104	104	SECTION 1. NEW LAW A new section of law to be codified

107	107	This act shall be known and may be cited as the "Campus
108	108	Accountability and Safety Act".
109	109	SECTION 2. NEW LAW A new section of law to be codified
110	110	in the Oklahoma Statute s as Section 3260.1 of Title 70, unless there
111	111	is created a duplication in numbering, reads as follows:
112	112	This act shall apply to each postseconda ry education institution
113	113	that receives any Title IV funding from the United States Department
114	114	of Education.
115	115	SECTION 3. NEW LAW A new s ection of law to be codified
116	116	in the Oklahoma Statutes as Sec tion 3260.2 of Title 70, unless there
117	117	is created a duplication in numbering, reads as follows:
118	118	For the purposes of this act, the following terms shall have the
119	119	following meanings unless the contex t clearly indicates otherwise:
120	120	1. "Institution" means a state educational institution as
121	121	defined in Section 3102 of Title 70 of the Oklahoma Statutes ;
122	122	2. "President" means the president of the system of the
123	123	respective institution ;
124	124	3. "Sexually oriented criminal offense" means any sexual
125	125	assault as defined in Section 112 of Title 21 of the Oklahoma
126	126	Statutes; and

154	154	4. "Title IX coordinator" means the individual designated a s a
155	155	responsible employee in Section 106. 8(a) of Title 34, Code of
156	156	Federal Regulations, as such section is in effect on the date of
157	157	enactment of this act.
158	158	SECTION 4. NEW LAW A new section of law to be codified
159	159	in the Oklahoma Statutes as Section 3260.3 of Title 70, unless there
160	160	is created a duplication in numbering, reads as follows:
161	161	A. Each institution and law enforcemen t and criminal justice
162	162	agency located within the county of the campus of the institution
163	163	shall enter into a memorandum of understanding to clearly delinea te
164	164	responsibilities and share information in accordance with applicable
165	165	federal and state confidential ity laws, including but not limited to
166	166	trends about sexually oriented criminal offenses occurring against
167	167	students of the institution.
168	168	B. The Oklahoma State Regents for Higher Education Uniform
169	169	Policy on Sexual Assault shall require that the memorandum of
170	170	understanding, as describ ed in subsection A of this section, be
171	171	updated every two (2) years.
172	172	C. Each memorandum of understanding entered into pursuant t o
173	173	this act shall include:
174	174	1. Delineation and sharing protocols of investigative
175	175	responsibilities;

203	203	2. Protocols for investigati ons, including standards for
204	204	notification and communication and measures to promote evidence
205	205	preservation;
206	206	3. Agreed-upon training and requirements for the partie s to the
207	207	memorandum of understanding on issues related to sexually oriented
208	208	criminal offenses for the purpose of sharing informatio n and
209	209	coordinating training to the extent possible; and
210	210	4. A method of sharing general in formation about sexually
211	211	oriented criminal offenses occurring within the jurisdiction of the
212	212	parties to the memorandum of unders tanding in order to improve
213	213	campus safety.
214	214	D. The local law enforcement agency shall include information
215	215	on its police report regarding the status of the alleged victim as a
216	216	student at an institution as defined in this act.
217	217	E. The institution shall not b e held liable if the local law
218	218	enforcement agency refuses to enter into a memorandum of
219	219	understanding as required by this section.
220	220	SECTION 5. NEW LAW A new section of law to be codified
221	221	in the Oklahoma Statu tes as Section 3260.4 of Title 70, unless there
222	222	is created a duplication in numbering, reads as follows:
223	223	A. 1. The Oklahoma State Regents for Higher Ed ucation shall
224	224	establish the Uniform Policy on Sexual Assault, which shall include
225	225	uniform policies and best practices to implement measures to address
226	226	the reporting of sexually oriented criminal offenses on institution

