212 | 206 | | previous month. This report shall detail the weight of marijuana |
---|
213 | 207 | | purchased at wholesale and the weight of marijuan a sold to licensed |
---|
214 | 208 | | medical marijuana patients and license d caregivers and account for |
---|
215 | 209 | | any waste. The report shall show total sales in dollars, tax |
---|
216 | 210 | | collected in dollars, and tax due in dollars. The Authority shall |
---|
217 | 211 | | have oversight and auditing responsibilities to ensure that all |
---|
218 | 212 | | marijuana being grown is accounted for. |
---|
219 | 213 | | D. Only a licensed medical marijuan a dispensary may conduct |
---|
220 | 214 | | retail sales of marijuana or marijuana derivatives. Beginning on |
---|
221 | 215 | | the effective date of this act, licens ed medical marijuana |
---|
222 | 216 | | dispensaries shall be authorized to package and sell pre-rolled |
---|
223 | 217 | | marijuana to licensed medical marijuana pa tients and licensed |
---|
224 | 218 | | caregivers. The products described in this subsection shall contain |
---|
225 | 219 | | only the ground parts of the marijuana p lant and shall not include |
---|
226 | 220 | | marijuana concentrates or der ivatives. The total net weight of each |
---|
227 | 221 | | pre-roll packaged and sold by a medical marijuana dispensary shall |
---|
228 | 222 | | not exceed one (1) gram. These products shall be tested, packaged |
---|
229 | 223 | | and labeled in accordance with Oklahoma law and rules promulgated by |

369 | 360 | | shall not be subject to taxation. Under no circumstances may a |

370 | 361 | | licensed medical marijuana commercial grower sell marijuana directly |
---|
371 | 362 | | to a licensed medical marijuana patient or licensed medical |
---|
372 | 363 | | marijuana caregiver. A licensed medical marijuana commercial grower |
---|
373 | 364 | | may only sell at the wholesale level to a licensed medical marijuana |
---|
374 | 365 | | dispensary, a licensed medical marijuana commercial grower or a |
---|
375 | 366 | | licensed medical marijuana processor. If the federal government |
---|
376 | 367 | | lifts restrictions on buying and selli ng marijuana between states, |
---|
377 | 368 | | then a licensed medical marijuana commercial grower would be allowed |
---|
378 | 369 | | to sell and buy marijuana wholesale from, or to, a n out-of-state |

624 | 610 | | the Authority may enforce these standards for licensed medical |
---|
625 | 611 | | marijuana processors. The Authority shall develop a standards |
---|
626 | 612 | | review procedure and these standards can be altered by calling |
---|
627 | 613 | | another council of twelve (12) Oklahoma mariju ana industry experts. |
---|
628 | 614 | | A signed letter of twenty operating, licensed medical marijuana |

629 | 615 | | processors shall constitute a need for a new council and standards |

