38152 SECTION 1. NEW LAW A new section of law not to be
39153 codified in the Oklahoma Sta tutes reads as follows:

41154 This act shall be known and may be cited as the "Improving
42155 Employment and Education Outcomes for Homeless Youth Act".

44156 SECTION 2. NEW LAW A new section of law to be cod ified
45157 in the Oklahoma Statutes as Section 601.6d of Title 10, unless there

48185 A. Persons who are believed to be homeless children and youth
49186 as defined in Section 600 of Title 10 of the Oklahoma Statute s may
50187 be verified as being homeless by:

52188 1. The director, or designee, of a homeless shelter;
53-
54189 2. The director, or designee, of a transitional living program;
55-
56190 3. The McKinney-Vento homeless liaison of a public scho ol; or
57-
58191 4. A continuum of care lead agency or its designee.

60192 B. Verification that a child or youth is homeless shall
61193 consist, at a minimum, of the following steps:
62-
63194 1. The child or youth shall be known to the person verifying
64195 his or her housing status; and
65-
66196 2. If verifying the status of a child or youth un der eighteen
67197 (18) years of age, the person verifying shall:
68-
69198 a. check the National Missing and Unidentified Persons
70199 System (NamUs) referenced in Section 151.3 of Title 74
71200 of the Oklahoma Statutes for the na me of the child or
72201 youth,

74-b. send a letter by return r eceipt mail to the last-known
202+b. send a letter by return r eceipt mail to the last known
75203 address of the parent or legal guardian of the child
76204 or youth informing the parent or legal gua rdian that
77205 the person verifying is assisting the child or youth
78206 in obtaining a REAL ID Noncompliant Identification
79207 Card, which shall be valid for a period of four (4)
80208 years from the month of issuance , and

94245 SECTION 3. AMENDATORY 47 O.S. 2021, Section 6 -105.3, as
95246 last amended by Section 6, Chapter 47, 1st Ext raordinary Session,
96247 O.S.L. 2023 (47 O.S. Supp. 2023, Section 6-105.3), is amended to
97248 read as follows:

99249 Section 6-105.3 A. In addition to the lice nses to operate
100250 motor vehicles, the Department of Public Safety may issue cards to
101251 Oklahoma residents for purp oses of identification only. The
102252 identification cards shall be issued, renewed, replaced, canceled
103253 and denied in the same manner as driver licens es in this state. A
104254 licensee whose record reflects a notation of the person's proof of
105255 legal presence, verifi ed by the U.S. Department of Homelan d
106256 Security, or proof of U.S. citizenship, may obtain a REAL ID
107257 Compliant Identification Card or a Noncompliant Identification Card
108258 from a motor license agent or the Department of Public Safety,

109285 regardless of the status o f the license held by the licensee.
110286 Provided, the licensee must comply with all REAL ID documentation
111287 requirements to obtain a REAL ID Compliant Identification Card. A
112288 person shall not apply for or possess more than one state-issued or
113289 territory-issued REAL ID Compliant Identification Card pursuant to
114290 the provisions of Section 6-101 of this title.

116291 The application for an identification card by any person under
117292 the age of eighteen (18) years shall be signed and verified by a
118293 custodial legal parent or legal guardian, either in person before a
119294 person authorized to administer oaths or electronically if
120295 completing an online application, or a notarized af fidavit signed by
121296 a custodial legal parent or legal guardian submitted before a person
122297 authorized to administe r oaths by the person under the age of
123298 eighteen (18) years with the application. Provided, that persons
124299 under eighteen (18) years of age who are homeless children and
125300 youth, as defined in Section 600 of Title 10 of the Oklahoma
126301 Statutes and verified as su ch through the process established i n
127302 Section 2 of this act, shall be allowed to apply for a REAL ID
128303 Noncompliant Identification Card, which shall be valid for a period
129304 of four (4) years from the month of issuance, without the signature
130305 of their parent or legal guardian. Except as otherwise provided in
131306 this section, the identification cards shall be valid for a period
132307 of either four (4) years from the month of issuance or eight (8)
133308 years from the month of issuance; ho wever, the identificat ion cards

137337 B. 1. The Department of Corrections shall coordinate with the
138338 Department of Public Safety to provide REAL ID N oncompliant
139339 Identification Cards to all inmates who do not have a curr ent state-
140340 issued identification card or driver li cense upon their release from
141341 custody. The identification cards shall be issued, replaced,
142342 canceled and denied in the same manner as dri ver licenses in this
143343 state.

145344 2. The Department of Public Safety shall allow the use of a
146345 certified copy of a birth cer tificate coupled with a Department of
147346 Corrections-issued consolidated record card to serve as a valid form
148347 of photo identification documen tation to obtain a REA L ID
149348 Noncompliant Identification Card.

151349 3. REAL ID Noncompliant Identification Cards issued wit h a
152350 consolidated record card from the Depa rtment of Corrections for
153351 inmates shall be valid for a period of four (4) years from the month
154352 of issuance for an allow able fee to be determined by the Department
155353 of Public Safety and are nonrenewable and nontransf erable.

