3661 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3862 SECTION 1. NEW LAW A new section of law to be codified
3963 in the Oklahoma Statutes as Section 1 -112 of Title 26, unless there
4064 is created a duplication in numbering, reads as follows:

4265 A. No election conducted by the State Election Board, a county
4366 election board, or any municipality authorized to conduct elections

4595 proportional ranked voting, preferential voting, or instant runoff

48-B. As used in this secti on, "ranked choice voting", "ranked
49-voting", "proportional ranked voting", and "preferential voting"
50-shall mean any voting system whereby a voter ranks candidates in a
96+voting.
97+B. As used in this section, "ranked choice voting, ranked
98+voting, proportional ranked voting, and preferential voting" shall
99+mean any voting system whereby a voter ranks candidates in a
51100 sequence from first, second, third, and onward on a ballot to
52101 determine a winning candidate.

54102 C. As used in this section, "instant runoff voting" shall mean
55103 any voting system where by a voter ranks candidates in a sequence
56104 from first, second, third, and onward to determine which candidates
57105 advance to a general election.

59106 D. Any existing or future ordinance enacted or adopted by a
60107 county, municipality, or any other local government en tity which is
61108 in conflict with this section is void. Any election for any public
62109 office in this state conducted under a voting system prohibited by
63110 this section is void.

65111 E. The Secretary of the State Election Board, or the President
66112 Pro Tempore of the Ok lahoma State Senate and the Speaker of the
67113 Oklahoma House of Representatives jointly, shall have the authority
68114 to bring a civil action in an appropriate court for such declaratory
69115 or injunctive relief as is necessary to carry out this section.

71116 SECTION 2. This act shall become effective November 1, 2024.
