5861 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5962 SECTION 1. NEW LAW A new section of law not to be
6063 codified in the Oklahoma Statutes reads as follows:
6164 A. This act shall be known and may be cited as the "Oklahoma
6265 Foreign Agents Registration Act".
6366 B. The purpose of this act is to provide public transparency
6467 for the political and propaganda activities conducted by agents
6568 representing principals from foreign countries of concern.

9296 SECTION 2. NEW LAW A new section of law to be codified
9397 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
9498 is created a duplication in numbering, reads as follows:
9599 As used in this act:
96100 1. "Person" means an individual, partnership, association,
97101 corporation, organization, or any other combination of individuals;
98102 2. "Foreign principal" shall mean:
99103 a. a government of a foreign country and a foreign
100104 political party, or
101105 b. a person outside of the Uni ted States, unless it is
102106 established that such person is an individual and a
103107 citizen of and domiciled within the United St ates, or
104108 that such person is not an individual and is organized
105109 under or created by the laws of the United States or
106110 of any state or other place subject to the
107111 jurisdiction of the United States and has its
108112 principal place of business within the United Stat es,
109113 c. a partnership, association, corporation, organization,
110114 or other combination of persons organized under the
111115 laws of or having it s principal place of business in a
112116 foreign country, or
113117 d. a partnership, association, corporation, organization,
114118 or other combination of persons that is at least
115119 twenty percent (20%) beneficially owned by a

146151 3. "Agent of a foreign principal " shall mean:
147152 a. any person who acts as an agent, representative,
148153 employee, or servant, or any person who acts in any
149154 other capacity at the order, request, or under the
150155 direction or control of a foreign principal or of a
151156 person any of whose activities are directly or
152157 indirectly supervised, directed, controlled, financed,
153158 or subsidized in whole or in part by a foreign
154159 principal, and who directly or through any other
155160 person:
156161 (1) engages within the State of Oklahoma in political
157162 activities for or in the interests of such
158163 foreign principal,
159164 (2) acts within the State of Oklahoma as a public
160165 relations counsel, publicity agent, information
161166 service employee, or political consultant for or
162167 in the interests of such foreign principal ,
163168 (3) within the State of Oklahoma solicits, collects,
164169 disburses, or dispenses contributions, loans,

193199 (4) within the State of Oklahoma represents the
194200 interests of such foreign p rincipal before any
195201 agency or official of the Government of the State
196202 of Oklahoma or of a local government of the State
197203 of Oklahoma, and
198204 b. any person who agrees, consents, assumes, or purports
199205 to act as, or who is or holds himself or herself out
200206 to be, whether or not purs uant to contractual
201207 relationship, an agent of a foreign principal as
202208 defined in division (1) of subparagraph a of paragraph
203209 3 of this section.
204210 Agent of a foreign principal does not include any news or press
205211 service or association organized under the laws of the United States
206212 or of any state or other place subject to the jurisdiction of the
207213 United States, or any n ewspaper, magazine, periodical, or other
208214 publication for which there is on file with the United States Postal
209215 Service information in compliance with federal law, solely by virtue
210216 of any bona fide news or journalistic activities, includ ing the
211217 solicitation or acceptance of advertisements, subscriptions, or
212218 other compensation therefor, so long as it is at least eighty
213219 percent (80%) beneficially owned by, and its officers and directors,
214220 if any, are citizens of the United States, and such n ews or press

242249 publication, is not owned, directed, supervised, controlled,
243250 subsidized, or financed, and none of its policies are determined by
244251 any foreign principal defined in subsection B of this section, or by
245252 any agent of a foreign principal required to register unde r this
246253 act;
247254 4. "Government of a foreign country " shall mean any person or
248255 group of persons exercising sovereign de facto or de jure political
249256 jurisdiction over any country, oth er than the United States, or over
250257 any part of such country, and includes any subdivision of any such
251258 group and any group or agency to which such sovereign de facto or de
252259 jure authority or functions are directly or indirectly delegat ed.
253260 Such term shall include any faction or body of insurgents within a
254261 country assuming to exercise governmental authority whether such
255262 faction or body of insurgents has or has not been recognized by the
256263 United States;
257264 5. "Foreign political party " shall mean any organization o r any
258265 other combination of individuals in a country other than the United
259266 States, or any unit or branch thereof, having for an aim or purpose,
260267 or which is engaged in any activi ty devoted in whole or in part to,
261268 the establishment, administration, control, o r acquisition of
262269 administration or control, of a government of a foreign country or a
263270 subdivision thereof, or the furtherance or influencing of the

