29	110		BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:

31	111		SECTION 1. AMENDATORY 20 O.S. 2021, Sectio n 1226, is
32	112		amended to read as follows:

34	113		Section 1226. A. At the request of the board of trustees of
35	114		the law library in a county having a population of thre e hundred
36	115		thousand (300,000) or more, the presiding judge of an administrative
37	116		district, with the ap proval of the Chief Justice of the Supreme
38	117		Court, shall be authorized to transfe r up to Ten Thousand Dollars
39	118		($10,000.00) per fiscal year from the court fun d of the county in
40	119		which the law library is located to the Law Library Fund of that
41	120		county.

43	147		B. In counties having a population of less than three hundred
44	148		thousand (300,000) five hundred thousand (500,000), the court fund
45	149		of the county in which a law libra ry is located shall annually

48	151		1. In counties having a population of l ess than ten thousand
49	152		(10,000), the sum of Fi ve Thousand Dollars ($5,000.00); and

51	153		2. In counties having a population of ten thousand (10,000) or
52	154		more, but less than thirty thousand (30,000), the sum of Seven
53	155		Thousand Dollars ($7,000.00); and

55	156		3. In counties having a population of thirty thousand (30 ,000)
56	157		or more, but less than three hundred thousand (300,000) five hundred
57	158		thousand (500,000), the sum of Nine Thousand Dollars ($9,000.00).

59	159		SECTION 2. AMENDATORY 20 O.S. 2021, Section 1224, is
60	160		amended to read as follows :

62	161		Section 1224. On August 1 each year the board of trustees shall
63	162		transmit to the Supreme Court for deposit in the State Judicial
64	163		Revolving Fund all funds on deposit in the law library fund in
65	164		excess of twenty-five percent (25%) of the income to such Fund
66	165		during the preceding fiscal year, the existing surplus on hand on
67	166		the effective date of this act being excluded. Except for counties
68	167		having a population of over five hundred thousand ( 500,000)
69	168		according to the most recent Federal Decennial Census , the board of
70	169		trustees shall vote to authorize any funds to the Court Fund.

128	261		Census, the sum of Twelve Dollars ($12.00) shall be assessed and
129	262		credited to the Law Library Fund pursuant to Section 1201 et seq. of
130	263		Title 20 of the Oklahoma Statutes.

132	264		C. In addition to the amounts collected pursuant to subsections
133	265		A and B of this section, the sum of Twenty-five Dollars ($25.00)
134	266		shall be assessed and c redited to the Oklahoma Court Information
135	267		System Revolving Fund created pursuant to Section 1 315 of Title 20

138	295		D. In addition to the amounts collected pursuant to subsection
139	296		A of this section, the sum of Five Dollars ($5.00) shall be assessed
140	297		and credited to the Oklahoma court-appointed special advocates

143	299		E. In addition to the amounts collected pursuant to subsection
144	300		A of this section, the sum of Two Dolla rs ($2.00) shall be assessed
145	301		and credited as follows:

147	302		1. One Dollar and fifty-five cents ($1.55) of such amount shall
148	303		be credited to the Council on Judicial Comp laints Revolving Fund;
149	304		and

151	305		2. Forty-five cents ($0.45) of such amount shall be credited to
152	306		the Supreme Court Revolving Fund and may be budgeted and expended by
153	307		the Supreme Court for expenses lawfully incurred for providing
154	308		qualified courtroom interpreter services in the district courts, for
155	309		credentialing and training Oklahoma courtroom interpreter s, and for
156	310		any other expenditures determined by the Supreme Court to be
157	311		necessary to provide language access in the district courts a s
158	312		required by state and federal law. Payments of expenses may be made
159	313		after the claim or expense is approved by the Chief Justice of the
160	314		Supreme Court or another justice designated by the Chief Justice.

162	315		F. In addition to the amounts collected pursuant to paragraphs
163	316		1, 3, 8, 9, 10 and 14 of subsection A of this section, each county
164	317		may assess, upon approval by the board of co unty commissioners, a
165	318		sum not to exceed Ten Dollars ($10.00) per case to be credited t o

167	346		arose for the purpose of enhan cing existing or providing additional

170	348		G. Until November 1, 2027, in addition to the amounts collected
171	349		pursuant to subsection A of this section, the sum of Ten Dollars
172	350		($10.00) shall be assessed and credited to the Court Clerk's Records
173	351		Management and Preservation Fund created in Section 31.3 of this
174	352		title.

176	353		H. In any case in which a litigant claims to have a just cause
177	354		of action and that, by reason of poverty, the litigant is unable to
178	355		pay the fees and costs provided for in this sectio n and is
179	356		financially unable to employ counsel, upon the filing of an
180	357		affidavit in forma pauperis executed before any officer authorized
181		-	by law to administer oaths to that effect and upon satisfactory ~~ENR. H. B. NO. 3039 Page 5~~
	358	+	by law to administer oaths to that effect and upon satisfactory
182	359		showing to the court that the litigant has no means and is,
183	360		therefore, unable to pay the applicable fees and costs and to empl oy
184	361		counsel, no fees or costs shall be required . The opposing party or
185	362		parties may file with the court clerk of the court having
186	363		jurisdiction of the cause an affidavit similarly executed
187	364		contradicting the allegation of poverty . In all such cases, the
188	365		court shall promptly set for hearing the determination of
189	366		eligibility to litigate without payment of fees or costs. Until a
190	367		final order is entered determining that the affiant is ineligible ,
191	368		the clerk shall permit the affiant to litigate without payment of

198	400		credit or debit card or other electronic payment method as provided
199	401		in paragraph 1 of subsection B of Section 151 of t his title.
