AS INTRODUCED 
 
An Act relating to Medicaid coverage; providing for 
Medicaid coverage for women twelve months after 
giving birth; increasing poverty rate; providing for 
codification; and providing an effective date. 
 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Sectio n 1011.20 of Title 56, unless 
there is created a duplication in numbering, reads as follows: 
A.  The Social Security Administration shall make payments for 
medical assistance and related services on behalf of any previously 
pregnant woman, whom the Oklahoma Health Care Authority, or the 
agency by contract with the Authority, determines to be eligible, 
subject to the income, assets, and categorical eligibility tests set 
forth in federal and state law.  Payment on behalf of any Medicaid-
eligible woman is subject to the availability of funds. 
B.  If either a woman for the duration of her pregnancy and for 
the postpartum period consisting of the 12 -month period beginning on

the last day of her pregnancy , or a child under the age of one (1) 
year old, is living in a family that has an income that is at or 
below one hundred thirty-three percent (133%) of the most current 
federal poverty level , such person is not subject to an assets test. 
A pregnant woman who applies for eligibility for the Medicaid 
program through a qualified Medicaid provider must be offered the 
opportunity, subject to federal rules, to be made presumptively 
eligible for the Medicaid program. 
SECTION 2.  This act shall become effective November 1, 2023.