292300 6. "Public relations counsel" shall mean any person who engages
293301 directly or indirectly in informing, advising, or in any way
294302 representing a principal in any public relations matter pertaining
295303 to political or public interests, policies, or relatio ns of such
296304 principal;
297305 7. "Publicity agent" shall mean any person who engages directly
298306 or indirectly in the p ublication or dissemination of oral, visual,
299307 graphic, written, or pictorial information or matter of any kind,
300308 including publication by means of ad vertising, books, periodicals,
301309 newspapers, lectures, broadcasts, motion pictures, or otherwise;
302310 8. "Information service employee" shall mean any person who is
303311 engaged in furnishing, disseminating, or publishing accounts,
304312 descriptions, information, or data with respect to the political,
305313 industrial, employment, economic, social, cultural, or other
306314 benefits, advantages, facts, or conditions of any country other than
307315 the United States or of any government of a foreign country or of a
308316 foreign political party or of a partnership, association,
309317 corporation, organization, or other combination of individuals
310318 organized under the laws of, or having its principal place of
311319 business in, a foreign country;
312320 9. "Registration statement " shall mean the registration
313321 statement required to be filed with the Oklahoma Attorney General

341350 thereto required to be filed under Section 3 or Section 4 of this
342351 act, and includes all documents and papers required to be filed
343352 therewith or amendatory thereof or supplemental thereto, whether
344353 attached thereto or incorp orated therein by reference;
345354 10. "United States", when used in a geographical sense, means
346355 the fifty States, the District of Columbia, the Territories, the
347356 insular possessions, and all other places now or hereafter subject
348357 to the civil or military jurisdiction of the United States;
349358 11. "Prints" means newspapers and periodicals, books,
350359 pamphlets, sheet music, visiti ng cards, address cards, printing
351360 proofs, engravings, photog raphs, pictures, drawings, plans, maps,
352361 patterns to be cut out, catalogs, prospectuses, advertisements, and
353362 printed, engraved, lithographed, or autographed notices of various
354363 kinds, and, in genera l, all impressions or reproductions obtained on
355364 paper or other material assimilable to paper, on parchment or on
356365 cardboard, by means of printing, engraving, lithography, autography,
357366 or any other easily recognizable mechanical process, with the
358367 exception of the copying press, stamps with movable or immovable
359368 type, and the typewriter;
360369 12. "Political activities" means any activity that the person
361370 engaging in believes will, or that the person intends to, in any way
362371 influence any agency or official of the Government of the State of
363372 Oklahoma or a local government of the State of Oklahoma, or any

390400 section of the public within the State of Oklahoma with reference to
391401 formulating, adopting, or changing the domestic or foreign policies
392402 of the United States or of the State of Oklahoma with reference to
393403 the political or public in terests, policies, or relations of a
394404 government of a foreign country or a foreign political party;
395405 13. "Political consultant" means any person who engages in
396406 informing or advising any other person with reference to the
397407 policies of the State of Oklahoma or the political or public
398408 interest, policies, or relations of a foreign country or of a
399409 foreign political party ;
400410 14. "Country of concern" shall mean any country designated by
401411 the United States Secretary of State as hostile or a Coun try of
402412 Concern (CPC).
403413 SECTION 3. NEW LAW A new section of law to be codified
404414 in the Oklahoma Statutes as Section 13002 of Title 74, unless there
405415 is created a duplication in numbering, reads as fol lows:
406416 A. No person shall act as an agent of a foreign principal from
407417 a country of concern unless he or she has filed with the Oklahoma
408418 Attorney General a true and complete registration statement and
409419 supplements thereto as required by subse ctions A and B of this
410420 section or unless he or she is exempt from registrati on under the
411421 provisions of this act. Except as hereinafter provided, every
412422 person who becomes an agent of a foreign principal from a country of
413423 concern shall, within ten (10) days thereafter, file with the

