34113 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36114 SECTION 1. NEW LAW A new section of law to be codified
37115 in the Oklahoma Statutes as Section 199.19 of Title 59, unless the re
38116 is created a duplication in numbering, reads as follows:

40117 A. The State Board of Cosmetology and Barbering shall issue a
41118 license to any nonprofit 501(c)(3) tax -exempt school located within
42119 a correctional facility in this state that proposes to provide
43120 cosmetology or barbering training courses designed to qualify
44121 persons for licensure to practice cosmetology or barbering.

46122 B. 1. Any nonprofit 501(c)(3) tax -exempt school seeking to
47123 operate within a correctional facility shall submit an application
48124 to the Board with the following:

50125 a. whether the school intends to operate as a secondary
51126 or postsecondary establishment,

53127 b. the names, addresses, and contact information of the:
54-
55128 (1) Director of Corrections,

57129 (2) Chief Administrator of Classification and

81172 2. An applicant shall obtain a memorandum of understanding from
82173 the Department stating that the Department shall allow the applica nt
83174 use of the designated area for one (1) year, or a sum of twelve -
84175 month increments, that shall be used for the proposed school to
85176 operate.

87177 3. Nonprofit 501(c)(3) tax -exempt schools within a correctional
88178 facility shall not charge tuition. Education shall be provided free
89179 of cost to all student s enrolled in the programs. All supplies

91207 private donations made to the organization. The Board shall not
92208 require a financial statement to be furnis hed by the school.

94209 4. All licenses, work permits, registration receipts, student
95210 permits, and all other information required by the Board shall be
96211 posted conspicuously.

98212 5. Licensed instructors shall adhere to all Department
99213 requirements necessary for vis itation within the correctional
100214 facility.

102215 C. The Board shall permit an applicant ’s inmate identification
103216 badge as his or her identification for purposes of enrollment. A
104217 student enrolled to take classes from a nonprofit 501(c)(3) tax-
105218 exempt school within a correctional facility shall automatically be
106219 considered a low-income individual. Proof of incarceration, or a
107220 consolidated record card, shall be sufficient for the applicant to
108221 be qualified for a one -time, one-year waiver of all fees associated
109222 with licensure, certification, or renewal.

121257 1. Schools located within a correctional facility shall not
122258 provide:

124259 a. individual student lockers, vending machines, or
125260 cosmetic or wig displays,

127261 b. a private facial and skin care room. All facial and
128262 skin care education shall take place where everyone
129263 may be seen,

131264 c. a break area. Restrooms shall be gender -specific to
132265 the institution housing the programs,

134266 d. a drinking fountain or water cooler,

136267 e. hand sanitizer; provided, that dry sanitizer may be
137268 permitted provided i t is located in a dispensary area.
138269 Individual containers are not permitted per Department

142272 items shall be cleaned and disinfected immediately
143273 after service is completed; and

145274 2. Schools located within a correctional facility shall:

147275 a. hold all supplies required by the school. Supplies
148276 shall be checked out and checked in by students and
149277 master instructors, except for metal implements, which
150278 shall be held in a secured area and c hecked out and

158309 d. provide a container to store hair pins and clips that
159310 shall be located in the dispens ary area. Students
160311 shall check out and check in these items as needed,

162312 e. provide a secure location for all metal implements,
163313 which shall include, but not be limited to , shears,
164314 thinning shears, razors, nail clippers, nail and
165315 cuticle trimmers, and metal cuticle pushers. A log
166316 shall be available to document the administration of
167317 all tools and implements by a designated clerk, and

169318 f. store all supplies, other than instructional books, in
170-the dispensary area or, as required by this section,