932 | 912 | | c. repairing, maintaining or monitoring the performance |

1025 | 1007 | | B. The Oklahoma Medical Marijuana Authority, with the aid of |
---|
1026 | 1008 | | the Office of Management and Enterprise Services, shall develop a |
---|
1027 | 1009 | | website for medical marijuana business license applications. |
---|
1028 | 1010 | | C. The Authority shall make available on it s website in an |
---|
1029 | 1011 | | easy-to-find location, applications for a temporary medical |
---|
1030 | 1012 | | marijuana business license and an nual medical marijuana business |
---|
1031 | 1013 | | license. |
---|
1032 | 1014 | | D. Beginning November 1, 2023, the Authority shall require all |
---|
1033 | 1015 | | persons or entities seeking licensure as a medical marijuana |
---|
1034 | 1016 | | commercial grower, medical marijuan a processor, medical marijuana |
---|
1035 | 1017 | | dispensary, or medical m arijuana transporter to first apply for a |
---|
1036 | 1018 | | temporary medical marijuana busi ness license. |
---|
1068 | 1049 | | marijuana or marijuana products by the licensee. A temporary |
---|
1069 | 1050 | | medical marijuana business licensee shall follow all applicable |
---|
1070 | 1051 | | rules and regulations promulgated by the Aut hority. |
---|
1071 | 1052 | | 2. A temporary medical marijuana business license does not |
---|
1072 | 1053 | | obligate the Authority to issue an annual medical marijua na business |
---|
1073 | 1054 | | license nor does the temporary medical marijuana business licens e |
---|
1074 | 1055 | | create a vested right in the holder to either an exte nsion of the |
---|
1075 | 1056 | | temporary medical marijuana business license or to the granti ng of a |
---|
1076 | 1057 | | subsequent annual medical marijuana busines s license. |
---|
1077 | 1058 | | 3. A temporary medical marijuana business license issued under |
---|
1078 | 1059 | | the provisions of this subsection shall be valid for one hundred |
---|
1079 | 1060 | | eighty (180) days from its effective date. |
---|
1080 | 1061 | | 4. A temporary medica l marijuana business license may be |
---|
1081 | 1062 | | extended by the Authority for additional ninety-day periods not to |
---|
1082 | 1063 | | exceed eighteen (18) mon ths if: |
---|
1083 | 1064 | | a. an application for an annual license has bee n |
---|
1084 | 1065 | | submitted to the Auth ority prior to the initial |
---|
1085 | 1066 | | expiration date of the t emporary medical marijuana |
---|
1086 | 1067 | | business license, and |
---|
1118 | 1098 | | 5. A nonrefundable application fee for a temporary medical |
---|
1119 | 1099 | | marijuana business license shall be assessed in the amount of One |
---|
1120 | 1100 | | Thousand Dollars ($1,000.00 ). A nonrefundable fee of One Thousand |
---|
1121 | 1101 | | Dollars ($1,000.00) shall be assessed for every ninety-day extension |
---|
1122 | 1102 | | requested by the holder of a temporary medical marijuana business |
---|
1123 | 1103 | | license and subsequently granted by the Authori ty. |
---|
1124 | 1104 | | 6. In addition to the general requirements provided for in |
---|
1125 | 1105 | | subsection F of this section, persons or entitie s applying for a |
---|
1126 | 1106 | | temporary medical marijuana busin ess license or applying to renew a |
---|
1127 | 1107 | | medical marijuana business license shall submit the followi ng to the |
---|
1128 | 1108 | | Authority: |
---|
