		-	g. has failed or refused to furn ish and keep in force any
158		-	bond required under Sections 581 through 588 of this

	192	+	bond required under Sections 581 through 588 of this
	193	+	title,
186	194		h. has installed or att empted to install a manufactured
187	195		home in an unworkmanlike manner, or
188	196		i. employs a person in connection with the sale of
189	197		manufactured homes without first obtaining a
190	198		certificate of registration for the person;
191	199		7. Being a used motor vehicle dealer who:
192	200		a. does not have an established place of business,
193	201		b. employs a person in con nection with the sale of used
194	202		vehicles without first obtaining a certifica te of
195	203		registration for the person,
196	204		c. fails or refuses to furnish or keep in force single
197	205		limit liability insurance on any vehicle offered for
198	206		sale and otherwise required under the f inancial
199	207		responsibility laws of this state, or
200	208		d. is not operating from th e address shown on the lic ense
201	209		if this change has not been reported to the
202	210		Commission; or
203	211		8. Being a manufactured home dealer or a restricted
204	212		manufactured home park dealer who:
205	213		a. does not have an established place of business,
206		-	b. fails or refuses to furn ish or keep in force garag e
207		-	liability and completed operations insurance, or

	241	+	b. fails or refuses to furn ish or keep in force garag e
	242	+	liability and completed operations insurance, or
234	243		c. is not operating from the add ress shown on the license
235	244		if this change has not been reported to the
236	245		Commission.
237	246		B. 1. The Commission shall deny an application for a license,
238	247		or revoke or suspend a lice nse after it has been granted, if a
239	248		manufactured home dealer does not meet the foll owing guidelines and
240	249		restrictions:
241	250		a. a display area for manufactured hom es which is easily
242	251		accessible, with sufficient parking for the public,
243	252		b. an office for conducting b usiness where the books,
244	253		records, and files are kept, with access to a restroom
245	254		for the public,
246	255		c. a place of business which meets all zoning, occupancy
247	256		and other requirements of the appropriate local
248	257		government and regular occupancy by a person, firm, or
249	258		corporation engaged in the b usiness of selling
250	259		manufactured homes, and
251	260		d. a place of business which is separate and apart from
252	261		any other dealer’s location.
253	262		2. The Commission shall deny an application for a res tricted
254	263		manufactured home park dealer license, or revoke or suspend a
255		-	license after it has been granted, if a manufactu red home park
256		-	dealer does not satisfy the following guidelines and restrictions:

	291	+	license after it has been granted, if a manufactured home p ark
	292	+	dealer does not satisfy the following guidelines and restrictions:
283	293		a. only mobile or manufactured homes that are “ready for
284	294		occupancy” are sold or offered for sale,
285	295		b. maintains an office for conducting business where the
286	296		books, records, and files are kept, with access to a
287	297		restroom for the public,
288	298		c. maintains a place of b usiness which meets all zoning,
289	299		occupancy and other re quirements of the appropriate
290	300		local government and regular occupancy by a person,
291	301		firm or corporation engaged in the business of selling
292	302		manufactured homes inside a park, and
293	303		d. maintains a place of bus iness which is separate and
294	304		apart from any other deale r’s location.
295	305		C. The Commission shall deny an application for a license, or
296	306		revoke or suspend a license after it has been grante d, if a
297	307		manufactured home installer:
298	308		1. Installs or attempts to install a manufactured home in a
299	309		manner that is not in compliance with installation standards as set
300	310		by the Commission pursuant to rule; or
301	311		2. Violates or fails to comply with any applicable rule as
302	312		promulgated by the Commission concerning manufactured home
303	313		installers.
304		-	D. The Commission shall deny an application for a license, or
305		-	revoke or suspend a license af ter it has been granted, if a
306		-	manufactured home manufacturer violates or fails to comply with any

	341	+	D. The Commission shall deny an application for a license, or
	342	+	revoke or suspend a license af ter it has been granted, if a
	343	+	manufactured home manufacturer violates or fails to c omply with any
333	344		applicable rule as promulgated by the Commission concernin g
334	345		manufactured home manufacturers.
335	346		E. The Commission shall deny an application for a license by a
336	347		motor vehicle manufacturer or factory if the application is for the
337	348		purpose of selling used motor vehicles to any retail consumer in the
338	349		state, other than th rough its retail franchised dealers, or acting
339	350		as a broker between a seller and a retail buyer. Thi s subsection
340	351		does not prohibit a manufacturer from selling used motor vehicles
341	352		where the retail customer is a nonprofit organization or a federal,
342	353		state, or local government or agency. This subsection does not
343	354		prohibit a manufacturer from providing inform ation to a consumer for
344	355		the purpose of marketing or facilitating the sale of used m otor
345	356		vehicles or from establishing a program to sell or offer to sell
346	357		used motor vehicles through the manufacturer ’s retail franchised
347	358		dealers as provided for in Sections 56 1 through 580.2 of this title.
348	359		This subsection shall not prevent a factory from ob taining a
349	360		wholesale used motor vehicle dealer ’s license or the factory ’s
350	361		financing subsidiary from obtaining a wholesale used motor vehicle
351	362		dealer’s license.
352	363		F. If the Commission denies issuance of a license the
353	364		Commission shall provide the grounds for th e action to the applicant
354		-	in writing and allow the applicant sixty (60) d ays to resolve any
355		-	issues that are the grounds for the action.

	392	+	in writing and allow the applicant sixty (60) d ays to resolve any
	393	+	issues that are the grounds for the action.
382	394		G. Each of the aforementioned ground s for suspension,
383	395		revocation, or denial of issuance or renewal of license shall als o
384	396		constitute a violation of Sections 581 through 588 of this title,
385	397		unless the person involved has been tried and acquitted of the
386	398		offense constituting such grounds.
387	399		The suspension, revocation or refusal to issue or renew a
388	400		license or the imposition of any other penalty by the Commission
389	401		shall be in addition to any penalty whic h might be imposed upon any
390	402		licensee upon a conviction at law for any violation of Sections 581
391	403		through 588 of this title.
392	404		H. This section shall not be construed to prohibit a used m otor
393	405		vehicle dealer from delivering a motor vehicle off site or from
394	406		selling a motor vehicle to a customer at the home or place of
395	407		business of the customer.
396	408		H. I. As used in this section:
397	409		1. “Substantially relates ” means the nature of criminal conduct
398	410		for which the person was convicted has a direct bear ing on the
399	411		fitness or ability to perform one or more of the duties or
400	412		responsibilities necessarily related to the occupatio n; and
401	413		2. “Poses a reasonable threat ” means the nature of criminal
402	414		conduct for which the person was convicted involved an act or thr eat
403		-	of harm against another and has a bearing on the fitness or ability
404		-	to serve the public or work with others in the occu pation.
405		-	SECTION 2. This act shall become effective Novem ber 1, 2023.
