42	143		BE IT ENACTED BY THE PEOP LE OF THE STATE OF OKLAHOMA:

44	144		SECTION 1. AMENDATORY 47 O.S. 2021, Sec tion 1135.2, as
45	145		amended by Section 2, Chapter 397, O.S.L. 2022 (47 O.S. Supp. 2022,

48	147		Section 1135.2 A. Service Oklahoma is hereby authorized to
49	148		design and issue appropriate official speci al license plates to
50	149		persons in recognition of their service or awards as provided by
51	150		this section.

53	177		Special license plates shall not be transferr ed to any other
54	178		person but shall be removed from the vehicle upon transfer of
55	179		ownership and retained. The spec ial license plate may then be used
56	180		on another vehicle but only after such other vehicle has been
57	181		registered for the current year.

59	182		Special license plates shall be renewed each year by Service
60	183		Oklahoma or a licensed operator. Service Oklahoma shall annually
61	184		notify by mail all persons issued special license plates. The
62	185		notice shall contain all necessary information and shall contain
63	186		instructions for the renewal procedure upon presentation to a
64	187		licensed operator or Service Oklahoma. The license plates shall be
65	188		issued on a staggered system except for legisla tive plates and
66	189		amateur radio operator license plates.

68	190		Service Oklahoma is hereby directed to develop and implement a
69	191		system whereby licensed operators are permitted to accept
70	192		applications for special license plates authorized under this
71	193		section. The licensed operator shall confirm the applicant's
72	194		eligibility, if appli cable, collect and deposit any amount
73	195		specifically authorized by law, accept and process the necessary
74	196		information directly into such system and generate a receipt
75	197		accordingly. For performance of these duties, licensed operators
76	198		shall retain the fee provi ded in Section 1141.1 of this title for
77	199		registration of a motor vehicle. The licensed operator fees for
78	200		acceptance of applications and renewals shall be pai d out of the

79	227		Oklahoma Tax Commission Reimbursement Fund. Beginning January 1,

84	231		B. The special license plates provided by this section are as
85	232		follows:

87	233		1. Prisoner of War License Plates - such plates shall be
88	234		designed for honorably discharged or present members of the United
89	235		States Armed Forces and ci vilians who were former prisoners of war
90	236		held by a foreign country and w ho can provide proper certification
91		-	of that status. Such persons may apply for a prisoner of war ~~ENR. H. B. NO. 2255 Page 3~~
	237	+	of that status. Such persons may apply for a prisoner of war
92	238		license plate for no more than two vehicles with each vehicle having
93	239		a rated carrying capacity of one (1) ton or less. The surviving
94	240		spouse of any deceased f ormer prisoner of war, if the spouse has not
95	241		since remarried, or if remarried, the remarriage is terminated by
96	242		death, divorce, or annulment, may apply for a pri soner of war
97	243		license plate for one vehicle with a rated carrying capacity of one
98	244		(1) ton or less. The fee provided by this section for the special
99	245		license plate authorized by this paragraph shall be in addition to
100	246		all other registration fees provided by l aw, except the registrat ion
101	247		fees levied by Section 1132 of this title;

103	248		2. National Guard Licens e Plates - such plates shall be
104	249		designed for active or retired members of the Oklahoma National
105	250		Guard. Retirees who are eligible for such plates shall provide

115	284		4. United States Armed Forces License Plates - such plates
116	285		shall be designed for active, retired, former or rese rve members of
117	286		the United States Armed Forces, and shall identify which branch of
118	287		service, and carry the emblem and name of either the Army, Navy, Air
119	288		Force, Marines or Coast Guard, according to the branch of service to
120	289		which the member belongs or did belo ng. Former members who have
121	290		been dishonorably discharged shall not be e ligible for such plates.
122	291		Persons applying for such license plate must show proof of present
123	292		or past military service by presenting a valid Uniformed Services
124	293		Identity Card or the Unit ed States Department of Defense Form
125	294		(DD)214. Retired or former members who are eligible for such plates
126	295		shall provide proof of eligibility upon initial application, but
127	296		shall not be required to provide proof of eligibility annuall y;

129	297		5. Congressional Med al of Honor Recipient License Plates - such
130	298		plates shall be designed for any resident of this state who has been
131	299		awarded the Congressional Medal of Honor. Such persons may apply
132	300		for a Congressional Medal of Honor recipient license plate for each

