61 | 54 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

62 | 55 | | SECTION 1. AMENDATORY Section 1, Chapter 11, O.S.L. 2022 |

63 | 56 | | (63 O.S. Supp. 2023, Section 1-731.4), is amended to read as |
---|

65 | 58 | | Section 1-731.4 A. As used in this section: |
---|
66 | 59 | | 1. The terms "abortion" and "unborn child" shall have the same |
---|
67 | 60 | | meaning as provided by Section 1 -730 of Title 63 of the Oklahoma |
---|
68 | 61 | | Statutes; and |
---|
99 | 91 | | a physical disorder, p hysical illness or physical injury including a |
---|
100 | 92 | | life-endangering physical condition caused by or a rising from the |
---|
101 | 93 | | pregnancy itself. |
---|
102 | 94 | | B. 1. Notwithstanding any other provision of law, a person |
---|
103 | 95 | | shall not purposely perform or attempt to perform an abortion except |
---|
104 | 96 | | to save unless necessary to preserve the life of a pregnant woman in |
---|
105 | 97 | | a medical emergency. The person performing or attempting to perform |
---|
106 | 98 | | an abortion shall prioritize preserving both the life of the |
---|
107 | 99 | | pregnant woman and the life of the baby, if however, the person |
---|
108 | 100 | | judges the birth of the baby to be a threat to the life of the |
---|
109 | 101 | | pregnant woman, then a n abortion may be performed to preserve the |
---|
110 | 102 | | life of the pregnant woman. |
---|
111 | 103 | | 2. A person convicted of p erforming or attempting to perform an |
---|
112 | 104 | | abortion shall be guilty of a felony punishable by a fine not to |
---|
113 | 105 | | exceed One Hundred Thousand Dollars ($100,000.00), or by confinement |
---|
114 | 106 | | in the custody of the D epartment of Correcti ons for a term not to |
---|
115 | 107 | | exceed ten (10) years, or by both such fine and imprisonment. |
---|
116 | 108 | | 3. This section does no t: |
---|
117 | 109 | | a. authorize the charging or conviction of a wom an with |
---|
118 | 110 | | any criminal offense in the death o f her own unborn |
---|
119 | 111 | | child, or |
---|
150 | 141 | | administered before the time when a pregnancy could be |
---|
151 | 142 | | determined through co nventional medical testing and if |
---|
152 | 143 | | the contraceptive measure, drug or chemical is sold, |
---|
153 | 144 | | used, prescribed or administered in accordance with |
---|
154 | 145 | | manufacturer instructio ns. |
---|
155 | 146 | | 4. It is an affirmative defense to prosecution under this |
---|
156 | 147 | | section if a licensed physician provides medical treatment to a |
---|
157 | 148 | | pregnant woman which results in the accidental or unintentional |
---|
158 | 149 | | injury or death to the unborn child. |
---|
159 | 150 | | SECTION 2. It being immediately necessary for the preservation |
---|
160 | 151 | | of the public peace, health or safety, an emergency is hereby |
---|
161 | 152 | | declared to exist, by reason where of this act shall take effect and |
---|
162 | 153 | | be in full force from and after its passage an d approval. |
