3942 deductions; amending 70 O.S. 2021, Section 5-139,

5861 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5962 SECTION 1. AMENDATORY 70 O.S. 2021, Section 5-139, is
6063 amended to read as follows:
6164 Section 5-139. School districts shall make payroll deductio ns
6265 for either or both professional or ganization dues and political
6366 contributions at the written request of any school employee subject
6467 to the provisions of Section 2 of this act and shall transmit
6568 deducted funds to the organization designated by the school district
66-employee. Such deductions shall be on a ten-month basis unless

96+employee. Such deductions shall be on a ten-month basis unless
9397 otherwise designated by the employee professional organization but
9498 shall not exceed one (1) year without reauthorization. However, a
9599 school employee may request at any time in writing , including by
96100 email or fax, for the school district to immediately terminat e or
97101 initiate payroll deductions to a professional organization. Upon
98102 receipt of any written request, the school district shall within
99103 five (5) business days or by the next pay period, which ever is
100104 earlier, terminate or initiat e any future payroll deducti ons of the
101105 requesting school employee to a professional organization. U pon
102106 receipt of a written request, the school district shall notify the
103107 professional organization of the initiation or t ermination of
104108 payroll deductions with in fifteen (15) business day s. If the
105109 request is to terminate a deduction, the school district shal l not
106110 make any advance payments to any professional organization of any
107111 future dues on behalf of the school employee , and no further debt
108112 from the school employee to the professional o rganization shall
109113 accrue. No school district policy or negotiated agree ment shall
110114 place any other conditions or requirements, including, but not
111115 limited to, personal hand delivery , upon any employee to initiate or
112116 terminate any payroll deduction to a professional organization
113117 except for a written request as outlined in this sec tion and as
114118 outlined in Section 2 of this act. Any school district policy or
115119 provision in a negotiated agreement that places additional
116-conditions or requirements on initiation or termination be yond those

147+conditions or requirements on initiation or termination be yond those
143148 outlined in this section and as outlined in Section 2 of this act
144149 shall be null and void. A school district which fails to terminat e
145150 payroll deductions for an employee in accordance w ith this section
146151 shall immediately reimburse the employ ee the amount of all payroll
147152 deductions made by the school district after the employee’s request,
148153 and the amount due the employee shall double every thirty (30) days
149154 until paid in full.
150155 SECTION 2. NEW LAW A new section of law to be codified
151156 in the Oklahoma Statutes as Section 5-139a of Title 70, unless there
152157 is created a duplication in numbering, reads as follows:
153158 A. Authorization for professional organization dues and
154159 political contributions as provided for in Section 5-139 of Title 70
155160 of the Oklahoma Statutes shall be on a form prescribed by the
156161 Superintendent of Pub lic Instruction.
157162 B. Authorization containing an employee’s full name, position,
158163 professional organization, and signature shall be submitted to the
159164 school district.
160165 C. An authorization shall expire at the start of the first f ull
161166 pay period each school year.
162167 D. The provisions of this section and Section 5-139 of Title 70
163168 of the Oklahoma Statutes shall apply to any new or mod ified
164169 collective bargaining agreement entered into after the effective
165170 date of this act.
