52 | 57 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 58 | | SECTION 1. AMENDATORY 70 O.S. 2021, Section 24 -102, is |
---|
54 | 59 | | amended to read as follows: |

55 | 60 | | Section 24-102. A. The superintendent, principal, teache r, or |
---|
56 | 61 | | security personnel of any public school in the State of Oklahoma, |
---|
57 | 62 | | upon reasonable suspicion, shall have the authority to detain and |
---|
58 | 63 | | search, or authorize the search , of, any pupil or property in the |
---|
59 | 64 | | possession of the pupil when said the pupil is on any school |
---|
60 | 65 | | premises, or while in transit under the authority of the school, or |
---|
61 | 66 | | while attending any function sponsored or authorized by the school, |
---|
90 | 96 | | alcoholic beverages, low-point beer, as defined by Section 163.2 of |
---|
91 | 97 | | Title 37 of the Oklahoma Statutes in the Oklahoma Alcoholic Beverage |
---|
92 | 98 | | Control Act, or for missing or stolen property if said the property |

93 | 99 | | be is reasonably suspected to have been taken from a pu pil, a school |

94 | 100 | | employee, or the school during school activities. The search shall |
---|
95 | 101 | | be conducted by a person of the same sex as the person being |
---|
96 | 102 | | searched and shall be witnessed by at least one other authorized |
---|
97 | 103 | | person, said person to be who is of the same sex if practicable. |
---|
98 | 104 | | B. The extent of any search conducted pursuant to this section |
---|
99 | 105 | | shall be reasonably related to the objective of the search and not |
---|
100 | 106 | | excessively intrusive in light of the age and sex of the student and |
---|
101 | 107 | | the nature of the infraction. In no event shall a strip search of a |
---|
102 | 108 | | student be allowed. No student 's clothing, except cold weather |
---|
103 | 109 | | outerwear, shall be removed prior to or during the conduct of any |
---|
104 | 110 | | warrantless search. |
---|
105 | 111 | | C. The superintendent, principal, teacher, or secu rity |
---|
106 | 112 | | personnel searching or authorizing the search shall have authority |
---|
107 | 113 | | to detain the pupil to be searched and to preserve any dang erous |
---|
108 | 114 | | weapons, controlled dangerous substances, intoxicating alcoholic |
---|
109 | 115 | | beverages, low-point beer, or missing or stolen proper ty that might |
---|
110 | 116 | | be in the pupil's possession including the authority to authorize |
---|
111 | 117 | | any other persons they deem necessary to restrain s uch pupil or to |
---|
140 | 147 | | stolen property. Students found to be in possession of such an item |
---|
141 | 148 | | shall be subject to the provisions of Sect ion 24-101.3 of this |
---|
142 | 149 | | title. |

143 | 150 | | D. The superintendent may designate school personnel to |
---|
144 | 151 | | transport items preserved as provided in subsection C of this |
---|
145 | 152 | | section from a school site to a centralized location within the |
---|
146 | 153 | | school district or to local law enforcement offices for lawful |
---|
147 | 154 | | disposal. While in transport, the designated school personnel shall |
---|
148 | 155 | | carry their school identification and a letter from the |
---|
149 | 156 | | superintendent confirming their authority to transport the items for |
---|
150 | 157 | | disposal. All items transported for disposal pursuant to this |
---|
151 | 158 | | subsection shall be transported in a locked c ontainer. |

152 | 159 | | E. Pupils shall not have any reasonable expectatio n of privacy |
---|
153 | 160 | | towards school administrators or teachers in the contents of a |
---|
154 | 161 | | school locker, desk, or other school property. School personnel |
---|
155 | 162 | | shall have access to school lockers, desks, and other school |
---|
156 | 163 | | property in order to properly supervise the welfare of pupils. |
---|
157 | 164 | | School lockers, desks, and other areas of school facilities may be |
---|
158 | 165 | | opened and examined by school officials at any time and no reason |
---|
159 | 166 | | shall be necessary for such search . Schools shall inform pupils in |
---|
160 | 167 | | the student discipline code that they have no reasonable expectation |
