45	48		certain debt after certain request to terminate is
46	49		provided; requiring authorization for professional
47	50		organization dues and political contributions to be
48	51		on certain form; requiring certain authorization to
49	52		include certain information; providing for expiration

58	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
59	62		SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-139, is
60	63		amended to read as follows:
61	64		Section 5-139. School districts shall make payroll deductio ns
62	65		for either or both professional or ganization dues and political
63	66		contributions at the written request of any school employee subject
64	67		to the provisions of Section 2 of this act and shall transmit
65	68		deducted funds to the organization designated by the school district
66		-	employee. Such deductions shall be on a ten-month basis unless

	96	+	employee. Such deductions shall be on a ten-month basis unless
93	97		otherwise designated by the employee professional organization but
94	98		shall not exceed one (1) year without reauthorization. However, a
95	99		school employee may request at any time in writing , including by
96	100		email or fax, for the school district to immediately terminat e or
97	101		initiate payroll deductions to a professional organization. Upon
98	102		receipt of any written request, the school district shall within
99	103		five (5) business days or by the next pay period, which ever is
100	104		earlier, terminate or initiat e any future payroll deducti ons of the
101	105		requesting school employee to a professional organization. U pon
102	106		receipt of a written request, the school district shall notify the
103	107		professional organization of the initiation or t ermination of
104	108		payroll deductions with in fifteen (15) business day s. If the
105	109		request is to terminate a deduction, the school district shal l not
106	110		make any advance payments to any professional organization of any
107	111		future dues on behalf of the school employee , and no further debt
108	112		from the school employee to the professional o rganization shall
109	113		accrue. No school district policy or negotiated agree ment shall
110	114		place any other conditions or requirements, including, but not
111	115		limited to, personal hand delivery , upon any employee to initiate or
112	116		terminate any payroll deduction to a professional organization
113	117		except for a written request as outlined in this sec tion and as
114	118		outlined in Section 2 of this act. Any school district policy or
115	119		provision in a negotiated agreement that places additional
116		-	conditions or requirements on initiation or termination be yond those

	147	+	conditions or requirements on initiation or termination be yond those
143	148		outlined in this section and as outlined in Section 2 of this act
144	149		shall be null and void. A school district which fails to terminat e
145	150		payroll deductions for an employee in accordance w ith this section
146	151		shall immediately reimburse the employ ee the amount of all payroll
147	152		deductions made by the school district after the employee’s request,
148	153		and the amount due the employee shall double every thirty (30) days
149	154		until paid in full.
150	155		SECTION 2. NEW LAW A new section of law to be codified
151	156		in the Oklahoma Statutes as Section 5-139a of Title 70, unless there
152	157		is created a duplication in numbering, reads as follows:
153	158		A. Authorization for professional organization dues and
154	159		political contributions as provided for in Section 5-139 of Title 70
155	160		of the Oklahoma Statutes shall be on a form prescribed by the
156	161		Superintendent of Pub lic Instruction.
157	162		B. Authorization containing an employee’s full name, position,
158	163		professional organization, and signature shall be submitted to the
159	164		school district.
160	165		C. An authorization shall expire at the start of the first f ull
161	166		pay period each school year.
162	167		D. The provisions of this section and Section 5-139 of Title 70
163	168		of the Oklahoma Statutes shall apply to any new or mod ified
164	169		collective bargaining agreement entered into after the effective
165	170		date of this act.
