56 | 59 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

57 | 60 | | SECTION 1. NEW LAW A new secti on of law to be codified |
---|
58 | 61 | | in the Oklahoma Statutes as Section 1289.31 of Title 21, unless |
---|
59 | 62 | | there is created a duplication in numbering, reads as follows: |

60 | 63 | | A. As used in this section: |
---|
61 | 64 | | 1. "Ammunition" means a loaded cartridge or shot shell, case, |
---|
62 | 65 | | primer, projectile, wadding, or propellant powder; |
---|
63 | 66 | | 2. "Company" means a for-profit organization, association, |
---|
64 | 67 | | corporation, partnership, joint venture, limited partnership, |
---|
92 | 96 | | including a wholly owned subsidiar y, majority-owned subsidiary, |
---|
93 | 97 | | parent company, or an affiliate of those entities or associations |
---|
94 | 98 | | that exists to make a profit. The term does not include a sole |
---|
95 | 99 | | proprietorship; |

96 | 100 | | 3. "Contract" means a promise or set of promises constituting |
---|
97 | 101 | | an agreement between the parties that gives each a legal duty to the |
---|
98 | 102 | | other and also the right to see k a remedy for the breach of those |
---|
99 | 103 | | duties, but does not include an agreement relat ed to investment |
---|
100 | 104 | | services; |
---|
101 | 105 | | 4. "Discriminate against a firearm entity or firearm trade |
---|
102 | 106 | | association" means, with respect to the entity or association, to: |
---|
103 | 107 | | a. refuse to engage in the trade of a ny goods or services |
---|
104 | 108 | | with the entity or association based solely on its |
---|
105 | 109 | | status as a firearm entity or fire arm trade |
---|
106 | 110 | | association, which includes the lawful products and |
---|
107 | 111 | | services and lawful practices provided by the firearm |
---|
108 | 112 | | entity or firearm trade associatio n, |
---|
109 | 113 | | b. refrain from continuing an existing business |
---|
110 | 114 | | relationship with the entity or association based |
---|
111 | 115 | | solely on its status as a firearm entity or firearm |
---|
112 | 116 | | trade association, which includes the lawful products |
---|
113 | 117 | | and services and lawful practices provided by the |
---|
114 | 118 | | firearm entity or firearm trade association , or |
---|

149 | 154 | | selling of ammunition, firea rms, or firearm accessories. The term |

150 | 155 | | also does not include a company 's refusal to engage in the trade of |
---|
151 | 156 | | any goods or services, deci sion to refrain from continuing an |
---|
152 | 157 | | existing business relationship, or decision to terminate an existing |
---|
153 | 158 | | business relationship to comply with federal, state, or local laws, |
---|
154 | 159 | | policies, or regulations or a directive by a regulatory agency, or |
---|
155 | 160 | | for any traditional business reason that is specific to t he customer |
---|
156 | 161 | | or potential customer and not based solely on the status of an |
---|
157 | 162 | | entity or association as a firearm entity or firearm trade |
---|
158 | 163 | | association, which includes the lawful products and serv ices and |
---|
159 | 164 | | lawful practices provided by the firearm entity or firearm trade |
---|
160 | 165 | | association; |
---|
161 | 166 | | 5. "Firearm" means a weapon that expels a projectile by the |
---|
162 | 167 | | action of explosive or expanding gases; |
---|
163 | 168 | | 6. "Firearm accessory" means a device specifically designed or |
---|
164 | 169 | | adapted to enable an indiv idual to wear, carry, store, or mount a |
---|

200 | 206 | | 8. "Firearm trade association " means any person, corporation, |

201 | 207 | | unincorporated association, federatio n, business league, or business |
---|
202 | 208 | | organization that: |

203 | 209 | | a. is not organized or operated for profit and for which |
---|
204 | 210 | | none of its net earnings inures to th e benefit of any |
---|
205 | 211 | | private shareholder or individual, |
---|
206 | 212 | | b. has two or more firearm entities as members, and |
---|
207 | 213 | | c. is exempt from federal income taxation under Sec tion |
---|
208 | 214 | | 501(a), Internal Revenue Code of 1986, as an |
---|
209 | 215 | | organization described by Section 501(c) of that co de; |
---|
210 | 216 | | 9. "Governmental entity" means any branch, department, agency, |
---|
211 | 217 | | or instrumentality of state government, or any official or other |
---|
212 | 218 | | person acting under co lor of state law, or any political subdivision |
---|
213 | 219 | | of this state; and |

244 | 251 | | B. The provisions of this section shall appl y only to a |

245 | 252 | | contract that: |
---|
246 | 253 | | 1. Is between a governmental entity and a company with at least |
---|
247 | 254 | | ten (10) full-time employees; and |
---|
248 | 255 | | 2. Has a value of at least O ne Hundred Thousand Dollars |
---|
249 | 256 | | ($100,000.00) that is paid wholly or partly from public funds of the |
---|
250 | 257 | | governmental entity. |
---|
251 | 258 | | C. Except as provid ed by subsection D of this section, a |
---|
252 | 259 | | governmental entity may not enter into a contract with a company for |
---|
253 | 260 | | the purchase of goods or services unless the contract co ntains a |
---|
254 | 261 | | written verification from the company that it: |
---|
255 | 262 | | 1. Does not have a practice, policy, guidance, or directive |
---|
256 | 263 | | that discriminates against a firearm entity or firearm trade |
---|
257 | 264 | | association; and |
---|
258 | 265 | | 2. Will not discriminate during the term of the contract |
---|
259 | 266 | | against a firearm entity or firearm trade association. |
---|
260 | 267 | | D. The provisions of subsection C of thi s section shall not |
---|
261 | 268 | | apply to a governmental entity that: |
---|
262 | 269 | | 1. Contracts with a sole-source provider; or |
---|
263 | 270 | | |
---|

297 | | - | F. A government entity shall utilize its current methods of |
---|
298 | | - | processing and analyzing the provisions within a contractual |
---|
299 | | - | agreement and shall con firm that the required written verification, |
---|
300 | | - | provided for in subsection C of this section, has been included a nd |
---|
301 | | - | made a part of the contractual agreement. |
---|
302 | | - | G. The provisions of this section shall only apply to financial |
---|
303 | | - | institutions that have Fifty Billion Dollars ($50,000,000,000.00) or |
---|
304 | | - | more in assets. |
---|
