62	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
63	64		SECTION 1. AMENDATORY 21 O.S. 2021, Section 1279, is
64	65		amended to read as follows:

107	109		SECTION 2. AMENDATORY 21 O.S. 2021, Section 1280, is

112	114		Any person violating the provisions of Section 1279 of this
113	115		title shall, upon conviction, be guilty of a misdemeanor punishable
114	116		by a fine of not less than O ne Hundred Dollars ($100.00) nor more
115	117		than One Thousand Dollars ($1,000.00) and shall be imprisoned in the
116	118		county jail for a period of not less than three (3) nor more than
117	119		twelve (12) months. Any person convicted of violating the
118	120		provisions of Section 12 79 of this title after having been issued a
119	121		handgun license pursuant to the provisions of the Oklahoma Self -
120	122		Defense Act shall have the handgun license revoked and shall be

156	159		Except for an act of self -defense, it A. It shall be unlawful
157	160		for any person to willfully or wit hout lawful cause lawful to point
158	161		a shotgun, rifle or pistol, firearm, knife, or any other deadly
159	162		weapon, whether loaded or not, at any another person or persons for
160	163		the purpose of threatening or with the intention of discharging the
161	164		firearm or with any ma lice or for any purpose of injuring, either
162	165		through physical injury or mental or emotiona l intimidation or for
163	166		purposes of whimsy, humor or prank, or in anger or otherwise, but
164	167		not to include the pointing of shotguns, rifles or pistols by law:
165	168		1. A person who can legally own or possess a weapon pursuant to
166	169		the provisions of Section 1272 of this title:
167	170		a. during an act of self -defense, or
168	171		b. in defense of real or private property , whether owned,
169	172		leased, or occupied by permission of the property

199	203		2. A person in the defensive dis play of a firearm or other
200	204		deadly weapon, as provided for in Section 1289.25 of this title;
201	205		3. Law enforcement authorities in the performance of their
202	206		duties, armed;
203	207		4. Armed security guards licensed by the Council on Law
204	208		Enforcement Education and Traini ng pursuant to the Oklahoma Security
205	209		Guard and Private Investigator Act in the performance of their
206	210		duties, members;
207	211		5. Members of the state military forces in the performance of
208	212		their duties, members;
209	213		6. Members of the federal military reserve and activ e military
210	214		components in the perfo rmance of their duties, or any;
211	215		7. Any federal government law enforcement office r in the
212	216		performance of any duty ,; or in
213	217		8. Any person during the performance of a play on stage, while
214	218		participating in a rodeo, or when participating in a television
215	219		program or on film, or in defense of any person, one 's home or
216	220		property project.
217	221		B. It shall be unlawful for any person to willfully an d without
218	222		lawful cause point a firea rm, knife or any other deadly weapon,
219	223		whether loaded or not, at any person or persons for the purp ose of

247	252		any malice or for any purpose of injuring, either through physical
248	253		injury or mental or emotional intimidation , or for purposes of
249	254		whimsy, humor or prank, or in anger or otherwise .
250	255		C. Any person convicted of a violation of the provisions of
251	256		this section shall be punished as provided in Section 1289.17 of
252	257		this title.
253	258		Any person convicted of a violation of the provisions of this
254	259		section after having been issued a handgun license pursua nt to the
255	260		Oklahoma Self-Defense Act shall have the license revoked and s hall
256	261		be subject to an administrative fine of One Thousand Dollars
257	262		($1,000.00), upon a hea ring and determination by the Oklahoma State
258	263		Bureau of Investigation that the person is in viol ation of the
259	264		provisions of this section.
260	265		SECTION 4. AMENDATORY 21 O.S. 2021, Section 1289.25, is

263	268		PHYSICAL OR DEADLY FORCE AGAINST INTRUDER

265	270		A. The Legislature hereby recognizes that the citizens of the
266	271		State of Oklahoma have a right to expect absolute safety within
267	272		their own homes, places of business, occupied premises, or places of
268	273		worship and have the right to establish policies regarding the
269	274		possession of weapons on property pursuant to the provisions of
270	275		Section 1290.22 of this ti tle.

