357 | 364 | | 2. The person or persons sought to be removed a re children or |
---|
358 | 365 | | grandchildren, or are otherwise in the lawful custody or under the |
---|
359 | 366 | | lawful guardianship of, the perso n against whom the defensive force |
---|
360 | 367 | | is used; or |
---|
361 | 368 | | 3. The person who uses defensive force is engaged in an |
---|
362 | 369 | | unlawful activity or is using the dwe lling, residence, occupied |
---|
363 | 370 | | vehicle, place of business or place of worship to further an |
---|
364 | 371 | | unlawful activity. |

365 | 372 | | D. A person who is not engaged in an unlawful activity and who |

366 | 373 | | is attacked in any other place wh ere he or she has a right to be has |

403 | 411 | | F. A person who uses defensive forc e, as permitted pursuant to |

404 | 412 | | the provisions of subsections A, B, D and E of this section, is |
---|
408 | 416 | | "criminal prosecution " includes charging or prosecuting the |
---|
409 | 417 | | defendant. |
---|
410 | 418 | | G. A law enforcement agency may use standard procedures for |
---|
411 | 419 | | investigating the use of defensive force, but th e law enforcement |
---|
412 | 420 | | agency may not arrest the person for using defensiv e force unless it |
---|
413 | 421 | | determines that there is probable cause that the defensive force |
---|
414 | 422 | | that was used was unlawful. |
---|
415 | 423 | | H. The court shall award reas onable attorney fees, court costs, |
---|
416 | 424 | | compensation for loss of income, and all expenses incur red by the |

454 | 463 | | K. 1. The defensive display of a firearm or other deadly |
---|
455 | 464 | | weapon by a person is justified when and to the extent a reasonable |
---|
456 | 465 | | person believes that physical force is im mediately necessary to |
---|
457 | 466 | | protect himself, herself or another person against the use or |
---|
458 | 467 | | attempted use of unlawful physical or deadly force by a person, |
---|
459 | 468 | | premises owner or controller in self -defense, or in defense of real |
---|
460 | 469 | | or private property, located on any pre mises, owned, rented, leased |
---|
461 | 470 | | or occupied by permission of the premise owner or controller , |
---|
462 | 471 | | whether or not a person is in possession of a valid handgun license |
---|
463 | 472 | | issued pursuant to the provisions of the Oklahoma Self -Defense Act |
---|