157354 4. The fee charged for the issuan ce or replacement of a REAL ID
158355 Noncompliant Identification Card pursuant to this subsection shall
159356 be deposited in the D epartment of Public Safety Revolving Fund.
160357 Provided, however, REAL ID Noncompliant Identifica tion Cards issued
161358 to individuals required t o register pursuant to the Sex Offenders

162385 Registration Act shall only be valid for a period of one (1) year.
163386 No person sixty-five (65) years of age or older shall be c harged a
164387 fee for a REAL ID Noncompliant Identi fication Card.

166388 5. The Department of Public Safety is authorized to promulgate
167389 rules and procedures to implement the provisions of this subs ection.

169390 C. No person shall hold more than one state-issued or
170391 territory-issued REAL ID Compliant Driver License o r REAL ID
171392 Compliant Identification Card, as d efined in subsection G of Section
172393 6-101 of this title. The Department shall not issue a REAL ID
173394 Compliant Identificati on Card to any applicant who has been
174395 previously issued a REAL ID Compliant Driver License o r REAL ID
175396 Compliant Identification Card unles s such license or identification
176397 card has been surrendered to the Department by the applicant. T he
177398 Department may promulgate rules related to the issuance of
178399 replacement REAL ID Compliant Identification Cards i n the event of
179400 loss or theft.

181401 D. The fee charged for the issuance or renewal of a REAL ID
182402 Compliant Identification Card shall be Twenty -five Dollars ($25.00)
183403 for a 4-year card and Fifty Dollars ($50.00) for an 8 -year card.
184404 The fee charged for the issuance or renewal of a REAL ID
185405 Noncompliant Identification Card pursuant to this sect ion shall be
186406 Twenty-five Dollars ($25.00) for a 4 -year card and Fifty Dollars
187407 ($50.00) for an 8-year card; however, no person sixty -five (65)
188408 years of age or older, or one hundred percent (100%) disabled

189435 veteran described in subsection P of Section 6-101 of this title, or
190436 persons who are homeless children and youth a s defined in Section
191437 600 of Title 10 of th e Oklahoma Statutes and verified through the
192438 process established in Section 2 of this act shall be charged a fee
193439 for an identification card. Of each fee charged pursuant to the
194440 provisions of this subsection:

196441 1. Seven Dollars ($7.00) of a 4 -year card and Fourteen Dollars
197442 ($14.00) of an 8-year card shall be apportioned as provided in
198443 Section 1104 of this title;
199-
200444 2. Three Dollars ($3.00) of a 4 -year card and Six Do llars
201445 ($6.00) of an 8-year card shall be credited to the Department of
202446 Public Safety Computer Imaging System Revolving Fund to be used
203447 solely for the purpose of the adminis tration and maintenance of the
204448 computerized imaging system of the Department;

206449 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollar s
207450 ($20.00) of an 8-year card shall be deposited in the Department of
208451 Public Safety Revolving Fund;

210452 4. Three Dollars ($ 3.00) of a 4-year card and Six Dollars
211453 ($6.00) of an 8-year card shall be deposited to the State Public
212454 Safety Fund created in Section 2 -147 of this title; and

215456 ($4.00) for an 8-year card of the fee authorized by this subsection
216457 related to the issuance or renewal of an identificati on card by a

219486 Noncompliant Driver Licenses or Identification Card s shall be
220487 retained by the licensed operator through June 30, 202 3. Beginning
221488 July 1, 2023, these monies shall be retained b y the licensed
222489 operator pursuant to su bsection E of Section 1141.1 of this title.

228494 fee for an identification card replacement. Of each fee charged
229495 pursuant to the provisions of this subse ction:

249536 Licenses or Identification Cards shall be retained by the licensed
250537 operator through June 30, 2023. Beginning July 1, 2023, these
251538 monies shall be retained by the licensed operator pursuant to
252539 subsection E of Section 11 41.1 of this title.

254540 F. The Oklahoma Tax Commission is her eby authorized to
255541 reimburse, from fund s available to that agency, each motor license
256542 agent issuing an identification card to a person sixty-five (65)
257543 years of age or older, an amount not to exceed O ne Dollar ($1.00)
258544 for each card or driver license so issue d through June 30, 2023 .
259545 The Tax Commission shall develop proced ures for claims for
260546 reimbursement.

262547 G. Notwithstanding any other provision of law, when a pers on
263548 makes application for a new identifi cation card, or makes
264549 application to renew an identificati on card, and the person has been
265550 convicted of, or received a def erred judgment for, any offense
266551 required to register pursuant to the Sex Offenders Registration Act,
267552 the identification card shall be valid for a period of one (1) year
268553 from the month of issua nce, but may be renewed yearly during the
269-time the person is sub ject to registration on the Sex Offender ENR. H. B. NO. 3231 Page 7
554+time the person is sub ject to registration on the Sex Offender
270555 Registry. The cost for such identification card shall be the same
271556 as for other identificatio n cards and renewals.

273557 H. Nothing in this section requires or authorizes the