297	303		B. A person, regard less of official capacity or lack of
298	304		official capacity, wi thin a place of worship or a pe rson, an owner,
299	305		manager or employee of a business is presumed to have held a
300	306		reasonable fear of imminent peril of death or great bodily harm t o
301	307		himself or herself or a nother when using defensive force that is
302	308		intended or likely to cause death or great bodi ly harm to another
303	309		if:
304	310		1. a. The person against whom the defensive force was used
305	311		was in the process of unlawfully and forcefully
306	312		entering, or had unlawfully and forci bly entered, a
307	313		dwelling, residence, occupied vehicle, plac e of
308	314		business, occupied premises, or place of worship, or
309	315		if that person had remove d or was attempting to remove
310	316		another against the will of that person from the
311	317		dwelling, residence, occupied vehicl e, place of
312	318		business, occupied premises, or place of worship.
313	319		b. The person who uses defe nsive force knew or had reason
314	320		to believe that an un lawful and forcible entry or
315	321		unlawful and forcible act on the occupied premises was
316	322		occurring or had occurred; or
317	323		2. The person who uses defensive force knew or had a reasonable
318	324		belief that the person ag ainst whom the defensive force was used
319	325		entered or was attempting to enter into a dwelling, residence,
320	326		occupied vehicle, place of business , occupied premises, or place of

347	354		worship for the purpose of committing a forcible felony, as defined
348	355		in Section 733 of this title, and that the defensive force was
349	356		necessary to prevent the commission of the forcible felony.
350	357		C. The presumption set forth in sub section B of this section
351	358		does not apply if:
352	359		1. The person against whom the defensive force is used has the
353	360		right to be in or is a lawful resident of the dwelling, r esidence,
354	361		or vehicle, such as an owner, lessee, or titleholder, and there is
355	362		not a protective order from domestic v iolence in effect or a written
356	363		pretrial supervision order of no contact against that pers on;
357	364		2. The person or persons sought to be removed a re children or
358	365		grandchildren, or are otherwise in the lawful custody or under the
359	366		lawful guardianship of, the perso n against whom the defensive force
360	367		is used; or
361	368		3. The person who uses defensive force is engaged in an
362	369		unlawful activity or is using the dwe lling, residence, occupied
363	370		vehicle, place of business or place of worship to further an
364	371		unlawful activity.
365	372		D. A person who is not engaged in an unlawful activity and who
366	373		is attacked in any other place wh ere he or she has a right to be has
367	374		no duty to retreat and has the right to stand his or her ground and
368	375		meet force with force, including deadl y force, if he or she
369	376		reasonably believes it is necessary to do so to prevent death or

396	404		great bodily harm to himsel f or herself or another or to prevent the
397	405		commission of a forcible felony.
398	406		E. A person who unlawfully and by force enters or attempts to
399	407		enter the dwelling, residence , occupied vehicle of another person,
400	408		place of business, occupied premises, or place of worship is
401	409		presumed to be doing so with the intent t o commit an unlawful a ct
402	410		involving force or violence.
403	411		F. A person who uses defensive forc e, as permitted pursuant to
404	412		the provisions of subsections A, B, D and E of this section, is
405		-	justified in using suc h defensive force and is immune from ~~and~~ shall
406		-	~~not~~ be subject to criminal prosecution and civil action for the use
407		-	of such defensive force. As ~~used~~ in this subsection, th e term
	413	+	justified in using suc h defensive force and is immune from shall not
	414	+	be subject to criminal prosecution and civil action for the use of
	415	+	such defensive force. As us ed in this subsection, th e term
408	416		"criminal prosecution " includes charging or prosecuting the
409	417		defendant.
410	418		G. A law enforcement agency may use standard procedures for
411	419		investigating the use of defensive force, but th e law enforcement
412	420		agency may not arrest the person for using defensiv e force unless it
413	421		determines that there is probable cause that the defensive force
414	422		that was used was unlawful.
415	423		H. The court shall award reas onable attorney fees, court costs,
416	424		compensation for loss of income, and all expenses incur red by the
417	425		defendant in defense of any civil action brought by a plaintiff if
418		-	the court finds that the defendant i s immune from ~~and~~ not subject to
	426	+	the court finds that the defendant i s immune from not subject to
419	427		prosecution as provided in subsection F of this section.