1129 | 1109 | | a. business-formation documents, which may include, but |
---|
1130 | 1110 | | not be limited to, articles of inco rporation, |
---|
1131 | 1111 | | operating agreements, partnership agree ments, and |
---|
1132 | 1112 | | fictitious business name statements. The applicant |
---|
1133 | 1113 | | shall also provide all document s filed with the |
---|
1134 | 1114 | | Oklahoma Secretary of State, |
---|
1135 | 1115 | | b. financial information pertaining to the operations of |
---|
1136 | 1116 | | the medical marijuana business, which shall include |
---|
1137 | 1117 | | the following: |
---|
1169 | 1148 | | of the financial institution, the address of the |
---|
1170 | 1149 | | financial institution, account type, account |
---|
1171 | 1150 | | number, and the amount of money in the account, |
---|
1172 | 1151 | | (2) a list of loans made to the applicant. For each |
---|
1173 | 1152 | | loan, the applicant shall provide the amount of |
---|
1174 | 1153 | | the loan, the date of th e loan, term of the loan, |
---|
1175 | 1154 | | security provided for th e loan, and the name, |
---|
1176 | 1155 | | address, and phone number of t he lender, |
---|
1177 | 1156 | | (3) a list of investments made into the medical |
---|
1178 | 1157 | | marijuana business. For each investment, the |
---|
1179 | 1158 | | applicant shall provide th e amount of the |
---|
1180 | 1159 | | investment, the date of the investment, term of |
---|
1181 | 1160 | | the investment, and the name, address, and phone |
---|
1182 | 1161 | | number of the investor, and |
---|
1183 | 1162 | | (4) a list of all monetary gifts, equipment, and |
---|
1184 | 1163 | | property of any kind given to the applicant for |
---|
1185 | 1164 | | the purpose of or in exchange for applyin g for or |
---|
1186 | 1165 | | operating a medical marijuana business. For each |
---|
1187 | 1166 | | gift, the applicant shall provide the value or a |
---|
1220 | 1198 | | d. whether the applicant has an o wnership or a financial |
---|
1221 | 1199 | | interest in any other medical marijuana business |
---|
1222 | 1200 | | licensed under the provis ions of the Oklahoma Me dical |
---|
1223 | 1201 | | Marijuana and Patient Protection Act, |
---|
1224 | 1202 | | e. a complete and detailed diagram of the proposed |
---|
1225 | 1203 | | premises. If changes to the proposed pr emises occur |
---|
1226 | 1204 | | during the application period, a revised set of plans |
---|
1227 | 1205 | | shall be submitted to the Autho rity for final |
---|
1228 | 1206 | | inspection. The diagram shall be to scale and shall |
---|
1229 | 1207 | | show the following: |
---|
1230 | 1208 | | (1) boundaries of the property and th e proposed |
---|
1231 | 1209 | | premises to be license d, showing all boundaries, |
---|
1232 | 1210 | | dimensions, entrances and exits, interior |
---|
1233 | 1211 | | partitions, walls, rooms, win dows, doorways, and |
---|
1234 | 1212 | | common or shared entryways, and shall include a |
---|
1235 | 1213 | | brief statement or description of the principal |
---|
1236 | 1214 | | activity to be conducted therein, |
---|
1270 | 1247 | | (4) if the proposed premi ses consists of only a |
---|
1271 | 1248 | | portion of the prope rty, labels indicating which |
---|
1272 | 1249 | | part of the property is th e proposed premises and |
---|
1273 | 1250 | | what the remaining property is used for, |
---|
1274 | 1251 | | f. if the applicant is not the landowner of the real |
---|