173321 If an inspector by the Board provides evidence of the need for

483+BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
484+SECTION 4. AMENDATORY 59 O.S. 2021, Section 199.7, is
485+amended to read as follows:
486+Section 199.7 A. Each cosmetology and barber school shall be
487+licensed annually by the S tate Board of Cosmetology and Barberin g.
488+Application for the first year's license for a cosmetology and
489+barber school shall be accompanied by a fee of Four Hundred Dollars
490+($400.00), which shall be retained by the Board if the application
491+is approved and a license is issued. The annual renew al license fee
492+for cosmetology or barber school s shall be One Hundred Twenty-five
493+Dollars ($125.00).
494+B. 1. No license or renewal thereof for a cosmetolo gy or
495+barber school shall be issued unless the owner thereof fur nishes to
496+the Board a good and suffici ent surety bond in the principal sum of
497+Two Thousand Dollars ($2,000.00) for the first instructor and an
498+additional One Thousand Dollars ($1,000.00) for e ach additional
499+instructor, executed by a surety company authoriz ed to do business
500+in this state, and c onditioned on the faith ful performance of the
501+terms and conditions of all contracts entered into between the owner
502+

528+of the cosmetology or barber school and all persons enrolling
529+therein.
530+2. The surety bond shall be in a form approved by the Attorney
531+General and filed in the Offi ce of the Secretary of S tate. Suit may
532+be brought on the bond by any person injured by reason of the breach
533+of the conditions ther eof.
534+C. It shall be the duty of the owner or manager of a
535+cosmetology or barber school to enter into a written contract with
536+all students before per mitting students to attend any classes.
537+Contracts shall be made out in triplicate, the original copy to be
538+retained by the school, the duplicate to be given to the studen t,
539+and the triplicate to be filed with the executive director of the
540+Board.
541+D. A school licensed or applying for licensure shall maintain
542+recognition as an institution of postsecondary study by meeting the
543+following conditions:
544+1. The school shall admit as a regular student only an
545+individual who has earned a reco gnized high school diplo ma, or who
546+is beyond the age of compulsory high school attendance;
547+2. The school shall be licensed by name , or in the case of an
548+applicant, shall apply for licensure by n ame, to offer one or more
549+training programs beyond the second ary level.
550+E. No license for a cosmetology or barber school shall be
551+issued unless the owner thereof presents evidence satisfactor y to
552+

578+the Board that the school has satisfactory facilities and e quipment
579+and has instructors qualified to give a course of st udy as provided
580+in the Oklahoma Cosmetology and Barbering Act.
581+F. There shall be included in the curriculum for cosmetology
582+and barber schools, courses of study in the theory of cosmetology
583+and barbering related theory, studies in m anipulative practices,
584+sterilization and sanita tion, shop management, and such other
585+related subjects as may be approved by the Board.
586+G. 1. The Board shall adopt a curriculum of required courses
587+of instruction in th eory and training, in accordance with this act,
588+of either one thousand five hundred ( 1,500) clock hours or an
589+equivalent number of credit hours as recognized by the United States
590+Department of Education or a regional or national accreditation
591+entity recognized by the United States Department o f Education in a
592+basic course to be taught in all cosmetology or barbering schools in
593+the state. The basic cosmetology or barbering course shall be
594+designed to qualify students completing the course to take the
595+examination for a license.
596+2. Cosmetology and barber students in v ocational, trade, and
597+industrial cosmetology and barbering classes in public schools,
598+parochial, private schools or home schools sh all qualify by
599+completing one thousand (1,000) hours in a basic course of
600+cosmetology or barbering and five hundred (500) hou rs of approved
601+related subjects to be selected from, but not limited to, the
602+

628+following high school courses in a public school, paro chial, private
629+or home school: psychology, biology, general sci ence, American
630+history, art, typing I, typing II, business ar ithmetic,
631+salesmanship, bookkeeping I, bookkeeping II, related mathematics,
632+English II, English III and English IV.
633+H. 1. No person shall be eligible to give instruction in
634+cosmetology or barbe ring unless the person is the holder o f a
635+current unrevoked instructor's license issued by the Board.
636+2. Each cosmetology or barber school shall employ at least one
637+instructor for the first f ifteen students registered therein, and at
638+least one additional instructor shall be employed for each
639+additional group of fif teen students, or major fraction thereof.
640+3. Students utilizing hybrid learning programs are included in
641+the total student number as referenced in the ratio in paragraph 2
642+of subsection G of thi s section.
643+I. A cosmetology or barber ing school may be opera ted in and as
644+part of an accredited high school.
645+J. No cosmetology or barber school owner or an establishment
646+owner shall charge s tudents or apprentices for cosmetic materials,
647+supplies, apparatus, or machines used by them in practi ce work. A
648+reasonable charge may be made by a cosmetology or barber school for
649+clinical work performed by students upon persons who are not
650+students therein. No instructor shall be permitted to do

