52 | 57 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 58 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
54 | 59 | | in the Oklahoma Statutes as Section 1-756.30 of Title 63, unless |
---|
55 | 60 | | there is created a duplication in numbering, reads as follows: |

56 | 61 | | A. As used in this act: |
---|
57 | 62 | | 1. "Abortion" means the use or pre scription of any ins trument, |
---|
58 | 63 | | medicine, drug, or any other substance or device intentionally to |
---|
59 | 64 | | terminate the pregnancy of a female known to be pregnan t with an |
---|
60 | 65 | | intention other than to increase the probability of a live birth , to |
---|
61 | 66 | | preserve the life or health of the child after li ve birth, to remove |
---|
89 | 95 | | the result of a spontaneous miscar riage, accidental trauma, or a |
---|
90 | 96 | | criminal assault on the pregnant female or her unborn child; |
---|
91 | 97 | | 2. "Abortion-inducing drug" means a medicine, drug, o r any |
---|
92 | 98 | | other substance prescribed or dispensed with the intent of inducing |
---|
93 | 99 | | an abortion. This includes off-label use of drugs known to have |
---|
94 | 100 | | abortion-inducing properties, which are prescribed specifically with |
---|
95 | 101 | | the intent of causing an abortion, such as misop rostol (Cytotec) and |
---|
96 | 102 | | methotrexate. This definition does not apply to drugs that may be |
---|
97 | 103 | | known to cause an abortion but which are prescribed for other |
---|
98 | 104 | | medical indications, such as chemotherapeutic agents or diagnostic |
---|
99 | 105 | | drugs, or for treatment of an ectopic p regnancy or spontaneous |
---|
100 | 106 | | miscarriage; |
---|
145 | 148 | | C. A person convicted of trafficking or attempting to traffic |
---|
146 | 149 | | abortion-inducing drugs shall be guilty of a felony punishable by a |
---|
147 | 150 | | fine not to exceed One Hundred Thousand Dollars ($100,000.00), or by |
---|
148 | 151 | | confinement in the custody of the Department of Corrections for a |
---|
149 | 152 | | term not to exceed ten (10) years, or by both such fine and |
---|
150 | 153 | | imprisonment. |
---|
151 | 154 | | D. This act does not apply to a pharmacist or a manufacturer or |
---|
152 | 155 | | distributor of drugs or surgical supplies who lawfully manufactures, |
---|
153 | 156 | | possesses, offers, sells, or distributes, in the usual course of |
---|
154 | 157 | | that entity's business or profession, any drug, medicine, or |
---|
155 | 158 | | instrument intended for any lawful medical purpose. |
---|
156 | | - | E. Nothing in this act may be construed to prohibit the use, |
---|
157 | | - | sale, prescription, or admi nistration of a preventive contraceptive |
---|
158 | | - | measure, drug, chemical, or device if the preventive contraceptive |
---|
159 | | - | measure, drug, chemical, or device is used, sold, prescrib ed, or |
---|
160 | | - | administered in accordance with manufacturer i nstructions. |
