4040 An Act relating to railroads; stating legislative
4141 intent; requiring certain railroad operators have two

5050 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5151 SECTION 1. NEW LAW A new section of law not to be
5252 codified in the Oklahoma Statutes reads as follows:
5353 The Legislature finds that adequate personnel are critical to
5454 ensuring railroad operational safety, secu rity, and, in the event of
5555 a hazardous material incident, support of first re sponder
5656 activities, as well as in the interest of the safety of the g eneral
5757 public. Therefore, the Legislature declares that this act
5858 regulating minimum railroad employee staffing to reduce risk to
5959 localities constitutes power to protect and pr omote the health,
6060 safety, security and welfare of the residents of this state by
6161 reducing the risk exposure to local communities and prote cting
6262 environmentally sensitive or pristine land and waterways .

8989 SECTION 2. NEW LAW A new section of law to be codified
9090 in the Oklahoma Statutes as Section 104 of Title 66, unless there is
9191 created a duplication in numbering, reads as follows:
9292 A. Railroads, excluding short lines, operating within this
9393 state shall maintain a minimum of two (2) crew members in the control
9494 compartment of the lead loc omotive unit of a train.
9595 B. Compliance with subsection A of th is section shall not be
9696 required during switching operations, brake testing, safety
9797 inspections or while performing setouts in conjunction with road
9898 service.
9999 SECTION 3. This act shall become effective November 1, 2023.
