HOUSE BILL 2716 	By: Hefner 
 
 
 
 
 
AS INTRODUCED 
 
An Act relating to poor persons; requiring Department 
of Human Services to report certain information ; 
requiring Department to publish ce rtain information 
on website; providing for codification; and providing 
an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    NEW LAW     A new section of law to be codified 
in the Oklahoma Stat utes as Section 1020.1 of Title 56, unless there 
is created a duplication in numbering, reads as follows: 
A.  The Department of Human Services shall, by January 1 of each 
year, report the following information on the Department’s Internet 
website, which shall be accessible to the public, and to the 
President Pro Tempore of the Senate and the Speaker of the House of 
Representatives: 
1.  Any payments made to providers in the prior fiscal year for 
home- and community-based services for individuals with intellectual 
disabilities ; and

2.  A strategic plan for serving more individuals with 
intellectual disabilities through home- and community-based services 
including goals and progress tow ard achieving such goals. 
B.  The Department shall, by the fifth day of each month, 
publish on the Department ’s website, which shall be accessible to 
the public, the following information: 
1.  The number of individual s with intellectual disabilitie s 
currently receiving home- and community-based services; 
2.  Services provided to individuals with intellectual 
disabilities through home- and community-based services including 
which waiver each individual received for the majority of the m onth; 
3. Demographic information on individuals waiting to receive 
home- and community-based services for individuals with intellectual 
disabilities including, but not limited to, age, gender, location , 
and whether or not they are currently receiving benefits or supports 
including, but not limited to Medicaid, the Supplemental Nutrition 
Assistance Program (SNAP), Temporary Assistance for Needy Families 
(TANF), and other major state or federal assistance programs; 
4. The number of applicants who began receiving home- and 
community-based services for individuals with intellectual 
disabilities during the assessment period; 
5.  Any relevant trends in data relating to individuals waiting 
to receive home- and community-based services;

6.  The frequency of contact between the Department and 
applicants and the mode of contact; 
7.  Resource gaps by type and by geographic area; 
8.  Resource or community supports and resources in need of 
expansion; 
9.  The number of individ uals with intellectual disabilities who 
stopped receiving services in the prior month including: 
a. the number of individuals removed from each home- and 
community-based services waiver for individuals with 
intellectual disabilitie s, 
b. which waiver the individual was receiving at the time 
of removal, 
c. the reasons for removal and number of individuals 
removed for each reason, and 
d. how many individuals were removed within one (1) year 
of beginning receipt of services, the reasons for 
removal, and the number of individuals removed for 
each reason; and 
10.  Total expenditures of home- and community-based services 
for individuals with intellectual disabilities by month and year to 
date, categorized by waiver. 
SECTION 2.  This act shall become effective November 1, 2023.