1275 | 1252 | | property upon which the premises is loca ted, the |
---|
1276 | 1253 | | applicant shall provide to the Aut hority a document |
---|
1277 | 1254 | | from the landowner or the agent of th e landowner that |
---|
1278 | 1255 | | states that the applicant has the right to occupy the |
---|
1279 | 1256 | | property and acknowledging the applicant may use the |
---|
1280 | 1257 | | property for the medical marijuana business activity |
---|
1281 | 1258 | | for which the applicant is applying for licensure. An |
---|
1282 | 1259 | | applicant shall also pro vide a copy of the rent al |
---|
1283 | 1260 | | agreement, as applicable, |
---|
1284 | 1261 | | g. if the applicant is the landowner of the real property |
---|
1285 | 1262 | | upon which the premises is located, the applicant |
---|
1286 | 1263 | | shall provide to the Authority a copy of the title or |
---|
1287 | 1264 | | deed to the property, |
---|
1321 | 1297 | | to, illumination, heating, cooling, and |
---|
1322 | 1298 | | ventilation, |
---|
1323 | 1299 | | (2) if the applicant is proposing to use a diversion |
---|
1324 | 1300 | | from a waterbody, groundwater w ell, or rain |
---|
1325 | 1301 | | catchment system as a water s ource for |
---|
1326 | 1302 | | cultivation, include the following locations on |
---|
1327 | 1303 | | the property diagram with locat ions also provided |
---|
1328 | 1304 | | as coordinates in either latitude and longitude |
---|
1329 | 1305 | | or the Oklahoma Coordinate System: |
---|
1330 | 1306 | | (a) sources of water used, including the |
---|
1331 | 1307 | | location of waterbody di version, pump |
---|
1332 | 1308 | | location, and distri bution system, and |
---|
1333 | 1309 | | (b) location, type, and capacity of each storage |
---|
1334 | 1310 | | unit to be used for cultivation, and |
---|
1335 | 1311 | | (3) a proposed cultivation plan, which shall include |
---|
1336 | 1312 | | identification of all water sources used for |
---|
1337 | 1313 | | cultivation activities, and |
---|
1338 | 1314 | | i. evidence of insurance including, but not limited to: |
---|
1372 | 1347 | | (3) product liability insurance. |
---|
1373 | 1348 | | 7. The Authority may request additional information from the |
---|
1374 | 1349 | | applicant. |
---|
1375 | 1350 | | 8. The Authority may reject an appl ication for an annual |
---|
1376 | 1351 | | medical marijuana bu siness license if the requirements for a |
---|
1377 | 1352 | | temporary medical marijuana business license or any provision of the |
---|
1378 | 1353 | | Oklahoma Medical Marijuana and Patient Protection Ac t are not |
---|
1379 | 1354 | | satisfied. |
---|
1380 | 1355 | | 9. For purposes of this subsec tion, "financial interest" |
---|
1381 | 1356 | | concerning a medical marijuana business shall inc lude any |
---|
1382 | 1357 | | contractual agreements for profit sharing, sub contracting, or |
---|
1383 | 1358 | | similar financial arrangements; provided, that such discl osures |
---|
1384 | 1359 | | alone shall not automatically indicate owners hip of the license or |
---|
1385 | 1360 | | require disclosure a s an owner of the license . |
---|
1386 | 1361 | | E. 1. The Minus the fee of One Thousand Dollars ($1,000.00) |
---|
1387 | 1362 | | for a temporary medical marijuana transporter license, the annual, |
---|
1388 | 1363 | | nonrefundable fee for a medical marijuana transporter license shall |
---|
1389 | 1364 | | be Two Thousand Five Hundred Dollars ($2,500.00). |

