27120 BE IT ENACTED BY THE PEOPLE O F THE STATE OF OKLAHOMA:

29121 SECTION 1. AMENDATORY 10A O.S. 2021, Section 1 -9-107, is
30122 amended to read as follows:

32123 Section 1-9-107. A. This section shall be known and may b e
33124 cited as the "Successful Adulthood Act".

35125 B. The purpose of the Successful Adulthood Act shall be:

37126 1. To ensure that eligible individuals, who hav e been or are in
38127 the foster care program of the Department of Hum an Services or a
39128 federally recognized Indi an tribe with whom the Depart ment has a
40129 contract, due to abus e or neglect, receive the protection and
41130 support necessary to allow those individuals to become self-reliant
42131 and productive citizens through the provisio n of requisite services

43158 that include, but are not limited to, transitio nal planning,
44159 housing, medical coverage, and education; provided, that eligibility
45160 for tuition waivers shall be as set f orth in Section 3230 of Title
46-70 of the Oklahoma Statutes; ENR. H. B. NO. 1929 Page 2

48162 2. To break the cycle of abuse and neglect that obligates the
49163 state to assume custody of children; and

51164 3. To help children who have experienced foster care at age
52165 fourteen (14) or older achieve m eaningful permanent connections with
53166 a caring adult.

55167 C. An individual is eligible to receive services for the
56168 transition of the child t o a successful adulthood from th e age of
57169 fourteen (14) until the age of eighteen (18), during the time the
58170 individual is in the custody of the Department or a federally
59171 recognized Indian tribe and in an out-of-home placement.

61172 D. The permanency plan for th e child in transition to a
62173 successful adulthood shall be developed in consultation with the
63174 child and, at the option of the child, with up to two members of the
64175 permanency planning team to be chosen by the child, excluding the
65176 foster parent and caseworker for the child, subject to the fo llowing
66177 provisions:

68178 1. One individual selected by the child may be designated to be
69179 the advisor and, as necessary, advocate of the child, with resp ect
70180 to the application of the reasonable and pr udent parent standard to
71181 the child; and

73208 2. The Department may reject an individual selected by the
74209 child to be a member of the permanency planning t eam at any time if
75210 the Department has good cause to believe that the selected
76211 individual would not act in t he best interests of the chil d.

78212 E. 1. Each child in foster care under the responsibility of
79213 the Department or a federally recognized Indian tribe a nd in an out-
80214 of-home placement, who has attained fourteen (14) years of age shall
81215 be given a written Notice of Rights that describes the following
82216 specific rights of th e child:

84217 a. the rights of the child with respect to education,
85218 health, visitation, and c ourt participation,
86-
87219 b. the right to be provided with the documents specified
88220 in subsection F of this sectio n, and
89-
90221 c. the right to stay safe and avoid exploitation.

92222 2. The child shall sign an acknowledgment stating that the
93223 child has been provided with a c opy of the Notice of Rights and that
94224 the rights described in the notice have been explained to the child
95225 in an age-appropriate way.

97226 F. A child about to leave foster ca re by reason of having
98227 attained eighteen (18) years of age and who has been in foster ca re
99228 for at least six (6) months shall be given the fol lowing documents
100229 pertaining to the child:

102230 1. An official or certified copy of the United States birth

105258 2. A Social Security card issued by the Commissioner of Social
106259 Security;

108260 3. Health insurance information;

110261 4. A copy of the medical re cords of the child;

112262 5. A state-issued driver license or identification card; and

114263 6. Official documentation necessary to show that the child was
115264 previously in foster care.

117265 G. Successful adulthood services may continue to the age of
118266 twenty-one (21) twenty-five (25), provided the individual is in the
119267 custody of the Department or a federally recognized Indian tribe due
120268 to abuse or neglect and is in an out -of-home placement at the time
121269 of the individual's sixteenth birthday.

123270 H. Individuals who are sixteen (16) years of a ge or older, who
124271 have been released from the custody of the Department or federally
125272 recognized Indian trib e due to the entry of an adoption decree or
126273 guardianship order are eligible to receive successful adultho od
127274 services until the age of twenty-one (21) twenty-five (25).

129275 I. Individuals who are eli gible for services pursuant t o the
130276 Successful Adulthood Act a nd who are between eighteen (18) and
131277 twenty-one (21) twenty-five (25) years of age shall be eligible for
132278 Medicaid coverage, provided such i ndividuals were also in the
133279 custody of the Department or a federally recognized India n tribe on
134280 the date they reached eighteen (18) years of age and meet Medicaid
135281 financial eligibility guidelines.

137308 J. The Department, in conj unction with the Oklahoma State
138309 Regents for Higher E ducation, shall provide parents and legal
139310 guardians of foster you th with information on the Oklah oma Higher
140311 Learning Access Program (OHLAP) including, but not limited to,
141312 eligibility, application guidelin es, academic requirements, and a ny
142313 other information required by the Oklahoma Higher Learning Access
143314 Act for participation in the Program.

145315 SECTION 2. This act shall become effective November 1, 2023.
