36	151		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

38	152		SECTION 1. NEW LAW A new section of law not to be
39	153		codified in the Oklahoma Sta tutes reads as follows:

41	154		This act shall be known and may be cited as the "Improving
42	155		Employment and Education Outcomes for Homeless Youth Act".

48	185		A. Persons who are believed to be homeless children and youth
49	186		as defined in Section 600 of Title 10 of the Oklahoma Statute s may
50	187		be verified as being homeless by:

52	188		1. The director, or designee, of a homeless shelter;
53		-
54	189		2. The director, or designee, of a transitional living program;
55		-
56	190		3. The McKinney-Vento homeless liaison of a public scho ol; or
57		-
58	191		4. A continuum of care lead agency or its designee.
59		-
60	192		B. Verification that a child or youth is homeless shall
61	193		consist, at a minimum, of the following steps:
62		-
63	194		1. The child or youth shall be known to the person verifying
64	195		his or her housing status; and
65		-
66	196		2. If verifying the status of a child or youth un der eighteen
67	197		(18) years of age, the person verifying shall:
68		-
69	198		a. check the National Missing and Unidentified Persons
70	199		System (NamUs) referenced in Section 151.3 of Title 74
71	200		of the Oklahoma Statutes for the na me of the child or
72	201		youth,

74		-	b. send a letter by return r eceipt mail to the last-known

75	203		address of the parent or legal guardian of the child

94	245		SECTION 3. AMENDATORY 47 O.S. 2021, Section 6 -105.3, as
95	246		last amended by Section 6, Chapter 47, 1st Ext raordinary Session,
96	247		O.S.L. 2023 (47 O.S. Supp. 2023, Section 6-105.3), is amended to
97	248		read as follows:

99	249		Section 6-105.3 A. In addition to the lice nses to operate
100	250		motor vehicles, the Department of Public Safety may issue cards to
101	251		Oklahoma residents for purp oses of identification only. The
102	252		identification cards shall be issued, renewed, replaced, canceled
103	253		and denied in the same manner as driver licens es in this state. A
104	254		licensee whose record reflects a notation of the person's proof of
105	255		legal presence, verifi ed by the U.S. Department of Homelan d
106	256		Security, or proof of U.S. citizenship, may obtain a REAL ID
107	257		Compliant Identification Card or a Noncompliant Identification Card
108	258		from a motor license agent or the Department of Public Safety,

110	286		Provided, the licensee must comply with all REAL ID documentation
111	287		requirements to obtain a REAL ID Compliant Identification Card. A
112	288		person shall not apply for or possess more than one state-issued or
113	289		territory-issued REAL ID Compliant Identification Card pursuant to
114	290		the provisions of Section 6-101 of this title.

116	291		The application for an identification card by any person under
117	292		the age of eighteen (18) years shall be signed and verified by a
118	293		custodial legal parent or legal guardian, either in person before a
119	294		person authorized to administer oaths or electronically if
120	295		completing an online application, or a notarized af fidavit signed by
121	296		a custodial legal parent or legal guardian submitted before a person
122	297		authorized to administe r oaths by the person under the age of
123	298		eighteen (18) years with the application. Provided, that persons
124	299		under eighteen (18) years of age who are homeless children and
125	300		youth, as defined in Section 600 of Title 10 of the Oklahoma
126	301		Statutes and verified as su ch through the process established i n
127	302		Section 2 of this act, shall be allowed to apply for a REAL ID
128	303		Noncompliant Identification Card, which shall be valid for a period
129	304		of four (4) years from the month of issuance, without the signature
130	305		of their parent or legal guardian. Except as otherwise provided in
131	306		this section, the identification cards shall be valid for a period
132	307		of either four (4) years from the month of issuance or eight (8)
133	308		years from the month of issuance; ho wever, the identificat ion cards

137	337		B. 1. The Department of Corrections shall coordinate with the
138	338		Department of Public Safety to provide REAL ID N oncompliant
139	339		Identification Cards to all inmates who do not have a curr ent state-
140	340		issued identification card or driver li cense upon their release from
141	341		custody. The identification cards shall be issued, replaced,
142	342		canceled and denied in the same manner as dri ver licenses in this
143	343		state.

