4043 An Act relating to firearms; defining terms;
4144 specifying types of entities that must compl y with
4245 certain contractual requirements; prohibiting
4346 governmental entities from contracting with companies
4447 under certain circumstances; stating specifics of
4548 written verification; providing an exception for
4649 specific governmental entities; requiring the
4750 Director of the Office of Management and Enter prise
4851 Services to provide oversight and advice to
4952 governmental entities; providing for codification;

5659 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5760 SECTION 1. NEW LAW A new secti on of law to be codified
5861 in the Oklahoma Statutes as Section 1289.31 of Title 21, unless
5962 there is created a duplication in numbering, reads as follows:
6063 A. As used in this section:
6164 1. "Ammunition" means a loaded cartridge or shot shell, case,
6265 primer, projectile, wadding, or propellant powder;
6366 2. "Company" means a for-profit organization, association,
6467 corporation, partnership, joint venture, limited partnership,

95+limited liability partnership , or limited liability com pany,
9296 including a wholly owned subsidiar y, majority-owned subsidiary,
9397 parent company, or an affiliate of those entities or associations
9498 that exists to make a profit. The term does not include a sole
9599 proprietorship;
96100 3. "Contract" means a promise or set of promises constituting
97101 an agreement between the parties that gives each a legal duty to the
98102 other and also the right to see k a remedy for the breach of those
99103 duties, but does not include an agreement relat ed to investment
100104 services;
101105 4. "Discriminate against a firearm entity or firearm trade
102106 association" means, with respect to the entity or association, to:
103107 a. refuse to engage in the trade of a ny goods or services
104108 with the entity or association based solely on its
105109 status as a firearm entity or fire arm trade
106110 association, which includes the lawful products and
107111 services and lawful practices provided by the firearm
108112 entity or firearm trade associatio n,
109113 b. refrain from continuing an existing business
110114 relationship with the entity or association based
111115 solely on its status as a firearm entity or firearm
112116 trade association, which includes the lawful products
113117 and services and lawful practices provided by the
114118 firearm entity or firearm trade association , or

141146 c. terminate an existing business relationship with the
142147 entity or association based solely on its status as a
143148 firearm entity or firearm trade association, which
144149 includes the lawful products and serv ices and lawful
145150 practices provided by the firearm entity or firearm
146151 trade association.
147152 The term does not include the policies of a vendor, merchant,
148153 retail seller, or platform that restrict or prohibit the listing or
149154 selling of ammunition, firea rms, or firearm accessories. The term
150155 also does not include a company 's refusal to engage in the trade of
151156 any goods or services, deci sion to refrain from continuing an
152157 existing business relationship, or decision to terminate an existing
153158 business relationship to comply with federal, state, or local laws,
154159 policies, or regulations or a directive by a regulatory agency, or
155160 for any traditional business reason that is specific to t he customer
156161 or potential customer and not based solely on the status of an
157162 entity or association as a firearm entity or firearm trade
158163 association, which includes the lawful products and serv ices and
159164 lawful practices provided by the firearm entity or firearm trade
160165 association;
161166 5. "Firearm" means a weapon that expels a projectile by the
162167 action of explosive or expanding gases;
163168 6. "Firearm accessory" means a device specifically designed or
164169 adapted to enable an indiv idual to wear, carry, store, or mount a

191197 firearm on the individual or on a conveyance and an item used in
192198 conjunction with or mounted on a firearm that is not essential to
193199 the basic function of the firearm. The term includes a detachable
194200 firearm magazine;
195201 7. "Firearm entity" means:
196202 a. a firearm, firearm accessory or ammunition
197203 manufacturer, distributor, wholesaler, supplier, or
198204 retailer, and
199205 b. a gun range;
200206 8. "Firearm trade association " means any person, corporation,
201207 unincorporated association, federatio n, business league, or business
202208 organization that:
203209 a. is not organized or operated for profit and for which
204210 none of its net earnings inures to th e benefit of any
205211 private shareholder or individual,
206212 b. has two or more firearm entities as members, and
207213 c. is exempt from federal income taxation under Sec tion
208214 501(a), Internal Revenue Code of 1986, as an
209215 organization described by Section 501(c) of that co de;
210216 9. "Governmental entity" means any branch, department, agency,
211217 or instrumentality of state government, or any official or other
212218 person acting under co lor of state law, or any political subdivision
213219 of this state; and

240247 10. "Sole-source provider" means a supplier who provides goods
241248 or services of a unique nature or goods or services that are solely
242249 available through the supplier and the supplier is the onl y
243250 practicable source to provide such goods or services.
244251 B. The provisions of this section shall appl y only to a
245252 contract that:
246253 1. Is between a governmental entity and a company with at least
247254 ten (10) full-time employees; and
248255 2. Has a value of at least O ne Hundred Thousand Dollars
249256 ($100,000.00) that is paid wholly or partly from public funds of the
250257 governmental entity.
251258 C. Except as provid ed by subsection D of this section, a
252259 governmental entity may not enter into a contract with a company for
253260 the purchase of goods or services unless the contract co ntains a
254261 written verification from the company that it:
255262 1. Does not have a practice, policy, guidance, or directive
256263 that discriminates against a firearm entity or firearm trade
257264 association; and
258265 2. Will not discriminate during the term of the contract
259266 against a firearm entity or firearm trade association.
260267 D. The provisions of subsection C of thi s section shall not
261268 apply to a governmental entity that:
262269 1. Contracts with a sole-source provider; or

289297 2. Does not receive a bid from a company that is able to
290298 provide the written verification required by subsection C of this
291299 section.
292300 E. The Central Purchasing Division of the Office of Management
293301 and Enterprise Services shall have the authority and responsibility
294302 of reviewing state governmental contracts to confirm that the
295-required documents of subsection C of this section have been
296-provided.
297-F. A government entity shall utilize its current methods of
298-processing and analyzing the provisions within a contractual
299-agreement and shall con firm that the required written verification,
300-provided for in subsection C of this section, has been included a nd
301-made a part of the contractual agreement.
302-G. The provisions of this section shall only apply to financial
303-institutions that have Fifty Billion Dollars ($50,000,000,000.00) or
304-more in assets.
303+requirements of subsection C of this section have been satisfied.
305304 SECTION 2. This act shall become effective November 1, 2023.
