3839 An Act relating to motor vehicle delivery; am ending
3940 47 O.S. 2021, Section 584, as last amended by Section
4041 4, Chapter 192, O.S.L. 2022 (47 O.S. Supp. 2022,
4142 Section 584), which relates to the basis for denial ,
4243 revocation, or suspension of license; providing
4344 certain exemption; and providing an effective date.

4853 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4954 SECTION 1. AMENDATORY 47 O.S. 2021, Section 584, as last
5055 amended by Section 4, Chapter 192, O.S.L. 2022 (47 O.S. Supp. 2022,
5156 Section 584), is amended to read as follows:
5257 Section 584. A. The Oklahoma Used Motor Vehicle and Parts
5358 Commission may deny an application for a license, impose a fine not
5459 to exceed One Thousand Dollars ($1,000.00) per occurre nce and/or
5560 revoke or suspend a license after it has been granted, when any
5661 provision of Sections 581 through 588 of this title is violated or
5762 for any of the following reasons:
58-1. On satisfactory proof of unfitness of the applicant or the
59-licensee, as the case may be, under the standards established by
60-Sections 581 through 588 of this title;

90+1. On satisfactory proof of unfitness of the applicant or the
91+licensee, as the case may be, under the standards established by
92+Sections 581 through 588 of this title;
8793 2. For fraud practices or any material misstatement made by an
8894 applicant in any application fo r license under the provisions of
8995 Sections 581 through 588 of this title;
9096 3. For any willful failure to comply with any provision of
9197 Section 581 et seq. of this tit le or with any rule promulgated by
9298 the Commission under authority vested in it by Sections 581 through
9399 588 of this title;
94100 4. Change of condition after license is g ranted resulting in
95101 failure to maintain the qualifications for license;
96102 5. Continued or fla grant violation of any of the rules of the
97103 Commission;
98104 6. Being a used motor vehicle deale r, a used motor vehicle
99105 salesperson, a wholesale used motor vehicle deale r, or a
100106 manufactured home dealer, a restricted manufactured home park
101107 dealer, a manufactured home installer, a manufactured home
102108 salesperson or a manufactured home manufacturer who:
103109 a. resorts to or uses any false or misleading advertising
104110 in connection with business as a used motor vehicle
105111 dealer, wholesale used motor vehicle dealer or a
106112 restricted manufactured home park dealer or
107113 manufactured home dealer, installer or manufacturer,
108-b. has committed any unlawful act which resulted in the
109-revocation of any similar license in another state,

141+b. has committed any unlawful act which resulted in the
142+revocation of any similar license in another state,
136143 c. has been convicted of a felony crime that
137144 substantially relates to the occupation of a used
138145 motor vehicle dealer, a wholesale used motor vehicle
139146 dealer, a manufactured home dealer, a restricted
140147 manufactured home park de aler, a manufactured home
141148 installer or a manufactured home manufacturer an d
142149 poses a reasonable threa t to public safety,
143150 d. has committed a fraudulent act in selling, purchasing
144151 or otherwise dealing in motor vehicles or manufactured
145152 homes or has misrepresen ted the terms and conditions
146153 of a sale, purchase or contract for sale or p urchase
147154 of a motor vehicle or manufactured home or any
148155 interest therein including an option to purchase such
149156 motor vehicles or manufactured homes,
150157 e. has engaged in business under a past or present
151158 license issued pursuant to Sections 581 through 588 of
152159 this title, in such a manner as to cause injury to the
153160 public or to those with whom the licensee is dealing,
154161 f. has failed to meet or maintain the conditions and
155162 requirements necessary to qualify for the issuance of
156163 a license,
157-g. has failed or refused to furn ish and keep in force any
158-bond required under Sections 581 through 588 of this
159-title,

191+g. has failed or refused to furn ish and keep in force any
192+bond required under Sections 581 through 588 of this
193+title,
186194 h. has installed or att empted to install a manufactured
187195 home in an unworkmanlike manner, or
188196 i. employs a person in connection with the sale of
189197 manufactured homes without first obtaining a
190198 certificate of registration for the person;
191199 7. Being a used motor vehicle dealer who:
192200 a. does not have an established place of business,
193201 b. employs a person in con nection with the sale of used
194202 vehicles without first obtaining a certifica te of
195203 registration for the person,
196204 c. fails or refuses to furnish or keep in force single
197205 limit liability insurance on any vehicle offered for
198206 sale and otherwise required under the f inancial
199207 responsibility laws of this state, or
200208 d. is not operating from th e address shown on the lic ense
201209 if this change has not been reported to the
202210 Commission; or
203211 8. Being a manufactured home dealer or a restricted
204212 manufactured home park dealer who:
205213 a. does not have an established place of business,
206-b. fails or refuses to furn ish or keep in force garag e

