24	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

26	54		SECTION 1. AMENDATORY 74 O.S. 2021 , Section 85.3, is
27	55		amended to read as follows:

29	56		Section 85.3 A. There is hereby created and established in the
30	57		Office of Management and Enterprise Services a Purchasing Division,
31	58		the administrative head of which shall be the State Purchasing
32	59		Director.

34	60		B. The Director of the Office of Management and Enterprise
35	61		Services shall hire the State Purchasing Director. The State
36	62		Purchasing Director shall:

38	63		1. Have a thorough knowledge of office practices and buying
39	64		procedures in volume purchasing; and

41	92		2. Be a graduate of an accredited college or university with at
42	93		least five (5) years' experience in commercial or governmental
43	94		purchasing, or, in lieu of such education, have at least ten (10)
44	95		years' experience in commercial or governmental purchasing.

46	96		C. The State Purchasing Director, with the approval of the
47	97		Director of the Office of Management and Enterprise Services, may
48	98		employ such personnel as may be necessary to exercise authority and
49	99		perform duties under the Oklahoma Central Purchasing Act.

51	100		D. All activities of any state agency, department, or
52	101		institution relating to purchasing shall be under the direction of
53	102		the Purchasing Division unless otherwise provided by the Oklahoma
54	103		Central Purchasing Act.

56	104		E. The Purchasing Division shall provide qualified personnel to
57	105		assist the purchasing activities of state agencies, departments, and
58	106		institutions, as required by the Oklahoma Central Purchasing Act.

60	107		F. Each state agency, department, and institution shall
61	108		designate personnel to coordinate its purchasing functions wi th the
62	109		Purchasing Division.

64	110		G. The Purchasing Division may, if the needs of a state agency,
65	111		department, or institution are such as to so require, employ, and
66	112		establish a buyer within a state agency. The state agency shall pay
67	113		all expenses incurred for an y buyer required to be placed within its
68	114		agency.

70	142		H. Except as provided in Section 34.36 of Title 62 of the
71	143		Oklahoma Statutes, no state a gency subject to the Oklahoma Central
72	144		Purchasing Act shall have or maintain a purchasing section without
73	145		the prior approval in writing of the Purchasing Division unless
74	146		otherwise provided in the Oklahoma Central Purchasing Act nor shall
75	147		such purchasing section perform purchasing functions for another
76	148		state agency.

78	149		I. The Purchasing Division shall make acquisitions from
79	150		industries operated by the Department of Corrections pursuant to the
80	151		provisions of Section 549.1 of Title 57 of the Oklahoma Statutes.

82	152		J. None of the personnel authorized by this section shall:

84	153		1. Sell to or otherwise provide acquisitions to any state
85	154		agency subject to the Oklahoma Central Purchasing Act;

87	155		2. Be employees, partners, associates, officers, or
88	156		stockholders in or with any business entity that sells to or
89	157		otherwise provides acquisitions to any state agency subject to the

92	159		3. Be employed in any of the positions authorized by this
93	160		section if a spouse or child owns any stock in any business entity
94	161		which sells to or otherwise provides acquisitions to any agency
95	162		subject to the Oklahoma Central Purchasing Act;

97	163		4. Be employed in any of the positions authorized by this
98	164		section if a relative within the third degree of consanguinity or
99	165		affinity sells to or otherwise provides acquisitions to any state

100	193		agency subject to the Oklahoma Central Purchasing Act or is
101	194		interested in any business entity which does so, except that such
102	195		relative, excluding a spouse or child, may own Twenty -five Thousand
103	196		Dollars ($25,000.00) worth or less, or one percent (1%) or less,
104	197		whichever amount is the lesser amount, of the stock of a corporation
105	198		or any business entity which sells to or otherwise provides
106	199		acquisitions to any state agency subject to the Oklahoma Central
107	200		Purchasing Act; or
108		-
109	201		5. Violate applicable rules of the Ethics Commission
110	202		promulgated pursuant to Article XXIX of the Oklahoma Constit ution
111	203		that relate to accepting gifts from a vendor or a vendor's agent.

113	204		K. Any state agency, department, institution, or satellite
114	205		office thereof that is otherwise subject to the provisions of the
115	206		Oklahoma Central Purchasing Act, but is located in a count y without
116	207		statewide contracted vendors, may elect to purchase necessary
117	208		equipment and supplies from a local business at or below state
118	209		contract pricing without first obtaining a waiver from or the
119	210		permission of the Purchasing Division after seventy -two (72) hours
120	211		from providing written or electronic notice to the Central
121	212		Purchasing Director of said purchase in an amount not to exceed Two
122	213		Thousand Five Hundred Dollars ($2,500.00). Any state agency that
123	214		elects to make purchases from local vendors pursuant to this
124	215		subsection shall maintain a document file for each acquisition the
125	216		state agency makes, which shall include, at a minimum, justification