446	455		I. The provisions of this section and the provisions of the
447	456		Oklahoma Self-Defense Act shall not be construed to require any
448	457		person using a weapon pursuant to the provisi ons of this section to
449	458		be licensed in any manner.
450	459		J. A person pointing a weapon at a perpetrator in self -defense
451	460		or in order to thwart, stop or deter a forcible felon y or attempted
452	461		forcible felony shall not be deemed guilty of committing a criminal
453	462		act.
454	463		K. 1. The defensive display of a firearm or other deadly
455	464		weapon by a person is justified when and to the extent a reasonable
456	465		person believes that physical force is im mediately necessary to
457	466		protect himself, herself or another person against the use or
458	467		attempted use of unlawful physical or deadly force by a person,
459	468		premises owner or controller in self -defense, or in defense of real
460	469		or private property, located on any pre mises, owned, rented, leased
461	470		or occupied by permission of the premise owner or controller ,
462	471		whether or not a person is in possession of a valid handgun license
463	472		issued pursuant to the provisions of the Oklahoma Self -Defense Act
464	473		and shall not be deemed a crim inal act.
465	474		2. The provisions of this subsection shall not apply to a
466	475		person who:
467	476		a. intentionally provokes another person to use or
468	477		attempt to use unlawful physical or deadly force, or

495	505		b. uses a firearm during the commission of an unlawful
496	506		act involving force or violence.
497	507		3. The provisions of this subsection do not require the
498	508		defensive display of a firearm or any other deadly weapon before th e
499	509		use of defensive force or the threat of defensive force by a person
500	510		who is justified in the use or threatened use of defensive force.
501	511		4. For purposes of this subsection, "defensive display of a
502	512		firearm" includes, but is not limited to:
503	513		a. verbally informing another person that the person
504	514		possesses or has available a firearm or any other
505	515		deadly weapon,
506	516		b. exposing or displaying a firearm or any other deadly
507	517		weapon in a manner that a reasonable person wou ld
508	518		understand was meant to protect the person agains t the
509	519		use or attempted use by another of unlawful physical
510	520		or deadly force, or
511	521		c. placing the hand of the person on a firearm or any
512	522		other deadly weapon while the firearm is contained in
513	523		a pocket, purse, holster, sling scabbard, case or
514	524		other means of containment or transport.
515	525		L. As used in this section:
516	526		1. "Defensive force" includes, but shall not be limited to,
517	527		pointing a weapon at a p erpetrator in self-defense or in order to

546	557		2. "Dwelling" means a building or conveyance of any kind,
547	558		including any attached porch, whether t he building or conveyance is
548	559		temporary or permanent, mobile or immobile, which has a roof over
549	560		it, including a tent, and is designed to be occupied by people;
550	561		3. "Occupied premises" means any premises occupied by an owner,
551	562		tenant, lessee, business, place of worship, liquor store, guest or
552	563		authorized user of the premises , including their agents;
553	564		4. "Place of worship" means:
554	565		a. any permanent building, structure, facili ty or office
555	566		space owned, leased, rented or borrowed, on a full -
556	567		time basis, when used for worship services, activit ies
557	568		and business of the congregation, which may include,
558	569		but not be limited to, churches, temples, synagogues
559	570		and mosques, and
560	571		b. any permanent building, structure, facility or office
561	572		space owned, leased, rente d or borrowed for use on a
562	573		temporary basis, when used for worship services,
563	574		activities and business of the congregation including,
564	575		but not limited to, churches, temples, synagogues and
565	576		mosques;

600	612		be in full force from and after i ts passage and approval.