254	254	campuses, the prevention of such crimes, and the medical and mental
255	255	health care needed for these alleged victims that includes
256	256	confidential advisors. The institution shall designate individuals
257	257	who shall serve as confidentia l advisors, such as health care staff,
258	258	clergy, staff of a women's center, or other such categories. Such
259	259	designation shall not preclude the institution from partnering with
260	260	national, state, or local victim services organizations to serve as
261	261	confidential advisors or to serve in other confidential roles.
262	262	2. The confidential advisor shall complete the training
263	263	requirements as provided in this act.
264	264	3. Not later than January 1, 2024, the Attorney General, in
265	265	collaboration with the State Regents, shall develop online training
266	266	materials, in addition to the training required under this act, for
267	267	the training of confidential advisors.
268	268	4. The confidential advisor shall inform the alleged victim of
269	269	the following:
270	270	a. the rights of the alleged victim under federal and
271	271	state law and the policies of the institution ,
272	272	b. the alleged victim's reporting options, including the
273	273	option to notify the institution, the option to notify
274	274	local law enforcement, and any o ther reporting
275	275	options,
276	276	c. if reasonably known, the potential consequences of the
277	277	reporting options provided in th is act,

307	307	e. the process of investigation and adjudication of the
308	308	criminal justice system,
309	309	f. the limited jurisdiction, scop e, and available
310	310	sanctions of the institutional student disciplinary
311	311	proceeding, and that it should not be considered a
312	312	substitute for the criminal justice process ,
313	313	g. potential reasonable accommodations that the
314	314	institution may provide to an alleged victi m, and
315	315	h. the name and location of the nearest medica l facility
316	316	where an alleged victim may have a rape kit
317	317	administered by an individual trained in sexual
318	318	assault forensic med ical examination and evidence
319	319	collection, and information on transportation opti ons
320	320	and available reimbursement for a visit to such
321	321	facility.
322	322	5. The confidential advisor may, as appropriate, serv e as a
323	323	liaison between an alleged victim and the ins titution or local law
324	324	enforcement, when directed to do so in writing by an alleged victi m
325	325	who has been fully and accurately informed about wh at procedures
326	326	shall occur if information is shared, and assist an alleged victim
327	327	in contacting and reporti ng to a responsible employee or local law
328	328	enforcement.

356	356	6. The confidential advisor shall be auth orized by the
357	357	institution to liaise with appropriate staff at the institution to
358	358	arrange reasonable accommodations through the institution to allow
359	359	the alleged victim to change living arrangements or class schedules,
360	360	obtain accessibility services, or arran ge other accommodations.
361	361	7. The confidential advisor shall be authorized to accompany
362	362	the alleged victim, when requested to do so by the alleged victim,
363	363	to interviews and other proceedings of a campus investigation and
364	364	institutional disciplinary proceedings.
365	365	8. The confidential advisor shall advise the all eged victim of,
366	366	and provide written information regarding, both the alleged victim's
367	367	rights and the institution's responsibilities regarding orders of
368	368	protection, no-contact orders, restraining orders, o r similar lawful
369	369	orders issued by a court of competen t jurisdiction or by the
370	370	institution.
371	371	9. The confidential advi sor shall not be obligated to report
372	372	crimes to the institution or law enforcement in a way that
373	373	identifies an alleged victim or an accused individual, unless
374	374	otherwise required to do so by law. The confidential advisor shall,
375	375	to the extent authorized unde r law, provide confidential services to
376	376	students. Any requests for accommodations, as provided in paragraph
377	377	6 of this subsection, made by a confidential advisor shall not
378	378	trigger an investigat ion by the institution.

406	406	10. No later than the beginning of the 2023-2024 academic year,
407	407	the institution shall appoint an adequate number of confidential
408	408	advisors. The State Regents shall determine t he adequate number of
409	409	confidential advisors for an institution, based upon its size, no
410	410	later than January 1, 2024.
411	411	11. Each institution that enrolls fewer than five thousand
412	412	(5,000) students may partner with another institution in its system
413	413	or region to provide the services described in this subsection.
414	414	However, this paragraph shall not absolve the institution of its
415	415	obligations under this act.
416	416	12. Each institution may offer the same accommodations to the
417	417	accused that are hereby required to be offered to the alleged
418	418	victim.
419	419	B. The institution shall list on its website:
420	420	1. The contact information for obtaining a confidential
421	421	advisor;
422	422	2. Reporting options for alleged victims of a sexually oriented
423	423	criminal offense;
424	424	3. The process of investigation and disciplinary proceedings of
425	425	the institution;
426	426	4. The process of investigation and adjudication of the
427	427	criminal justice system;
428	428	5. Potential reasonable accommodations that the institution may
429	429	provide to an alleged victim ;

