42143 BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:

44144 SECTION 1. AMENDATORY 47 O.S. 2021, Sec tion 1135.2, as
45145 amended by Section 2, Chapter 397, O.S.L. 2022 (47 O.S. Supp. 2022,

48147 Section 1135.2 A. Service Oklahoma is hereby authorized to
49148 design and issue appropriate official speci al license plates to
50149 persons in recognition of their service or awards as provided by

53177 Special license plates shall not be transferr ed to any other
54178 person but shall be removed from the vehicle upon transfer of
55179 ownership and retained. The spec ial license plate may then be used
56180 on another vehicle but only after such other vehicle has been
57181 registered for the current year.

59182 Special license plates shall be renewed each year by Service
60183 Oklahoma or a licensed operator. Service Oklahoma shall annually
61184 notify by mail all persons issued special license plates. The
62185 notice shall contain all necessary information and shall contain
63186 instructions for the renewal procedure upon presentation to a
64187 licensed operator or Service Oklahoma. The license plates shall be
65188 issued on a staggered system except for legisla tive plates and
66189 amateur radio operator license plates.

68190 Service Oklahoma is hereby directed to develop and implement a
69191 system whereby licensed operators are permitted to accept
70192 applications for special license plates authorized under this
71193 section. The licensed operator shall confirm the applicant's
72194 eligibility, if appli cable, collect and deposit any amount
73195 specifically authorized by law, accept and process the necessary
74196 information directly into such system and generate a receipt
75197 accordingly. For performance of these duties, licensed operators
76198 shall retain the fee provi ded in Section 1141.1 of this title for
77199 registration of a motor vehicle. The licensed operator fees for
78200 acceptance of applications and renewals shall be pai d out of the

79227 Oklahoma Tax Commission Reimbursement Fund. Beginning January 1,

84231 B. The special license plates provided by this section are as

87233 1. Prisoner of War License Plates - such plates shall be
88234 designed for honorably discharged or present members of the United
89235 States Armed Forces and ci vilians who were former prisoners of war
90236 held by a foreign country and w ho can provide proper certification
91-of that status. Such persons may apply for a prisoner of war ENR. H. B. NO. 2255 Page 3
237+of that status. Such persons may apply for a prisoner of war
92238 license plate for no more than two vehicles with each vehicle having
93239 a rated carrying capacity of one (1) ton or less. The surviving
94240 spouse of any deceased f ormer prisoner of war, if the spouse has not
95241 since remarried, or if remarried, the remarriage is terminated by
96242 death, divorce, or annulment, may apply for a pri soner of war
97243 license plate for one vehicle with a rated carrying capacity of one
98244 (1) ton or less. The fee provided by this section for the special
99245 license plate authorized by this paragraph shall be in addition to
100246 all other registration fees provided by l aw, except the registrat ion
101247 fees levied by Section 1132 of this title;

103248 2. National Guard Licens e Plates - such plates shall be

115284 4. United States Armed Forces License Plates - such plates
116285 shall be designed for active, retired, former or rese rve members of
117286 the United States Armed Forces, and shall identify which branch of
118287 service, and carry the emblem and name of either the Army, Navy, Air
119288 Force, Marines or Coast Guard, according to the branch of service to
120289 which the member belongs or did belo ng. Former members who have
121290 been dishonorably discharged shall not be e ligible for such plates.
122291 Persons applying for such license plate must show proof of present
123292 or past military service by presenting a valid Uniformed Services
124293 Identity Card or the Unit ed States Department of Defense Form
125294 (DD)214. Retired or former members who are eligible for such plates
126295 shall provide proof of eligibility upon initial application, but
127296 shall not be required to provide proof of eligibility annuall y;

129297 5. Congressional Med al of Honor Recipient License Plates - such
130298 plates shall be designed for any resident of this state who has been
131299 awarded the Congressional Medal of Honor. Such persons may apply

