83134 SECTION 1. AMENDATORY 63 O.S. 2021, Section 421, as last
84135 amended by Section 1, Chapter 332, O.S.L. 2022 (63 O.S. Supp. 2022,
85136 Section 421), is amended to read as follows:

87137 Section 421. A. The Oklahoma Medical Marijuana Author ity shall
88138 make available on its website in an easy-to-find location an
89139 application for a medical marijuana dispensary license. The
90140 application fee to be paid by the applicant shall be in the amounts

97171 Oklahoma resident and must be registered to do business in Oklahoma.
98172 The Authority shall have ninety (90) business days to review the
99173 application; approve, reject , or deny the application; and mail send
100174 the approval, rejection , or denial letter stating reasons for the
101175 rejection or denial to the appli cant in the same method the
102176 application was submitted to the Authority.

104177 B. The Authority shall approve all applications which meet the
105178 following criteria:

107179 1. The applicant must be twenty -five (25) years of age or

110181 2. The applicant, if applying as an individual, must show
111182 residency in the State of Oklahoma this state;

113183 3. All applying entities must show that all members, managers,
114184 and board members are Oklahoma residents;

116185 4. An applying entity may show ownership of non -Oklahoma
117186 residents, but that percentage ownership may not exceed twen ty-five
118187 percent (25%);

123216 6. All applicants must disclose all ownership interests in the

126218 Applicants with a nonviolent felony conviction in the las t two
127219 (2) years, any other felony conviction in the last five (5) years,
128220 inmates in the custody of the Department of Corrections or any
129221 person currently incarcerated shall not qualify for a medic al
130222 marijuana dispensary license.

132223 C. Licensed medical marijua na dispensaries shall be required to
133224 complete a monthly sales report to the Authority. This rep ort shall
134225 be due on the fifteenth of each month and provide reporting on the
135226 previous month. This report shall detail the weight of mariju ana

138227 purchased at wholesale and the weight of marijuana sold to licensed
139228 medical marijuana patients and licensed careg ivers and account for
140229 any waste. The report shall show total sales in dollars, tax
141230 collected in dollars, and tax due in dollars. The Auth ority shall
142231 have oversight and auditing responsibilities to ensure that all
143232 marijuana being grown is accounted for.

145233 D. Only a licensed medical marijuana dispensary may conduct
146234 retail sales of marijuana or marijuana derivatives. Beginning on
147235 the effective date of this act November 1, 2021, licensed medical
148236 marijuana dispensaries shall be authorized to package and sell p re-
149237 rolled marijuana to licensed medical marijuana patients and licensed
150238 caregivers. The products d escribed in this subsection shall contai n
151239 only the ground parts of the marijuana plant and shall not include

152266 marijuana concentrates or derivatives. The tota l net weight of each
153267 pre-roll packaged and sold by a medical marijuana dispensary shall
154268 not exceed one (1) gram. These products shall be t ested, packaged
155269 and labeled in accordance with Oklahoma law and rules promulgated by
156270 the Authority.

158271 E. No medical marijuana dispensary shall offer or allow a
159272 medical marijuana patient licensee, caregiver licensee or other
160273 member of the public to handle or otherwise have physi cal contact
161274 with any medical marijuana not contained in a sealed or separate
162275 package. Provided, such prohibition shall not preclude an employee
163276 of the medical marijuana dispensary from handling loose or
164277 nonpackaged medical marijuana t o be placed in packag ing consistent
165278 with the Oklahoma Medical Marijuana and Patient Protection Act and
166279 the rules promulgated by the Authority for the packaging of medical
167280 marijuana for retail sale. Provided, further , such prohibition
168281 shall not prevent a m edical marijuana disp ensary from displaying
169282 samples of its medical marijuana in separate display cases, jars or
170283 other containers and allowing medical marijuana patient licensees
171284 and caregiver licensees the ability to handle or smell the various
172285 samples as long as the sample me dical marijuana is used for display
173286 purposes only and is not offered for retail sale.

