6154 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6255 SECTION 1. AMENDATORY Section 1, Chapter 11, O.S.L. 2022
6356 (63 O.S. Supp. 2023, Section 1-731.4), is amended to read as
6457 follows:
6558 Section 1-731.4 A. As used in this section:
6659 1. The terms "abortion" and "unborn child" shall have the same
6760 meaning as provided by Section 1 -730 of Title 63 of the Oklahoma
6861 Statutes; and
62+2. "Medical emergency" means a condition which cannot be
63+remedied by delivery of the child in which an abortion is necessary
64+to preserve the life of a pregnant woman w hose life is endangered by

96-2. "Medical emergency" means a condition which cannot be
97-remedied by delivery of the child in which an abortion is necessary
98-to preserve the life of a pregnant woman w hose life is endangered by
9991 a physical disorder, p hysical illness or physical injury including a
10092 life-endangering physical condition caused by or a rising from the
10193 pregnancy itself.
10294 B. 1. Notwithstanding any other provision of law, a person
10395 shall not purposely perform or attempt to perform an abortion except
10496 to save unless necessary to preserve the life of a pregnant woman in
10597 a medical emergency. The person performing or attempting to perform
10698 an abortion shall prioritize preserving both the life of the
10799 pregnant woman and the life of the baby, if however, the person
108100 judges the birth of the baby to be a threat to the life of the
109101 pregnant woman, then a n abortion may be performed to preserve the
110102 life of the pregnant woman.
111103 2. A person convicted of p erforming or attempting to perform an
112104 abortion shall be guilty of a felony punishable by a fine not to
113105 exceed One Hundred Thousand Dollars ($100,000.00), or by confinement
114106 in the custody of the D epartment of Correcti ons for a term not to
115107 exceed ten (10) years, or by both such fine and imprisonment.
116108 3. This section does no t:
117109 a. authorize the charging or conviction of a wom an with
118110 any criminal offense in the death o f her own unborn
119111 child, or
112+b. prohibit the sale, use, prescription or administration
113+of a contraceptive measure, drug or chemical if the

147-b. prohibit the sale, use, prescription or administration
148-of a contraceptive measure, drug or chemical if the
149-contraceptive measure, dr ug or chemical is
150141 administered before the time when a pregnancy could be
151142 determined through co nventional medical testing and if
152143 the contraceptive measure, drug or chemical is sold,
153144 used, prescribed or administered in accordance with
154145 manufacturer instructio ns.
155146 4. It is an affirmative defense to prosecution under this
156147 section if a licensed physician provides medical treatment to a
157148 pregnant woman which results in the accidental or unintentional
158149 injury or death to the unborn child.
159150 SECTION 2. It being immediately necessary for the preservation
160151 of the public peace, health or safety, an emergency is hereby
161152 declared to exist, by reason where of this act shall take effect and
162153 be in full force from and after its passage an d approval.
