22112 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:

24113 SECTION 1. AMENDATORY 40 O.S. 2021, Section 141.6, is
25114 amended to read as follows:

27115 Section 141.6 A. All firms or corporations engaged in the
28116 service, repair and/or installati on of boilers or pressure vessels
29117 located in this state shall be licensed b y the Commissioner to
30118 perform such work. Provided, no license shall be required for any
31119 firms or corporations engaged in the service, repair and/or
32120 installation of hot water supply heaters as provided in paragraph 12
33-of subsection A of Section 2 141.2 of this act title. The
34-Commissioner of Labor sh all abide by any existing code of
35-installation presently adopted or as may be hereinafter adopted by
36-this state or its agencies or by any county, municipality or school
37-district as pertains to hot water supply heaters. The annual
38-license fee shall be paya ble in advance on or before January 31 of
39-each calendar year. Each firm or corporation must furnish evidence
40-suitable to the Commissioner that they are qualified to perform such
41-work.

43155 B. All hearings for the issuance or r evocations of license
44156 under this section s hall comply with the Oklahoma Administrative
45157 Procedures Act.

47158 C. Any person who shall violate any of the provisions of this
48159 act or who violates any rule or order of the Commissi oner pursuant
49160 to this act shall be gu ilty of a misdemeanor, and in addition
50161 thereto, may be enjoined from continuing such action. Each day upon
51162 which such violation occurs shall constitute a separate violation.

53163 D. The Commissioner of Labor may promulgate rules establishing
54164 a schedule of administrative penalties and fines for viola tions of
55165 the Boiler and Pressure Vessel Safety Act and/or the Boiler and
56166 Pressure Vessel Rules which may be in additio n to or in lieu of the
57167 criminal penalties provided in this s ection. The promulgation of an
58168 administrative fine schedule shall grant the C ommissioner authority
59169 to impose those administrative fines for any violation of the Boiler
60170 and Pressure Vessel Safety A ct and/or the Boiler and Pressure Vessel
61171 Rules. Funds collected as payment from a violator for
62172 administrative fines imposed for a violat ion of the Boiler and
63173 Pressure Vessel Safety Act and/or the Boiler and Pressure Vessel