457	457	6. The telephone number and website address for a local, state,
458	458	or national hotline providing information t o sexual violence
459	459	victims, which shall be upd ated on a timely basis; and
460	460	7. The name and location of the nearest medical facility where
461	461	an individual may have a rape kit administer ed by an individual
462	462	trained in sexual assault forensic medical examination and evidence
463	463	collection, and information on transportation options and available
464	464	reimbursement for a vis it to such facility.
465	465	C. The institution may provide an online reporting system to
466	466	collect anonymous disclosures of crimes and track patterns of crime
467	467	on campus. An individual may submit a confide ntial report about a
468	468	specific crime to the institution using the online reporting system.
469	469	If the institution uses an online reporting sys tem, the online
470	470	system shall also include information regarding how to rep ort a
471	471	crime to a responsible employee and law enforcement and how to
472	472	contact a confidential advisor.
473	473	D. The institution shall provide an amnesty policy f or any
474	474	student who reports, in good faith, sexual violence to the
475	475	institution. Such student shall not be sanctioned by the
476	476	institution for a nonvi olent student conduct violation, such as
477	477	underage drinking, that is revealed in the course of such a report.
478	478	E. Not later than January 1 , 2024, the Oklahoma State Regents
479	479	for Higher Education , in coordination with the Attorney General and
480	480	in consultation with state or local victim services organizations,

509	509	involved in implementing an institution 's student grievance
510	510	procedures, including each individual who is responsible for
511	511	resolving complaints of reported sex offenses or sexual misconduct
512	512	policy violations, and each employee of an institution who ha s
513	513	responsibility for conducting an interview with an all eged victim of
514	514	a sexually oriented criminal offense. Each institution shall ensure
515	515	that the individuals and employees receive the training described in
516	516	this subsection no later than the beginnin g of the 2024-2025
517	517	academic year.
518	518	F. The Oklahoma State Regents for Higher Education Uniform
519	519	Policy on Sexual Assault shall require that institutions communicate
520	520	with each other regarding transfer of students against whom
521	521	disciplinary action has been taken because of a code of conduct
522	522	violation relating to sexually oriented criminal offenses. The
523	523	State Regents' Uniform Policy on Sexual Assault shall require that
524	524	institutions withhold transcripts of students seeking a transfer
525	525	with pending disciplinary action relative to sexually oriented
526	526	criminal offenses, until such investigation and ad judication is
527	527	complete.
528	528	SECTION 6. NEW LAW A new section of law to be codified

558	558	A. When funding is made available, each state educational
559	559	institution shall administer an annual, anonymous sexual assault
560	560	climate survey to its students.
561	561	B. Participation in the sexual assault climate survey shall be
562	562	voluntary. No student shall be required or coerced to particip ate
563	563	in the survey nor shall any student face retribution or negative
564	564	consequence of any kind for declining to participate.
565	565	C. The Oklahoma State Regents for Higher Education shall
566	566	develop the survey and establish procedures for the administration
567	567	of the survey and shall use the survey developed by the Center on
568	568	Violence Against Women and Children at the Rutgers University S chool
569	569	of Social Work as a model.
570	570	D. Each state educational institution shall:
571	571	1. Administer the survey to students who choose to participate;
572	572	and
573	573	2. Report school-specific results of the survey to the Board of
574	574	Regents.
575	575	E. The Oklahoma State Regents for Higher Education shall:
576	576	1. Submit a written report not later than September 1 of each
577	577	year regarding the survey results of each state educational
578	578	institution and the state as a whole to t he Governor and the Senate
579	579	and House of Representatives committees on education for the
580	580	previous academic year; and
