AS INTRODUCED 
 
An Act relating to railroads; stating legislative 
intent; requiring certain railroad operators have two 
crewmembers; making certain ex ceptions; providing for 
noncodification; providing for codification; and 
providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law not to be 
codified in the Oklahoma Statutes reads as follows: 
The Legislature finds that adequate personnel are critical to 
ensuring railroad operational safety, secu rity, and, in the event of 
a hazardous material incident, support of first re sponder 
activities, as well as in the interest of the safety of the g eneral 
public.  Therefore, the Legislature declares that this act 
regulating minimum railroad employee staffing to reduce risk to 
localities constitutes power to protect and pr omote the health, 
safety, security and welfare of the residents of this state by 
reducing the risk exposure to local communities and prote cting 
environmentally sensitive or pristine land and waterways .

SECTION 2.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 104 of Title 66, unless there is 
created a duplication in numbering, reads as follows: 
A.  Railroads, excluding short lines, operating within this 
state shall maintain a minimum of two (2) crew members in the control 
compartment of the lead loc omotive unit of a train. 
B.  Compliance with subsection A of th is section shall not be 
required during switching operations, brake testing, safety 
inspections or while performing setouts in conjunction with road 
service. 
SECTION 3.  This act shall become effective November 1, 2023.
