199203 2. A person in the defensive dis play of a firearm or other
200204 deadly weapon, as provided for in Section 1289.25 of this title;
201205 3. Law enforcement authorities in the performance of their
202206 duties, armed;
203207 4. Armed security guards licensed by the Council on Law
204208 Enforcement Education and Traini ng pursuant to the Oklahoma Security
205209 Guard and Private Investigator Act in the performance of their
206210 duties, members;
207211 5. Members of the state military forces in the performance of
208212 their duties, members;
209213 6. Members of the federal military reserve and activ e military
210214 components in the perfo rmance of their duties, or any;
211215 7. Any federal government law enforcement office r in the
212216 performance of any duty ,; or in
213217 8. Any person during the performance of a play on stage, while
214218 participating in a rodeo, or when participating in a television
215219 program or on film, or in defense of any person, one 's home or
216220 property project.
217221 B. It shall be unlawful for any person to willfully an d without

247252 any malice or for any purpose of injuring, either through physical
248253 injury or mental or emotional intimidation , or for purposes of
249254 whimsy, humor or prank, or in anger or otherwise .
250255 C. Any person convicted of a violation of the provisions of
251256 this section shall be punished as provided in Section 1289.17 of
252257 this title.
253258 Any person convicted of a violation of the provisions of this
254259 section after having been issued a handgun license pursua nt to the
255260 Oklahoma Self-Defense Act shall have the license revoked and s hall
256261 be subject to an administrative fine of One Thousand Dollars
257262 ($1,000.00), upon a hea ring and determination by the Oklahoma State
258263 Bureau of Investigation that the person is in viol ation of the
259264 provisions of this section.

265270 A. The Legislature hereby recognizes that the citizens of the
266271 State of Oklahoma have a right to expect absolute safety within
267272 their own homes, places of business, occupied premises, or places of
268273 worship and have the right to establish policies regarding the
269274 possession of weapons on property pursuant to the provisions of
270275 Section 1290.22 of this ti tle.

297303 B. A person, regard less of official capacity or lack of
298304 official capacity, wi thin a place of worship or a pe rson, an owner,
299305 manager or employee of a business is presumed to have held a
300306 reasonable fear of imminent peril of death or great bodily harm t o
301307 himself or herself or a nother when using defensive force that is
302308 intended or likely to cause death or great bodi ly harm to another
303309 if:
304310 1. a. The person against whom the defensive force was used
305311 was in the process of unlawfully and forcefully
306312 entering, or had unlawfully and forci bly entered, a
307313 dwelling, residence, occupied vehicle, plac e of
308314 business, occupied premises, or place of worship, or
309315 if that person had remove d or was attempting to remove
310316 another against the will of that person from the
311317 dwelling, residence, occupied vehicl e, place of
312318 business, occupied premises, or place of worship.
313319 b. The person who uses defe nsive force knew or had reason
314320 to believe that an un lawful and forcible entry or
315321 unlawful and forcible act on the occupied premises was
316322 occurring or had occurred; or
317323 2. The person who uses defensive force knew or had a reasonable
318324 belief that the person ag ainst whom the defensive force was used
319325 entered or was attempting to enter into a dwelling, residence,
320326 occupied vehicle, place of business , occupied premises, or place of

347354 worship for the purpose of committing a forcible felony, as defined
348355 in Section 733 of this title, and that the defensive force was
349356 necessary to prevent the commission of the forcible felony.
350357 C. The presumption set forth in sub section B of this section
351358 does not apply if:
352359 1. The person against whom the defensive force is used has the
353360 right to be in or is a lawful resident of the dwelling, r esidence,
354361 or vehicle, such as an owner, lessee, or titleholder, and there is
355362 not a protective order from domestic v iolence in effect or a written
356363 pretrial supervision order of no contact against that pers on;
357364 2. The person or persons sought to be removed a re children or
358365 grandchildren, or are otherwise in the lawful custody or under the
359366 lawful guardianship of, the perso n against whom the defensive force
360367 is used; or
361368 3. The person who uses defensive force is engaged in an
362369 unlawful activity or is using the dwe lling, residence, occupied
363370 vehicle, place of business or place of worship to further an
364371 unlawful activity.
365372 D. A person who is not engaged in an unlawful activity and who
366373 is attacked in any other place wh ere he or she has a right to be has
367374 no duty to retreat and has the right to stand his or her ground and
368375 meet force with force, including deadl y force, if he or she
369376 reasonably believes it is necessary to do so to prevent death or

