87	87	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
88	88	SECTION 1. NEW LAW A new section of law to be codified
89	89	in the Oklahoma Statutes as Section 1022.1 of Title 82, unless there
90	90	is created a duplication in numbering, reads as follows:
91	91	A. The Legislature finds that the people of Oklahoma are
92	92	dependent in whole or in par t upon groundwater basins for their
93	93	water supply and that in certain basins and sub-basins withdrawal of

145	145	groundwater is greatly in excess of a sustainable annual yield and
146	146	that this is threatening to destroy the economy of certain ar eas of
147	147	this state and is threatening to do substantial injury to the
148	148	general economy and welfare of this state and its citizens. The
149	149	Legislature further finds that it is in the best interest of the
150	150	general economy and welfare of this state and its citizen s that the
151	151	Legislature utilize its police power to prescribe which uses of
152	152	groundwater are most beneficial and economically effective.
153	153	B. It is therefore declared to be the public policy of this
154	154	state that in the interest of protecting and stabilizing the general
155	155	economy and welfare of this state and its citizens , it is necessary
156	156	to conserve, protect, and allocate the use of certain groundwater
157	157	resources of the state and to provide a framework for the
158	158	comprehensive management and regulation of the withdraw al,
159	159	transportation, use, co nservation, and conveyance of rights to use
160	160	the identified groundwaters in this state.
161	161	SECTION 2. NEW LAW A new section of law to be codified
162	162	in the Oklahoma Statutes as Section 1022.2 of Title 82, unless there
163	163	is created a duplication in numbering, reads as follows:
164	164	A. The Oklahoma Water Resources Board may designate an area as
165	165	a critical groundwater management area if the Board determines,
166	166	after notice and hearing, that any of the following exists:

218	218	1. Active critical groundwater management practices are
219	219	necessary to preserve the existing supply of groundwat er for future
220	220	needs;
221	221	2. Land subsidence or fissuring is endangering property or
222	222	potential groundwater storage capacity ; or
223	223	3. Use of groundwater is resulting in actual or threatened
224	224	water quality degradation.
225	225	B. An active critical groundwater management area designated
226	226	pursuant to this section may include more than one groundwater basin
227	227	but shall not be smaller than a groundwater basin or include only a
228	228	portion of a groundwater basin.
229	229	SECTION 3. NEW LAW A new section of law to be codified
230	230	in the Oklahoma Statutes as Section 1022.3 of Title 82, unless there
231	231	is created a duplication in numbering, reads as follows:
232	232	A. If the Oklahoma Water Resources Board proposes to designate
233	233	a groundwater basin as a critical groundwater management area
234	234	pursuant to Section 2 of this act , the Board shall hold a public
235	235	hearing to consider:
236	236	1. Whether to issue an order declaring the area an active
237	237	critical groundwater management area; and
238	238	2. The boundaries and any sub-basins of the proposed active
239	239	critical groundwater management area.
240	240	B. The Board shall give reasonable notice of the hearing which
241	241	shall include publication once each week for two (2) consecutive

293	293	weeks in a newspaper of general circulation in each county in which
294	294	the proposed critical groundwater management area is located and
295	295	certified mail notice to those persons holding a groundwater use
296	296	permit for the basin. Any notice shall contain the time and place
297	297	of the hearing, the legal description and a map clearly identifying
298	298	and describing all lands to be included in the proposed active
299	299	critical groundwater management area and any sub -basins, and any
300	300	other information the Board deems n ecessary.
301	301	C. The hearing shall be held at a location within th e proposed
302	302	critical groundwater management area. At the hearing, the Bo ard
303	303	shall present factual data in support of the proposed action. Any
304	304	person may appear at the hearing, either in person o r by
305	305	representative, and submit oral or documentary evidence for or
306	306	against the proposed action. In making its determination, the Boar d
307	307	shall give full consideration to public com ment and to
308	308	recommendations made by local political subdivisions.
309	309	SECTION 4. NEW LAW A new section of law to be codified
310	310	in the Oklahoma Statutes as Section 1022.4 of Title 82, unless there
311	311	is created a duplication in numbering, reads as follows:
312	312	A. The Oklahoma Water Resources Board shall review the criti cal
313	313	groundwater management area or any of it s sub-basins as conditions
314	314	require and when factual data justify, but no less than ten (10)
315	315	years after the initial designation and each ten (10) years
316	316	thereafter.

368	368	B. The Executive Director of the Oklahoma Water Resources Board
369	369	shall review the boundaries of a critical groundwater management
370	370	area or any of the sub-basins by request of the loc al advisory
371	371	council in the critical groundwater management area.
372	372	C. Before modifying the boundaries of a subsequent active
373	373	critical groundwater management area or any of its sub -basins, the
374	374	Executive Director shall give notice of and hold a hearing on the
375	375	proposed modifications pursuant to the procedures p rescribed by
376	376	Section 3 of this act.
377	377	SECTION 5. NEW LAW A new section of law to be codified
378	378	in the Oklahoma Statutes as Section 1022.5 of Title 82 of the
379	379	Oklahoma Statutes, unless there is created a duplication in
380	380	numbering, reads as follows:
381	381	A. In an active critical groundwater management area, a person
382	382	may:
383	383	1. Withdraw and use groundwater only in accordance w ith the
384	384	provisions of Title 82 of the Oklahoma Statutes and any associated
385	385	rules promulgated by the Oklahom a Water Resources Board ; and
386	386	2. Store water in a storage facility in accordance with
387	387	applicable provisions of the Oklahom a Statutes.
388	388	B. Nothing in Title 82 of the Oklahoma Statutes shall be
389	389	construed to affect the definition of surface water in Section 60 of
390	390	Title 60 of the Oklahoma Statutes and the definition of water ,
391	391	subject to appropria tion.

443	443	SECTION 6. NEW LAW A new sect ion of law to be codified
444	444	in the Oklahoma Statutes as Section 1022.6 of Title 82, unless there
445	445	is created a duplication in numbering, reads as follows:
446	446	A. The Oklahoma Water Resources Board shall develop a
447	447	management plan for each critical groundwater management area and
448	448	shall adopt the plans only aft er public hearings held pursuant to
449	449	Section 3 of this act . The plans shall include a continuing
450	450	mandatory conservation program for all persons withdr awing,
451	451	distributing, or receiving groundwater that is designed to achieve
452	452	reductions in withdrawals of groundwater.
453	453	B. The management plan may require additional well spacing and
454	454	the temporary reduction of the amount of water available under a
455	455	regular permit to take and use groundwater.
456	456	SECTION 7. NEW LAW A new section of law to be codified
457	457	in the Oklahoma Statutes as Section 1022.7 of Title 82, unless there
458	458	is created a duplication in numbering, reads as follows:
459	459	The Oklahoma Water Resources Board is authorized to create a
460	460	local advisory council for each established critical groundwater
461	461	management area. The Board shall establish rules stating the
462	462	qualifications for membership and organization of the councils.
463	463	Each council shall have the duty to review the progress of the
464	464	approved management plans and recommend updates to the manag ement
465	465	plans to the Board, provided such wr itten recommendations have been
466	466	concurred upon by a majority of the membership of the council.
