19	50		assault examination fund; increasing the sexual

33	64		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	65		SECTION 1. AMENDATORY 21 O.S. 2021, Section 142.20, i s
36	66		amended to read as follows :

38	67		Section 142.20 A. A Sexual Assault Examination Fund shall be
39	68		established for the purpose of providing to a victim of a s exual
40	69		assault a forensic medical examination by a qualified licensed

44	98		B. As used in this section:

46		-	1. “Sexual assault” means: ENR. H. B. NO. 2236 Page 2

	99	+	1. “Sexual assault” means:
48	100		a. rape, or rape by instrumentation, as defined in
49	101		Sections 1111, 1111.1 and 1114 of this title, or
50		-
51	102		b. forcible sodomy, as defined in Section 888 of this
52	103		title; and

54	104		2. “Qualified licensed health care professional ” means a
55	105		physician, registered nurse, or other licensed heal th care
56	106		professional qualified by training and experience to perform sexual
57	107		assault examinations.

59	108		C. The Crime Victims Compensa tion Board is authorized to pay
60	109		for this examination and the medicatio ns directed by the qualified
61	110		licensed health care professi onal upon application submitted by the
62	111		victim of a sexual assault.

64	112		D. The Crime Victim s Compensation Board shall establish the
65	113		procedures for disbursement of th e Sexual Assault Examination Fund,
66	114		but in no event shall the Crime Victims Compensation Board p ay an
67	115		amount to exceed:

69	116		1. Four Hundred Fifty Dollars ($450.00) Eight Hundred Dollars
70	117		($800.00) for a sexual assault examination; and

72	144		2. Fifty Dollars ($50.00) One Hundred Dollars ($100.00) for
73	145		medications which are related to the sexual assault and directed an d
74	146		deemed necessary by said the health care professional.

76	147		Such payments shall not exceed the a mounts specified by this
77	148		subsection regardless of the amount of any individual bills
78	149		comprising the claim. Payments shall be made only upon claims
79	150		signed by the victim or guardian and health care professional.

81	151		E. The District Attorneys Council is hereby authorized to
82	152		transfer funds, as specified in the appropriations bill annually,
83	153		from the Crime Victims Compensation Fund to the Sexual Assault
84	154		Examination Fund for the payment of sexual assault forensic
85	155		examinations and medications, pursuant to this sectio n.

87	156		F. Nothing in this section shall prevent the Legislature from
88	157		appropriating money to the Sexua l Assault Examination Fund for the
89	158		payment of sexual assault fo rensic examinations and medications,
90	159		pursuant to this section.

92	160		SECTION 2. NEW LAW A new section of law to be codified
93	161		in the Oklahoma Statutes as Section 215.41 of Title 19, unless there
94	162		is created a duplication in numb ering, reads as follows:

96	163		Subject to availability of fu nding, there is esta blished until
97	164		October 1, 2025, within the District Attorneys Council under the
98	165		direction of the Executive Coor dinator of the District Attorneys
99	166		Council, the position of Sexual Assault Nurse Examiner (SANE)
100	167		Statewide Coordinator. The Statewide Coordinator shall oversee