145	344		2. The Department of Public Safety shall allow the use of a
146	345		certified copy of a birth cer tificate coupled with a Department of
147	346		Corrections-issued consolidated record card to serve as a valid form
148	347		of photo identification documen tation to obtain a REA L ID
149	348		Noncompliant Identification Card.

151	349		3. REAL ID Noncompliant Identification Cards issued wit h a
152	350		consolidated record card from the Depa rtment of Corrections for
153	351		inmates shall be valid for a period of four (4) years from the month
154	352		of issuance for an allow able fee to be determined by the Department
155	353		of Public Safety and are nonrenewable and nontransf erable.

157	354		4. The fee charged for the issuan ce or replacement of a REAL ID
158	355		Noncompliant Identification Card pursuant to this subsection shall
159	356		be deposited in the D epartment of Public Safety Revolving Fund.
160	357		Provided, however, REAL ID Noncompliant Identifica tion Cards issued
161	358		to individuals required t o register pursuant to the Sex Offenders

169	390		C. No person shall hold more than one state-issued or
170	391		territory-issued REAL ID Compliant Driver License o r REAL ID
171	392		Compliant Identification Card, as d efined in subsection G of Section
172	393		6-101 of this title. The Department shall not issue a REAL ID
173	394		Compliant Identificati on Card to any applicant who has been
174	395		previously issued a REAL ID Compliant Driver License o r REAL ID
175	396		Compliant Identification Card unles s such license or identification
176	397		card has been surrendered to the Department by the applicant. T he
177	398		Department may promulgate rules related to the issuance of
178	399		replacement REAL ID Compliant Identification Cards i n the event of
179	400		loss or theft.

181	401		D. The fee charged for the issuance or renewal of a REAL ID
182	402		Compliant Identification Card shall be Twenty -five Dollars ($25.00)
183	403		for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card.
184	404		The fee charged for the issuance or renewal of a REAL ID
185	405		Noncompliant Identification Card pursuant to this sect ion shall be
186	406		Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars
187	407		($50.00) for an 8-year card; however, no person sixty -five (65)
188	408		years of age or older, or one hundred percent (100%) disabled

192	438		process established in Section 2 of this act shall be charged a fee
193	439		for an identification card. Of each fee charged pursuant to the
194	440		provisions of this subsection:

196	441		1. Seven Dollars ($7.00) of a 4 -year card and Fourteen Dollars
197	442		($14.00) of an 8-year card shall be apportioned as provided in
198	443		Section 1104 of this title;
199		-
200	444		2. Three Dollars ($3.00) of a 4 -year card and Six Do llars
201	445		($6.00) of an 8-year card shall be credited to the Department of
202	446		Public Safety Computer Imaging System Revolving Fund to be used
203	447		solely for the purpose of the adminis tration and maintenance of the
204	448		computerized imaging system of the Department;

206	449		3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollar s
207	450		($20.00) of an 8-year card shall be deposited in the Department of
208	451		Public Safety Revolving Fund;

210	452		4. Three Dollars ($ 3.00) of a 4-year card and Six Dollars
211	453		($6.00) of an 8-year card shall be deposited to the State Public
212	454		Safety Fund created in Section 2 -147 of this title; and

214	455		5. Two Dollars ($2.00) for a 4-year card and Four Dollars
215	456		($4.00) for an 8-year card of the fee authorized by this subsection

229	495		pursuant to the provisions of this subse ction:

254	540		F. The Oklahoma Tax Commission is her eby authorized to
255	541		reimburse, from fund s available to that agency, each motor license
256	542		agent issuing an identification card to a person sixty-five (65)
257	543		years of age or older, an amount not to exceed O ne Dollar ($1.00)
258	544		for each card or driver license so issue d through June 30, 2023 .
259	545		The Tax Commission shall develop proced ures for claims for
260	546		reimbursement.

262	547		G. Notwithstanding any other provision of law, when a pers on
263	548		makes application for a new identifi cation card, or makes
264	549		application to renew an identificati on card, and the person has been
265	550		convicted of, or received a def erred judgment for, any offense
266	551		required to register pursuant to the Sex Offenders Registration Act,
267	552		the identification card shall be valid for a period of one (1) year
268	553		from the month of issua nce, but may be renewed yearly during the
269		-	time the person is sub ject to registration on the Sex Offender ~~ENR. H. B. NO. 3231 Page 7~~

270	555		Registry. The cost for such identification card shall be the same