677+professional or clinical work in a cosmetology or barber school at
678+any time.
679+K. No cosmetology or barber establishment shall ever be
680+operated in or as a part of a cosmetology school.
681+L. 1. Students shall:
682+a. have an eighth-grade education or the equivalent
683+thereof, and
684+b. be at least sixteen (16) years of age unless they are
685+public or private school stude nts who will be sixteen
686+(16) years of age by November 1 of the year in which
687+cosmetology or barbering instr uction begins.
688+Student entrance requirements for the Basic Cosme tologist,
689+Manicurist/Nail Technician, Cosmetician,
690+Esthetician/Facialist/Facial Oper ator, Barber and Barber Instructor
691+courses are as follows:
692+a. the student shall:
693+(1) be at least sixteen (16) years of age by November
694+1 of the current year,
695+(2) submit a completed student registration
696+application accompanied by a fe e of Five Dollars
697+($5.00) before attending classes,
698+(3) submit a copy of the completed student/school
699+contract with the student reg istration

727+(4) submit proof of at least eighth grade education
728+or equivalency or submit proof of having
729+satisfactorily passed an ability to benefit exam,
730+(5) submit, if under eighteen (18) years of age, a
731+photocopy of his or her birth certificate or
732+other legal proof of age ,
733+(6) submit a two inch by two inch (2" x 2") current
734+full-face photograph of the applicant a s
735+requested on the registration form. A current
736+photograph is one taken within the last six (6)
737+months with no embellishments or fil ters of any
738+kind that alter the face of the applicant.
739+Students enrolling in a school located in a n
740+institution of the Depar tment of Corrections or
741+correctional facility shall send a copy of their
742+Inmate ID Badge, which has a photo ,
743+b. each student shall be registered with the Board before
744+attending school,
745+c. each student shall be provided with an approv ed
746+textbook or manual u pon commencing training ,
747+d. all applicants who register with the Board as students
748+or who apply for a license shall be considered without
749+regard to race, sex, creed, color, religion, or
750+national origin provided they have met all

778+of the Board. All students shall be conside red for
779+enrollment in a school. Admission to public schoo ls
780+is governed by applicable state and federal laws .
781+2. Credit shall not be given to any person by the B oard or by a
782+cosmetology or barber school for hours spent in attending a
783+cosmetology or barber school unless the person has registered with
784+the Board as a student prior to the attendance, except that a
785+student who has attended a cosmetology or barber schoo l out of state
786+may receive credit for such attendan ce for transfer upon proper
787+certification as provided by rule of the Board.
788+3. No student shall be credited with more than eight (8) hours'
789+attendance in a cosmetolog y or barber school in any one (1) day.
790+4. No person shall be eligible to take the Board -issued
791+examination for a license unless such person is at least seventeen
792+(17) years of age or a hig h school graduate.
793+M. 1. No student shall be eligible to take the examination for
794+a Board-issued license without furnishing to the Board the affidavit
795+of the owner of the cosmetology or barber sch ool that the student
796+has satisfactorily completed the requ irements specified in paragraph
797+1 of subsection F of this section, except public and private school
798+students who will complete t he requirements specified in paragraph 2
799+of subsection F of this section by the close of the current school

826+year may take the ex amination next preceding the end of the school
827+year.
828+2. Students who are eligible to take the examinatio n shall be
829+given an oral examination if requested b y their instructor and proof
830+of qualifying disability is proven.
831+N. No person shall be eligible to register for the examination
832+for an instructor's license unless suc h person is a high school
833+graduate, or has obtained a General Equivalency Diploma (GED) a s to
834+which the applicant shall qualify by tests to be prescribed by the
835+Board and conducted by quali fied examiners selected by the Board,
836+and has:
837+1. Satisfactorily c ompleted all hours required for the
838+appropriate specialty cou rse and an additional one th ousand (1,000)
839+instructor training hours o r equivalent number of credit hours as
840+recognized by the United States Department of Education or as
841+recognized by a national accreditation entity prescribed by th e
842+Board in a cosmetolog y school in this state; or
843+2. Completed all hours required for the appropriate specialty
844+course, three hundred (300) instructor training hours, prescribed by
845+the Board in a cosmetology school in this state and has been engaged
846+in the practice of cosmetolo gy for at least the precedin g two (2)
847+years.

