153	153	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154	154	SECTION 1. AMENDATORY 25 O.S. 2021, Section 2003, is
155	155	amended to read as follows:
156	156	Section 2003. A. The board of educ ation of a school district,
157	157	in consultation with parents, teachers , and administrators, shall
158	158	develop and adopt a policy to promote the invo lvement of parents and
159	159	guardians of children enrolled in the sc hools within the school
160	160	district, including:
161	161	1. A plan for parent participation in the schools which is
162	162	designed to improve parent and teacher cooperation in such areas as
163	163	homework, attendance , and discipline;
164	164	2. Procedures by which parents may learn abo ut the course of
165	165	study for their children and review learning materials, including
166	166	the source of any supplemental educational materials;
167	167	3. Procedures by which parents who object to any learnin g
168	168	material or activity on the basis that it is harmful may wit hdraw
169	169	their children from the a ctivity or from the cl ass or program in
170	170	which the material is used. Objection to a learning material or
171	171	activity on the basis that it is harmful includes objectio n to a
172	172	material or activity because it questions beliefs or pr actices in
173	173	sex, morality, or religion;
174	174	4. If a school district offers any sex education curricula
175	175	pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes or

233	233	5. Procedures by which parents will be notified in advance o f
234	234	and given the opportunity to withdraw their children from provide
235	235	written consent for a child to participate in any instruction or
236	236	presentations, class, program, test, activity, survey , or
237	237	questionnaire regarding sexuality in courses other than formal se x
238	238	education curricula pursuant to Section 11 -105.1 of Title 70 of the
239	239	Oklahoma Statutes;
240	240	6. Procedures by which parents may learn about the nature and
241	241	purpose of clubs and activities that are part of th e school
242	242	curriculum, as well as extracurricular clubs and activities that
243	243	have been approved by the school; and
244	244	7. Procedures by which parents may learn about parental rights
245	245	and responsibilities und er the laws of this state, including the
246	246	following:
247	247	a. the right to opt out of in to a sex education
248	248	curriculum if one is provided by the school district,
249	249	b. open enrollment rights,

376	376	106 of Title 70 of the Oklahoma Statutes,
377	377	m. the right to public review of courses of st udy and
378	378	textbooks,
379	379	n. the right to be excused from sc hool attendance for
380	380	religious purposes,
381	381	o. policies related to parental involvement pursuant to
382	382	this section,
383	383	p. the right to participate in parent -teacher
384	384	associations and organizations that are sanctio ned by
385	385	the board of education o f a school district, a nd
386	386	q. the right to opt out of any data collection instrument
387	387	at the district level that would capture data for
388	388	inclusion in the state longitudinal student data
389	389	system except what is necessary and essenti al for
390	390	establishing a student ’s public school record.
391	391	B. The board of education of a school district may adopt a
392	392	policy to provide to parents the information required by this
393	393	section in an electronic form.
394	394	C. A parent shall submit a written request for i nformation
395	395	pursuant to this sec tion during regular bu siness hours to either the
396	396	school principal at the school site or the su perintendent of the
397	397	school district at the office of the school district. Within ten
398	398	(10) days of receiving the request for inform ation, the school

451	451	deliver the requested information to th e parent or submit to the
452	452	parent a written explanation of the reasons for t he denial of the
453	453	requested information. If the request for information is denied or
454	454	the parent does not rece ive the requested information within fifteen
455	455	(15) days after submitting the request for information, the parent
456	456	may submit a written request for th e information to the board of
457	457	education of a school dist rict, which shall formally cons ider the
458	458	request at the next scheduled public meeting of the board if the
459	459	request can be prope rly noticed on the agenda. If the request
460	460	cannot be properly noticed on th e agenda, the board of education of
461	461	a school district sh all formally consider the reque st at the next
462	462	subsequent public meeting of the board.
463	463	SECTION 2. AMENDATORY 70 O.S. 20 21, Section 11-105.1, is
464	464	amended to read as follows:
465	465	Section 11-105.1. A. All curriculum and materials includi ng
466	466	supplementary materials which will be used to teac h or will be used
467	467	for or in connection with a sex education class or program which i s
468	468	designed for the exclusive purpose of discus sing sexual behavior or
469	469	attitudes,; or any test, school counselor-led course, survey, or
470	470	questionnaire whose primary purpose i s to elicit responses on sexual
471	471	behavior or attitudes ; or any curriculum, materials, test, surv ey,
472	472	questionnaire, activity, or instr uction of any kind related to
473	473	sexual orientation and gender identity, r egardless of whether it is

