53 | 52 | | in the Oklahoma Statutes as Section 25001 of Title 74, unless there |

54 | 53 | | is created a duplication in numbering, reads as follows: |

55 | 54 | | It is the public policy of this state to protect those persons |
---|
56 | 55 | | disclosing wrongdoing by state agencies, po litical subdivisions, |
---|
57 | 56 | | public trusts, and those in the private sector who have supervisory |
---|
58 | 57 | | or other controls over persons in th eir workplace who rep ort |
---|
59 | 58 | | wrongdoing without fear or threat of retaliation. Such persons |
---|
60 | 59 | | reporting wrongdoing shall be known as "whistleblowers". |

91 | 89 | | A. As used in this section "retaliation" means any threat or |

94 | 92 | | B. Any public official and/or employee, employer or employee |

95 | 93 | | who supervises a whistleblower that engages in an actio n or activity |
---|
96 | 94 | | that violated public policy as defined in Section 1 of this act for |
---|
97 | 95 | | reporting wrongdoing shall be guilty of a misdemeanor punishable by |
---|
98 | 96 | | incarceration for up to one (1) year and a Five Thousand Dollar |
---|
99 | 97 | | ($5,000.00) fine, and liable civilly for a ll economic, emotional and |
---|
100 | 98 | | mental anguish directly caused thereby together with punitive |
---|
101 | 99 | | damages, and such person shall be prohibited from holding any public |
---|
102 | 100 | | office or employment. |
---|
103 | 101 | | C. Any whistle blower who successfully prosecutes an action |
---|
104 | 102 | | under this act shall be entitled to a r easonable attorney fee |
---|
105 | 103 | | together with costs. |
---|
106 | 104 | | SECTION 3. This act shall become effective November 1, 2024. |
---|