976+C. All fees shall be submitted to the Board in the form of a
977+cashier's check, money order , or business check. Personal checks
978+are not accepted by the Board.
979+D. 1. Waiver of fee for low-income individuals, pursuant to
980+the provisions of subsection A of Section 4003 of this title, upon
981+presentation of satisfactory evidence that an applicant for initi al
982+licensure or certification, or that a licensee or certific ate holder
983+seeking renewal is a low-income individual, the Board shall grant a
984+one-time, one-year waiver of the fee for licensure, certification,
985+or renewal. A low-income individual is a person who is enrolled in
986+a state or federal public assistance program, including, but not
987+limited to, the Temporary Assistance for Needy Families, Medicaid or
988+the Supplemental Nutrition Assistance P rogram, or whose household
989+adjusted gross income is below one hu ndred forty percent (140%) of
990+the federal poverty line. An applicant for licensure shall provide
991+documentation showing participation in one of the aforementioned
992+programs or submit income tax returns showing income b elow the
993+established threshold. The documentation shall be current and shall
994+be issued by the feder al or state entity administering the program.
995+Copies of income tax re turns shall be from the most recent tax year
996+prior to the date of licensure applicat ion.

1023+2. Students attending school at a 5 01(c)(3) nonprofit school
1024+within a correctional facility shall automatically be consider ed a
1025+low-income individual. Proof of incarceration (CRC card) shall be
1026+all the evidence that is needed to qualify for a one-time, one-year
1027+waiver of the fee for licens ure, certification, or renewal.
1028+C. E. Any person licensed as an advanced operator prior to July
1029+1, 1985, may renew the advanced co smetologist license annually by
1030+payment of the fee required b y this section and by being in
1031+compliance with the rules promulg ated by the State Board of
1032+Cosmetology and Barbering.
1033+SECTION 6. NEW LAW A new section of law to be codified
1034+in the Oklahoma Statutes as Section 199.19 of Title 59, unless there
1035+is created a duplication in numbering, reads as fol lows:
1036+A. Any nonprofit 501(c)(3) tax-exempt school that proposes to
1037+provide cosmetology or barber training courses designed to qualif y
1038+persons who complete courses for a professional license to practice
1039+cosmetology or barbering, s hall be required to obta in a license for
1040+the nonprofit 501(c)(3) tax-exempt postsecondary school from the
1041+State Board of Cosmetology and Barbering.
1042+B. The license application form shall be completed in full ,
1043+making note whether the school intends to operate as a secondary or
1044+postsecondary establishment and returned to t he Board and shall
1045+contain the following information :

1079+persons to be the instructors of the proposed school and that of the
1080+manager, if other than the owner .
1081+C. Each initial public, priv ately owned, and nonprofit
1082+501(c)(3) tax-exempt cosmetology or barber school shall be required
1083+to pay to the Board the initial license fee of Four Hundred Dollars
1084+($400.00). Each public, privately owned, and nonprofit 501(c)(3)
1085+tax-exempt school shall als o pay the annual license renewal fee of
1086+One Hundred Twenty-five Dollars ($125.00). Each school license
1087+shall expire annually on June 30 . No provision is made for pro rata
1088+of any license fee. A school shall be inspected at least once each
1089+year in order to be eligible for renewal.
1090+D. A surety bond in the amount of Two Thousand Dollars
1091+($2,000.00) for the first instructor and One Thousand Dollars
1092+($1,000.00) for each additional instruct or shall be submitted for
1093+each cosmetology or barber school license. The bond shall be in an
1094+amount sufficient to meet bonding requirements for all staff.

