1545 An Act relating to medical loan repayment; amending
1646 63 O.S. 2021, Section 1 -2721, as amended by Section
1747 3, Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023,

3563 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3764 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2721, as
3865 amended by Section 3, Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023,
3966 Section 1-2721), is amended to read as follows:

4167 Section 1-2721. A. 1. The Health Care Workforce Training
4268 Commission shall administer the Oklahoma Medical Loan Repayment

4597 2. For the purposes of this section, "primary care physicians"
46-shall mean physicians practicing in family medicine, geriatrics, ENR. H. B. NO. 1696 Page 2
98+shall mean physicians practicing in family medicine, geriatr ics,
4799 general internal medicine, general pediatrics,
48100 obstetrics/gynecology, or emergency medicine, or general surgery .

50101 3. For the purposes of this sect ion, "health center" shall mean
51102 a federally qualified health center Federally Qualified Health
52103 Center as defined by 42 U.S.C., Section 1905(1)(2)(B).

54104 4. For the purposes of this section, "teaching health center"
55105 shall mean a health center that supports th e residencies of primary
56106 care physicians within the operations of the health center.

58107 5. The Program program, depending upon and limited to available
59108 funding, shall provide educational loan repayment assistance to
60109 Oklahoma-licensed primary care physicians and, physician assistants ,
61110 and certified nurse practitioners who agree to establish a practice
62111 in a community located in Oklahoma approved by the Commission.

64112 6. Each award of educational loan repayment assistance shall be
65113 for a contracted period and shall be distributed to the participant
66114 by drafts made payable to the participant at the end of each
67115 contract year with disbursements not to exceed an amount to be
68116 established annually by the Commission. Prior to any disbursement,
69117 the Commission shall certify and properly review reports submitted
70118 by the participating physician or, physician assistant, or certified
71119 nurse practitioner detailing performance of activities in accordance
72120 with the Program program.

74148 7. The Commission shall review the performance in the Program
75149 program of the participating physician or, physician assistant, or
76150 certified nurse practitioner and determine whether an award may be
77151 granted for additional years pursuant to rules promulgated by the
78152 Commission.

80153 B. The physicians and, physician assistants, and certified
81154 nurse practitioners entering the Program program each year shall
82155 agree to provide medical care and services in areas designated by
83156 the Commission to provide medical care and services to Medicaid
84157 recipients as authorized by the Okla homa Health Care Authority.

86158 C. A physician or, physician assistant, or certified nurse
87159 practitioner shall be eligible to participate in the loan repayment
88160 program if the individual:

90161 1. Is a physician that, physician assistant, or certified nurse
91-practitioner who holds a current Oklahoma medical license; ENR. H. B. NO. 1696 Page 3

162+practitioner who holds a current Oklahoma medical license;
93163 2. Is a new primary care graduate physician or, physician
94164 assistant, or certified nurse practitioner . Preference will be
95165 given to graduates of the primary care residency programs affiliated
96166 with the Oklahoma State University College of Osteopathic Medicine,
97167 the University of Oklahoma College of Medicine , and the teaching
98168 hospitals affiliated with both schools of medicine and teaching
99169 health centers located in this state; or

101197 3. Is a current practicing phy sician or, physician assistant,
102198 or certified nurse practitioner and has met criteria established by
103199 the Commission.

105200 D. The Commission may accept donations of public or private
106201 funds to assist in funding the Oklahoma Medical Loan Repayment
107202 Program. The Commission may, at its discretion, contract with other
108203 public entities and nonprofit corporations for the e ndowment,
109204 management and administration of such funds.

111205 E. The Commission shall present a report on the operation of
112206 the Program program to the Governor, the Speaker of the Oklahoma
113207 House of Representatives, and the President Pro Tempore of the
114208 Oklahoma State Senate within one (1) month of the beginning of each
115209 regular session of the Legislature, including but not limited to the
116210 progress made in accompli shing the goal of the Program program.

118211 SECTION 2. AMENDATORY 63 O.S. 2021, Sect ion 1-2722, as
119212 amended by Section 4, Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023,
120213 Section 1-2722), is amended to read as follows:

122214 Section 1-2722. The amount of the award of educational loan
123215 repayment assistance shall not exceed any maximum or minimum amount
124216 as promulgated by rules of the Health Care Workforce Training
125217 Commission pursuant to the Oklahoma Medical Loan Repayment Program.
126218 The actual amount of the award shall be based upon a determination