136	329		6. Missing In Action License Plates - such plates shall be
137	330		designed to honor members of the United States Arm ed Forces who are
138	331		missing in action. The spouse of such missing person, if the spouse
139	332		has not since remarried, or if remarried, the remarriage is
140	333		terminated by death, divorce, or annulment, and each parent of the
141	334		missing person may apply for a missing in action license plate upo n
142	335		presenting proper certification that the person is missing in action
143	336		and that the person making the application is the qualifying spouse
144	337		or the parent of the missing pe rson. The qualifying spouse and each
145	338		parent of the missing pe rson may each apply for the missing in
146	339		action license plate for each vehicle with a rated carryi ng capacity
147	340		of one (1) ton or less;

149	341		7. Purple Heart Recipient License Plates - such plates shall be
150	342		designed for any resident of this state presenting proper
151	343		certification from the Un ited States Department of Veterans Affairs
152	344		or the Armed Forces of the Un ited States certifying that such
153	345		resident has been awarded the Purple Heart military decoration.
154	346		Such persons may apply for a Purple Heart recipient license pl ate
155	347		for vehicles having a rated carrying capacity of one (1) ton or
156	348		less. The surviving spouse of any deceased veteran who has been
157	349		awarded the Purple Heart military decoration, if such spouse has not
158	350		since remarried, or if remarried, the remarriage has b een terminated

165	382		designed for any resident of this state who can be verified by the
166	383		United States Department of Veterans Affairs or t he Armed Forces of
167	384		the United States as being:

169	385		a. a member of the United States Armed Forces on December
170	386		7, 1941,
171		-
172	387		b. stationed on December 7, 1941, during the hours of
173	388		7:55 a.m. to 9:45 a.m. Hawaii time at Pearl Harbor,
174	389		the island of Oahu, or offshore at a distance not to
175	390		exceed three (3) miles, and
176		-
177	391		c. a recipient of an honorable discharge from the United
178	392		States Armed Forces.

180	393		Such person may apply for a Pe arl Harbor Survivor license plate
181	394		for each vehicle with a rated carrying capacity of one (1) ton or

184	396		9. Iwo Jima License Plates - such plates shall be designed for
185	397		any resident of this state who can be verified by the United States
186	398		Department of Veterans Affairs or the Armed Forces of the United

201	434		Such license plate shall have the legend "Oklahoma OK" and shall
202	435		contain three letters and three numbers. Between the letters and
203	436		numbers shall be a logo of the flag-raising at Iwo Jima. Below the
204	437		letters, logo and numbers, the plate shall contai n the words "FEB."
205	438		at the left, "Iwo Jima" in the center and "1945" at the right. Such
206	439		plates shall not be subject to the design requirements of any other
207	440		license plates prescribed by law other than the space for the
208	441		placement of the yearly decals for eac h succeeding year of
209	442		registration after the initial issue;

211	443		10. D-Day Survivor License Plates - such plates shall be
212	444		designed for any resident of this state who can be verified by the
213	445		United States Department of Veterans Affairs or the Armed Forces of
214	446		the United States as being:

216	447		a. a member of the United States Armed Forces on June 6,

234	487		designed to honor members of the United States Armed F orces who were
235	488		killed in action. The spouse of the deceased person, if the spouse
236	489		has not remarried, or if remarried, the remarriage is terminated by
237	490		death, divorce, or annulment, may apply for a killed in action
238	491		license plate upon presenting proper certi fication that the person
239	492		was killed in action and that the person making the application is
240	493		the qualifying spouse of the deceased person. The qualifying spouse
241	494		may apply for a killed in action license plate for no more than two
242	495		vehicles with each vehicle with a rated carrying ca pacity of one (1)
243	496		ton or less. The fee provided by this section for the special
244	497		license plate authorized by this paragraph shall be in addition to
245	498		all other registration fees provided by law, except the registration

251	530		person, if the spouse has not remarried, or if remarried, the
252	531		remarriage is terminated by death, divorce or annulment, may apply
253	532		for a killed in action license plate upon pres enting proper
254	533		certification that the person was killed in action and that the
255	534		person making the application is the qualifying spouse or family
256	535		member of the deceased person. The qualifying spouse or family
257	536		member may apply for a killed in action license p late for no more
258	537		than two vehicles with each vehicle with a rated carrying capa city
259	538		of one (1) ton or less. The license plate shall have a white
260	539		background and the legend "Killed in Action" and shall contain any
261	540		combination of numbers and letters from one to a maximum of seven in
262	541		black, as for personalized license plates. To the le ft of the
263	542		numbers and letters shall be the Battlefield Cross in gold. The
264	543		killed in action license plate shall be exempt from any minimum
265	544		issuance criteria related to license p late applications;