221373 C. A licensed medical marijuana commercial gro wer may sell
222374 marijuana to a licensed medical marijuana dispensary or a licensed

225375 medical marijuana processor. Further , sales by a licensed medical
226376 marijuana commercial grower shall be considered wholesale sales and
227377 shall not be subject to taxation. Under no circumstances may a
228378 licensed medical marijuana commercial grower sell marijuana directly
229379 to a licensed medical mar ijuana patient or licensed medical
230380 marijuana caregiver. A licensed medical marijuana commercial gr ower
231381 may only sell at the wholesale leve l to a licensed medic al marijuana
232382 dispensary, a licensed medical marijuana commercial grower or a
233383 licensed medical marijuana processor. If the federal government
234384 lifts restrictions on buying and selling marijuana be tween states,
235385 then a licensed medical ma rijuana commercial gr ower would be allowed
236386 to sell and buy marijuana wholesale from, or to, an out -of-state
237387 wholesale provider. A licensed medical marijuana commercial grower
238388 shall be required to complete a monthly yield and sales report to
239389 the Authority. This report shall be due on the fifteenth of each

240416 month and provide reporting on the previous month. This report
241417 shall detail the amount of marijuana harvested in pounds, the amount
242418 of drying or dried marijuana on hand, the amount of marijuana sold
243419 to licensed processors in pounds, the amount of waste in pounds, and
244420 the amount of marijuana sold to licensed medical mar ijuana
245421 dispensaries in pounds. Additionally, this report shall show total
246422 wholesale sales in dolla rs. The Authority shall have oversight and
247423 auditing responsibilities to ensure that all marijuana being grown
248424 by licensed medical marijuana commercial growe rs is accounted for.

250425 D. There shall be no limits on how much marijuana a licensed
251426 medical marijuana commercial grower can grow.

253427 E. Beginning on the effective date of this act November 1,
254428 2021, licensed medical marijuana commercial growers shall be
255429 authorized to package and sell pre -rolled marijuana to licensed
256430 medical marijuana dispensaries. The products described in this
257431 subsection shall contain only the grou nd parts of the marijuana
258432 plant and shall not include marijuana concentrates or derivative s.
259433 The total net weight of each pre -roll packaged and sold by licensed
260434 medical marijuana commercial growers shall not exceed one (1) gram.
261435 These products must be te sted, packaged and labeled in accordance
262436 with Oklahoma law and rules promulgated by the Au thority.

270466 Section 423. A. The Oklahoma Medical Marijuana Au thority shall

272468 application for a medical marijuan a processing license. The
273469 Authority shall be authorized to issue two types of medical
274470 marijuana processor licenses based on the level of risk pose d by the
275471 type of processing conducted:

277472 1. Nonhazardous medical marijuana processor license; and

279473 2. Hazardous medical marijuana processor licens e.

281474 The application fee for a nonhazardous or hazardous medical
282475 marijuana processor license shall be paid by the applicant in the
283476 amounts provided for in Section 427.14 of this title. A method of
284477 payment shall be provide d on the website of the Authority. The

322530 distill or process these plants into concentrates, edibles, and
323531 other forms for consumption.

325532 2. As required by subsection D of this secti on, the Authority
326533 shall make available a set of standards which shall be used by
327534 licensed processors in the preparation of e dible marijuana products.
328535 The standards should be in line with current food preparation
329536 guidelines. No excessive or punitive rules may be established by
330537 the Authority.

332564 3. Up to two times a year, the Authority may inspect a
333565 processing operation and deter mine its compliance with the
334566 preparation standards. If deficiencies are found, a written report
335567 of the deficiency shall be issued t o the licensed processor. The
336568 licensed processor shall h ave one (1) month to correct the
337569 deficiency or be subject to a fine of Five Hundred Dollars ($500.00)
338570 for each deficiency.

340571 4. A licensed processor may sell marijuana products it creates
341572 to a licensed dispensary or any other licensed p rocessor. All sales
342573 by a licensed processor shall be considered wholesale sales and
343574 shall not be subject to taxation.

345575 5. Under no circumstances may a licensed processor sell
346576 marijuana or any marijuana product directly to a licensed medical
347577 marijuana patient or licensed careg iver. However, a licensed
348578 processor may process cannabis into a co ncentrated form for a
349579 licensed medical marijuana patient for a fee.

351580 6. Licensed processors shall be required to complete a monthly
352581 yield and sales report to the Author ity. This report sha ll be due
353582 on the fifteenth of each month and shall provide reportin g on the

356583 previous month. This report shall detail the amount of marijuana
357584 and medical marijuana products purchased in pounds, the a mount of
358585 marijuana cooked or process ed in pounds, and the amount of waste in

361614 responsibilities to ensure that all marijuana bein g processed is
362615 accounted for.

