30	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

32	60		SECTION 1. AMENDATORY 59 O.S. 2021, Section 1000.24, is
33	61		amended to read as follows:

35	62		Section 1000.24 A. 1. Beginning July 1, 2009, pursuant to and
36	63		in compliance with Article I of the Administrative Procedures Act,
37	64		the Oklahoma Uniform Building Code Commis sion shall have the power
38	65		to adopt, amend, repeal and promulgate rules as may be necessary to
39	66		perform the duties required under the Oklahoma Uniform Building Code

40	94		Commission Act. Rules authorized under this section shall not
41	95		become effective prior to Octo ber 1, 2009.

43	96		2. Beginning October 1, 2009, the Commission shall have the
44	97		power to enforce the provisions of the Oklahoma Uniform Building

46	99		3. Any codes adopted by state agencies, municipalities or other
47	100		political subdivisions of the s tate prior to uniform codes being
48	101		adopted by the Oklahoma Uniform Building Code Commission, pursuant
49	102		to the provisions of, or rules promulgated pursuant to, the Oklahoma
50	103		Uniform Building Code Commission Act, shall be considered valid and
51	104		in effect until uniform codes are adopted by the Oklahoma Uniform
52	105		Building Code Commission.

54	106		B. The Oklahoma Uniform Building Code Commission shall have the
55	107		following powers:

57	108		1. Exercise all incidental powers and duties which are
58	109		necessary to effectuate the provisions of the Oklahoma Uniform
59	110		Building Code Commission Act;

61	111		2. Adopt and have an official seal;

63	112		3. Maintain an administrative staff , including, but not limited
64	113		to, an Oklahoma Uniform Building Code Commission Chief Executive
65	114		Officer;

67	115		4. Direct such other expendit ures as may be necessary in the
68	116		performance of its duties, including, but not limited to,
69	117		expenditures for office space, equipment, furnishings and contracts

70	145		for services. All expenditures shall be made pursuant to the
71	146		Oklahoma Central Purchasing Act ;

73	147		5. Appoint technical committees to review and recommend for
74	148		adoption all building codes. The technical committees shall review
75	149		and recommend building codes with any amendments f or adoption by the
76	150		Commission; and

78	151		6. Create a website listing all building codes adopted by the
79	152		Commission. The website shall provide a method for listing all
80	153		codes adopted by a state agency, city or any other political
81	154		subdivision of the st ate containing higher standards and
82	155		requirements than the codes adopted pursuant to the Oklahoma Uniform
83	156		Building Code Commission Act as required in Section 14-107 of Title
84	157		11 of the Oklahoma Statutes.

86	158		C. After October 1, 2009, the Commission shall account for all
87	159		receipts and expenditures of the monies of the Commission, including
88	160		annually preparing and publishing a statement of receipts and
89	161		expenditures of the Commission for each fiscal year. The

	162	+	Commission's annual statement of receipts and expenditures shall be
91	163		audited by the State Auditor and Inspector or an independent
92	164		accounting firm, and the audit report shall be certified to the
93	165		Governor of this state to be true and correct, under oath, by the
94	166		chair and vice-chair of the Commission.