1541 | 1513 | | separate license from the Authority for each type of |

1542 | 1514 | | grow operation and shall be subject to the licensing |
---|
1575 | 1546 | | cultivation of flowering marijuana plants. The |
---|
1576 | 1547 | | surface area of the plant canopy must be |
---|
1577 | 1548 | | calculated in square feet and measured and must |
---|
1578 | 1549 | | include all of the area within the boundaries |
---|
1579 | 1550 | | where the cultivation of the flowering marijuana |
---|
1580 | 1551 | | plants occurs. If the surface of the plant |
---|
1581 | 1552 | | canopy consists of noncontiguous areas, each |

1734 | 1702 | | E. F. All applicants seeking licensure or licensure renewal as |

1735 | 1703 | | a medical marijuana business shall comply with the following general |
---|

1737 | 1705 | | 1. All applications for licenses and registrations authorized |
---|
1738 | 1706 | | pursuant to this section shall be made upon forms prescribed by the |
---|
1739 | 1707 | | Authority; |
---|
1740 | 1708 | | 2. Each application shall ide ntify the city or county in which |
---|
1741 | 1709 | | the applicant seeks to obtain licensure as a medical marijuana |
---|
1742 | 1710 | | business; |
---|
1743 | 1711 | | 3. Applicants shall submit a complete application to the |
---|
1744 | 1712 | | Authority before the application may be accepted or considered; |
---|
1745 | 1713 | | 4. All applications shall be complete and accurate in every |
---|
1746 | 1714 | | detail; |
---|
1777 | 1744 | | 6. All applications shall be accompanied by a full remittance |
---|
1778 | 1745 | | for the whole amount of the application fees. Application fees are |
---|
1779 | 1746 | | nonrefundable; |
---|
1780 | 1747 | | 7. All applicants shall be approved for licensing review that, |
---|
1781 | 1748 | | at a minimum, meets the following criteria: |
---|
1782 | 1749 | | a. twenty-five (25) years of age or older, |
---|
1783 | 1750 | | b. if applying as an individual, proof that the applicant |
---|
1784 | 1751 | | is an Oklahoma resident pursuant to paragraph 11 of |
---|
1785 | 1752 | | this subsection, |
---|
1786 | 1753 | | c. if applying as an entity, proof that seventy-five |
---|
1787 | 1754 | | percent (75%) of all members, managers, executive |
---|
1788 | 1755 | | officers, partners, board members or any other form of |
---|
1789 | 1756 | | business ownership are Oklahoma residents pursuant to |
---|
1790 | 1757 | | paragraph 11 of this subsection, |
---|
1791 | 1758 | | d. if applying as an individual or entity, proof that the |
---|
1792 | 1759 | | individual or entity is registered to conduct business |
---|
1793 | 1760 | | in the State of Oklahoma, |
---|
1794 | 1761 | | e. disclosure of all ownership interests pursu ant to the |
---|
1795 | 1762 | | Oklahoma Medical Marijuana and Patient Protection Act, |
---|
1796 | 1763 | | and |
---|
1828 | 1794 | | convicted of a nonviolent felony in the last two (2) |
---|
1829 | 1795 | | years, or any other felony conviction within the last |
---|
1830 | 1796 | | five (5) years, is not a current inmate in the custody |
---|
1831 | 1797 | | of the Department of Corrections, or currently |
---|
1832 | 1798 | | incarcerated in a jail or correc tions facility; |
---|
1833 | 1799 | | 8. There shall be no limit to the number of medical marijuana |
---|
1834 | 1800 | | business licenses or categories that an individual or entity can |
---|
1835 | 1801 | | apply for or receive, although each application and each category |
---|
1836 | 1802 | | shall require a separate application and appli cation fee. A |
---|
1837 | 1803 | | commercial grower, processor and dispensary, or any combination |
---|
1838 | 1804 | | thereof, are authorized to share the same address or physical |
---|
1839 | 1805 | | location, subject to the restrictions set forth in the Oklahoma |
---|
1840 | 1806 | | Medical Marijuana and Patient Protection Act; |
---|
1841 | 1807 | | 9. All applicants for a medical marijuana business license, |
---|
1842 | 1808 | | research facility license or education facility license authorized |
---|
1843 | 1809 | | by the Oklahoma Medical Marijuana and Patient Protection Act, or for |
---|
1844 | 1810 | | a renewal of such license, shall undergo an Oklahoma criminal |
---|
1845 | 1811 | | history background check conducted by the Oklahoma State Bureau of |
---|
1846 | 1812 | | Investigation (OSBI) within thirty (30) days prior to the |
---|
1847 | 1813 | | application for the license, including: |
---|
1878 | 1843 | | d. all owners of an entity as defined by the Oklahoma |
---|
1879 | 1844 | | Medical Marijuana and Patient Protection Act; |
---|
1880 | 1845 | | 10. All applicable fees charged by the OSBI are the |
---|
1881 | 1846 | | responsibility of the applicant and shall not be higher than fees |
---|
1882 | 1847 | | charged to any other person or industry for such background checks; |
---|
1883 | 1848 | | 11. In order to be considered an Oklahoma resident for purposes |
---|

1991 | 1954 | | only be rejected or denied based on the applicant not meeting the |
---|
1992 | 1955 | | standards set forth in the provisions of subsection D of this |
---|
1993 | 1956 | | section for a temporary medical marijuana business license, the |
---|
1994 | 1957 | | provisions of the Oklahoma Medical Marijuana and Patient Protection |
---|

2042 | 2004 | | 4. Approval, rejection, denial or status-update letters shall |

2043 | 2005 | | be sent to the applicant in the same method the application was |

2044 | 2006 | | submitted to the Authority. |
---|
2045 | 2007 | | 5. Medical marijuana businesses issued a medical m arijuana |
---|
2046 | 2008 | | business license prior to the effective date of this a ct shall be |
---|
2047 | 2009 | | required to submit business -formation documents, financial |
---|
2048 | 2010 | | information, and insurance information pertainin g to the operations |
---|

2091 | 2052 | | 6. Medical marijuana businesses that have been issued a |

2092 | 2053 | | temporary and annual medical marijuana busin ess license pursuant to |

2093 | 2054 | | the provisions of subsectio n D of this section shall be required to |

