6565 An Act relating to schools; amending 25 O.S. 2021,

153153 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
154154 SECTION 1. AMENDATORY 25 O.S. 2021, Section 2003, is
155155 amended to read as follows:
156156 Section 2003. A. The board of educ ation of a school district,
157157 in consultation with parents, teachers , and administrators, shall
158158 develop and adopt a policy to promote the invo lvement of parents and
159159 guardians of children enrolled in the sc hools within the school
160160 district, including:
161161 1. A plan for parent participation in the schools which is
162162 designed to improve parent and teacher cooperation in such areas as
163163 homework, attendance , and discipline;
164164 2. Procedures by which parents may learn abo ut the course of
165165 study for their children and review learning materials, including
166166 the source of any supplemental educational materials;
167167 3. Procedures by which parents who object to any learnin g
168168 material or activity on the basis that it is harmful may wit hdraw
169169 their children from the a ctivity or from the cl ass or program in
170170 which the material is used. Objection to a learning material or
171171 activity on the basis that it is harmful includes objectio n to a
172172 material or activity because it questions beliefs or pr actices in
173173 sex, morality, or religion;
174174 4. If a school district offers any sex education curricula
175175 pursuant to Section 11 -105.1 of Title 70 of the Oklahoma Statutes or

227227 pursuant to any rules adopt ed by the State Board of Education,
228228 procedures to opt out of a school district from providing require
229229 written consent from a parent for a child to participate in sex
230230 education instruction to a child if the child ’s parent provides
231231 written objection to the child ’s participation in the sex education
232232 curricula;
233233 5. Procedures by which parents will be notified in advance o f
234234 and given the opportunity to withdraw their children from provide
235235 written consent for a child to participate in any instruction or
236236 presentations, class, program, test, activity, survey , or
237237 questionnaire regarding sexuality in courses other than formal se x
238238 education curricula pursuant to Section 11 -105.1 of Title 70 of the
239239 Oklahoma Statutes;
240240 6. Procedures by which parents may learn about the nature and
241241 purpose of clubs and activities that are part of th e school
242242 curriculum, as well as extracurricular clubs and activities that
243243 have been approved by the school; and
244244 7. Procedures by which parents may learn about parental rights
245245 and responsibilities und er the laws of this state, including the
246246 following:
247247 a. the right to opt out of in to a sex education
248248 curriculum if one is provided by the school district,
249249 b. open enrollment rights,

375375 l. the attendance requirements prescribed in Section 10 -
376376 106 of Title 70 of the Oklahoma Statutes,
377377 m. the right to public review of courses of st udy and
378378 textbooks,
379379 n. the right to be excused from sc hool attendance for
380380 religious purposes,
381381 o. policies related to parental involvement pursuant to
382382 this section,
383383 p. the right to participate in parent -teacher
384384 associations and organizations that are sanctio ned by
385385 the board of education o f a school district, a nd
386386 q. the right to opt out of any data collection instrument
387387 at the district level that would capture data for
388388 inclusion in the state longitudinal student data
389389 system except what is necessary and essenti al for
390390 establishing a student ’s public school record.
391391 B. The board of education of a school district may adopt a
392392 policy to provide to parents the information required by this
393393 section in an electronic form.
394394 C. A parent shall submit a written request for i nformation
395395 pursuant to this sec tion during regular bu siness hours to either the
396396 school principal at the school site or the su perintendent of the
397397 school district at the office of the school district. Within ten
398398 (10) days of receiving the request for inform ation, the school

450450 principal or the superintendent of the school district shall either
451451 deliver the requested information to th e parent or submit to the
452452 parent a written explanation of the reasons for t he denial of the
453453 requested information. If the request for information is denied or
454454 the parent does not rece ive the requested information within fifteen
455455 (15) days after submitting the request for information, the parent
456456 may submit a written request for th e information to the board of
457457 education of a school dist rict, which shall formally cons ider the
458458 request at the next scheduled public meeting of the board if the
459459 request can be prope rly noticed on the agenda. If the request
460460 cannot be properly noticed on th e agenda, the board of education of
461461 a school district sh all formally consider the reque st at the next
462462 subsequent public meeting of the board.
463463 SECTION 2. AMENDATORY 70 O.S. 20 21, Section 11-105.1, is
464464 amended to read as follows:
465465 Section 11-105.1. A. All curriculum and materials includi ng
466466 supplementary materials which will be used to teac h or will be used
467467 for or in connection with a sex education class or program which i s
468468 designed for the exclusive purpose of discus sing sexual behavior or
469469 attitudes,; or any test, school counselor-led course, survey, or
470470 questionnaire whose primary purpose i s to elicit responses on sexual
471471 behavior or attitudes ; or any curriculum, materials, test, surv ey,
472472 questionnaire, activity, or instr uction of any kind related to
473473 sexual orientation and gender identity, r egardless of whether it is

