6958 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7059 SECTION 1. AMENDATORY 63 O.S. 2021, Section 420, as
7160 amended by Section 1, Chapter 251, O.S.L. 2022 (63 O.S. Supp . 2023,
7261 Section 420), is amended to read as follows:
62+Section 420. A. A person in possession of a state-issued
63+medical marijuana patient license shall be able to:
64+1. Consume marijuana legally;
65+2. Legally possess up to th ree (3) ounces or eighty-four and
66+nine-tenths (84.9) grams of marijuana on their person;

100-Section 420. A. A person in possession of a state-issued
101-medical marijuana patient license shall be able to:
102-1. Consume marijuana legally;
103-2. Legally possess up to th ree (3) ounces or eighty-four and
104-nine-tenths (84.9) grams of marijuana on their person;
10593 3. Legally possess six mature marijuana plants and the
10694 harvested marijuana therefrom;
10795 4. Legally possess six seedli ng plants;
10896 5. Legally possess one (1) ounce or tw enty-eight and three-
10997 tenths (28.3) grams of concentrated marijuana;
11098 6. Legally possess sevent y-two (72) ounces or two thousand
11199 thirty-seven and six-tenths (2,037.6) grams of edible marijuana;
112100 7. Legally possess up to eight (8) ounces or two hundred
113101 twenty-six and four-tenths (226.4) grams of marijuana in their
114102 residence; and
115103 8. Legally possess s eventy-two (72) ounces of topical
116104 marijuana.
117105 B. Possession of up to one and one-half (1.5) ounces or forty -
118106 two and forty-five one-hundredths (42.45) grams of ma rijuana by
119107 persons who can state a medical condition, but are not in possession
120108 of a state-issued medical marijuana patient license, shall
121109 constitute a misdemeanor offense not subject to imprisonment but
122110 punishable by a fine not to exceed Four Hundred Doll ars ($400.00).
123111 Any law enforcement officer who comes in contact with a person in
112+violation of this subsection and who is satisfied as to the identity
113+of the person, as well as any other pertinent informatio n the law
114+enforcement officer deems necessary, sh all issue to the person a
115+written citation containing a notice to answer the charge against
116+the person in the appropriate court. Upon receiving the written

151-violation of this subsection and who is satisfied as to the identity
152-of the person, as well as any other pertinent informatio n the law
153-enforcement officer deems necessary, sh all issue to the person a
154-written citation containing a notice to answer the charge against
155-the person in the appropriate court. Upon receiving the written
156143 promise of the alleged violator to answer as speci fied in the
157144 citation, the law enforcement officer shall release the person upon
158145 personal recognizance unless there has been a violation of anoth er
159146 provision of law.
160147 C. The Oklahoma Medical Marijuana Authority shall be
161148 established which shall receive applications for medical marijuana
162149 patient and caregiver license recipients, dispensaries, growers and
163150 processors within sixty (60) days of the passage o f this initiative.
164151 D. The Authority shall, within thirty (30) days of passage of
165152 this initiative, make available on its website, in an easy-to-find
166153 location, an application for a medical marijuana patient license.
167154 The license shall be valid for two (2) years. The biannual
168155 application fee shall be One Hundred Dollars ($100. 00), or Twenty
169156 Dollars ($20.00) for individuals on Medicaid, Medicare or
170157 SoonerCare. The methods of payment shall be provided on the website
171158 of the Authority. Reprints of the medical marijuana pat ient license
172159 shall be Twenty Dollars ($20.00).
173160 E. A short-term medical marijuana patient license application
174161 shall also be made available on th e website of the Authority. A
162+short-term medical marijuana patient license shall be granted to any
163+applicant who can meet th e requirements for a two-year medical
164+marijuana patient license, but whose physician recommendation for
165+medical marijuana is only valid for sixty (60) days. Short-term
166+medical marijuana patient licenses shall be iss ued for sixty (60)

202-short-term medical marijuana patient license shall be granted to any
203-applicant who can meet th e requirements for a two-year medical
204-marijuana patient license, but whose physician recommendation for
205-medical marijuana is only valid for sixty (60) days. Short-term
206-medical marijuana patient licenses shall be iss ued for sixty (60)
207193 days. The fee for a short-term medical marijuana patient license,
208194 reprints of the short-term medical marijuana patient licen se and the
209195 procedure for extending or renewing the license shall be determined
210196 by the Executive Director of the Authority.
211197 F. A temporary nonresident medical marijuana patient license
212198 application shall also be available on the website of the Authority
213199 for residents of other states. Temporary Nonresident medical
214200 marijuana patient licenses shall be gra nted to medical marijuana
215201 license holders from ot her states, provided that such states have
216202 state-regulated medical marijuana programs and app licants can prove
217203 they are members of such programs the patient is under the care of a
218204 licensed Oklahoma physician located within the State of Oklahoma.
219205 Temporary Nonresident medical marijuana patient licenses shall be
220206 issued for thirty (30) days two (2) years. The cost for a temporary
221207 nonresident medical marijuana patient license shall be One Hundred
222208 Dollars ($100.00) Two Hundred Fifty Dollars ($ 250.00). Renewal
223209 shall be granted with resubmission of a new application. No
224210 additional criteria shall be required for adult medical marijuana
225211 patients but medical marijuana patients wh o are eighteen (18) years
212+of age or younger shall meet the requirements provided for in
213+subsection L of this section. Reprints of the temporary nonresident
214+medical marijuana patient license shall be Twe nty Dollars ($20.00).
215+Fees collected pursuant to this subsection shall be distributed as
216+follows:

