4340 An Act relating to law enforcement officers; stating
4441 membership requirements for government entities that
4542 establish citizen review boards ; requiring majority
4643 vote when making findings or recommendations;
4744 providing procedures when member ship requirements are
4845 not met; providing exemptions; stating findings of
4946 the Legislature; providing for codifica tion; and

5552 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5653 SECTION 1. NEW LAW A new section of law to be codified
5754 in the Oklahoma Statutes as Section 34.6 of Title 22, unless there
5855 is created a duplication in numbering, reads as follows:
5956 A. When a government entity establishes a citizen review board
6057 to investigate an allegation of misconduct by a law enforcement
6158 officer, at least two-thirds (2/3) of the committee, board, agency,
6259 department, office or entity that makes a rec ommendation or imposes
6360 disciplinary action shall be composed of law enforcement officers
6461 certified by the Council o n Law Enforcement Education and Training.

9288 B. Any findings or recommendatio ns from any committee, board,
9389 agency, department, office or entity shall require a majority vo te
9490 to do any of the following:
9591 1. Investigate law enforcement officer mis conduct;
9692 2. Influence the conduct of or certify law enforcement officer
9793 misconduct investigations;
9894 3. Recommend disciplinary actions for law enforcement officer
9995 misconduct; or
10096 4. Impose discipline for law enforcement officer misconduct.
10197 C. If the person or committee, board, age ncy, department,
10298 office or entity does n ot meet the two-thirds (2/3) requirement
10399 prescribed in subsection A of this section, a supervisor, a
104100 department or an agency head that supervises a law enforcement
105101 officer may investigate and impose discipline for th e law
106102 enforcement officer's misconduct if the supervisor, department or
107103 agency head acts independently of the person, committee, board,
108104 agency, department, office or entity.
109105 D. This section shall not apply to any of the following:
110106 1. A person or a committee, board, agency, department , office,
111107 civil service board or entity that only r eviews the actions
112108 described in subsection A of this section and does not determine the
113109 initial level of discipline or have the authority to increase the
114110 severity of the disciplinary action ;

142137 2. The Council on Law Enforcement Education and Training
143138 (CLEET);
144139 3. A multijurisdictional law enforcement agency or task force
145140 or a similar entity that is charged with investigating the use of
146141 force by law enforcement offi cers, if at least two -thirds (2/3) of
147142 the membership of the multijurisdictional law enforcement agency or
148143 task force or the similar entity consists of law enforcement
149144 officers who are certified by CLEET;
150145 4. An entity that investigates federal employment
151146 discrimination; and
152147 5. The Oklahoma Stat e Bureau of Investigation .
153148 E. The Legislature finds that setting and maintaining standards
154149 of professionalism and integrity of law enforcement officers in this
155150 state are of statewide concern.
156151 SECTION 2. This act shall become effective November 1, 2023.