525525 offered as part of a sex e ducation class or pro gram or as part of
526526 any other class, program, or activity shall be available through the
527527 superintendent or a designee of the school district for inspection
528528 by parents and guardians of the student who will be involved with
529529 the instruction, class, program or, test, activity, survey, or
530530 questionnaire. Such curriculum, materials, cl asses, programs,
531531 tests, school counselor-led course, surveys, or questionnaires shall
532532 include information ab out consent and shall have as one of its
533533 primary purposes the teaching of or informin g students about the
534534 practice of abstinence. For the purpo ses of this section, “consent”
535535 shall have the same meaning as that provided by Section 113 of Title
536536 21 of the Oklahoma Statutes. The superintendent or a designee of
537537 the school district shall provi de prior written notification to the
538538 parents or guardians o f the students involved of their righ t to
539539 inspect the curriculum and material, and of their obligation to
540540 notify the parents or guardians shall provide the school in writing
541541 written consent if they do not want their child to part icipate in
542542 the instruction, class, program, test, activity, survey, or
543543 questionnaire. Each local board of education sha ll determine the
544544 means of providing written notif ication to the parents and guardian
545545 which will ensure effective notice in an efficient an d appropriate
546546 manner. No student shall be req uired to participate in a sex
547547 education class or program or participate in a school counselor-led
548548 course which discusses sexual behavior or atti tudes, or any

601601 questionnaire which dis cusses sexual orientation and gender i dentity
602602 if a parent or guardian of the student objects in writing to does
603603 not provide written consent for such participation. If the type of
604604 instruction, program, test, activity, survey, or questionnaire
605605 referred to in this section is a part of or is taught during a
606606 credit course, a student may be requi red to enroll in the co urse but
607607 shall not be required to receive instruction in or participate in
608608 the program, test, activity, survey, or questionnaire if a parent or
609609 guardian objects in writing does not provide written con sent.
610610 B. The superintendent or a designee of a school d istrict in
611611 which sex education or matters pertaining to sexual orientation or
612612 gender identity is taught or a program is offe red which is designed
613613 for the exclusive purpose of discussing sexual behavio r or attitudes
614614 or matters pertaining to sexual orientati on or gender identity shall
615615 approve all curriculum and materials which will be used for such
616616 education and any test, school counselor-led course, survey, or
617617 questionnaire whose primary purpose is to e licit responses on sexual
618618 behavior or attitudes used in the school prior to their use in the
619619 classroom or school. The teacher or school counselor involved in
620620 the instruction, class, program, testing test, activity, or survey
621621 shall submit the curriculum, m aterials, tests, or surveys to the
622622 superintendent or a designee for approval prior to their use in the
623623 classroom or school. This section shall not a pply to those students

676676 through an alternative education program.
677677 C. A school district shall be p rohibited from offering
678678 instruction, a program, a tes t, an activity, a survey, or a
679679 questionnaire on matters pertaining to sex education, sexual
680680 orientation, or gender identity to students in grades p re-
681681 kindergarten through five.
682682 D. The prior written notification required by subsecti on A of
683683 this section shall include a list with the audio-visual or written
684684 curriculum and materials to be used in the instruction, class,
685685 program, test, activity, or survey. The notification shall include :
686686 1. A link to the audio-visual or written curricu lum and
687687 materials to be used if they are available electronically ; or
688688 2. Information on how and where to review a hard copy of the
689689 audio-visual or written curriculum and materials.
690690 E. The provisions of this section shal l not be construed to
691691 require written notification prior to:
692692 1. A teacher responding to student questions during c lass
693693 regarding sexual orientation and gender identity as it relates to
694694 any topic of instruction;
695695 2. Referring to the sexual orientation or g ender identity of
696696 any historic person, group, or public figure when such information
697697 provides necessary context in relation to any topic of instruction;

749749 3. Referring to sexual or ientation and gender identity if
750750 necessary to address a disciplinary matte r, such as an instance of
751751 bullying; or
752752 4. Responding to student questions or providing assist ance
753753 relating to the student ’s physical hygiene.
754754 F. The provisions of this section shall not be construed to
755755 require that a public school offer instruction, a class, a program,
756756 a test, an activity, or a survey on sex education, sexual behavior
757757 or attitudes, sexual orientation, or gender identity.
758758 G. For the purposes of this section:
759759 1. “Gender identity” means one’s psychological sense of their
760760 gender. Gender identity may also be known as “gender dysphoria,” a
761761 clinically significant distress or impairme nt related to a strong
762762 desire to be of another gender, which may include a desire to change
763763 primary and/or secondary sex characteristics; and
764764 2. “Sexual orientation” means an individual’s actual or
765765 perceived orientation as heterosexual, homosexual, or bisexual.
766766 H. Upon a finding of noncompliance with the provisions of this
767767 section by the State Board of Education, the noncompliant school
768768 district shall receive a five percen t (5%) reduction in state
769769 funding for the fisca l year following the year of noncompliance.
770770 SECTION 3. This act shall become effective July 1, 2023.
771771 SECTION 4. It being immediately necessary for the preservation
772772 of the public peace, health or safety, an emergency is her eby