1137+tax-exempt postsecondary school from the State Board of Cosmetology
1138+and Barbering.
1139+B. The license application form shall be completed in fu ll,
1140+making note of whether the school intends to operate as a secondary
1141+or postsecondary establishment , and returned to the Board and shall
1142+contain the following information:

1174+teach in the school. The file number of the instructor shall be
1175+submitted;
1176+2. A notarized affidavit stating the source of sufficient bond
1177+coverage and that the building wherein the sc hool is proposed to be
1178+conducted is owned by the Department of Corrections; and
1179+3. Phone numbers of the correctional facility and a brief
1180+general description of the correctional facility location within the
1181+institution and other building training sections and parking areas.
1182+C. Each initial public, privately owned, and nonprofit
1183+501(c)(3) tax-exempt cosmetology or barber school shall be required

1235+by private donations made to the organization. A financial
1236+statement shall not be required for this type of school.
1237+G. Applicants shall obtain a memorandum of understanding from
1238+the Oklahoma Department of Corrections stating that the Department
1239+will allow the applicant use of the designated area for one (1)
1240+year, or a sum of twelve-month increments, that will be used for the
1241+proposed school to operate.
1242+SECTION 8. NEW LAW A new section of law to be cod ified

1274+B. A 501(c)(3) tax-exempt license renewal application, forms,
1275+and instructions shall be mailed annually to schools by the State
1276+Board of Cosmetology and Barbering. Forms include a surety bond
1277+renewal form, power of attorney, and verification form.
1278+C. A fee of One Hundred Twenty-five Dollars ($125.00) is
1279+required for school li cense renewal.
1280+D. Any advertisement for recruitment of students shall state
1281+that the school is proposed to be open and sh all not contain
1282+deceptive or misleading language and shall state that the school has
1283+applied for licensure.
1284+SECTION 9. NEW LAW A new section o f law to be codified
1285+in the Oklahoma Statutes as Section 199.22 of Title 59, unless there
1286+is created a duplication in numbering, re ads as follows:
1287+A. An applicant shall submit a written request for an initial
1288+Board consultation and inspection for approval of the location,
1289+building, parking, electrica l facilities, plumbing facilities,
1290+construction, and building codes for the proposed school. The
1291+applicant shall provide city inspection certificate, fire
1292+department, electrical, and plumbing certificates as a pplicable for
1293+the city or county where propose d school is located and other

1322+B. At the initial inspection, the Board's representative shall
1323+consult with the proposed owner(s), instructor(s), and other
1324+person(s) designated by the license applicant as responsible for the
1325+proposed school regarding the requirements necessary to the physical
1326+arrangements of the proposed building and space.
1327+1. Adequate lighting and ventilation , cleanable floor surfaces,
1328+parking facilities, and other building appointments as applicable in
1329+the specific plans and location, shall be addressed in the initial
1330+consultation.
1331+2. The proposed school space shall meet federal, state and
1332+local construction, electrical, plumbing, fire , and safety codes.
1333+The proposed owner shall show the inspector proof of certification
1334+of compliance with applicable codes upon request. At least two
1335+points of ingress/egress for the building are required. In the
1336+event of multiple stories or building levels, fire escape(s) shall
1337+be approved and appropriate exit signs shall be posted for safe exit
1338+from the building.
1339+3. a. The proposed school building space shall contain a
1340+minimum of two thousand two hundred (2,200) square
1341+feet of floor space. The Board considers a working
1342+area of five feet by eight feet (5' x 8'), forty (40)
1343+square feet per student as necessary and adequate for

1375+are not included in th e five feet by eight feet (5' x
1376+8') work area required for each student. Schools
1377+located within a correctional facility shall be exempt
1378+from having individual student lockers, vending
1379+machines, and cosmetic or wig displays.
1380+b. The proposed building space plans shall contain
1381+separate classroom setting s large enough to
1382+accommodate at least fifteen (15) students in one
1383+group, one (1) mannequin table, one (1) chalk or
1384+marker board (white board/smart board), three (3 )
1385+manicure tables, or one (1) narrow eighteen inch (18")
1386+folding table satisfactory for manicure practice .
1387+c. The proposed school plans shall contain a facial and
1388+skin care room designed to provide maximum sanitation
1389+methods and privacy to patrons. Schools located
1390+within a correctional facility shall be exempt from
1391+having a private facial and skin care room, per ODOC
1392+Policy. All facial and skin care education shall take
1393+place where everyone can see.