242+liability and completed operations insurance, or
234243 c. is not operating from the add ress shown on the license
235244 if this change has not been reported to the
236245 Commission.
237246 B. 1. The Commission shall deny an application for a license,
238247 or revoke or suspend a lice nse after it has been granted, if a
239248 manufactured home dealer does not meet the foll owing guidelines and
240249 restrictions:
241250 a. a display area for manufactured hom es which is easily
242251 accessible, with sufficient parking for the public,
243252 b. an office for conducting b usiness where the books,
244253 records, and files are kept, with access to a restroom
245254 for the public,
246255 c. a place of business which meets all zoning, occupancy
247256 and other requirements of the appropriate local
248257 government and regular occupancy by a person, firm, or
249258 corporation engaged in the b usiness of selling
250259 manufactured homes, and
251260 d. a place of business which is separate and apart from
252261 any other dealer’s location.
253262 2. The Commission shall deny an application for a res tricted
254263 manufactured home park dealer license, or revoke or suspend a
255-license after it has been granted, if a manufactu red home park
256-dealer does not satisfy the following guidelines and restrictions:

291+license after it has been granted, if a manufactured home p ark
292+dealer does not satisfy the following guidelines and restrictions:
283293 a. only mobile or manufactured homes that are “ready for
284294 occupancy” are sold or offered for sale,
285295 b. maintains an office for conducting business where the
286296 books, records, and files are kept, with access to a
287297 restroom for the public,
288298 c. maintains a place of b usiness which meets all zoning,
289299 occupancy and other re quirements of the appropriate
290300 local government and regular occupancy by a person,
291301 firm or corporation engaged in the business of selling
292302 manufactured homes inside a park, and
293303 d. maintains a place of bus iness which is separate and
294304 apart from any other deale r’s location.
295305 C. The Commission shall deny an application for a license, or
296306 revoke or suspend a license after it has been grante d, if a
297307 manufactured home installer:
298308 1. Installs or attempts to install a manufactured home in a
299309 manner that is not in compliance with installation standards as set
300310 by the Commission pursuant to rule; or
301311 2. Violates or fails to comply with any applicable rule as
302312 promulgated by the Commission concerning manufactured home
303313 installers.
304-D. The Commission shall deny an application for a license, or
305-revoke or suspend a license af ter it has been granted, if a

341+D. The Commission shall deny an application for a license, or
342+revoke or suspend a license af ter it has been granted, if a
343+manufactured home manufacturer violates or fails to c omply with any
333344 applicable rule as promulgated by the Commission concernin g
334345 manufactured home manufacturers.
335346 E. The Commission shall deny an application for a license by a
336347 motor vehicle manufacturer or factory if the application is for the
337348 purpose of selling used motor vehicles to any retail consumer in the
338349 state, other than th rough its retail franchised dealers, or acting
339350 as a broker between a seller and a retail buyer. Thi s subsection
340351 does not prohibit a manufacturer from selling used motor vehicles
341352 where the retail customer is a nonprofit organization or a federal,
342353 state, or local government or agency. This subsection does not
343354 prohibit a manufacturer from providing inform ation to a consumer for
344355 the purpose of marketing or facilitating the sale of used m otor
345356 vehicles or from establishing a program to sell or offer to sell
346357 used motor vehicles through the manufacturer ’s retail franchised
347358 dealers as provided for in Sections 56 1 through 580.2 of this title.
348359 This subsection shall not prevent a factory from ob taining a
349360 wholesale used motor vehicle dealer ’s license or the factory ’s
350361 financing subsidiary from obtaining a wholesale used motor vehicle
351362 dealer’s license.
352363 F. If the Commission denies issuance of a license the
353364 Commission shall provide the grounds for th e action to the applicant
354-in writing and allow the applicant sixty (60) d ays to resolve any
355-issues that are the grounds for the action.

392+in writing and allow the applicant sixty (60) d ays to resolve any
393+issues that are the grounds for the action.
382394 G. Each of the aforementioned ground s for suspension,
383395 revocation, or denial of issuance or renewal of license shall als o
384396 constitute a violation of Sections 581 through 588 of this title,
385397 unless the person involved has been tried and acquitted of the
386398 offense constituting such grounds.
387399 The suspension, revocation or refusal to issue or renew a
388400 license or the imposition of any other penalty by the Commission
389401 shall be in addition to any penalty whic h might be imposed upon any
390402 licensee upon a conviction at law for any violation of Sections 581
391403 through 588 of this title.
392404 H. This section shall not be construed to prohibit a used m otor
393405 vehicle dealer from delivering a motor vehicle off site or from
394406 selling a motor vehicle to a customer at the home or place of
395407 business of the customer.
396408 H. I. As used in this section:
397409 1. “Substantially relates ” means the nature of criminal conduct
398410 for which the person was convicted has a direct bear ing on the
399411 fitness or ability to perform one or more of the duties or
400412 responsibilities necessarily related to the occupatio n; and
401413 2. “Poses a reasonable threat ” means the nature of criminal
402414 conduct for which the person was convicted involved an act or thr eat
403-of harm against another and has a bearing on the fitness or ability
404-to serve the public or work with others in the occu pation.
405-SECTION 2. This act shall become effective Novem ber 1, 2023.