136329 6. Missing In Action License Plates - such plates shall be
137330 designed to honor members of the United States Arm ed Forces who are
138331 missing in action. The spouse of such missing person, if the spouse
139332 has not since remarried, or if remarried, the remarriage is
140333 terminated by death, divorce, or annulment, and each parent of the
141334 missing person may apply for a missing in action license plate upo n
142335 presenting proper certification that the person is missing in action
143336 and that the person making the application is the qualifying spouse
144337 or the parent of the missing pe rson. The qualifying spouse and each
145338 parent of the missing pe rson may each apply for the missing in
146339 action license plate for each vehicle with a rated carryi ng capacity
147340 of one (1) ton or less;

149341 7. Purple Heart Recipient License Plates - such plates shall be
150342 designed for any resident of this state presenting proper
151343 certification from the Un ited States Department of Veterans Affairs
152344 or the Armed Forces of the Un ited States certifying that such
153345 resident has been awarded the Purple Heart military decoration.
154346 Such persons may apply for a Purple Heart recipient license pl ate
155347 for vehicles having a rated carrying capacity of one (1) ton or
156348 less. The surviving spouse of any deceased veteran who has been
157349 awarded the Purple Heart military decoration, if such spouse has not
158350 since remarried, or if remarried, the remarriage has b een terminated

165382 designed for any resident of this state who can be verified by the
166383 United States Department of Veterans Affairs or t he Armed Forces of
167384 the United States as being:

169385 a. a member of the United States Armed Forces on December
170386 7, 1941,

172387 b. stationed on December 7, 1941, during the hours of
173388 7:55 a.m. to 9:45 a.m. Hawaii time at Pearl Harbor,
174389 the island of Oahu, or offshore at a distance not to
175390 exceed three (3) miles, and

177391 c. a recipient of an honorable discharge from the United
178392 States Armed Forces.

203436 numbers shall be a logo of the flag-raising at Iwo Jima. Below the
204437 letters, logo and numbers, the plate shall contai n the words "FEB."

206439 plates shall not be subject to the design requirements of any other
207440 license plates prescribed by law other than the space for the
208441 placement of the yearly decals for eac h succeeding year of

212444 designed for any resident of this state who can be verified by the
213445 United States Department of Veterans Affairs or the Armed Forces of

221477 participation cannot be verified by the United States

238491 license plate upon presenting proper certi fication that the person

242495 vehicles with each vehicle with a rated carrying ca pacity of one (1)

247526 2021, the killed in action license plate shall be designed to honor
248527 members of the United States Armed Forces who were killed in action
249528 while engaged in combat with a hostile forc e. The parents,
250529 siblings, half-siblings, grandparents or spouse of the decease d
251530 person, if the spouse has not remarried, or if remarried, the
252531 remarriage is terminated by death, divorce or annulment, may apply
253532 for a killed in action license plate upon pres enting proper
254533 certification that the person was killed in action and that the
255534 person making the application is the qualifying spouse or family
256535 member of the deceased person. The qualifying spouse or family
257536 member may apply for a killed in action license p late for no more
258537 than two vehicles with each vehicle with a rated carrying capa city
259538 of one (1) ton or less. The license plate shall have a white
260539 background and the legend "Killed in Action" and shall contain any
261540 combination of numbers and letters from one to a maximum of seven in
262541 black, as for personalized license plates. To the le ft of the
263542 numbers and letters shall be the Battlefield Cross in gold. The
264543 killed in action license plate shall be exempt from any minimum
265544 issuance criteria related to license p late applications;

267545 12. Gold Star Families License Plates - such plates shall be
268-designed to honor members of the United States Armed Forces who were ENR. H. B. NO. 2255 Page 7
546+designed to honor members of the United States Armed Forces who were
269547 killed while on active duty. The parents, siblings, half-siblings
270548 or grandparents of the deceased person may apply for a gold star

282585 13. Military Decoration License Plates - such plates shall be
283586 designed for any reside nt of this state who has been awarde d the
284587 Distinguished Service Medal, the Distinguished Service Cross, the
285588 Distinguished Flying Cross, the Bronze Star military decoration or
286589 the Silver Star military decoration. Such persons may apply for a
287590 military decoration license plate for each vehicle with a rated
288591 carrying capacity of one (1) ton or less;

290592 14. Vietnam Veteran Li cense Plates - such plates shall be
291593 designed for honorably discharged or present members of the United
292594 States Armed Forces who served in the Vietnam Conflict. Such
293595 persons may apply for a Vietnam veteran license plate for each
294596 vehicle with a rated carryin g capacity of one (1) ton or less;