364616 D. The Authority shall ove rsee the inspection and compliance of
365617 licensed processors producing products with marijuana as an
366618 additive. The Authority shall be compelled to, within thirty (30)
367619 days of passage of this initiative , appoint twelve (12) Oklahoma
368620 residents to the Medical M arijuana Advisory Council, who are
369621 marijuana industry experts, to c reate a list of food safety
370622 standards for processing and handling medical marijuana in Oklahoma.
371623 These standards shall be adopted b y the Authority and the Authority
372624 may enforce these stand ards for licensed processors. The Authority
373625 shall develop a standa rds review procedure and these standards can
374626 be altered by calling another council of twelve (12) Oklahoma
375627 marijuana industry expert s. A signed letter of twenty operat ing,
376628 licensed processors shall constitute a need for a new council and
377629 standards review.

379630 E. If it becomes permissible under federal law, marijuana may
380631 be moved across state lines.

382632 F. Any device used for the processing or consumption of medical
383633 marijuana shall be considered l egal to be sold, manufactured,
384634 distributed and possessed. No merch ant, wholesaler, manufacturer or
385635 individual may be unduly harassed or prosecuted for selling,
386636 manufacturing or possessing marijuana paraphernalia.

388663 SECTION 4. AMENDATORY 63 O.S. 2021, Section 427.3, as

393667 Section 427.3. A. There is hereby crea ted the Oklahoma Medical
394668 Marijuana Authority within the State Department of Health which
395669 shall address issues related to the medical marijuana program in
396670 Oklahoma including, but not limited to, the i ssuance of patient
397671 licenses and medical marijuana busines s licenses, and the

400672 dispensing, cultivating, processing, testing, transporting, storage,
401673 research, and the use of and sal e of medical marijuana pursuant to
402674 the Oklahoma Medical Marijuana and Patient Protection Act.

404675 B. The Department s hall provide support staff to perform
405676 designated duties of the Authority. The Department shall also
406677 provide office space for meetings of the Authority.

408678 C. The Authority shall implement the provisions of the Oklahoma
409679 Medical Marijuana and Patient Protecti on Act consistently w ith the
410680 voter-approved State Question No. 788, Initiative Petition No. 412,
411681 subject to the provisions of the Oklahoma Med ical Marijuana and
412682 Patient Protection Act.

414683 D. The Authority shall exercise it s respective powers and
415684 perform its respective duties and functions as specified in the
416685 Oklahoma Medical Marijuana and Patient Protection Act and this title

420714 or legislative in nature , to ensure that rese arch on marijuana and
421715 marijuana products is being conducted for public purposes, including
422716 the advancement of:

424717 a. public health policy and public safety policy,

426718 b. agronomic and horticultural best pr actices, and
427-
428719 c. medical and pharmaco poeia best practices;

430720 2. Contract with third-party vendors and other governmental
431721 entities in order to carry out the respective duties and fu nctions
432722 as specified in the Oklahoma Medical Marijuana and Patient
433723 Protection Act;

435724 3. Upon complaint or upon its own motion and upon a completed
436725 investigation, levy fines as prescribed in applicable laws, rules,
437726 and regulations and suspend, revoke, or not renew licenses pursuant
438727 to applicable laws, rules, and regulations;

442728 4. Issue subpoenas for the appearance or pro duction of persons,
443729 records, and things in connection with disciplinary or contested
444730 cases considered by the Authority;

12342013 Authority may recommend denial of an application where the applicant
12352014 or licensee made misstatements, omissions, misrepresentations or

12372016 investigation of the applicant. This type of conduct may be grounds
12382017 for administrative action against the applican t or licensee. Typos
12392018 and scrivener errors shall not be grounds for denial.

15462507 recommendations shall be submitted to the Authority no later t han
15472508 June 1, 2023. The Authority s hall have ninety (90) days from the
15482509 date it receives the recommendations to promulgate new rules or
15492510 modify its current rules for laboratory standards and testing.
15502511 Beginning June 1, 2024, medical marijuana testing laborato ries
15512512 renewing their medical mariju ana business license shall be subject
15522513 to and comply with any new or modified rules rel ating to the testing
15532514 of medical marijuana, medical mar ijuana concentrate, and medical
15542515 marijuana products. The refusal or failure of a m edical marijuana
15552516 testing laboratory licensee to comply with new or modified rules
15562517 relating to laboratory standards and t esting procedures promulgated
15572518 under the provisions of this paragraph shall result in the permanent
15582519 revocation of the medical marijuana t esting laboratory license.

