4245 An Act relating to public finance; restricting use of

5457 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5558 SECTION 1. NEW LAW A new section of law to be codified
5659 in the Oklahoma Statu tes as Section 2501 of Title 62, unless there
5760 is created a duplication in numbering, reads as follows:
5861 A. Except as otherwise provided by this section, no state
5962 revenues, whether derived from taxes, fees, assessments or any other
6063 source or means shall be used knowingly to provide benefits of any
6164 kind to a person who is not authorized pursuant to federal
6265 immigration law to be present in a state or in the United States .
6366 As used in this section, "benefits" shall not be deemed to include
64-any costs incurred for :

91-1. Incarceration of a person or transportation of a person to
92-an out-of-state destination;
93-2. Law enforcement agencies or personnel to investig ate
94-incidents involving domestic violence;
95-3. Law enforcement agencies or personnel to investigate
96-incidents involving human trafficking; or
97-4. Providing education to children from p re-kindergarten
98-through the twelfth grade .
94+any costs incurred for incarceration of a person or transportation
95+of a person to an out-of-state destination.
9996 B. The provisions of this section and the restrictions on the
10097 use of state revenues shall also be applicable to the use of state
10198 revenues by any political subdivision of the state or by any other
10299 legal entity that knowingly provides state funds, state funded
103100 assistance, state funded support or state funded sanctuary status to
104101 a person or persons not lawfully present in the state or not
105102 lawfully present in the United States pursuant to the provisions of
106103 federal immigration law.
107104 C. The provisions of this section shall not restrict the
108105 ability of a person or entity to provide emergency medical services
109106 to a person if the se rvices are required to be provi ded pursuant to
110107 federal law.
111-D. The provisions of this section shall not restrict the
112-ability of an Office of Attorney General -certified victim service
113-program to provide domestic violence, sexual assault, stalking, or

142108 SECTION 2. This act shall becom e effective July 1, 2024.
143109 SECTION 3. It being immediately necessary for the preservation
144110 of the public peace, health or safety, an emergency is hereby
145111 declared to exist, by reason whereof this act shall take effect and
146112 be in full force fro m and after its passage and approval.
