BE IT RESOLVED BY THE SENATE AND THE HOUSE OF RE PRESENTATIVES OF THE 1ST SESSION OF THE 59TH OKLAHOMA LEGISLATURE: SECTION 1. The Secretary of State shall refer t o the people for their approval or rejection, as and in the manner provided by law, the following proposed amendment to Secti on 30 of Article II of the Oklahoma Constitution to read as follows: Section 30. The right of the people to be secure in their persons, houses, electronic data and electronic communicati ons, papers, and effects against unreasonable searches or seizures shall not be violated; and no warrant shall issue but upo n probable cause supported by oath or affirmation, describing as particularly a s may be the place to be searched and the person or t hing to be seized. The Ballot Title for t he proposed Constitutional amendment as set forth in SECTI ON 1 of this resolution shall be in the following form: BALLOT TITLE Legislative Referendum No. ____ State Question No. ____ THE GIST OF THE PROPOSITION IS AS FOLLOWS: This measure amends Section 30 of Article 2 of the Oklahoma Constitution. This section protects the rights of the people against unreasonable searches and seizures . This measure would add electronic data and electronic communications to the list of items that require a warrant based on pro bable cause to search for or seize such items.