267	545		12. Gold Star Families License Plates - such plates shall be

285	588		Distinguished Flying Cross, the Bronze Star military decoration or
286	589		the Silver Star military decoration. Such persons may apply for a
287	590		military decoration license plate for each vehicle with a rated
288	591		carrying capacity of one (1) ton or less;

290	592		14. Vietnam Veteran Li cense Plates - such plates shall be
291	593		designed for honorably discharged or present members of the United
292	594		States Armed Forces who served in the Vietnam Conflict. Such
293	595		persons may apply for a Vietnam veteran license plate for each
294	596		vehicle with a rated carryin g capacity of one (1) ton or less;

296	597		15. Police Officer License Plates - such plates shall be
297	598		designed for any currently employed, reserve or retired municipal

311	638		consultation with municip al police departments of this state;

316	642		16. World War II Veteran License Plates - such plates shall be
317	643		designed to honor honorably discharged former members of the United
318	644		States Armed Forces who are residents of this state and who can be
319	645		verified by the Military Department of the State of Oklahoma, the

873	1682		specifically authorized by law, accept and process the necessary

876	1685		shall retain the fee provided in Section 1141.1 of this title for
877	1686		registration of a motor vehicle. The licensed operator fees for
878	1687		acceptance of applications and renewals shall be paid out of the

1760	3275		shall be the word "Retired". The letters "TRP" shall be used in
1761	3276		combination with three numbers on either side of the insignia or
1762	3277		emblem. The color of the letters and numbers shall be brown.
1763	3278		Retirees who are eligible for such plates shall provide proof of
1764	3279		eligibility upon initial application, but shall not be required to
1765	3280		provide proof of eligibility annually. The surviving spouse of any

1810	3373		children in permanent, safe homes. The license plates shall be
1811	3374		designed and final terminology delivered in consultation with the
1812	3375		Oklahoma Adoption Coalition and the Department of Human Services.

2849	5363		Oklahoma. The Tax Commission shall be authorized to enter into
2850	5364		licensing agreements with Diabetes Solutions of Oklahoma for any
2851	5365		licensing fees which may be required in order to use the Diabetes
2852	5366		Solutions of Oklahoma logos or designs. The licensing agreements
2853	5367		shall provide for a deposit to the Diabetes Awareness License Plate

2875	5413		District for any licensing fees which may be required in order to
2876	5414		use the school district's logo or design. The licensing agreement
2877	5415		shall provide for a payment to the Stillwater School District of not
2878	5416		more than Twenty Dollars ($20.00) for each license plate issued; and

2880	5417		114. Ally's House License Plate – such plates shall be designed
2881	5418		and issued to those persons who live in Oklahoma, have had a child
2882	5419		diagnosed with a form of cancer and wish to demonstrate support for
2883	5420		Ally's House. The license plates shall be designed in consultation
2884	5421		with Ally's House. Service Oklahoma shall be authorized to enter
2885	5422		into a licensing agreement with Ally's House for any licensing fees
2886	5423		which may be required in order to use the Ally's House logo or

2891	5453		C. The fee for such plates shall be Thirty-five Dollars
2892	5454		($35.00) per year of r enewal and shall be in addition to all other
2893	5455		registration fees provided by the Oklahoma Vehicle Licens e and
2894	5456		Registration Act. The fee shall be apportioned as follows:

2896	5457		1. Twenty Dollars ($20.00) per year of renewal or any other
2897	5458		amount as provided in this title of the fee shall be apportioned as
2898	5459		provided or deposited in a fund as specified within the parag raph
2899	5460		authorizing the special license plate;

2901	5461		2. Eight Dollars ($8.00) per year of renewal of t he fee shall
2902	5462		be deposited in the Oklahoma Tax Commission Rei mbursement Fund to be
2903	5463		used for the administration of the Oklahoma Vehicle License and
2904	5464		Registration Act. Beginning January 1, 2023, Eight Dollars ($8.00)
2905	5465		per year of renewal of the fee shall be deposited in th e Service
2906	5466		Oklahoma Reimbursement Fund to be used for the administrati on of the
2907	5467		Oklahoma Vehicle Lic ense and Registration Act; and
2908		-
2909	5468		3. Any remaining amounts of the fee shall be apportioned as
2910	5469		provided in Section 1104 of this title.

2912	5470		SECTION 4. This act shall become effective November 1, 2023.
