42	42	General; stating purpose of databas e; authorizing the
43	43	Attorney General to oversee the creation, development
44	44	and implementation of the database; providing
45	45	procedures for submitting report to the database;
46	46	directing the Attorney General to establish certain
47	47	procedures and guidelines; allowing the Attorney
48	48	General access to certain data and reports;
49	49	restricting accessibility to the database; providi ng
50	50	for the creation of a public website; stating
51	51	information available to the public via the website;
52	52	directing the Attorney General to promulgate rules;
53	53	providing for codification; and providing an

60	60	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
61	61	SECTION 1. NEW LAW A new section of law to be codified
62	62	in the Oklahoma Statutes as Section 20m of Title 74, unless there is
63	63	created a duplication in numbering, reads as follows:
64	64	A. There is hereby established within the Office of the
65	65	Attorney General a firearm usage database for the purpose of
66	66	assisting law enforcement agencies in investigating crimes involving

93	93	firearms and identifying the sourc es of illegal firearms in the
94	94	state of Oklahoma.
95	95	B. The Attorney General is hereby authori zed to oversee the
96	96	creation, development , and implementation of a statewide firearm
97	97	usage database with the assistance fr om the Office of Manag ement and
98	98	Enterprise Services.
99	99	C. In any case where a person is arrested for a crime in which
100	100	a firearm is used, a firearm usage report shall be completed by the
101	101	law enforcement officer who made the arrest. The report shall be
102	102	transmitted to the Office of the Attorney General who shall then
103	103	enter the information into the firearm usag e database. The Attorney
104	104	General shall prescribe the form and format of the firearm usage
105	105	report.
106	106	D. The Attorney General shall establish procedures and
107	107	guidelines necessary for maintaining the firearm usage database and
108	108	guidelines for law enforc ement agencies concerning the collection of
109	109	information necessary for inclusion in the database. The Attorney
110	110	General shall have access to any data and reports kept by law
111	111	enforcement agencies that are necessary for creating, developing ,
112	112	implementing and maintaining the firearm usage database.
113	113	E. The firearm usage database shall be accessible to law
114	114	enforcement agencies t hroughout the state of Oklahoma for criminal
115	115	investigations only. A separate online website accessible to the
116	116	public free of charge shall be developed in con junction with the

143	143	firearm usage database. Data and statistics concerning crimes
144	144	committed with firearms, illegal transfers of fire arms, illegal
145	145	possession and transportation of firearms, and straw purchases shall
146	146	be available to the public on the website.
147	147	F. The Office of the Attorney General shall promulgate rules
148	148	necessary to implement the provisio ns of this act.
149	149	SECTION 2. This act shall become effective November 1, 2023.
