	54	+	transport items preserved as provided for in subsection C of this
	55	+	section from a school site to a centralized location within the
	56	+	school district or to local law enforcement offices for lawful
	57	+	disposal. While in transport, the designated school personnel shall
	58	+	carry their school identification and a letter from the
	59	+	superintendent confirming their authority to transport the items for
	60	+	disposal. All items transported for disposal pursuant to this
	61	+	subsection shall be transported in a locked container.”

33	157		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	158		SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -102, is
36	159		amended to read as follows:

38	160		Section 24-102. A. The superintendent, principal, teacher, or
39	161		security personnel of any public school in the State of Oklahoma ,
40	162		upon reasonable suspicion, shall have the authority to detain and
41	163		search or authorize the search, of an y pupil or property in the
42	164		possession of the pupil when said the pupil is on any school
43	165		premises, or while in transit under the authority of the school , or
44	166		while attending any function sponsored or authorized by the school,
45	167		for dangerous weapons, controlle d dangerous substances, as defined
46		-	in the Uniform Controlled Dangerous Substances Act, intoxicating ENR. H. B. NO. 1634 Page 2

	194	+	in the Uniform Controlled Dangerous Substances Act, intoxicating
47	195		alcoholic beverages, low-point beer, as defined by Section 163.2 of
48	196		Title 37 of the Oklahoma St atutes in the Oklahoma Alcoholic Beverage
49	197		Control Act, or for missing or stolen property if said the property
50	198		be is reasonably suspected to have been taken from a pu pil, a school
51	199		employee or the school during sch ool activities. The search shall
52	200		be conducted by a person of the same sex as the person being
53	201		searched and shall be witnessed by at least one other authorized
54	202		person, said person to b e of the same sex if prac ticable.

56	203		B. The extent of any search conducted pursuant to this section
57	204		shall be reasonably related to the objective of the search and not
58	205		excessively intrusive in light of the age and sex of the student and
59	206		the nature of the infracti on. In no event shal l a strip search of a
60	207		student be allowed. No s tudent's clothing, except cold weather
61	208		outerwear, shoes, and hand and head coverings, except religious head
62	209		coverings, shall be removed prior to or dur ing the conduct of any
63	210		warrantless search.

65	211		C. The superintendent, principal, teacher, or security
66	212		personnel searching or authorizing the search shal l have authority
67	213		to detain the pupil to be searched and to preserve any dangerous
68	214		weapons, controlled dange rous substances, intoxicating alcoholic
69	215		beverages, low-point beer, or missing or stolen property that mig ht
70	216		be in the pupil's possession including th e authority to authorize
71	217		any other persons they deem necessary to restrain such p upil or to

72	244		preserve any dangerous weapons, controlled dangerous substances,
73	245		intoxicating alcoholic beverages, low-point beer, or missing or
74	246		stolen property. Students found to be in possession of such an item
75	247		shall be subject to the provisions of Section 2 4-101.3 of this
76	248		title.

78	249		D. Pupils shall not have any reasonable expectation of priva cy
79	250		towards school administrators or teachers in the contents of a
80	251		school locker, desk, or other school property. School personnel
81	252		shall have access to school lockers, desk s, and other school
82	253		property in order to properly supervise the welfare of pupils.
83	254		School lockers, desks, and other areas of schoo l facilities may be
84	255		opened and examined by school officials at any time and no reason
85	256		shall be necessary for such search. Sc hools shall inform pupils in
86	257		the student discipline code that they have no reasonabl e expectation
87	258		of privacy rights towards school officials in school lockers, desks,
88	259		or other school property.
