45 | 167 | | for dangerous weapons, controlle d dangerous substances, as defined |
---|
47 | 195 | | alcoholic beverages, low-point beer, as defined by Section 163.2 of |

48 | 196 | | Title 37 of the Oklahoma St atutes in the Oklahoma Alcoholic Beverage |

49 | 197 | | Control Act, or for missing or stolen property if said the property |

50 | 198 | | be is reasonably suspected to have been taken from a pu pil, a school |

51 | 199 | | employee or the school during sch ool activities. The search shall |

52 | 200 | | be conducted by a person of the same sex as the person being |
---|
53 | 201 | | searched and shall be witnessed by at least one other authorized |

54 | 202 | | person, said person to b e of the same sex if prac ticable. |

56 | 203 | | B. The extent of any search conducted pursuant to this section |
---|
57 | 204 | | shall be reasonably related to the objective of the search and not |
---|
58 | 205 | | excessively intrusive in light of the age and sex of the student and |
---|
59 | 206 | | the nature of the infracti on. In no event shal l a strip search of a |
---|
60 | 207 | | student be allowed. No s tudent's clothing, except cold weather |
---|
61 | 208 | | outerwear, shoes, and hand and head coverings, except religious head |
---|
62 | 209 | | coverings, shall be removed prior to or dur ing the conduct of any |
---|
63 | 210 | | warrantless search. |

65 | 211 | | C. The superintendent, principal, teacher, or security |
---|
66 | 212 | | personnel searching or authorizing the search shal l have authority |
---|
67 | 213 | | to detain the pupil to be searched and to preserve any dangerous |

68 | 214 | | weapons, controlled dange rous substances, intoxicating alcoholic |
