2451 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

2652 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -173, is
2753 amended to read as follows:

2954 Section 3-173. A. There is hereby re-created to continue until
3055 July 1, 2023 2025, in accordance with the provisions of the Oklahoma
3156 Sunset Law, the Okla homa Advisory Council on Indian Education.

4894 C. The Council shall be c omposed of eighteen (18) members as

5196 1. Five members who shall each r epresent an Indian tribe in the
5297 state, of which at least one shall represent an Indian tribe which
5398 has an enrollment of less than ten thousand (10,000) members who
5499 reside in the state, appointed by the Governor from a list of
55100 nominations submitted by the d ifferent Indian tribes in the state;

57101 2. Four members who shall each represent the tribal education
58102 departments of an Indian tribe in the state, appointed by the
59103 Governor from a list of nominations subm itted by the different
60104 Indian tribes in the state;

87149 D. Appointments to the Council sha ll be made by September 1,
88150 2010. The first meeting of the Council shall be called by the State
89151 Superintendent of Public Instruction. At the first meeting, the
90152 members of the Council shall elect a chair and vice -chair from among
91-the members. Meetings of the Council shall be held at least ENR. H. B. NO. 2819 Page 3
153+the members. Meetings of the Council shall be held at least
92154 quarterly at the call of the chair. Members s hall serve at the
93155 pleasure of their appointing authorities. A maj ority of the members
94156 of the Council shall constitute a quorum to transact business, but
95157 no vacancy shall impa ir the right of the remaining members to
96158 exercise all of the powers of the Counci l. A vacancy on the Council
97159 shall be filled by the original appoi nting authority. The State
98160 Department of Education, Oklahoma Department of Career and
99161 Technology Education, and the Oklahoma State Regents for Higher
100162 Education shall provide staff, support and information as requested
101163 by the Council.

103191 E. Members of the Co uncil shall receive no compensation for
104192 serving on the Council, but shall receive travel reimbursement as
105193 follows:

107194 1. State employees who are members of the Council shall be
108195 reimbursed for travel expenses incurred in the performance of their
109196 duties by their respective agencies in accordance with the State
110197 Travel Reimbursement Act; and

112198 2. All other members of th e Council shall be reimbursed by the
113199 Office of Management and Enterprise Services for travel expenses
114200 incurred in the performance of their duties i n accordance with the
115201 State Travel Reimbursement Act.

117202 F. The Council shall act in accordance with the provis ions of
118203 the Oklahoma Open Meeting Act and the Oklahoma Open Records Act.

120204 G. Members who serve on the Council shall be exempt from the
121205 dual-office-holding prohibitions of Section 6 of Title 51 of the
122206 Oklahoma Statutes.

124207 H. The Council shall have the follow ing duties:

126208 1. Identify strategies for developing an efficient and reliable
127209 process of communications between Oklahoma education entities,
128210 educators, tribal organizations and other interested parties;

130211 2. Identify and disseminate research -based, measurable
131212 criteria, both behavioral and academic, by which the success and
132213 efficacy of the education offered to Native American students in
133214 Oklahoma may be measured;

141246 5. Make recommendations to the State Board of Education for
142247 programs that will help achieve the purposes of the O klahoma
143248 Advisory Council on Indian Education Act.

145249 I. The Council shall evaluate and make an annual report on the
146250 effectiveness of the public educa tion system in Oklahoma in meeting
147251 the needs of Native American students in Oklahoma. The report shall
148252 be submitted to the State Board of Education. The report shall also
149253 contain a summary of the findings made by the Council pursuant to
150254 subsection H of this section, a summary of all data collected by the
151255 Council, a summary of the means by which all data was col lected by
152256 the Council, and any other information deemed necessary by the
153257 Council.
