40	40	An Act relating to counties; directing that count ies
41	41	give priority to veteran operated business entities;
42	42	directing that counties shall provide certain
43	43	utilities; placing limitations; exempting certain
44	44	properties; providing for codification; and providing
45	45	an effective date.

50	50	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	51	SECTION 1. NEW LAW A new se ction of law to be codi fied
52	52	in the Oklahoma Statutes as Section 440 of Title 19, unless there is
53	53	created a duplication in numbering, reads as follows:
54	54	A. It shall be the duty of the board of county commissioners of
55	55	each county, with regard to the premises of county property under
56	56	their respective juri sdictions or the premises of prop erty leased by
57	57	them in whole or in part, to give priority to vending facilities
58	58	operated by business entities whose majority equity ownership is
59	59	owned by one or more veterans . Proof of veteran statu s and business
60	60	ownership shall be provided to the board of county commissioners.
61	61	B. Counties shall make available free of any charge, fee,
62	62	assessment or commission on sales adequate space with sufficient

89	89	electrical, plumbing, heatin g and ventilation outle ts for the
90	90	operation of a vending facility on satisfac tory sites. Counties
91	91	shall provide free of any charge, fee, assessment or commission on
92	92	sales the use of utilities needed to operate a vending facility.
93	93	C. The provisions of thi s section shall not app ly to the
94	94	operation of fairgrounds, exposition centers , trade/consumer show
95	95	facilities, parks, golf courses, hospitals operated by county trust
96	96	authorities, or commissaries for the benefit of persons lawfully
97	97	confined in the county j ail under the custody o f the county sheriff.
98	98	D. The provisions of this section shall not prohibit counties
99	99	from deciding to grant licensed blind operators priority p ursuant
100	100	Section 73 of Title 7 of the Oklahoma Statutes .
101	101	SECTION 2. This act shall become effective November 1, 2023.
