4297 directed by said the health care professional.

4498 B. As used in this section:

46-1. “Sexual assault” means: ENR. H. B. NO. 2236 Page 2

99+1. “Sexual assault” means:
48100 a. rape, or rape by instrumentation, as defined in
49101 Sections 1111, 1111.1 and 1114 of this title, or
50-
51102 b. forcible sodomy, as defined in Section 888 of this
52103 title; and

54104 2. “Qualified licensed health care professional ” means a
55105 physician, registered nurse, or other licensed heal th care
56106 professional qualified by training and experience to perform sexual
57107 assault examinations.

59108 C. The Crime Victims Compensa tion Board is authorized to pay
60109 for this examination and the medicatio ns directed by the qualified
61110 licensed health care professi onal upon application submitted by the
62111 victim of a sexual assault.

64112 D. The Crime Victim s Compensation Board shall establish the
65113 procedures for disbursement of th e Sexual Assault Examination Fund,
66114 but in no event shall the Crime Victims Compensation Board p ay an
67115 amount to exceed:

69116 1. Four Hundred Fifty Dollars ($450.00) Eight Hundred Dollars
70117 ($800.00) for a sexual assault examination; and

72144 2. Fifty Dollars ($50.00) One Hundred Dollars ($100.00) for
73145 medications which are related to the sexual assault and directed an d
74146 deemed necessary by said the health care professional.

76147 Such payments shall not exceed the a mounts specified by this
77148 subsection regardless of the amount of any individual bills
78149 comprising the claim. Payments shall be made only upon claims
79150 signed by the victim or guardian and health care professional.

81151 E. The District Attorneys Council is hereby authorized to
82152 transfer funds, as specified in the appropriations bill annually,
83153 from the Crime Victims Compensation Fund to the Sexual Assault
84154 Examination Fund for the payment of sexual assault forensic
85155 examinations and medications, pursuant to this sectio n.

87156 F. Nothing in this section shall prevent the Legislature from
88157 appropriating money to the Sexua l Assault Examination Fund for the
89158 payment of sexual assault fo rensic examinations and medications,
90159 pursuant to this section.

92160 SECTION 2. NEW LAW A new section of law to be codified
93161 in the Oklahoma Statutes as Section 215.41 of Title 19, unless there
94162 is created a duplication in numb ering, reads as follows:

96163 Subject to availability of fu nding, there is esta blished until
97164 October 1, 2025, within the District Attorneys Council under the
98165 direction of the Executive Coor dinator of the District Attorneys
99166 Council, the position of Sexual Assault Nurse Examiner (SANE)
100167 Statewide Coordinator. The Statewide Coordinator shall oversee

101194 forensic medical examination training throughout the state, recruit
102195 and develop SANE professionals, create and expand local Sexual
103196 Assault Nurse Examiner programs and Sexual Assault Response Team
104197 programs throughout this state, and coordinate payments from the
105198 Sexual Assault Examination Fund.

107199 SECTION 3. This act shall become eff ective November 1, 2023.