440451 Oklahoma Attorney General, in duplicate, a reg istration statement,
441452 under oath on a form prescribed by the Oklahoma Attorney General.
442453 The obligation of an agent of a foreign principal from a countr y of
443454 concern to file a regi stration statement shall, after the tenth day
444455 of his or her becoming such agent, continue from day to day, and
445456 termination of such status shall not relieve such agent from his or
446457 her obligation to file a registration statement f or the period
447458 during which he or she was an agent of a foreign principal from a
448459 country of concern. The registration statement shall include the
449460 following, which shall be regarded as material for the purposes of
450461 this subsection:
451462 1. Registrant's name, principal business address, and all other
452463 business addresses in the United States or elsewhere, and all
453464 residence addresses, if any;
454465 2. Status of the registrant; if an individual, nationality; if
455466 a partnership, name, residence addresses, and nationality of e ach
456467 partner and a true and complete copy of its a rticles of
457468 copartnership; if an association, corporation, or ganization, or any
458469 other combination of individuals, the name, residence addresses, and
459470 nationality of each director and officer and of each person
460471 performing the functions of a director or office r and a true and
461472 complete copy of its charter, articles of i ncorporation,
462473 association, constitution, and bylaws, and amendments thereto; a
463474 copy of every other instrument or document and a statement of the

491503 organization, powers, and purposes; and a statemen t of its ownership
492504 and control;
493505 3. A comprehensive statement of the nature of the registrant's
494506 business; a complete list of the registrant's employees and a
495507 statement of the nature of the work of ea ch; the name and address of
496508 every foreign principal from a country of concern for whom the
497509 registrant is acting, assuming or purporting to act or has agreed to
498510 act; the character of the business or other activities of every such
499511 foreign principal from a co untry of concern, and, if any such
500512 foreign principal from a country of concern be other than a natural
501513 person, a statement of the ownership and control of each; and the
502514 extent, if any, to which each such foreign principal from a country
503515 of concern is supervised, directed, owned, controlled, financed, or
504516 subsidized, in whole or in part, by any government of a foreign
505517 country or foreign political party, or by any other foreign
506518 principal from a country of con cern;
507519 4. Copies of each written agreement and the t erms and
508520 conditions of each oral agreement, including all modifications of
509521 such agreements, or, where no contract exists, a full statement of
510522 all the circumstances, by reason of which the registrant is an agent
511523 of a foreign principal from a country of conc ern; a comprehensive
512524 statement of the nature and method o f performance of each such
513525 contract, and of the existing and proposed activity or activities

544557 5. The nature and amount of contributions, income, money, or
545558 thing of value, if any, that the registrant has rec eived within the
546559 preceding one hundred eighty (180) days from each such foreig n
547560 principal from a country of concern, either as compensation or for
548561 disbursement or otherwise, and the form and time of each such
549562 payment and from whom such payment was received;
550563 6. A detailed statement of every activity which the registrant
551564 is performing or is assuming or purporting or has agreed to perform
552565 for himself or herself or any other person other than a foreign
553566 principal from a country of concern and which requires his or her
554567 registration hereunder, includin g a detailed statement of any such
555568 activity which is a political activity;
556569 7. The name, business, and residence addresses, and if an
557570 individual, the nationality, o f any person other than a foreign
558571 principal from a country of concern for whom the registran t is
559572 acting, assuming or purporting to act or has agreed to act under
560573 such circumstances as require d by his or her registration hereunder;
561574 the extent to which each such pe rson is supervised, directed, owned,
562575 controlled, financed, or subsidized, in whole or in part, b y any
563576 government of a foreign country or foreign political party or by any

