24	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

26	52		SECTION 1. AMENDATORY 70 O.S. 2021, Section 3 -173, is
27	53		amended to read as follows:

29	54		Section 3-173. A. There is hereby re-created to continue until
30	55		July 1, 2023 2025, in accordance with the provisions of the Oklahoma
31	56		Sunset Law, the Okla homa Advisory Council on Indian Education.

33	57		B. The Council shal l:

35	58		1. Make recommendations to the State Board of Education and the
36	59		State Superintendent of Public Instruction in educational matters
37	60		affecting the education of Native American students;

39	61		2. Promote educational opportunities and improvement of the
40	62		quality of education provided to Nativ e American students throughout
41	63		the state;

48	94		C. The Council shall be c omposed of eighteen (18) members as
49	95		follows:

51	96		1. Five members who shall each r epresent an Indian tribe in the
52	97		state, of which at least one shall represent an Indian tribe which
53	98		has an enrollment of less than ten thousand (10,000) members who
54	99		reside in the state, appointed by the Governor from a list of
55	100		nominations submitted by the d ifferent Indian tribes in the state;

57	101		2. Four members who shall each represent the tribal education
58	102		departments of an Indian tribe in the state, appointed by the
59	103		Governor from a list of nominations subm itted by the different
60	104		Indian tribes in the state;

62	105		3. One member who shall represent the Oklahoma Council on
63	106		Indian Education, appointed by the Governor;

65	107		4. Two members who shall represent two different statewide
66	108		organizations representing public school teachers, appointed by the
67	109		President Pro Tempore of th e Senate;

70	111		representing public school superintende nts appointed by the Speaker

76	142		7. The Director of the Native American Cultural and Educational

87	149		D. Appointments to the Council sha ll be made by September 1,
88	150		2010. The first meeting of the Council shall be called by the State
89	151		Superintendent of Public Instruction. At the first meeting, the
90	152		members of the Council shall elect a chair and vice -chair from among

	153	+	the members. Meetings of the Council shall be held at least
92	154		quarterly at the call of the chair. Members s hall serve at the
93	155		pleasure of their appointing authorities. A maj ority of the members
94	156		of the Council shall constitute a quorum to transact business, but
95	157		no vacancy shall impa ir the right of the remaining members to
96	158		exercise all of the powers of the Counci l. A vacancy on the Council
97	159		shall be filled by the original appoi nting authority. The State
98	160		Department of Education, Oklahoma Department of Career and
99	161		Technology Education, and the Oklahoma State Regents for Higher
100	162		Education shall provide staff, support and information as requested
101	163		by the Council.

103	191		E. Members of the Co uncil shall receive no compensation for
104	192		serving on the Council, but shall receive travel reimbursement as
105	193		follows:

107	194		1. State employees who are members of the Council shall be
108	195		reimbursed for travel expenses incurred in the performance of their
109	196		duties by their respective agencies in accordance with the State
110	197		Travel Reimbursement Act; and

112	198		2. All other members of th e Council shall be reimbursed by the
113	199		Office of Management and Enterprise Services for travel expenses
114	200		incurred in the performance of their duties i n accordance with the
115	201		State Travel Reimbursement Act.

117	202		F. The Council shall act in accordance with the provis ions of
118	203		the Oklahoma Open Meeting Act and the Oklahoma Open Records Act.

120	204		G. Members who serve on the Council shall be exempt from the
121	205		dual-office-holding prohibitions of Section 6 of Title 51 of the
122	206		Oklahoma Statutes.

124	207		H. The Council shall have the follow ing duties:

126	208		1. Identify strategies for developing an efficient and reliable
127	209		process of communications between Oklahoma education entities,
128	210		educators, tribal organizations and other interested parties;

130	211		2. Identify and disseminate research -based, measurable
131	212		criteria, both behavioral and academic, by which the success and
132	213		efficacy of the education offered to Native American students in
133	214		Oklahoma may be measured;

135	242		3. Analyze data to ensure that education agencies in Oklahoma

138	244		4. Encourage and promote Native American educa tional leadership
139	245		at all levels of the education system; and

141	246		5. Make recommendations to the State Board of Education for
142	247		programs that will help achieve the purposes of the O klahoma
143	248		Advisory Council on Indian Education Act.

145	249		I. The Council shall evaluate and make an annual report on the
146	250		effectiveness of the public educa tion system in Oklahoma in meeting
147	251		the needs of Native American students in Oklahoma. The report shall
148	252		be submitted to the State Board of Education. The report shall also
149	253		contain a summary of the findings made by the Council pursuant to
150	254		subsection H of this section, a summary of all data collected by the
151	255		Council, a summary of the means by which all data was col lected by
152	256		the Council, and any other information deemed necessary by the
153	257		Council.