2094 | 2055 | | annually submit update d business-formation documents, financial |
---|
2095 | 2056 | | information, and insurance information pertaining to the operations |
---|
2096 | 2057 | | of the medical marijuana busines s, as prescribed in subparagraphs a, |
---|
2097 | 2058 | | b, c, d, e, f, and i of paragraph 6 of subsection D of this section, |
---|
2098 | 2059 | | to the Authority when seeking renewal of the medical mar ijuana |
---|
2099 | 2060 | | business license. |
---|
2129 | 2089 | | medical marijuana waste disposal facility shall not be issued to or |
---|
2130 | 2090 | | held by: |
---|
2131 | 2091 | | 1. A person until all required fees have been paid; |
---|
2132 | 2092 | | 2. A person who has been convicted of a nonviolent felony |
---|
2133 | 2093 | | within two (2) years of the date of application, or within five (5) |
---|
2134 | 2094 | | years for any other felony; |
---|
2135 | 2095 | | 3. A corporation, if the criminal history of any of its |
---|
2136 | 2096 | | officers, directors or stockholders indicates that the officer, |
---|
2137 | 2097 | | director or stockholder has been convicted of a nonviolent felony |
---|
2138 | 2098 | | within two (2) years of the date of application, or within five (5) |
---|
2139 | 2099 | | years for any other felony; |
---|
2140 | 2100 | | 4. A person under twenty-five (25) years of age; |
---|
2141 | 2101 | | 5. A person licensed pursuant to this section who, during a |
---|
2142 | 2102 | | period of licensure, or who, at the time of application, has failed |
---|
2143 | 2103 | | to: |

