40	40	An Act relating to railroads; stating legislative
41	41	intent; requiring certain railroad operators have two
42	42	crewmembers; making certain ex ceptions; providing for
43	43	noncodification; providing for codification; and

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new section of law not to be
52	52	codified in the Oklahoma Statutes reads as follows:
53	53	The Legislature finds that adequate personnel are critical to
54	54	ensuring railroad operational safety, secu rity, and, in the event of
55	55	a hazardous material incident, support of first re sponder
56	56	activities, as well as in the interest of the safety of the g eneral
57	57	public. Therefore, the Legislature declares that this act
58	58	regulating minimum railroad employee staffing to reduce risk to
59	59	localities constitutes power to protect and pr omote the health,
60	60	safety, security and welfare of the residents of this state by
61	61	reducing the risk exposure to local communities and prote cting
62	62	environmentally sensitive or pristine land and waterways .

89	89	SECTION 2. NEW LAW A new section of law to be codified
90	90	in the Oklahoma Statutes as Section 104 of Title 66, unless there is
91	91	created a duplication in numbering, reads as follows:
92	92	A. Railroads, excluding short lines, operating within this
93	93	state shall maintain a minimum of two (2) crew members in the control
94	94	compartment of the lead loc omotive unit of a train.
95	95	B. Compliance with subsection A of th is section shall not be
96	96	required during switching operations, brake testing, safety
97	97	inspections or while performing setouts in conjunction with road
98	98	service.
99	99	SECTION 3. This act shall become effective November 1, 2023.
