83156 2. “Aeronautical hazard” means any structure, object of natural
84157 growth or use of land, which obstructs the airspace required for the
85158 flight of aircraft in landing o r taking off at an airport that is
86159 otherwise hazardous to the operation and naviga tion of aircraft;

88160 3. “Air navigation facility” means any facility used in,
89161 available for use in, or designed for use in, aid of air navigation
90162 including landing areas, any s tructures, mechanisms, lights,

94164 or devices used or u seful as an aid, or constituting an advantage or

99168 4. “Aircraft” means any contraption now known, or hereafter
100169 invented, used or designed for navigation of or flight in the air or

105173 navigation of aircraft while under way, and any individual who is
106174 directly in charge of the inspection, maintenance, overhauling or

113206 7. “Airspace” means that portion of th e atmosphere overlying a
114207 designated geographical area considered as subjec t to territorial
115208 jurisdiction or internation al law in respect to its use by aircraft,
116209 guided missiles, and rockets;

146256 14. 15. “Manned aircraft” means an aircraft, as defined in this
147257 section, that is operated with a person in or on the aircraft;

149258 15. 16. “Model aircraft” means an aircraft as defined in t his
150259 section that is mechan ically driven or launched into flight and that

153261 a. is flown solely for hobby or recreational purpo ses,

162268 16. 17. “Municipality” means any incorporated city, village, or
163269 town of this state a nd any county or political subdivision or
164270 district in this state, or any public trust thereof, which is, or
165271 may be, authorized by law to acquire, establish, construct,
166272 maintain, improve, and operate airports, airstrips, and aeronautical
167273 navigation facilities;

169274 17. 18. “Operation of aircraft” or “operate aircraft” means the
170275 use, navigation or piloting of aircraft i n the airspace over this
171276 state or upon any airport within this state;

173277 18. 19. “Person” means any individual, firm, partnership,
174278 corporation, company, ass ociation, joint stock assoc iation or body

180308 19. 20. “Primary commercial service airport” means an airport
181309 meeting the current Federal Aviation Administration definitio n for
182310 primary commercial se rvice airport;

184311 20. 21. “Reliever airport” means an airport designated by the
185312 Federal Aviation Administration as a reliever airport and which
186313 provides substantial capacity or instrument training relief to a
187314 primary commercial service airport;

189315 21. 22. “Resources” means services, facilities, funds,
190316 equipment, property, personnel and such other activities as are
191317 customarily included within the term;

193318 22. 23. “State” or “this state” means the State of Oklahoma;

195319 23. 24. “Unmanned aircraft” means an aircraft, as defined in
196320 this section, that is operated without the possibility of human
197321 intervention from within or on the aircraft; and

199322 24. 25. “Unmanned aircraft system” means an unmanned aircraft
200323 and associated elements including communication links and co mponents
201324 that control the unmanned aircraft that are required for the pilot
202325 in command to operate safely and efficiently in the National
203326 Airspace System.

205327 SECTION 3. AMENDATORY 3 O.S. 2021, Section 84, is

208356 Section 84. A. There is hereby created the Oklahoma Aerospace
209357 and Aeronautics Commission, which shall be the successor to the
210358 Oklahoma Aviation Commiss ion created by Section 81 et seq. of this
211359 title. The Oklahoma Aerospace and Aeronautics Commission shall
212360 consist of seven (7) members, who shall be appointed by the Governor
213361 and who shall continue in office, as designated by the Governor a t
214362 the time of appointment, through the last day of the second, third,
215363 fourth, fifth, sixth, a nd seventh calendar years, respectively,
216364 following the passage of this act Section 81 et seq. of this title,
217365 with the initial seventh member remaining in office un til the end of
218366 the calendar year 1979. The successors of the members initially
219367 appointed shall be appointed for terms of six (6) years in the same
220368 manner as the members originally appointed unde r this act Section 81
221369 et seq. of this title, except that any person appointed to fill a

224370 vacancy shall be appointed only for the remainder of such term.
225371 Each member shall serve until the appointment and qualification of a
226372 successor. One member shall be ap pointed from each congressional
227373 district and any remaining members shall be appointed from the state
228374 at large. However, when congressional districts are redrawn eac h
229375 member appointed prior to July 1 of the year in which such
230376 modification becomes effective shall complete the current term of
231377 office and appointments made after July 1 of the year in which such
232378 modification becomes effective shall be based on the redrawn
233379 districts. Appointments made after July 1 of the year in which such

234407 modification becomes e ffective shall be from any redrawn districts
235408 which are not represented by a board member until such time as each
236409 of the modified congressional districts are represen ted by a board
237410 member. No appointments may be made aft er July 1 of the year in
238411 which such modification becomes effective if such appointment would
239412 result in more than two members serving from the same modified
240413 district. To qualify for appointment to the Commission, an
241414 appointee shall have the foll owing minimum qualifications:
242-
243415 1. A citizen and bona fide resident of the state; and
244-
245416 2. Three (3) years’ experience in aeronautical activities, such
246417 as general aviation, agricultural aviation, airport management, or
247418 air carrier operation.

