AS INTRODUCED 
 
An Act relating to counties; directing that count ies 
give priority to veteran operated business entities; 
directing that counties shall provide certain 
utilities; placing limitations; exempting certain 
properties; providing for codification; and providing 
an effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new se ction of law to be codi fied 
in the Oklahoma Statutes as Section 440 of Title 19, unless there is 
created a duplication in numbering, reads as follows: 
A.  It shall be the duty of the board of county commissioners of 
each county, with regard to the premises of county property under 
their respective juri sdictions or the premises of prop erty leased by 
them in whole or in part, to give priority to vending facilities 
operated by business entities whose majority equity ownership is 
owned by one or more veterans .  Proof of veteran statu s and business 
ownership shall be provided to the board of county commissioners. 
B.  Counties shall make available free of any charge, fee, 
assessment or commission on sales adequate space with sufficient

electrical, plumbing, heatin g and ventilation outle ts for the 
operation of a vending facility on satisfac tory sites.  Counties 
shall provide free of any charge, fee, assessment or commission on 
sales the use of utilities needed to operate a vending facility. 
C.  The provisions of thi s section shall not app ly to the 
operation of fairgrounds, exposition centers , trade/consumer show 
facilities, parks, golf courses, hospitals operated by county trust 
authorities, or commissaries for the benefit of persons lawfully 
confined in the county j ail under the custody o f the county sheriff. 
D. The provisions of this section shall not prohibit counties 
from deciding to grant licensed blind operators priority p ursuant 
Section 73 of Title 7 of the Oklahoma Statutes . 
SECTION 2.  This act shall become effective November 1, 2023.