1421+space (one locker per student) and separate restroom
1422+facilities for male and female students. Schools
1423+located within a correctional facility are exempt from
1424+having a break area and personal student lockers, per
1425+ODOC policy. Restrooms shall be gender specific to
1426+the institution (e.g. women's facility shall only have
1427+women's restrooms and men's facility shall only have
1428+men's restrooms).
1429+4. a. A sanitary drinking fountain or water cooler shall be
1430+provided, maintained, and in good repair at all times.
1431+Schools located within a correctional facility shall
1432+be exempt from having a drinking fountain or water
1433+cooler.
1434+b. Each school shall have a dispensary room equipped with
1435+a sink plumbed with hot and cold water.
1436+c. A school shall provide space for a reception area with
1437+seating capacity of no less than ten (10) persons.
1438+d. Interiors of schools sh all be maintained in a clean,
1439+sanitary condition, and in good repair .
1440+(1) floors in work areas (shampoo and styling areas)
1441+shall be covered with a hard, cleanable surface
1442+of vinyl, linoleum, or other impervious floor

1477+A. The following minimum equipment is considered by the Board
1478+to be adequate for the appropriate and safe training of no more than
1479+thirty-seven (37) students. The minimum equipment shall be required
1480+for all schools with one (1) to and including thirty-seven (37)
1481+students:
1482+1. One (1) school seal;
1483+2. One (1) Chart of Anatomy to include:
1484+a. bones,
1485+b. muscles,
1486+c. nerves,
1487+d. circulatory system, and
1488+e. skin;
1489+3. One (1) blackboard (or one (1) white board/smart board);

1528+Schools located within a correctional facility shall not have a
1529+container for soiled items. The soiled i tems shall be cleaned and
1530+disinfected immediately after service is completed;
1531+8. Four (4) shampoo basins equipped with shampoo sp rays and
1532+connected with hot and cold water (one shampoo basin for each
1533+additional 15 students or major fraction thereof) ;
1534+9. Four (4) shampoo chairs (one for each additional 15 students
1535+or major fraction thereo f);
1536+10. Four (4) hair dryers – hood or chair type;
1537+11. Twelve (12) blow-dryers (one for each additional 15
1538+students or major fraction thereof);

1583+cosmetology-related periodicals (electro nic periodicals are
1584+acceptable);
1585+22. Four (4) heaters and irons and /or four (4) electric
1586+pressing combs;
1587+23. Five (5) head forms;
1588+24. Five (5) wefts;
1589+25. Two (2) facial chairs considered adequate fo r patron
1590+service; reclining, styling , or shampoo are acceptable for studen t

1628+acceptable for student practice. This is a requirement for a
1629+cosmetology school and not a barber school;

1632+barber school. Schools located within a correctional facility shall
1633+have a large container of hair pins or clippies that shall be
1634+located in the dispensary room. Students shall check in/out these
1635+items as needed;
1636+29. Schools located within a correctional facility shall have a
1637+locked tool cage that holds all metal implements. The tool cage
1638+shall store all shears, thinning shears, razors, toenail clippers,
1639+nail/cuticle trimmers, and metal cuticle pushers. There shall be a

1672+SECTION 11. NEW LAW A new section of law to be codified
1673+in the Oklahoma Statutes as Section 199.24 of Title 59, unless there
1674+is created a duplication in numbering, reads as follows:
1675+A. The one thousand five hundred (1,500) clock hour curriculum
1676+(pure cosmetology) for a privately owned cosmetology school is
1677+prescribed as follows (Note: Hours may be measured in credits and
1678+ratio as recognized by the United States Department of Education or
1679+by a regional or national accreditatio n entity recognized by the
1680+United States Department of Education.):
1681+1. Theory (shall be coordinated with each practical practice
1682+subject as is appropriate throughout the course of training) - one
1683+hundred fifty (150) clock hours;
1684+2. Manicuring and pedicuring (includi ng sculptured nails and

