2453 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2654 SECTION 1. AMENDATORY 74 O.S. 2021 , Section 85.3, is
2755 amended to read as follows:

2956 Section 85.3 A. There is hereby created and established in the
3057 Office of Management and Enterprise Services a Purchasing Division,
3158 the administrative head of which shall be the State Purchasing
3259 Director.

3460 B. The Director of the Office of Management and Enterprise
3561 Services shall hire the State Purchasing Director. The State
3662 Purchasing Director shall:

3863 1. Have a thorough knowledge of office practices and buying
3964 procedures in volume purchasing; and

4192 2. Be a graduate of an accredited college or university with at
4293 least five (5) years' experience in commercial or governmental
4394 purchasing, or, in lieu of such education, have at least ten (10)
4495 years' experience in commercial or governmental purchasing.

4696 C. The State Purchasing Director, with the approval of the
4797 Director of the Office of Management and Enterprise Services, may
4898 employ such personnel as may be necessary to exercise authority and
4999 perform duties under the Oklahoma Central Purchasing Act.

51100 D. All activities of any state agency, department, or
52101 institution relating to purchasing shall be under the direction of
53102 the Purchasing Division unless otherwise provided by the Oklahoma
54103 Central Purchasing Act.

56104 E. The Purchasing Division shall provide qualified personnel to
57105 assist the purchasing activities of state agencies, departments, and
58106 institutions, as required by the Oklahoma Central Purchasing Act.

60107 F. Each state agency, department, and institution shall
61108 designate personnel to coordinate its purchasing functions wi th the
62109 Purchasing Division.

64110 G. The Purchasing Division may, if the needs of a state agency,
65111 department, or institution are such as to so require, employ, and
66112 establish a buyer within a state agency. The state agency shall pay
67113 all expenses incurred for an y buyer required to be placed within its
68114 agency.

70142 H. Except as provided in Section 34.36 of Title 62 of the
71143 Oklahoma Statutes, no state a gency subject to the Oklahoma Central
72144 Purchasing Act shall have or maintain a purchasing section without
73145 the prior approval in writing of the Purchasing Division unless
74146 otherwise provided in the Oklahoma Central Purchasing Act nor shall
75147 such purchasing section perform purchasing functions for another
76148 state agency.

78149 I. The Purchasing Division shall make acquisitions from
79150 industries operated by the Department of Corrections pursuant to the
80151 provisions of Section 549.1 of Title 57 of the Oklahoma Statutes.

82152 J. None of the personnel authorized by this section shall:

84153 1. Sell to or otherwise provide acquisitions to any state
85154 agency subject to the Oklahoma Central Purchasing Act;

87155 2. Be employees, partners, associates, officers, or
88156 stockholders in or with any business entity that sells to or
89157 otherwise provides acquisitions to any state agency subject to the

92159 3. Be employed in any of the positions authorized by this
93160 section if a spouse or child owns any stock in any business entity
94161 which sells to or otherwise provides acquisitions to any agency
95162 subject to the Oklahoma Central Purchasing Act;

97163 4. Be employed in any of the positions authorized by this
98164 section if a relative within the third degree of consanguinity or
99165 affinity sells to or otherwise provides acquisitions to any state

100193 agency subject to the Oklahoma Central Purchasing Act or is
101194 interested in any business entity which does so, except that such
102195 relative, excluding a spouse or child, may own Twenty -five Thousand
103196 Dollars ($25,000.00) worth or less, or one percent (1%) or less,
104197 whichever amount is the lesser amount, of the stock of a corporation
105198 or any business entity which sells to or otherwise provides
106199 acquisitions to any state agency subject to the Oklahoma Central
107200 Purchasing Act; or

109201 5. Violate applicable rules of the Ethics Commission
110202 promulgated pursuant to Article XXIX of the Oklahoma Constit ution
111203 that relate to accepting gifts from a vendor or a vendor's agent.

113204 K. Any state agency, department, institution, or satellite
114205 office thereof that is otherwise subject to the provisions of the
115206 Oklahoma Central Purchasing Act, but is located in a count y without
116207 statewide contracted vendors, may elect to purchase necessary
117208 equipment and supplies from a local business at or below state
118209 contract pricing without first obtaining a waiver from or the
119210 permission of the Purchasing Division after seventy -two (72) hours
120211 from providing written or electronic notice to the Central
121212 Purchasing Director of said purchase in an amount not to exceed Two
122213 Thousand Five Hundred Dollars ($2,500.00). Any state agency that
123214 elects to make purchases from local vendors pursuant to this
124215 subsection shall maintain a document file for each acquisition the
125216 state agency makes, which shall include, at a minimum, justification