2144 | 2104 | | a. file taxes, interest or penalties due related to a |
---|
2145 | 2105 | | medical marijuana business, or |
---|
2146 | 2106 | | b. pay taxes, interest or penalties due related to a |
---|
2147 | 2107 | | medical marijuana business; |
---|
2148 | 2108 | | 6. A sheriff, deputy sheriff, police officer or prosecuting |
---|
2149 | 2109 | | officer, or an officer or employee of the Authority or municipality; |
---|
2179 | 2138 | | 8. A person who was involved in the management or operations of |
---|
2180 | 2139 | | any medical marijuana business, medical marijuana research facility, |
---|
2181 | 2140 | | medical marijuana education facility or medical marijuana waste |
---|
2182 | 2141 | | disposal facility that, after the initiation of a disciplinary |
---|
2183 | 2142 | | action, has had a medical marijuana license revoked, not renewed, or |
---|
2184 | 2143 | | surrendered during the five (5) years preceding submission of the |
---|
2185 | 2144 | | application and for the following violations: |
---|
2186 | 2145 | | a. unlawful sales or purchases, |
---|
2187 | 2146 | | b. any fraudulent acts, falsification of records or |
---|
2188 | 2147 | | misrepresentation to the Authority, medical marijuana |
---|
2189 | 2148 | | patient licensees, caregiver licensees or medical |
---|
2190 | 2149 | | marijuana business licensees, |
---|
2191 | 2150 | | c. any grossly inaccurate or fraudulent reporting, |
---|
2192 | 2151 | | d. threatening or harming any medical marijuana patient, |
---|
2193 | 2152 | | caregiver, medical practitioner or employee of the |
---|
2194 | 2153 | | Authority, |
---|
2195 | 2154 | | e. knowingly or intentionally refus ing to permit the |
---|
2196 | 2155 | | Authority access to premises or records, |
---|
2197 | 2156 | | f. using a prohibited, hazardous substance for processing |
---|
2198 | 2157 | | in a residential area, |
---|
2199 | 2158 | | g. criminal acts relating to t he operation of a medical |
---|
2200 | 2159 | | marijuana business, or |
---|
2230 | 2188 | | I. J. In investigating the qualifications of an applicant or a |
---|
2231 | 2189 | | licensee, the Authority and municipalities may have access to |
---|
2232 | 2190 | | criminal history record information furnished by a criminal justice |
---|
2233 | 2191 | | agency subject to any restrictions imposed by such an agency. |
---|
2234 | 2192 | | J. K. The failure of an applicant or licensee to provide the |
---|
2235 | 2193 | | requested information by the Authority deadline may be grounds for |
---|
2236 | 2194 | | denial of the application. |
---|
2237 | 2195 | | K. L. All applicants and licensees shall submit information to |
---|
2238 | 2196 | | the Authority in a full, faithful, truthful and fair manner. The |
---|
2239 | 2197 | | Authority may recommend denial of an application where the ap plicant |
---|
2240 | 2198 | | or licensee made misstatements, omissions, misrepresentations or |
---|
2241 | 2199 | | untruths in the application or in connection with the background |
---|
2242 | 2200 | | investigation of the applicant. This type of conduct may be grounds |
---|
2243 | 2201 | | for administrative action against the applicant or licensee. Typos |
---|
2244 | 2202 | | and scrivener errors shall not be grounds for denial. |
---|
2245 | 2203 | | L. M. A licensed medical marijuana business premises shall be |
---|
2246 | 2204 | | subject to and responsible for compliance with applicable provisions |
---|
2247 | 2205 | | consistent with the zoning where such business is located as |
---|
2248 | 2206 | | described in the most recent versions of the Oklahoma Uniform |
---|
2249 | 2207 | | Building Code, the International Building Code and the International |
---|
2250 | 2208 | | Fire Code, unless granted an exemption by a municipality or |
---|
2251 | 2209 | | appropriate code enforcement entity. |
---|
2281 | 2238 | | marijuana waste disposal facility licensees shall pay the relevant |
---|
2282 | 2239 | | licensure fees prior to receiving licensure to operate. |
---|
2283 | 2240 | | N. O. A medical marijuana business, medical marijuana rese arch |
---|
2284 | 2241 | | facility, medical marijuana education facility or medical marijuana |
---|
2285 | 2242 | | waste disposal facility that attempts to renew its license after the |
---|
2286 | 2243 | | expiration date of the license shall pay a late renewal fee in an |
---|
2287 | 2244 | | amount to be determined by the Authority to reinstate the license. |
---|
2288 | 2245 | | Late renewal fees are nonrefundable. A license that has been |
---|
2289 | 2246 | | expired for more than ninety (90) days shall not be renewed. |
---|
2290 | 2247 | | O. P. No medical marijuana business, medical marijuana research |
---|
2291 | 2248 | | facility, medical marijuana education fa cility or medical marijuana |
---|
2292 | 2249 | | waste disposal facility shall possess, sell or transfer medical |
---|
2293 | 2250 | | marijuana or medical marijuana products without a valid, unexpired |
---|
2294 | 2251 | | license issued by the Authority. |
---|
2295 | 2252 | | SECTION 7. AMENDATORY 63 O.S. 2021, Section 427.16, as |

2339 | 2295 | | may also be issued to qualifying appli cants who are registered with |

2340 | 2296 | | the Secretary of State and otherwise meet the requirements for a |

2341 | 2297 | | medical marijuana business license set forth in Section 427.14 of |
---|
2342 | 2298 | | this title, the Oklahoma Medical Marijuana and Pat ient Protection |
---|
2343 | 2299 | | Act and the requirements set forth in this section to provide |

