55 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

56 | 53 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
57 | 54 | | in the Oklahoma Statutes as Section 34.6 of Title 22, unless there |
---|
58 | 55 | | is created a duplication in numbering, reads as follows: |

59 | 56 | | A. When a government entity establishes a citizen review board |
---|
60 | 57 | | to investigate an allegation of misconduct by a law enforcement |
---|
61 | 58 | | officer, at least two-thirds (2/3) of the committee, board, agency, |
---|
62 | 59 | | department, office or entity that makes a rec ommendation or imposes |
---|
63 | 60 | | disciplinary action shall be composed of law enforcement officers |
---|
64 | 61 | | certified by the Council o n Law Enforcement Education and Training. |

96 | 92 | | 2. Influence the conduct of or certify law enforcement officer |

97 | 93 | | misconduct investigations; |

98 | 94 | | 3. Recommend disciplinary actions for law enforcement officer |
---|
99 | 95 | | misconduct; or |
---|
100 | 96 | | 4. Impose discipline for law enforcement officer misconduct. |

101 | 97 | | C. If the person or committee, board, age ncy, department, |
---|
102 | 98 | | office or entity does n ot meet the two-thirds (2/3) requirement |
---|
103 | 99 | | prescribed in subsection A of this section, a supervisor, a |
---|
104 | 100 | | department or an agency head that supervises a law enforcement |
---|
105 | 101 | | officer may investigate and impose discipline for th e law |
---|
106 | 102 | | enforcement officer's misconduct if the supervisor, department or |
---|
107 | 103 | | agency head acts independently of the person, committee, board, |
---|
108 | 104 | | agency, department, office or entity. |
---|
109 | 105 | | D. This section shall not apply to any of the following: |
---|
110 | 106 | | 1. A person or a committee, board, agency, department , office, |
---|
111 | 107 | | civil service board or entity that only r eviews the actions |
---|
112 | 108 | | described in subsection A of this section and does not determine the |
---|
113 | 109 | | initial level of discipline or have the authority to increase the |
---|
114 | 110 | | severity of the disciplinary action ; |

147 | 142 | | the membership of the multijurisdictional law enforcement agency or |

148 | 143 | | task force or the similar entity consists of law enforcement |

149 | 144 | | officers who are certified by CLEET; |
---|
150 | 145 | | 4. An entity that investigates federal employment |

151 | 146 | | discrimination; and |
---|
152 | 147 | | 5. The Oklahoma Stat e Bureau of Investigation . |
---|
153 | 148 | | E. The Legislature finds that setting and maintaining standards |
---|
154 | 149 | | of professionalism and integrity of law enforcement officers in this |
---|
155 | 150 | | state are of statewide concern. |
---|
156 | 151 | | SECTION 2. This act shall become effective November 1, 2023. |