591605 and amount of contributions, income, money, or thing of value, i f
592606 any, that the registrant has received during the preceding one
593607 hundred eighty (180) days from each such person in connection with
594608 any of the activities referred to in paragraph 6 of this subsection,
595609 either as compensation or for disbursement or otherwise , and the
596610 form and time of each such payment and fr om whom received;
597611 8. A detailed statement of the money and other things of value
598612 spent or disposed of by the registrant during the preceding one
599613 hundred eighty (180) days in furtherance of or in connectio n with
600614 activities which require his or her registration hereunder and which
601615 have been undertaken by him or her either as an agent of a foreign
602616 principal from a country of concern or for himself or herself or any
603617 other person or in connection with any activ ities relating to his or
604618 her becoming an agent of such pr incipal from a countr y of concern,
605619 and a detailed statement of any contributions of money or other
606620 things of value made by him or her during the preceding one hundred
607621 eighty (180) days other than contributions the making of which is
608622 prohibited under federal law in connection with an election to any
609623 political office or in connection with any primary election,
610624 convention, or caucus held to select candidates f or any political
611625 office;
612626 9. Copies of each written agreement and the terms and
613627 conditions of each oral agreement, including all modifications of

640655 such agreements, or, where no contract exists, a full statement o f
641656 all the circumstances, by reason of which t he registrant is
642657 performing or assuming or purporting or has agreed to perform for
643658 himself or herself or for a foreign principal from a country of
644659 concern or for any person other than a foreign principal from a
645660 country of concern any activities which requi re his or her
646661 registration hereunder;
647662 10. Such other statements, information, or documents pertinent
648663 to the purposes of this subsection as the Oklahoma Attorney General,
649664 having due regard for th e national security and the public interest,
650665 may from time to time require; and
651666 11. Such further statements and such further copies of
652667 documents as are nece ssary to make the statements made in the
653668 registration statement and supplements thereto, and the co pies of
654669 documents furnished therewith, not misleading.
655670 B. Every agent of a foreign principal from a country of concern
656671 who has filed a registration statemen t required by subsection A of
657672 this section shall, within thirty (30) days after the expiration of
658673 each period of six (6) months succeeding such filing, file wit h the
659674 Oklahoma Attorney General a supplement thereto under o ath, on a form
660675 prescribed by the Oklahoma Attorney General, which shall set forth
661676 with respect to such preceding six (6) months' period such facts as
662677 the Oklahoma Attorney General, having due regard for the national
663678 security and the public interest, may deem necessary to make the

691707 current with respect to such period. In connection with the
692708 information furnished under paragraphs 3, 4, 6, and 9 of subsection
693709 A of this section, the registrant shall give notice to the Oklahoma
694710 Attorney General of any changes therein within ten (10) days after
695711 such changes occur. If the Oklahoma Attorney General, having due
696712 regard for the national security and the public interest, determines
697713 that it is necessary to carry out the purposes of this act, he or
698714 she may, in any particular case, require supplements to the
699715 registration statement to be filed at more frequent intervals in
700716 respect to all or particular items of information to be furnished.
701717 C. The registration statement and supplements thereto shall be
702718 executed under oath as follows: If the registrant is an individual,
703719 by him or her; if the registrant is a partnership, by the majority
704720 of the members thereof; if the registrant is a p erson other than an
705721 individual or a partnership, by a majority of the of ficers thereof
706722 or persons performing the functions of officers or by a majority of
707723 the board of directors thereof or persons performing the functions
708724 of directors, if any.
709725 D. The fact that a registration statement or supplement thereto
710726 has been filed shall not necessarily be deemed a full compliance
711727 with this act and the regulations thereunder on the part of the
712728 registrant; nor shall it indicate that the Oklahoma Attorney General
713729 has in any way passed upon the merits of such registration statement

741758 provided for in this act, for willful failure to fil e a registration
742759 statement or supplement thereto when due or for a willful false
743760 statement of a material fact therein or the willful omission of a
744761 material fact required to be stated therein or the willful omission
745762 of a material fact or copy of a material document necessary to make
746763 the statements made in a registration statement and supplements
747764 thereto, and the copies of documents furnished therewith, not
748765 misleading.
749766 E. If any agent of a foreign principal from a country of
750767 concern, required to register under th e provisions of this act, has
751768 previously thereto registered with the Oklahoma Attorney General

896916 which he or she believes will be, or which he or she intends to be,
897917 disseminated or circulated among two or more persons shall, not
898918 later than forty-eight (48) hours after the beginning of th e
899919 transmittal thereof, f ile with the Oklahoma Attorney General two
900920 copies thereof.
901921 B. It shall be unlawful for any pers on within the United States
902922 who is an agent of a foreign principal from a country of concern and
903923 required to register under the provisio ns of this act to transmit or
904924 cause to be transmitted in the United States mail or by any means or
905925 instrumentality of in terstate or foreign commerce any informational
906926 materials for or in the interests of such foreign principal from a
907927 country of concern wit hout placing in such inform ational materials a
908928 conspicuous statement that the materials are distrib uted by the
909929 agent on behalf of the foreign principal from a country of concern,
910930 and that additional information is on file with the Oklahoma
911931 Attorney General. The Oklahoma Attorney General may define what
912932 constitutes a conspicuous statement for the purpos es of this
913933 section.

