8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8888 SECTION 1. NEW LAW A new section of law to be codified
8989 in the Oklahoma Statutes as Section 1022.1 of Title 82, unless there
9090 is created a duplication in numbering, reads as follows:
9191 A. The Legislature finds that the people of Oklahoma are
9292 dependent in whole or in par t upon groundwater basins for their
9393 water supply and that in certain basins and sub-basins withdrawal of

145145 groundwater is greatly in excess of a sustainable annual yield and
146146 that this is threatening to destroy the economy of certain ar eas of
147147 this state and is threatening to do substantial injury to the
148148 general economy and welfare of this state and its citizens. The
149149 Legislature further finds that it is in the best interest of the
150150 general economy and welfare of this state and its citizen s that the
151151 Legislature utilize its police power to prescribe which uses of
152152 groundwater are most beneficial and economically effective.
153153 B. It is therefore declared to be the public policy of this
154154 state that in the interest of protecting and stabilizing the general
155155 economy and welfare of this state and its citizens , it is necessary
156156 to conserve, protect, and allocate the use of certain groundwater
157157 resources of the state and to provide a framework for the
158158 comprehensive management and regulation of the withdraw al,
159159 transportation, use, co nservation, and conveyance of rights to use
160160 the identified groundwaters in this state.
161161 SECTION 2. NEW LAW A new section of law to be codified
162162 in the Oklahoma Statutes as Section 1022.2 of Title 82, unless there
163163 is created a duplication in numbering, reads as follows:
164164 A. The Oklahoma Water Resources Board may designate an area as
165165 a critical groundwater management area if the Board determines,
166166 after notice and hearing, that any of the following exists:

218218 1. Active critical groundwater management practices are
219219 necessary to preserve the existing supply of groundwat er for future
220220 needs;
221221 2. Land subsidence or fissuring is endangering property or
222222 potential groundwater storage capacity ; or
223223 3. Use of groundwater is resulting in actual or threatened
224224 water quality degradation.
225225 B. An active critical groundwater management area designated
226226 pursuant to this section may include more than one groundwater basin
227227 but shall not be smaller than a groundwater basin or include only a
228228 portion of a groundwater basin.
229229 SECTION 3. NEW LAW A new section of law to be codified
230230 in the Oklahoma Statutes as Section 1022.3 of Title 82, unless there
231231 is created a duplication in numbering, reads as follows:
232232 A. If the Oklahoma Water Resources Board proposes to designate
233233 a groundwater basin as a critical groundwater management area
234234 pursuant to Section 2 of this act , the Board shall hold a public
235235 hearing to consider:
236236 1. Whether to issue an order declaring the area an active
237237 critical groundwater management area; and
238238 2. The boundaries and any sub-basins of the proposed active
239239 critical groundwater management area.
240240 B. The Board shall give reasonable notice of the hearing which
241241 shall include publication once each week for two (2) consecutive

293293 weeks in a newspaper of general circulation in each county in which
294294 the proposed critical groundwater management area is located and
295295 certified mail notice to those persons holding a groundwater use
296296 permit for the basin. Any notice shall contain the time and place
297297 of the hearing, the legal description and a map clearly identifying
298298 and describing all lands to be included in the proposed active
299299 critical groundwater management area and any sub -basins, and any
300300 other information the Board deems n ecessary.
301301 C. The hearing shall be held at a location within th e proposed
302302 critical groundwater management area. At the hearing, the Bo ard
303303 shall present factual data in support of the proposed action. Any
304304 person may appear at the hearing, either in person o r by
305305 representative, and submit oral or documentary evidence for or
306306 against the proposed action. In making its determination, the Boar d
307307 shall give full consideration to public com ment and to
308308 recommendations made by local political subdivisions.
309309 SECTION 4. NEW LAW A new section of law to be codified
310310 in the Oklahoma Statutes as Section 1022.4 of Title 82, unless there
311311 is created a duplication in numbering, reads as follows:
312312 A. The Oklahoma Water Resources Board shall review the criti cal
313313 groundwater management area or any of it s sub-basins as conditions
314314 require and when factual data justify, but no less than ten (10)
315315 years after the initial designation and each ten (10) years
316316 thereafter.

368368 B. The Executive Director of the Oklahoma Water Resources Board
369369 shall review the boundaries of a critical groundwater management
370370 area or any of the sub-basins by request of the loc al advisory
371371 council in the critical groundwater management area.
372372 C. Before modifying the boundaries of a subsequent active
373373 critical groundwater management area or any of its sub -basins, the
374374 Executive Director shall give notice of and hold a hearing on the
375375 proposed modifications pursuant to the procedures p rescribed by
376376 Section 3 of this act.
377377 SECTION 5. NEW LAW A new section of law to be codified
378378 in the Oklahoma Statutes as Section 1022.5 of Title 82 of the
379379 Oklahoma Statutes, unless there is created a duplication in
380380 numbering, reads as follows:
381381 A. In an active critical groundwater management area, a person
382382 may:
383383 1. Withdraw and use groundwater only in accordance w ith the
384384 provisions of Title 82 of the Oklahoma Statutes and any associated
385385 rules promulgated by the Oklahom a Water Resources Board ; and
386386 2. Store water in a storage facility in accordance with
387387 applicable provisions of the Oklahom a Statutes.
388388 B. Nothing in Title 82 of the Oklahoma Statutes shall be
389389 construed to affect the definition of surface water in Section 60 of
390390 Title 60 of the Oklahoma Statutes and the definition of water ,
391391 subject to appropria tion.

443443 SECTION 6. NEW LAW A new sect ion of law to be codified
444444 in the Oklahoma Statutes as Section 1022.6 of Title 82, unless there
445445 is created a duplication in numbering, reads as follows:
446446 A. The Oklahoma Water Resources Board shall develop a
447447 management plan for each critical groundwater management area and
448448 shall adopt the plans only aft er public hearings held pursuant to
449449 Section 3 of this act . The plans shall include a continuing
450450 mandatory conservation program for all persons withdr awing,
451451 distributing, or receiving groundwater that is designed to achieve
452452 reductions in withdrawals of groundwater.
453453 B. The management plan may require additional well spacing and
454454 the temporary reduction of the amount of water available under a
455455 regular permit to take and use groundwater.
456456 SECTION 7. NEW LAW A new section of law to be codified
457457 in the Oklahoma Statutes as Section 1022.7 of Title 82, unless there
458458 is created a duplication in numbering, reads as follows:
459459 The Oklahoma Water Resources Board is authorized to create a
460460 local advisory council for each established critical groundwater
461461 management area. The Board shall establish rules stating the
462462 qualifications for membership and organization of the councils.
463463 Each council shall have the duty to review the progress of the
464464 approved management plans and recommend updates to the manag ement
465465 plans to the Board, provided such wr itten recommendations have been
466466 concurred upon by a majority of the membership of the council.