15872567 approved medical marijuana testing facility shall operate unless a
15882568 medical laboratory director is on site during operational hours.

16342657 Medical Marijuana and Patient Protection Act and the rules adopted
16352658 pursuant thereto, between the originating medical marijuana business
16362659 requesting testing servic es and the destination laboratory
16372660 performing testing s ervices.

16392661 M. The medical marijuana testing laboratory shall establish
16402662 policies to prevent the existence of or appearance of undue
16412663 commercial, financial or other influences that may diminish the
16422664 competency, impartiality and integrity of the testing processe s or
16432665 results of the laboratory, or that may diminish public confidence in
16442666 the competency, impartiality and integrity of the testing processes
16452667 or results of the laboratory. At a minimum, employees, owne rs or
16462668 agents of a medical marijuana testing laboratory who participate in
16472669 any aspect of the analysis and results of a sample are prohibi ted
16482670 from improperly influencing the testing process, improperly
16492671 manipulating data or improperly benefiting from any ongo ing
16502672 financial, employment, personal or business relati onship with the

18262963 Act and the rules and regulations promulgated by the Executive
18272964 Director. Remediated and de contaminated medical marijuana may be
18282965 returned only to the originating licensed c ommercial grower.

19353147 medical marijuana dispensary, the secret shopper shall ask for the
19363148 certificate of analysis for each product purchased.

19383149 C. D. The secret shopper shall deliver the medical marijuan a or
19393150 marijuana products to a quality assurance laboratory , which may be
19403151 the Authority’s quality assurance laboratory, for homogenization.
19413152 Once the samples have been homogenized, the sa mples shall be
19423153 delivered to four randomly selected two licensed medical marijuana
19433154 testing laboratories, one of which may be the Authority’s quality
19443155 assurance laboratory, for compliance testing which shall include the
19453156 testing for pesticides, heavy metals, m icrobials, residual solvents
19463157 for extracted products, and potency. One sample shall be kept by
19473158 the Authority in reserve. If the medical marijuana or marijuana
19483159 products were previous ly tested with available results from a
19493160 licensed medical marijuana testing laboratory, that testing
19503161 laboratory shall be one of the four licensed medical marijuana
19513162 testing laboratories chosen by the Authority. For the avoidance of
19523163 doubt, neither the licens ed medical marijuana dispensary nor the
19533164 licensed medical marijuana testing laboratory shall be told that the
19543165 business entity is selling medical marijuana or marijuana products
19553166 to a secret shopper or testing samples submitted by a secre t shopper
19563167 employed by the Authority and posing as a licensed medical marijuana

19613197 January 1, 2024. In the year 2025, the Authority shall inspect, by
19623198 secret shopper, a minimum of ten percent (10%) of randomly s elected
19633199 licensed medical marijuana dispensar ies in Oklahoma per year.

19673200 E. F. 1. When the licensed medical marijuana testing
19683201 laboratories unanimously confirm test results with safety f ailures
19693202 for contaminants, the Authority shall recall the medical marijua na
19703203 or marijuana product within seven (7) day s of obtaining the test
19713204 results. The name of the licensed medical marijuana dispensary and
19723205 any other relevant product information shall be made public via a
19733206 press release issued by the Authority. If there is gr eater than one
19743207 but less than four contaminant fails among the licensed me dical
19753208 marijuana testing laboratories, the Authority shall work with a
19763209 quality assurance la boratory to verify th e results of the licensed
19773210 medical marijuana testing laboratories and tak e appropriate action.

19793211 2. When the average o f total potency or total terp ene results
19803212 collected from a licensed medical marijuana testing laboratory for a
19813213 particular product is outside the allowable limits, the Authority
19823214 shall work with a quality assurance laboratory to verify the results
19833215 of the testing laboratory. If results a re verified to be outside
19843216 the allowable limits, the Authority shall require relabeling of the
19853217 medical marijuana or marijuana products.
