An Act relating to public health and safety ; amending 
63 O.S. 2021, Section 5060, which relates to state 
Medicaid program not to contra ct with out of state 
providers; unauthorizing the Oklahoma Health Care 
Authority from providing coverage for certain out of 
state Medicaid programs in certain situa tions; and 
providing an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA: 
SECTION 1.     AMENDATORY     63 O.S. 2021, Section 5060, is 
amended to read as follows: 
Section 5060. A.  Where practicable and in accordance with 
state and federal law, t he state Medicaid program shall not contract 
with an out-of-state medical provider for treatment that is 
available from one or more provi ders licensed and practicing in the 
State of Oklahoma. 
B. The Oklahoma Health Care Authority shall not authorize 
payment through the state Medicaid program to an out -of-state

medical provider unless that state also allows their residents to 
contract with providers under their state Medicaid program in 
Oklahoma. 
C. The Oklahoma Health Care Authori ty shall seek any federal 
approval necessary to implement the provisions of this section. 
SECTION 2.  This act shall become effective November 1, 2023.
