20	50		the Oklahoma Medical Loan Repayment Program;
21	51		modifying definition; including certified nurse
22	52		practitioners for medical loan repayment; amending 63
23	53		O.S. 2021, Section 1 -2722, as amended by Section 4,
24	54		Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023, Section
25	55		1-2722), which relates to amount of award and
26	56		determination of the Oklahoma Medical Loan Repayment
27	57		Program; including physician assistant and certified
28	58		nurse practitioner for award; and providing an
29	59		effective date.

35	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37	64		SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -2721, as
38	65		amended by Section 3, Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023,
39	66		Section 1-2721), is amended to read as follows:

41	67		Section 1-2721. A. 1. The Health Care Workforce Training
42	68		Commission shall administer the Oklahoma Medical Loan Repayment
43	69		Program.

45	97		2. For the purposes of this section, "primary care physicians"
46		-	shall mean physicians practicing in family medicine, ~~geriatrics~~, ~~ENR. H. B. NO. 1696 Page 2~~
	98	+	shall mean physicians practicing in family medicine, geriatr ics,
47	99		general internal medicine, general pediatrics,
48	100		obstetrics/gynecology, or emergency medicine, or general surgery .

50	101		3. For the purposes of this sect ion, "health center" shall mean
51	102		a federally qualified health center Federally Qualified Health
52	103		Center as defined by 42 U.S.C., Section 1905(1)(2)(B).

54	104		4. For the purposes of this section, "teaching health center"
55	105		shall mean a health center that supports th e residencies of primary
56	106		care physicians within the operations of the health center.

58	107		5. The Program program, depending upon and limited to available
59	108		funding, shall provide educational loan repayment assistance to
60	109		Oklahoma-licensed primary care physicians and, physician assistants ,
61	110		and certified nurse practitioners who agree to establish a practice
62	111		in a community located in Oklahoma approved by the Commission.

64	112		6. Each award of educational loan repayment assistance shall be
65	113		for a contracted period and shall be distributed to the participant
66	114		by drafts made payable to the participant at the end of each
67	115		contract year with disbursements not to exceed an amount to be
68	116		established annually by the Commission. Prior to any disbursement,
69	117		the Commission shall certify and properly review reports submitted
70	118		by the participating physician or, physician assistant, or certified
71	119		nurse practitioner detailing performance of activities in accordance
72	120		with the Program program.

74	148		7. The Commission shall review the performance in the Program
75	149		program of the participating physician or, physician assistant, or
76	150		certified nurse practitioner and determine whether an award may be
77	151		granted for additional years pursuant to rules promulgated by the
78	152		Commission.

80	153		B. The physicians and, physician assistants, and certified
81	154		nurse practitioners entering the Program program each year shall
82	155		agree to provide medical care and services in areas designated by
83	156		the Commission to provide medical care and services to Medicaid
84	157		recipients as authorized by the Okla homa Health Care Authority.

86	158		C. A physician or, physician assistant, or certified nurse
87	159		practitioner shall be eligible to participate in the loan repayment
88	160		program if the individual:

90	161		1. Is a physician that, physician assistant, or certified nurse

	162	+	practitioner who holds a current Oklahoma medical license;
93	163		2. Is a new primary care graduate physician or, physician
94	164		assistant, or certified nurse practitioner . Preference will be
95	165		given to graduates of the primary care residency programs affiliated
96	166		with the Oklahoma State University College of Osteopathic Medicine,
97	167		the University of Oklahoma College of Medicine , and the teaching
98	168		hospitals affiliated with both schools of medicine and teaching
99	169		health centers located in this state; or

101	197		3. Is a current practicing phy sician or, physician assistant,
102	198		or certified nurse practitioner and has met criteria established by
103	199		the Commission.

105	200		D. The Commission may accept donations of public or private
106	201		funds to assist in funding the Oklahoma Medical Loan Repayment
107	202		Program. The Commission may, at its discretion, contract with other
108	203		public entities and nonprofit corporations for the e ndowment,
109	204		management and administration of such funds.

111	205		E. The Commission shall present a report on the operation of
112	206		the Program program to the Governor, the Speaker of the Oklahoma
113	207		House of Representatives, and the President Pro Tempore of the
114	208		Oklahoma State Senate within one (1) month of the beginning of each
115	209		regular session of the Legislature, including but not limited to the
116	210		progress made in accompli shing the goal of the Program program.

118	211		SECTION 2. AMENDATORY 63 O.S. 2021, Sect ion 1-2722, as
119	212		amended by Section 4, Chapter 407, O.S.L. 2022 (63 O.S. Supp. 2023,
120	213		Section 1-2722), is amended to read as follows:

122	214		Section 1-2722. The amount of the award of educational loan
123	215		repayment assistance shall not exceed any maximum or minimum amount
124	216		as promulgated by rules of the Health Care Workforce Training
125	217		Commission pursuant to the Oklahoma Medical Loan Repayment Program.
126	218		The actual amount of the award shall be based upon a determination