2344 | 2300 | | logistics, distribution and storage of medical marijuana, medical |
---|
2345 | 2301 | | marijuana concentrate and medical marijuana products. |
---|
2346 | 2302 | | D. A medical marijuana transporter license shall be valid for |
---|
2347 | 2303 | | one (1) year and shall not be transferred with a change of |
---|
2348 | 2304 | | ownership. A licensed medical marijuana transporter shall be |
---|
2349 | 2305 | | responsible for all medical marijuana, medical marijuana concentrate |
---|
2350 | 2306 | | and medical marijuana products once the transporter takes con trol of |
---|
2351 | 2307 | | the product. |
---|
2352 | 2308 | | E. A transporter license shall be required for any person or |
---|
2353 | 2309 | | entity to transport or transfer medical marijuana, medical marijuana |
---|
2383 | 2338 | | medical marijuana business to a medical marijuana research facility |
---|
2384 | 2339 | | or medical marijuana education facility. |
---|
2385 | 2340 | | F. A medical marijuana transporter licensee may contract with |
---|
2386 | 2341 | | multiple licensed medical marijuana businesses. |
---|
2387 | 2342 | | G. A medical marijuana transporter may maintain a licensed |
---|
2388 | 2343 | | premises to temporarily store medical marijuana, medical marijuana |
---|
2389 | 2344 | | concentrate and medical marijuana products and to use as a |
---|
2390 | 2345 | | centralized distribution point. A medical marijuana transporter may |
---|
2391 | 2346 | | store and distribute medical marijuana, medical marijuana |
---|
2392 | 2347 | | concentrate and medical marijuana products from the licensed |
---|
2393 | 2348 | | premises. The licensed premises shall meet all security |
---|
2394 | 2349 | | requirements applicable to a medical marijuana business. |
---|
2395 | 2350 | | H. A medical marijuana transp orter licensee shall use the seed- |
---|
2396 | 2351 | | to-sale tracking system developed pursuant to the Oklahoma Medical |
---|
2397 | 2352 | | Marijuana and Patient Protection Act to create shipping manifests |
---|
2398 | 2353 | | documenting the transport of medical marijuana, medical marijuana |
---|
2399 | 2354 | | concentrate and medical marijuana products throughout the state. |
---|
2400 | 2355 | | I. A licensed medical marijuana transporter may maintain and |
---|
2401 | 2356 | | operate one or more warehouses in the state to handle medical |
---|
2402 | 2357 | | marijuana, medical marijuana concentrate and medical marijuana |
---|
2403 | 2358 | | products. Each location sh all be registered and inspected by the |
---|
2404 | 2359 | | Authority prior to its use. |
---|

2444 | 2398 | | licensed medical marijuana business, licensed medical marijuana |
---|
2445 | 2399 | | research facility or licensed medical marijuana education facility. |
---|
2446 | 2400 | | The Authority shall administer and enforce the provisions of this |
---|
2447 | 2401 | | section concerning transportation. |
---|
2448 | 2402 | | L. The Authority shall issue a transporter agent license to |
---|
2449 | 2403 | | individual agents, employees, officers or owners of a transporter |
---|
2450 | 2404 | | license in order for the individual to qualify to transport medical |
---|
2451 | 2405 | | marijuana, medical marijuana concentrate or medical marijuana |
---|
2452 | 2406 | | products. |

2453 | 2407 | | M. The annual fee for a transporter agent license shall be |
---|
2454 | 2408 | | Twenty-five Dollars ($25.00) and shall be paid by the transporter |
---|
2484 | 2437 | | N. The Authority shall issue each transporter agent a registry |

2485 | 2438 | | identification card within thirty (30) days of receipt of: |

2486 | 2439 | | 1. The name, address and date of birth of the person; |
---|

2494 | 2447 | | Oklahoma State Bureau of Investigation, paid for by the applicant. |

2495 | 2448 | | O. If the transporter agent application is denied, the |
---|
2496 | 2449 | | Authority shall notify the transporter in writing of the reason for |
---|
2497 | 2450 | | denying the registry identification card. |
---|
2498 | 2451 | | P. A registry identification card for a transporter shall |
---|
2499 | 2452 | | expire one (1) year after the date of issuance or upon notification |
---|
2500 | 2453 | | from the holder of the transporter l icense that the transporter |
---|
2501 | 2454 | | agent ceases to work as a transporter. |
---|
2502 | 2455 | | Q. The Authority may revoke the registry identification card of |
---|
2503 | 2456 | | a transporter agent who know ingly violates any provision of this |
---|
2504 | 2457 | | section, and the transporter is subject to any o ther penalties |
---|
2505 | 2458 | | established by law for the violation. |
---|
