60+BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
61+SECTION 1. AMENDATORY 52 O.S. 2021, Section 288.3, is
62+amended to read as follows:
63+There is hereby re-created until July 1, 2024 July 1, 2025, the
64+Oklahoma Energy Resources Board which shall be subject to the
65+provisions of the Oklahoma Sunset Law . The purpose of the Board is
66+to coordinate a program desig ned to demonstrate to the general
67+public the importance of the Oklahoma oil and natural gas
68+

163+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
164+SECTION 2. AMENDATORY 5 9 O.S. 2021, Section 161.4, is
165+amended to read as follows:
166+Section 161.4 A. A Board of Chiropractic Examiners is hereby
167+re-created to continue until July 1, 2023, in accordance with the
168+provisions of the Oklahoma Sunset Law . The Board shall regulate the
169+practice of chiropractic in this state in accordance with the
170+provisions of the Oklahoma Chiropractic Practice Act. The Board,
171+appointed by the Governor, shall be composed of eight chiropractic
172+physicians and one lay member representing the public.
173+B. Each chiropractic physician m ember of the Board shall:
174+1. Be a legal resident of this state;

26-SECTION 1. AMENDATORY 52 O.S. 2021, Section 288.3, is
27-amended to read as follows:
201+2. Have practiced chiropractic conti nuously in this state
202+during the five (5) years immediately preceding appointment to the
203+Board;
204+3. Be free of pending discipl inary action or active
205+investigation by the Board;
206+4. Be a person of recogniz ed professional ability, integrity
207+and good reputation; and
208+5. Be in active clinical chiropractic practice at least fifty
209+percent (50%) of the time.
210+C. The lay member of the Bo ard shall:
211+1. Be a legal resident of this state; and
212+2. Not be a registered or licensed practitioner of any of the
213+healing arts or be related within the third degree of consanguinity
214+or affinity to any such person.
215+D. The Governor shall appoint members to the Board and for
216+terms of years as follows:
217+1. Position 1: Upon expirati on of the term of the board member
218+whose term expires November 2, 2006, the Governor shall appoint a
219+board member from District 1 for a term of four (4) years to expire
220+on November 1, 2010, and every four ( 4) years thereafter;
221+2. Position 2: Upon expirat ion of the term of the board member
222+whose term expires November 1, 2005, the Governor shall appoint a
223+board member from District 2 for a term of four (4) years to expire
224+on November 1, 2009, and every four (4) years thereafter;

268+expire on November 1, 2008, and every four (4) years thereafter;
269+8. Position 8: Upon expiration of the term of the board member
270+whose term expires June 7, 2005, the Governor shall appoint a board
271+member from the state at large for a term o f four (4) years to
272+expire on June 1, 2009, and ever y four (4) years thereafter; and
273+9. Position 9: The lay member of the Board shall serve a term
274+coterminous with that of the Governor.

301+E. For the purpose of the Oklahoma Chiropractic Practice Act,
302+the state shall be divided into the following districts:
303+1. District 1: Alfalfa, Beaver, Beckham, Caddo, Cimarron,
304+Custer, Dewey, Ellis, Grant, Greer, Garfield, Harmon, Harper,
305+Jackson, Kiowa, Major, Noble, Ro ger Mills, Texas, Washita, Woods and
306+Woodward Counties;
307+2. District 2: Tulsa County;
308+3. District 3: Kay, Logan, Lincoln, Osage, Pawnee, Payne and
309+Pottawatomie Counties;
310+4. District 4: Carter, Comanche, Cotton, Garvin, Grad y, Love,
311+Murray, Jefferson, Stephens and Tillman Counties;
312+5. District 5: Blaine, Canadian, Cleveland, Kingfisher,
313+McClain and Oklahoma Counties;
314+6. District 6: Atoka, Bryan, Coal, Choctaw, Creek, Hughes,
315+Johnston, Latimer, LeFlore, Marshall, McCurtain , Okfuskee,
316+Pittsburg, Pontotoc, Pushmataha and Seminole Counties; and
317+7. District 7: Adair, Cherokee, Craig, Delaware, Haskell,
318+Mayes, McIntosh, Muskogee, Nowata, Okmulgee, Ottawa, Rogers,
319+Sequoyah, Wagoner and Washington Counties.
320+Members appointed aft er June 2002 shall serve no more than two (2)
321+consecutive terms.
322+F. Each member shall hold office until the expiration of the
323+term of office for which appointed or until a qualified successor
324+has been duly appointed. An appointment shall be made by the

351+Governor within ninety (90) d ays after the expiration of the term of
352+any member, or the occurrence of a vacancy on the Board due to
353+resignation, death, or any other cause resulting in an unexpired
354+term.
355+G. Before assuming duties on the Board, each member s hall take
356+and subscribe to the oath or affirmation provided in Article XV of
357+the Oklahoma Constitution, which oath or affirmation shall be
358+administered and filed as provided in the article.
359+H. A member may be removed from the Board by the Governor for
360+cause which shall include, but not be limited to:
361+1. Ceasing to be qualified;
362+2. Being found guilty by a court of competent jurisdi ction of a
363+felony or any offense involving moral turpitude;
364+3. Being found guilty, through due process, of malfeasance,
365+misfeasance or nonfeasance in rel ation to Board duties;
366+4. Being found mentally in competent by a court of competent
367+jurisdiction;
368+5. Being found in violation of any provision of the Oklahoma
369+Chiropractic Practice Act; or
370+6. Failing to attend three meetings o f the Board without just
371+cause, as determined by the Board.
372+I. No member of the Board shall be:
373+1. A registered lobbyist;

400+2. An officer, board member or employee of a statewide
401+organization established for the purpose of advocating the interests
402+of chiropractors licensed pursuant to the Oklahoma Chiropractic
403+Practice Act; or
404+3. An insurance claims adjuster, reviewer, or consultan t;
405+provided, however, a person shall not be considered to be a
406+consultant solely for testi fying in a court as an expert witnes s.