941962 section to be filed with the Oklahoma Attorney General shall be
942963 available for public inspection under such regulations as the
943964 Oklahoma Attorney General may prescribe.
944965 D. Under the provisions of thi s act, it shall be unlawful for
945966 any person who is an agent of a foreign principal from a country of
946967 concern within the State of Oklahoma to transmit, convey, or
947968 otherwise furnish to any State of Oklahoma government a gency or
948969 official (including any member or committee of the Oklahoma State
949970 Legislature and/or local government) any political propaganda or to
950971 request from any such agency or official any information or advice
951972 with respect to any matter pertaining to the poli tical or public
952973 interests, policies, relations, or political party that is in the
953974 interests of such foreign principal f rom a country of concern or
954975 pertaining to the foreign or domestic policies of the United State s
955976 of America or the State of Oklahoma , unless the propaganda or the
956977 request is prefaced or accompanied by a true and accurate statement
957978 to the effect that such person is re gistered as an agent of a
958979 foreign principal from a country of concern.
959980 E. Whenever any agent of a foreign principal from a country of
960981 concern required to register under this subsection appears before
961982 any committee of the Oklahoma State Legislature or a local
962983 government to testify for or in the interests of such foreign
963984 principal from a country of concer n, he or she shall, at the time of

9961018 in the Oklahoma Statutes as Section 13006 of Title 74, unless there

9981020 Every agent of a foreign princip al from a country of concern
9991021 registered under this act shall keep and preserve while he or she is
10001022 an agent of a foreign principal from a co untry of concern such books
10011023 of account and other recor ds with respect to all of his or her
10021024 activities, the disclosure of which is required under the provisions
10031025 of this act, in accordance with such business a nd accounting
10041026 practices, as the Oklahoma Attorney General, having due regard for
10051027 the national security and the public interest, may by regulation
10061028 prescribe as necessa ry or appropriate for the enforcement of the
10071029 provisions of this act and shall preserve the same for a period of
10081030 three years following the term ination of such status. Until
10091031 regulations are in effect under this section , every agent of a
10101032 foreign principal fr om a country of conce rn shall keep books of
10111033 account and shall preserve all writ ten records with respect to his
10121034 or her activities. Such books and records shall be open at all
10131035 reasonable times to the inspection of any official charged with the

10491072 A. The Oklahoma Attorney General shall retain in permanent form

10521075 and inspection at such reasonable hours, under suc h regulations, as
10531076 the Oklahoma Attorney General may prescribe, and copies of the same
10541077 shall be furnished to every applic ant at such reasonable fee as the
10551078 Oklahoma Attorney General may prescribe.
10561079 B. The Oklahoma Attorney General shall, promptly upon receip t,
10571080 transmit one copy of every registration statement filed hereunder
10581081 and one copy of every amendment or supplemen t thereto filed
10591082 hereunder, to the United States Secretary of State for such comment
10601083 and use as the United States Secretary of State may determi ne to be
10611084 appropriate from the point of view of the foreign relations of the
10621085 United States. Failure of the Oklahoma Attorney General to transmit
10631086 such copy shall not be a bar to prosecution under th is act.