253-of age or younger shall meet the requirements provided for in
254-subsection L of this section. Reprints of the temporary nonresident
255-medical marijuana patient license shall be Twe nty Dollars ($20.00).
256-Fees collected pursuant to this subsection shall be distributed as
257-follows:
258243 1. Twenty percent (20%) to the Oklahoma Medi cal Marijuana
259244 Authority Fund for the costs of issuing medical marijuana p atient
260245 licenses to veterans; and
261246 2. Eighty percent (80%) to the Bureau of Narcotics Revolving
262247 Fund, created in Section 150.19a of Title 74 of the Oklahoma
263248 Statutes, for the investigation and enforcement of the provisions of
264249 the Oklahoma Medical Marijuana and Patient Protection Act and the
265250 Uniform Controlled Dangerous Substance Act .
266251 The Authority shall be authorized to promulgate rules to
267252 establish a process by which the fees collected pursuant to
268253 paragraph 1 of this subsection are adm inistered and applied toward
269254 the costs of issuing medical marijuana pat ient licenses to veterans.
270255 G. Medical marijuana patient license applicants shall submit
271256 their applications to the Authority for approval. The applicant
272257 shall be a resident of this state and shall prove residency by a
273258 valid driver license, utility bills, or other accepted methods.
274259 H. The Authority shall review the medical marijuana patient
275260 license application; approve, reject or deny the application; and
276261 mail the approval, rejection or denial letter stating any reasons
262+for the rejection or denial to the applicant within fourteen (14)
263+business days of receipt of the application. Approved applicants
264+shall be issued a medical marijuana patient license w hich shall act
265+as proof of his or her approved status. Applications may only be

304-for the rejection or denial to the applicant within fourteen (14)
305-business days of receipt of the application. Approved applicants
306-shall be issued a medical marijuana patient license w hich shall act
307-as proof of his or her approved status. Applications may only be
308292 rejected or denied based on the applicant not meeting stated
309293 criteria or improper completion of the application.
310294 I. The Authority shall make available, both on its website and
311295 through a telephone verification system, an easy method to validate
312296 the authenticity of the medical marijuana patient license by the
313297 unique 24-character identification number.
314298 J. The Authority shall ensure that all medical marijuana
315299 patient and caregiver records and information are sealed to protect
316300 the privacy of medical marijuana patient license applicants.
317301 K. A caregiver license shall be made available for qualified
318302 caregivers of a medical marijua na patient license holder who is
319303 homebound. As provided in Section 427.11 of this title, the
320304 caregiver license shall provide the caregiver the same rights as the
321305 medical marijuana patient licensee including the ability to possess
322306 marijuana, marijuana prod ucts and mature and immature plants
323307 pursuant to the Oklahoma Medical Marijuana and Patient Protection
324308 Act, but excluding the ability to use marijuana or marijuana
325309 products unless the caregiver has a medical marijuana patient
326310 license. Applicants for a care giver license shall submit proof of
327311 the license status and homebound status of the medical marijuana
312+patient and proof that the applicant is the designee of the medical
313+marijuana patient. The applicant shall also submit proof that he or
314+she is eighteen (18) years of age or older and proof of his or h er
315+state residency.

355-patient and proof that the applicant is the designee of the medical
356-marijuana patient. The applicant shall also submit proof that he or
357-she is eighteen (18) years of age or older and proof of his or h er
358-state residency.
359342 L. All applicants for a medical marijuana patient license shall
360343 be eighteen (18) years of age or older. A special excep tion shall
361344 be granted to an applicant under the age of eight een (18); however,
362345 these applications shall b e signed by two physicians and the parent
363346 or legal guardian of the applicant.
364347 M. All applications for a medical marijuana patient license
365348 shall be signed by an Oklahoma physician licensed by and in good
366349 standing with the State Board of Medical Licensure and Supervision,
367350 the State Board of Osteopathic Examiners, or the Board of Podiatric
368351 Medical Examiners. There are no qualifying conditions for adult
369352 medical marijuana patients. A medical marijuana patient license
370353 shall be recommended according to the accepted standards a
371354 reasonable and prudent physician would follow when recommending or
372355 approving any medication. No physician may be unduly stigmatized or
373356 harassed for signing a medical marijuana patient license
374357 application.
375358 N. Counties and cities may enact medical marijuana guidelines
376359 allowing medical marijuana patient license holders or caregiver
377360 license holders to exceed the state limits set forth in subsection A
378361 of this section.
362+SECTION 2. This act shall become effective November 1, 2024.