296597 15. Police Officer License Plates - such plates shall be
297598 designed for any currently employed, reserve or retired municipal

302629 apply for police officer license plates for vehicles with a rated
303630 capacity of one (1) to n or less or for a motorcycle upon proof of
304631 employment by or retirement from a municipal, university or common
305632 education police department by either an identification card or
306633 letter from the chief of the police department or the Oklahoma
307634 Police Pension and Retirement Board. Retirees who are eligible for
308635 such plates shall provide proof of eligibility upon initial
309636 application but shall not be re quired to provide proof of
310637 eligibility annually. The license plates shall be designed in
311638 consultation with municip al police departments of this state;

316642 16. World War II Veteran License Plates - such plates shall be
317643 designed to honor honorably discharged former members of the United
318644 States Armed Forces who are residents of this state and who can be
319645 verified by the Military Department of the State of Oklahoma, the
320646 Department of Veterans Affairs or the Armed Forces of the United
321647 States as having served on federal active duty anytime during the
322648 period from September 16, 1940, to December 7, 1945. The former

326677 The license plate shall have the legend "Oklahoma" and shall
327678 contain, in the center of the plate, either the Thunderbird Insignia
328679 of the 45th Infantry Division in the prescribed red and gold
329680 coloring or the emblem of the Army, Navy, U.S. Army Air Corps,
330681 Marines or Coast Guard according to the branch of service to which
331682 the member belonged. For the purpose of license plate
332683 identification, the plate shall contain four digits, two digits at
333684 the left and two digits at the right of the insignia or emblem.
334685 Centered on the bottom of the license plate shall be the words
335686 "WORLD WAR II";

337687 17. Korean War Veteran License Plates - such plates shall be
338688 designed to honor honorably discharged former members of th e United
339689 States Armed Forces who are residents of this state and who can be
340690 verified by the Military Department of the State of Oklahoma , the
341691 Department of Veterans Affairs or the Armed Forces of the United
342692 States as having served on federal activ e duty anytime during the
343693 period from June 27, 1950, to January 31, 1955, both dates
344694 inclusive. The former members may apply for a Korean War Vete ran
345695 license plate for vehicles with a rated carrying capacity of one (1)
346696 ton or less.

348697 The license plate shall have the legend "OKLAHOMA" and shall

358732 18. Municipal Official License Plates - such plates shall be
359733 designed for persons elected to a municipal office in this state and
360734 shall designate the name of the municipality and the district or
361735 ward in which the municipa l official serves. The plates shall only
362736 be produced upon application;

364737 19. Red Cross Volunteer License Plates - such plates shall be
365738 designed to honor American Red Cross volunteers and staff who are
366739 residents of this state. Such persons must present an
367740 identification card issued by the American Red Cross and bearing a
368741 photograph of the per son. The license plate shall be designed with
369742 the assistance of the American Red Cross and shall have the legend
370743 "Oklahoma OK!" in the color Pantone 186C Red. Below t he legend the
371744 symbol of the American Red Cross and no more than three letters and
372745 three numbers shall be in the color Pantone 186C Red. Below the
373746 symbol and letters and numbers shall be the words "American Red
374747 Cross" in black. The plates shall not be sub ject to the design
375748 requirements of any other license plates prescribed by law other

28915453 C. The fee for such plates shall be Thirty-five Dollars
28925454 ($35.00) per year of r enewal and shall be in addition to all other
28935455 registration fees provided by the Oklahoma Vehicle Licens e and
28945456 Registration Act. The fee shall be apportioned as follows:

28965457 1. Twenty Dollars ($20.00) per year of renewal or any other
28975458 amount as provided in this title of the fee shall be apportioned as
28985459 provided or deposited in a fund as specified within the parag raph

29025462 be deposited in the Oklahoma Tax Commission Rei mbursement Fund to be

29045464 Registration Act. Beginning January 1, 2023, Eight Dollars ($8.00)
29055465 per year of renewal of the fee shall be deposited in th e Service
29065466 Oklahoma Reimbursement Fund to be used for the administrati on of the
29075467 Oklahoma Vehicle Lic ense and Registration Act; and