1734+high school subjects) is prescribed for public school, parochial
1735+school, private scho ol, or home schooled students in the f ollowing
1736+situations:
1737+1. Cosmetology students that are currently attending high
1738+school, parochial, private school, or a home school;

1768+a. Students who shall qualify for training in this matter
1769+shall complete one thousand (1,000) clock hours in a
1770+basic cosmetology course and five hundred (500) clock
1771+hours of approved related subjects. The official
1772+parochial, private school, or home school high school
1773+transcript shall serve as documentation for the five
1774+hundred (500) clock hours of related instruction. The
1775+transcript shall show passing grades in related
1776+subjects and completion of at least the first semester
1777+of the twelfth grade. Related subjects shall run
1778+concurrently with and shall be in no instance older
1779+than three (3) years at time of enrollment in a
1780+cosmetology school course. The curriculum as follo ws
1781+has a recommended completion time of two (2) school
1782+years.
1783+b. Adult students registered in a cosmetology school are
1784+not eligible to train under the one thousand (1,000)
1785+clock hours pure cosmetology plus five hundred (500)
1786+clock hours of cosmetology-related high school
1787+subjects unless qualified under paragraphs 1 and 2 of
1788+subsection B of this section;

2014+safety measures, and chemistry and shall be carried through all
2015+classes in which it is used. Mannequin practice shall be given to
2016+each student.
2017+B. A student who has completed the training in the basic
2018+courses in a cosmetology a nd/or barbering school or as an apprentice
2019+who completed the course in an establishment, shall have had the
2020+required amount of patron practice by working under actual
2021+cosmetology/barbering establishment conditions so that he or she
2022+should be able to:
2023+1. Perform any ordinary operation satisfactorily and in the
2024+same amount of time customarily allotted to that operation in an
2025+establishment;
2026+2. Conduct a consultation on any ordinary cosmetology or
2027+barbering subject and prescribe proper treatment; and
2028+3. Mix any preparation used in an establishment.
2029+C. Establishment management shall include purchasing, price
2030+determination, selling, appointment scheduling, dispensing of
2031+supplies, and personal management .
2032+D. The teaching of wig styling and hairpieces shall con sist of
2033+training in the proper fitting, dressing, styling, and arranging of
2034+wigs and hairpieces.
2035+E. State cosmetology and barbering law and Board rules and
2036+regulations shall be taught in all courses.

2063+F. A school owner shall maintain an adequate dispensar y room
2064+with supplies necessary for school operation and student training.
2065+G. A student enrolled in a school shall not be allowed to work
2066+on the public until such time as he or she has received at least one
2067+hundred fifty (150) clock hours or equivalent num ber of credit hours
2068+of training spent in classroom theory and in mannequin or student
2069+practice under the direct supervision of a licensed i nstructor.
2070+H. A basic cosmetology or barber student who fails t o complete
2071+the course and registers in the manicurist, cosmetician, or
2072+facialist course may be credited with ten percent (10%) of the
2073+previously accumulated hours. A manicurist, cosmetician, facialist,
2074+or barber student who fails to complete the course an d registers in
2075+the basic cosmetology or barber course may be credited with ten
2076+percent (10%) of the previously accumulated hours.
2077+I. If a person who holds a current Board license and register s
2078+in any course other than a master instructor course, a credit of two
2079+hundred twenty-four (224) clock hours is allow ed.
2080+J. 1. Cosmetology and barber schools shall teach the
2081+curriculum for each course approved by the Board. A copy of current
2082+curriculum shall be on file with the Board. The curriculum shall be
2083+proven by a schedule which shall be posted, followed, and made
2084+available to students. The schedule may be interrupted for a period
2085+not to exceed more than eight (8) hours per month for assembly
2086+purposes.

