53+“E. The superintendent may designate school personnel to
54+transport items preserved as provided for in subsection C of this
55+section from a school site to a centralized location within the
56+school district or to local law enforcement offices for lawful
57+disposal. While in transport, the designated school personnel shall
58+carry their school identification and a letter from the
59+superintendent confirming their authority to transport the items for
60+disposal. All items transported for disposal pursuant to this
61+subsection shall be transported in a locked container.”

33157 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35158 SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -102, is
36159 amended to read as follows:

38160 Section 24-102. A. The superintendent, principal, teacher, or
39161 security personnel of any public school in the State of Oklahoma ,
40162 upon reasonable suspicion, shall have the authority to detain and
41163 search or authorize the search, of an y pupil or property in the
42164 possession of the pupil when said the pupil is on any school
43165 premises, or while in transit under the authority of the school , or
44166 while attending any function sponsored or authorized by the school,
45167 for dangerous weapons, controlle d dangerous substances, as defined
46-in the Uniform Controlled Dangerous Substances Act, intoxicating ENR. H. B. NO. 1634 Page 2

194+in the Uniform Controlled Dangerous Substances Act, intoxicating
47195 alcoholic beverages, low-point beer, as defined by Section 163.2 of
48196 Title 37 of the Oklahoma St atutes in the Oklahoma Alcoholic Beverage
49197 Control Act, or for missing or stolen property if said the property
50198 be is reasonably suspected to have been taken from a pu pil, a school
51199 employee or the school during sch ool activities. The search shall
52200 be conducted by a person of the same sex as the person being
53201 searched and shall be witnessed by at least one other authorized
54202 person, said person to b e of the same sex if prac ticable.

56203 B. The extent of any search conducted pursuant to this section
57204 shall be reasonably related to the objective of the search and not
58205 excessively intrusive in light of the age and sex of the student and
59206 the nature of the infracti on. In no event shal l a strip search of a
60207 student be allowed. No s tudent's clothing, except cold weather
61208 outerwear, shoes, and hand and head coverings, except religious head
62209 coverings, shall be removed prior to or dur ing the conduct of any
63210 warrantless search.

65211 C. The superintendent, principal, teacher, or security
66212 personnel searching or authorizing the search shal l have authority
67213 to detain the pupil to be searched and to preserve any dangerous
68214 weapons, controlled dange rous substances, intoxicating alcoholic

72244 preserve any dangerous weapons, controlled dangerous substances,
73245 intoxicating alcoholic beverages, low-point beer, or missing or
74246 stolen property. Students found to be in possession of such an item
75247 shall be subject to the provisions of Section 2 4-101.3 of this
76248 title.

78249 D. Pupils shall not have any reasonable expectation of priva cy
79250 towards school administrators or teachers in the contents of a
80251 school locker, desk, or other school property. School personnel
81252 shall have access to school lockers, desk s, and other school
82253 property in order to properly supervise the welfare of pupils.
83254 School lockers, desks, and other areas of schoo l facilities may be
84255 opened and examined by school officials at any time and no reason
85256 shall be necessary for such search. Sc hools shall inform pupils in
86257 the student discipline code that they have no reasonabl e expectation
87258 of privacy rights towards school officials in school lockers, desks,
88259 or other school property.