396404 great bodily harm to himsel f or herself or another or to prevent the
397405 commission of a forcible felony.
398406 E. A person who unlawfully and by force enters or attempts to
399407 enter the dwelling, residence , occupied vehicle of another person,
400408 place of business, occupied premises, or place of worship is
401409 presumed to be doing so with the intent t o commit an unlawful a ct
402410 involving force or violence.
403411 F. A person who uses defensive forc e, as permitted pursuant to
404412 the provisions of subsections A, B, D and E of this section, is
405-justified in using suc h defensive force and is immune from and shall
406-not be subject to criminal prosecution and civil action for the use
407-of such defensive force. As used in this subsection, th e term

408416 "criminal prosecution " includes charging or prosecuting the
409417 defendant.
410418 G. A law enforcement agency may use standard procedures for
411419 investigating the use of defensive force, but th e law enforcement
412420 agency may not arrest the person for using defensiv e force unless it
413421 determines that there is probable cause that the defensive force
414422 that was used was unlawful.
415423 H. The court shall award reas onable attorney fees, court costs,
416424 compensation for loss of income, and all expenses incur red by the
417425 defendant in defense of any civil action brought by a plaintiff if
418-the court finds that the defendant i s immune from and not subject to
426+the court finds that the defendant i s immune from not subject to
419427 prosecution as provided in subsection F of this section.

446455 I. The provisions of this section and the provisions of the
447456 Oklahoma Self-Defense Act shall not be construed to require any
448457 person using a weapon pursuant to the provisi ons of this section to
449458 be licensed in any manner.
450459 J. A person pointing a weapon at a perpetrator in self -defense
451460 or in order to thwart, stop or deter a forcible felon y or attempted
452461 forcible felony shall not be deemed guilty of committing a criminal
453462 act.
454463 K. 1. The defensive display of a firearm or other deadly
455464 weapon by a person is justified when and to the extent a reasonable
456465 person believes that physical force is im mediately necessary to
457466 protect himself, herself or another person against the use or
458467 attempted use of unlawful physical or deadly force by a person,
459468 premises owner or controller in self -defense, or in defense of real
460469 or private property, located on any pre mises, owned, rented, leased
461470 or occupied by permission of the premise owner or controller ,
462471 whether or not a person is in possession of a valid handgun license
463472 issued pursuant to the provisions of the Oklahoma Self -Defense Act
464473 and shall not be deemed a crim inal act.
465474 2. The provisions of this subsection shall not apply to a
466475 person who:
467476 a. intentionally provokes another person to use or
468477 attempt to use unlawful physical or deadly force, or

495505 b. uses a firearm during the commission of an unlawful
496506 act involving force or violence.
497507 3. The provisions of this subsection do not require the
498508 defensive display of a firearm or any other deadly weapon before th e
499509 use of defensive force or the threat of defensive force by a person
500510 who is justified in the use or threatened use of defensive force.
501511 4. For purposes of this subsection, "defensive display of a
502512 firearm" includes, but is not limited to:
503513 a. verbally informing another person that the person
504514 possesses or has available a firearm or any other
505515 deadly weapon,
506516 b. exposing or displaying a firearm or any other deadly
507517 weapon in a manner that a reasonable person wou ld
508518 understand was meant to protect the person agains t the
509519 use or attempted use by another of unlawful physical
510520 or deadly force, or
511521 c. placing the hand of the person on a firearm or any
512522 other deadly weapon while the firearm is contained in
513523 a pocket, purse, holster, sling scabbard, case or
514524 other means of containment or transport.
515525 L. As used in this section:
516526 1. "Defensive force" includes, but shall not be limited to,
517527 pointing a weapon at a p erpetrator in self-defense or in order to

546557 2. "Dwelling" means a building or conveyance of any kind,
547558 including any attached porch, whether t he building or conveyance is
548559 temporary or permanent, mobile or immobile, which has a roof over
549560 it, including a tent, and is designed to be occupied by people;
550561 3. "Occupied premises" means any premises occupied by an owner,
551562 tenant, lessee, business, place of worship, liquor store, guest or
552563 authorized user of the premises , including their agents;
553564 4. "Place of worship" means:
554565 a. any permanent building, structure, facili ty or office
555566 space owned, leased, rented or borrowed, on a full -
556567 time basis, when used for worship services, activit ies
557568 and business of the congregation, which may include,
558569 but not be limited to, churches, temples, synagogues
559570 and mosques, and
560571 b. any permanent building, structure, facility or office
561572 space owned, leased, rente d or borrowed for use on a
562573 temporary basis, when used for worship services,
563574 activities and business of the congregation including,
564575 but not limited to, churches, temples, synagogues and

592604 4. 5. "Residence" means a dwelling in which a person resides

597609 SECTION 5. It being immediately n ecessary for the preservation