249419 Members of the Commission shall receive no salary but shall be
250420 entitled to be reimbursed for necessary travel expenses pursu ant to
251421 the State Travel Reimbursement Act. The members of the Commission
252422 may be removed by the Governor for inefficiency, neglect of duty, or
253423 malfeasance in office in the manner provided by law for the removal
254424 of officers not subject to impeachment.

256425 B. 1. A The Director of the Oklahoma Department of Aerospace
257426 and Aeronautics shall be appointed by the Commission, who and shall
258427 serve at the pleasure of the Commission. The Director shall be
259428 appointed with due regard to such person’s fitness, by aeronautical
260429 education and by knowledge of and recent pr actical experience in
261430 aeronautics for the efficient dispatch of the powers and duties duly

262458 vested in and imposed upon the Director. The Director shall devote
263459 full time to the duties of the office and shall not be actively
264460 engaged or employed in any other business, vocation, or employment,
265461 nor shall the Director have any pecuniary interest in or any st ock

268462 in or bonds of any civil aeronautics enterprise. The Di rector shall
269463 be reimbursed for all traveling and other expenses incurred in the
270464 discharge of the official duties of the Director, subject to general
271465 statutory limitations on such expenses as conta ined in the State
272466 Travel Reimbursement Act.

274467 2. The Director shall be the executive officer of the
275468 Commission Department and under its supervision shall admin ister the
276469 provisions of this act Section 81 et seq. of this tit le and rules,
277470 regulations, and orders established thereunder and all other laws of
278471 the state relative to aeronautics. The Director shall attend all
279472 meetings of the Commission, but shall have no vote. The Director
280473 shall be in charge of the offices of the Commission Department and
281474 responsible to the Commission for the preparation of reports and the
282475 collection and dissemination of data and other public information
283476 relating to aerospace and aeronautics. The Director is hereby
284477 empowered to execute all contracts entered into by the Commission.

286478 3. The Commission may, by written order filed in its office ,
287479 delegate to the Director any of the powers or duties vested in or
288480 imposed upon it by this act Section 81 et seq. of this title. Such

290509 name of the Commission.

292510 4. The Director shall appoi nt, subject to the approval of the
293511 Commission, such experts, field and office assistants, clerks, and
294512 other employees as may be required and authorized for the proper
295513 discharge of the functions of the Commission Department.

297514 C. The Commission shall, within thirty (30) days after its
298515 appointment, organize, adopt a seal, an d make such rules and
299516 regulations for its administration, not inconsistent herewith, nor
300517 inconsistent with, or contrary to, any act of the Congress of the
301518 United States or regulations promulgated or standards established
302519 pursuant thereto, as it may deem ex pedient and from time to time
303520 amend such rules and regulations. At such organizational meeting it
304521 shall elect from among its member s a chair, a vice chair, and a
305522 secretary, to serve f or one (1) year, and annually thereafter shall
306523 elect such officers, all to serve until their successors ar e
307524 appointed and qualified. The Commission shall schedule meetings at
308525 a convenient time and place as they become necessary. Four (4)
309526 members shall constitute a quorum, and no action shall be taken by

312527 less than a majority of the Commission. Special meetings may be
313528 called as provided by the rules and regulations of the Commission.
314529 Regular meetings shall be held at the e stablished offices of the
315530 Commission Department, but, whenever the convenience of the public
316531 or of the parties may be promoted, or delay or expense may be

317559 prevented, the Commission may hold meetings, hearings, or
318560 proceedings at any other place d esignated by it. The Commission
319561 Department shall report in writing to the Governor on or about
320562 January 31 of each year. The report shall contain a summary of the
321563 proceedings of the Commission Department during the preceding fiscal
322564 year, a detailed and it emized statement of all revenu e and of all
323565 expenditures made by or in on behalf of the Commission Department,
324566 such other information as it may deem ne cessary or useful, and any
325567 additional information which m ay be requested by the Governor.

327568 D. Suitable office space shall be provided by th e Office of
328569 Management and Enterprise Services for the Commission Department in
329570 the City of Oklahoma City, and the Commission Department may incur
330571 the necessary expense for o ffice rent, furniture, stationery,
331572 printing, incidental expenses, and other necess ary expenses needed
332573 for the administration of this act Section 81 et seq. of this tit le.