10971121 D. The Oklahoma Attorney General shall every six (6) months
10981122 report to the State Legislature concerning administr ation of this
10991123 act, including registrations filed pursuant to this act, and the
11001124 nature, sources, and content of political propaganda disseminated
11011125 and distributed.
11021126 E. The Oklahoma Attorney General shall every month report on a
11031127 web portal administered by the Oklahoma Attorney General concerning
11041128 administration of this act, including registrations filed pursuant
11051129 to this act, and the nature, sources, and content of political
11061130 propaganda disseminated and distributed.
11071131 SECTION 9. NEW LAW A new section of law to be codified
11081132 in the Oklahoma Statutes as Section 13008 of Title 74, unless there

11451170 this act. Dissolution of any organization acting as an agent of a
11461171 foreign principal from a country of concern shall not relieve any
11471172 officer, or person performing the functions of an officer, or any
11481173 director, or person performing the functions of a director, from
11491174 complying with the provisions of this section. In case of failure
11501175 of any such agent of a foreign principal from a country of concern
11511176 to comply with any of the requirements of this act, each of its
11521177 officers, or persons performing the funct ions of officers, and each
11531178 of its directors, or persons performing the functions of dire ctors,
11541179 shall be subject to prosecution therefor.
11551180 SECTION 10. NEW LAW A new section of law to be codified

12011227 B. Any person who is a student, faculty member, researcher,
12021228 adjunct, or otherwise em ployed or associated with an institution
12031229 within The Oklahoma State System of Higher Education who:
12041230 1. Willfully violates any provision of this act or any
12051231 regulation thereunder; or
12061232 2. In any registration statement or supplement thereto or in
12071233 any other document filed with or furnished to the Oklahoma Attorney
12081234 General under the provisions of this subsection willfully m akes a
12091235 false statement of a material fact or willfully omits any material
12101236 fact required to be stated therein or willfully om its a material
12111237 fact or a copy of a material document necessary to make the
12121238 statements therein and the copies of documents furnished therewith
12131239 not misleading, shall, upon conviction thereof, be expelled or

12431270 3. Each institution of higher education in Oklahoma shall adopt
12441271 a policy for expulsion or dismissal of individuals found in
12451272 violation of this act.
12461273 C. In any proceeding under this act in which it is charged that
12471274 a person is an agent of a foreign principal from a country of
12481275 concern with respect to a foreign principal o utside of the United
12491276 States of America, proof of the specific identi ty of the foreign
12501277 principal from a country of c oncern shall be permissible but not
12511278 necessary.
12521279 D. Any alien who shall be convicted of a violation of, or a
12531280 conspiracy to violate, any provis ion of this act or any regulation
12541281 thereunder shall be subject to refe rral to the United States
12551282 Department of Justic e for removal pursuant to Chapter 4 of Title II
12561283 of the Immigration and Nationality Act (8 U.S.C.A. Section 1221 et
12571284 seq.).
12581285 E. Failure to file any such registration statement or
12591286 supplements thereto as is required by ei ther Section 3A or Section
12601287 3B of this act shall be considered a continuing offense for as long
12611288 as such failure exists, notwithstanding any statute of limitatio n or
12621289 other statute to the contrary.

12891317 F. Whenever in the judgment of the Oklahoma Attorney General,
12901318 any person who is engaged in or about to engage in any acts which
12911319 constitute or will constitute a violation of any provision of this
12921320 act, or regulations issu ed thereunder, or whe never any agent of a
12931321 foreign principal from a country of concern fails to comply with any
12941322 of the provisions of this act or the regulations issued thereunder,
12951323 or otherwise is in violation of the act, the Oklahoma Attorney
12961324 General may make application to the appropriate state court for an
12971325 order enjoining such acts or enjoining such person from continui ng
12981326 to act as an agent of such foreig n principal from a country of
12991327 concern, or for an order requiring compliance with any appropriate
13001328 provision of the act or regulation thereunder. The state court
13011329 shall have jurisdiction and authority to issue a temporary o r
13021330 permanent injunction, restraining order, or such other order, which
13031331 it may deem proper.
13041332 G. If the Oklahoma Attorney General determines that a
13051333 registration statement does not comply with the requirements of this
13061334 act or the regulations issued thereunder, he or she shall so notify
13071335 the registrant in writing, s pecifying in what respects the statement
13081336 is deficient. It shall be unlawful for any person to act as an
13091337 agent of a foreign principal from a country of concern at any time
13101338 ten (10) days or more after re ceipt of such notifi cation without
13111339 filing an amended registration statement in full compliance with the
13121340 requirements of this act and the regulations issued thereunder.