525	525	offered as part of a sex e ducation class or pro gram or as part of
526	526	any other class, program, or activity shall be available through the
527	527	superintendent or a designee of the school district for inspection
528	528	by parents and guardians of the student who will be involved with
529	529	the instruction, class, program or, test, activity, survey, or
530	530	questionnaire. Such curriculum, materials, cl asses, programs,
531	531	tests, school counselor-led course, surveys, or questionnaires shall
532	532	include information ab out consent and shall have as one of its
533	533	primary purposes the teaching of or informin g students about the
534	534	practice of abstinence. For the purpo ses of this section, “consent”
535	535	shall have the same meaning as that provided by Section 113 of Title
536	536	21 of the Oklahoma Statutes. The superintendent or a designee of
537	537	the school district shall provi de prior written notification to the
538	538	parents or guardians o f the students involved of their righ t to
539	539	inspect the curriculum and material, and of their obligation to
540	540	notify the parents or guardians shall provide the school in writing
541	541	written consent if they do not want their child to part icipate in
542	542	the instruction, class, program, test, activity, survey, or
543	543	questionnaire. Each local board of education sha ll determine the
544	544	means of providing written notif ication to the parents and guardian
545	545	which will ensure effective notice in an efficient an d appropriate
546	546	manner. No student shall be req uired to participate in a sex
547	547	education class or program or participate in a school counselor-led
548	548	course which discusses sexual behavior or atti tudes, or any

602	602	if a parent or guardian of the student objects in writing to does
603	603	not provide written consent for such participation. If the type of
604	604	instruction, program, test, activity, survey, or questionnaire
605	605	referred to in this section is a part of or is taught during a
606	606	credit course, a student may be requi red to enroll in the co urse but
607	607	shall not be required to receive instruction in or participate in
608	608	the program, test, activity, survey, or questionnaire if a parent or
609	609	guardian objects in writing does not provide written con sent.
610	610	B. The superintendent or a designee of a school d istrict in
611	611	which sex education or matters pertaining to sexual orientation or
612	612	gender identity is taught or a program is offe red which is designed
613	613	for the exclusive purpose of discussing sexual behavio r or attitudes
614	614	or matters pertaining to sexual orientati on or gender identity shall
615	615	approve all curriculum and materials which will be used for such
616	616	education and any test, school counselor-led course, survey, or
617	617	questionnaire whose primary purpose is to e licit responses on sexual
618	618	behavior or attitudes used in the school prior to their use in the
619	619	classroom or school. The teacher or school counselor involved in
620	620	the instruction, class, program, testing test, activity, or survey
621	621	shall submit the curriculum, m aterials, tests, or surveys to the
622	622	superintendent or a designee for approval prior to their use in the
623	623	classroom or school. This section shall not a pply to those students

677	677	C. A school district shall be p rohibited from offering
678	678	instruction, a program, a tes t, an activity, a survey, or a
679	679	questionnaire on matters pertaining to sex education, sexual
680	680	orientation, or gender identity to students in grades p re-
681	681	kindergarten through five.
682	682	D. The prior written notification required by subsecti on A of
683	683	this section shall include a list with the audio-visual or written
684	684	curriculum and materials to be used in the instruction, class,
685	685	program, test, activity, or survey. The notification shall include :
686	686	1. A link to the audio-visual or written curricu lum and
687	687	materials to be used if they are available electronically ; or
688	688	2. Information on how and where to review a hard copy of the
689	689	audio-visual or written curriculum and materials.
690	690	E. The provisions of this section shal l not be construed to
691	691	require written notification prior to:
692	692	1. A teacher responding to student questions during c lass
693	693	regarding sexual orientation and gender identity as it relates to
694	694	any topic of instruction;
695	695	2. Referring to the sexual orientation or g ender identity of
696	696	any historic person, group, or public figure when such information
697	697	provides necessary context in relation to any topic of instruction;

749	749	3. Referring to sexual or ientation and gender identity if
750	750	necessary to address a disciplinary matte r, such as an instance of
751	751	bullying; or
752	752	4. Responding to student questions or providing assist ance
753	753	relating to the student ’s physical hygiene.
754	754	F. The provisions of this section shall not be construed to
755	755	require that a public school offer instruction, a class, a program,
756	756	a test, an activity, or a survey on sex education, sexual behavior
757	757	or attitudes, sexual orientation, or gender identity.
758	758	G. For the purposes of this section:
759	759	1. “Gender identity” means one’s psychological sense of their
760	760	gender. Gender identity may also be known as “gender dysphoria,” a
761	761	clinically significant distress or impairme nt related to a strong
762	762	desire to be of another gender, which may include a desire to change
763	763	primary and/or secondary sex characteristics; and
764	764	2. “Sexual orientation” means an individual’s actual or
765	765	perceived orientation as heterosexual, homosexual, or bisexual.
766	766	H. Upon a finding of noncompliance with the provisions of this
767	767	section by the State Board of Education, the noncompliant school
768	768	district shall receive a five percen t (5%) reduction in state
769	769	funding for the fisca l year following the year of noncompliance.
770	770	SECTION 3. This act shall become effective July 1, 2023.
771	771	SECTION 4. It being immediately necessary for the preservation