334574 SECTION 4. AMENDATORY 3 O.S. 2021, Section 84.2, is
335575 amended to read as follows:

337576 Section 84.2. A. Beginning July 1, 2002, the Oklahoma
338577 Aeronautics Commission Department of Aerospace and Aeronautics shall
339578 cease to be part of or a division of the Department of
340579 Transportation and shall be deemed to be a separate and distinct
341580 agency, to be known as t he Oklahoma Aeronautics Commission
342581 Department of Aerospace and Aeronautics , and not under the Merit
343582 System of Personnel Administration. The Oklahoma Aeronautics

346612 continue to exercise their statutory powe rs, duties, and
347613 responsibilities. All records, property , equipment, assets, monies,
348614 matters pending, and funds of the division shall be transferred to
349615 the Oklahoma Aeronautics Commission Department of Aerospace and
350616 Aeronautics.

352617 B. 1. The number of full -time-equivalent employees for the
353618 Oklahoma Aeronautics Commission Department of Aerospace and

356619 Aeronautics shall not be less than ten, nor more than the number of
357620 employees currently allowed by law for the O klahoma Aeronautics
358621 Commission division of t he Department of Transportation and who
359622 transfer to the Oklaho ma Aeronautics Commission Department of
360623 Aerospace and Aeronautics pursuant to this section. In no event
361624 shall the total full-time-equivalent employees of the Oklahoma
362625 Aeronautics Commission Department of Aerospace and Aeronautics
363626 transferring or electing to remain with the Department of
364627 Transportation exceed eighteen full-time-equivalent positions.

366628 2. All full-time-equivalent employee positions for th e Oklahoma
367629 Aeronautics Commission Department of Aerospace and Aeronautics shall
368630 not be under the Merit Sys tem of Personnel Administration and shall
369631 be considered unclassified service. All employees shall serve at
370632 the pleasure of the Director of the Oklaho ma Aeronautics Commission
371633 Department of Aerospace and Aeronautics.

373661 3. The Oklahoma Aeronautics Commission Department of Aerospace
374662 and Aeronautics and the Department of Transportation may enter into
375663 an agreement for the transfer of personnel fr om the Department of
376664 Transportation to the Oklahoma Aeronautics Commission Department of
377665 Aerospace and Aeronautics . No employee shall be transferred to the
378666 Oklahoma Aeronautics Commission Department of Aerospace and
379667 Aeronautics except on the freely given written cons ent of the
380668 employee. All classified employees und er the Merit System of
381669 Personnel Administration who are not transferred to the Oklahoma
382670 Aeronautics Commission Department of Aerospace and Aeronautics shall
383671 retain the status in the class to which the posit ion occupied by the
384672 employee on July 1, 2002, is a llocated by the Office of Personnel
385673 Management. The sal ary of such an employee shall not be reduced as
386674 a result of such position allocation. All employees who are
387675 transferred to the Oklahoma Aeronautics Commission Department of
388676 Aerospace and Aeronautics shall not be required to accept a lesser
389677 grade or salary than presently received. All employees shall retain
390678 leave, sick and annual time earned, and any retirement and longevity
391679 benefits which have accrued during their tenure with the Department
392680 of Transportation. The transfer of personnel between the state
393681 agencies shall be coordinated with the Office of Personnel
394682 Management.

396683 C. The Oklahoma Aeronautics Commissio n Department of Aerospace
397684 and Aeronautics shall be authorized to rent, lease, or own the

401713 business. The Oklahoma Aeronautics Commission Department of
402714 Aerospace and Aeronautics is authorized to accept gifts, bequests,
403715 devises, contributions, and grants, public or private, including
404716 federal funds or funds from any other source for use in furt hering
405717 the purpose of the Oklahoma Aeronautics Commission Department of
406718 Aerospace and Aeronautics .

408719 D. Funding for the Oklahoma Aeronautics Commission Department
409720 of Aerospace and Aeronautics shall be provided for in the
410721 appropriation process of the Legisla ture, in addition to any other
411722 funding provided by law. The expenses incurred by the Oklahoma
412723 Aeronautics Commission Department of Aerospace and Aero nautics as a
413724 result of the transfer required by th is section shall be paid by the
414725 Oklahoma Aeronautics Commission Department of Aerospace and
415726 Aeronautics.

417727 E. The division within the Department of Transportation kn own
418728 as the Oklahoma Aeronautics Commission shall be abolished by the
419729 Transportation Commissi on after the transfer has been completed.

15042555 runways and bombing ranges. No individual wind turbine or any o ther

15072558 is an active Determinati on of No Hazard from the FAA and advers e
15082559 impacts to the United States Department of Defense , pursuant to

16982911 construction. If the wind energy developer makes a search with
16992912 reasonable diligence, and the whereabouts of a party entitled to any

17012914 notice cannot be delivered, then an affidavit attesting to such

17182955 G. The owner of a wind energy facility shall not commence
17192956 construction on the facility until the notification and public
17202957 meeting requirements of this section have been met. If an owner of
17212958 a wind energy facilit y fails to submit the infor mation as required
17222959 in this section, the owner shall be subject to an administrati ve
17232960 penalty from the Corporation Commission not to exceed One Thousand
17242961 Five Hundred Dollars ($1,500.00) per day, per violation as provided
17252962 by law.