2114+times that arise where school shall be interrupted due to facility
2115+lockdowns for an unknown amount of time. When this arises, the
2116+school shall have to remain closed until the loc kdown is complete.
2117+Once the lockdown is complete, school shall resume as normal.
2118+K. If a school stays open more than eight (8 ) hours per day, a
2119+curriculum and schedule shall be submitted to the Board covering
2120+extra hours.
2121+L. An evening school cannot be approv ed unless information as
2122+to the instructors in charge and a curricul um and schedule for each
2123+course to be taught is submi tted to the Board before beginning
2124+evening classes. A student may attend both day and evening classes,
2125+provided the entire time does not exceed eight (8) hours daily. A
2126+schedule shall be submitted to each student training in such manne r.
2127+M. Each manager, instructor or other person shall exercise the
2128+greatest care in keeping h is or her person and all instruments used
2129+in school in the cleanest possible condition. Each manager,
2130+instructor, or other perso n shall be knowledgeable of the more
2131+communicable diseases and the techniques necessary to prevent the
2132+transmission of disease.

2163+shall be done by licensed instructors only. Professional persons in
2164+fields related to cosmetology and ba rbering may lecture in schools.
2165+B. The total time given to produc t demonstrations or lectures
2166+shall not exceed eight (8) hours per month in any one school.
2167+C. No person may demonstrate a product in a cosmetology school
2168+unless the person is licensed by the Board.
2169+D. Schools shall maintain a current list of substitute
2170+instructors.
2171+1. The list of current instructors shall contain names,
2172+addresses and phone numbers in the event of emergencies, vacations,
2173+leaves, or absence to assure appropriate instruction for the number
2174+of students enrolled.
2175+2. Any substitute instructor in any school shall possess a
2176+valid instructor license issued by the Board in order for hours of
2177+training to be credited to a student.
2178+3. Schools located within a correctional facility shall be
2179+allowed to have licensed instructors that have a valid ODOC
2180+volunteer badge. These shall not be employees, but licensed
2181+instructors that donate their time to teaching within the
2182+correctional facility.
2183+E. If the owner of a school is the only instructor or one of
2184+the minimum number of instructors required for the n umber of
2185+students enrolled and registered in the school, the owner instructor

2216+SECTION 14. NEW LAW A n ew section of law to be codified
2217+in the Oklahoma Statutes as Section 199.27 of Title 59, unless there
2218+is created a duplication in numbering, reads as follows:
2219+A. A part-time schedule shall be submitted and approved by the
2220+Board. Students shall attend a clock hour school at least three (3)
2221+hours per day, five (5) days per week, or a total of fifteen (15)
2222+hours per week.
2223+B. Due to lockdown or outside medical appointments applicable
2224+to schools located within a correctional facility, students may not
2225+be allowed to attend the fifteen (15) hours a week minimum.
2226+Students shall only be allowed to miss the fifteen (15) hour
2227+required minimum if the institute is on lockdown, or if they have
2228+proof of an outside medical appointment.
2229+C. In addition to maintaining a current record of student
2230+hours, clock hour schools shall k eep a record of daily attendance.
2231+Students registered in a clock hour school shall sign in or clock in
2232+and out of each class daily.
2233+D. Credit hour schools shall maintain a current record of
2234+credit hours earned by each student and turned in at the end of each
2235+term.

2266+G. All attendance and educational r ecords shall be available
2267+during inspection or upon request of the Board as allowed under th e
2268+Cosmetology and Barbering Act.
2269+H. All clock hour schools shall be required to submit a report
2270+of all student hours earned to the Board monthly and shall be due by
2271+the tenth of the following month. All hours shall be submitted as
2272+follows: Private school hours shall reflect day and evening
2273+classes, the student's name, file/registration number, and
2274+accumulated hours received. Public school hours shall reflect the
2275+instructor who teaches the program and program taught, whether day
2276+or evening class, student 's name, file/registration number, and
2277+hours received by the student.
2278+SECTION 15. NEW LAW A new section of law to be codified

2321+C. The code of ethics shall be posted in each school.
2322+D. Current inspection r eports shall be posted in a place easily
2323+viewed by the public.
2324+E. All persons practicing in a salon shall be required to have
2325+a current form of photo identification on their person and be
2326+prepared to produce it to the inspector at the time of inspection.
2327+SECTION 16. This act shall become effective November 1, 2024.
